R-1406 - 10/14/2014 - FIRE DEPARTMENT - Resolutions RESOLUTION 2014-FD-AID-IGA-R-1406 A RESOLUTION APPROVING AN AUTOMATIC AID AGREEMENT BY AND BETWEEN THE VILLAGE OF OAK BROOK AND THE VILLAGE OF WESTMONT WHEREAS, cooperation between and among governmental agencies and entities through intergovernmental agreements is authorized and encouraged by Article VII, Section 10 of the Illinois Constitution of 1970 and by the Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq.; and WHEREAS, the Village and the Village of Westmont have had a long-standing automatic aid agreement for the fire departments of each village to aid the other in times of emergency; and WHEREAS, the current automatic aid agreement is ending; and WHEREAS, the Village and the Village of Westmont desire to enter into a new automatic aid agreement, which agreement is attached hereto as Exhibit A ("Agreement"); and WHEREAS, the Village President and Board of Trustees hereby find and determine that it is in the best interest of the Village to approve and enter into the Agreement with the Village of Westmont; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: Recitals. The foregoing recitals are incorporated into, and made a part of, this Resolution as the findings of the Village President and Board of Trustees. Section 2: Approval of the Agreement. The President and Board of Trustees hereby approve the Agreement by and between the Village and the Village of Westmont in substantially the same form as attached hereto as Exhibit A. Section 3: Authorization and Execution of the Agreement. The Village President and Village Clerk shall be, and hereby are, authorized to execute the final Agreement on behalf of the Village after receipt of the final Agreement executed by the Village of Westmont. Section 4: Effective Date. This Resolution shall be in full force and effect upon passage and approval in the manner provided by law. Pruss k,,4a n , I Village Clerk ,ve. ..�,- "i v ��.:;I Resolution 2014-FD-AID-IGA-R-1406 Automatic Aid Agreement w/Westmont Page 3 of 3 EXHIBIT A AGREEMENT #33462746_vi Automatic Aid Agreement The Village of Westmont Fire Department and the Village of Oak Brook Fire Department are entering into an Automatic Aid Agreement for emergencies governed by the following conditions. Purpose To provide an automatic aid engine, truck, squad company, communications vehicle, chief and/or any specialty vehicle, to be dispatched simultaneously with equipment and personnel from the stricken community to predetermined areas in the event of an emergency. Definitions A. Mutual Aid Box Alarm System (MABAS). A definite and prearranged plan whereby response and assistance is provided to a Stricken Unit by the Aiding Unit(s) in accordance with the system established and maintained by MABAS Member Units and amended from time to time. B. Stricken Unit. A Member Unit which requests aid in the event of an emergency. C. Aiding Unit. A Member Unit furnishing equipment, personnel and/or services to a Stricken Unit. D. Member Unit. A unit of local government including but not limited to a city, village or fire protection district having a fire department recognized by the State of Illinois; or an intergovernmental agency and the units of which the intergovernmental agency is comprised which is a party to the MABAS Agreement and has been appropriately authorized by the governing body to enter into such an agreement, and to comply with the rules and regulations of MABAS. E. Emergency. An occurrence or condition in a Member Unit's territorial jurisdiction which results in a situation of such magnitude and/or consequence that it cannot be adequately handled by the Stricken Unit and such that a Member Unit determines the necessity and advisability of requesting aid. F. Automatic Mutual Aid. The automatic dispatch of an Aiding Unit to a Stricken Community in a predetermined area upon the receipt of a report of an emergency. A minimum of three (3) personnel will respond on all apparatus. If manpower or an Aiding Unit is not available, the Stricken Unit must be promptly notified that no assistance will be given. Dispatching Village of Westmont Incidents As Downers Grove Village Operations Center(VOC) dispatches for Westmont Fire Department, they shall direct all requests for automatic aid from Oak Brook to DuComm via emergency phone line (630-462-7999), which will notify Oak Brook. Downers Grove VOC will advise responding Oak Brook units of the Westmont Fire Department Incident Command designation. Responding Oak Brook units will communicate directly with Downers Grove VOC for the duration of the incident. Village of Oak Brook Incidents Oak Brook shall direct all requests for automatic aid from the Village of Westmont to DuComm, which will then notify the Downers Grove VOC via emergency phone line (630-968-2141). DuComm will advise responding Westmont units of the Oak Brook Incident Command designation. Responding Westmont Fire Department units will communicate directly with DuComm for the duration of the incident. Cancellation of Automatic Aid Companies Upon arrival of the Stricken Unit's first arriving company, and it is determined as a result of their investigation that there is no emergency, the Incident Commander shall cancel and/or return the automatic Aiding Unit as soon as possible. Areas of Response Response to the Village of Westmont for all reported emergencies will be with a Squad Company, Engine Company, Truck Company, Medic Unit, Specialty Vehicle or Chief Officer as specified in the most current version of the running orders and MABAS Box Alarm cards for the Westmont Fire Department. Response to the Village of Oak Brook for all reported emergencies will be with a Squad Company, Engine Company, Truck Company, Medic Unit, Specialty Vehicle or Chief Officer as specified in the most current version of the running orders and MABAS Box Alarm cards for the Village of Oak Brook Fire Department. Unavailability of Equipment In the event that a designated unit is not available to respond in its designated area, the Aiding Unit shall not be required to substitute apparatus from another location. Training Each department will be responsible for familiarization with all areas of response. Interdepartmental training will be conducted on a regular ongoing basis. Maps and Pre-Plans: Each department will furnish the other department with current maps and pre-plans for the unit's areas of response. Cancellation of this Agreement In the event that one party wishes to termination this Agreement, it must notify the other party in writing at least ninety(90)days prior to the specified date of termination. MABAS Agreement The MABAS Agreement adopted in 1989 by all Member Units is hereby made a part of this Agreement as if fully set forth herein.
