S-1411 - 10/14/2014 - ANNEXATION - Ordinances ORDINANCE 2014-AN-EX-S-1411 AN ORDINANCE ANNEXING CERTAIN TERRITORY LYING ALONG THE BOUNDARY LINE OF THE VILLAGE OF LOMBARD AND THE VILLAGE OF OAK BROOK WHEREAS, the Village of Oak Brook ("Village") is an Illinois municipal corporation; and WHEREAS, Article VII, Section 10 of the 1970 Constitution of the State of Illinois authorizes units of local government to contract or otherwise associate among themselves "to obtain or share services and to exercise, combine, or transfer any power or function, in any manner not prohibited by law or ordinance," as well as to use their revenues, credit and other resources for intergovernmental activities; and WHEREAS, the Village, the Village of Lombard, Oak Brook Holdings, LLC, and DMG Real Estate Holdings, LLC (collectively, the "Parties"), entered into that certain Intergovernmental Agreement dated September 2, 2010, relating to a transfer of land between owners and related improvements to the right- of-way known as Technology Drive ("Intergovernmental Agreement"); and WHEREAS, on March 7, 2013, the Parties amended the Intergovernmental Agreement to make adjustments to the schedule for completion of the Parties' respective obligations under the Intergovernmental Agreement ("Amendment") (the Intergovernmental Agreement, as amended by the Amendment, is the "IGA"); and WHEREAS, the IGA provides that, pursuant to Section 7-1-24 of the Illinois Municipal Code, 65 ILCS 5/7-1-24, the Village of Lombard shall disconnect that certain real estate within its corporate limits legally described in Exhibit A and depicted in Exhibit B attached hereto ("Subject Property") and, upon disconnection, the Village shall annex the Subject Property into its corporate limits; and WHEREAS, on June 18, 2014, pursuant to Section 7-1-24 of the Illinois Municipal Code, the Owner of the Subject Property petitioned the Village of Lombard to disconnect the Subject Property from the Village of Lombard; and WHEREAS, on October 2, 2014, pursuant to Section 7-1-24 of the Illinois Municipal Code, the Village of Lombard adopted Ordinance No. 7001 disconnecting the Subject Property from its corporate limits effective upon the Village's annexation of the Subject Property into its corporate limits; and WHEREAS, pursuant to Section 7-1-24 of the Illinois Municipal Code, the owner of the Subject Property filed a petition with the Village for the Village to annex the Subject Property into its corporate limits; and WHEREAS, subject to the terms set forth in this Ordinance, the Village desires to annex the Subject Property pursuant to Illinois law, including without limitation Section 7-1-24 of the Illinois Municipal Code; and WHEREAS, the corporate authorities of the Village have determined that annexation of the Subject Property is in the best interests of the Village and its residents; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part of, this Ordinance as the findings of the President and Board of Trustees of the Village of Oak Brook. Section 2: Annexation of Subject Property. The Village, pursuant to Section 7-1-24 of the Illinois Municipal Code, hereby annexes into its corporate limits the Subject Property. The Village Clerk is hereby directed to cause a certified copy of this Ordinance, together with an accurate map of the annexed territory, to be recorded with the Recorder of Deeds of DuPage County, Illinois within 90 days of passage of this Ordinance. In addition, the Village Clerk is authorized and directed hereby to forward a certified copy of this Ordinance to the Village Clerk of the Village of Lombard. Section 4: Effective Date.
