SUBJECT: Automatic Aid Agreement with Village of Downers Grove

RECOMMENDED MOTION: I move that the Village Board approve the continuation of
an updated automatic aid agreement between the Village of Oak Brook and the Village of
Downers Grove, so that both entities can continue to provide either an engine, truck,
squad, communications vehicle, chief officer and/or any specialty vehicle and associated
personnel, to be dispatched simultaneously with equipment and personnel from the
stricken community to predetermined areas of response in the event of an emergency.
Background/History:
The current automatic aid agreement between the Village of Oak Brook and the Village of
Downers Grove has been a positive and cooperative venture which has remained in effect for
many years. Proven to be effective in providing assistance to supplement equipment and
personnel when available resources of either community have been exhausted, the agreement
outlines specific criteria for disseminating and dispatching incidents, defining strategic areas of
response, promoting joint training opportunities and is compliant with all applicable Mutual Aid
Box Alarm System(MABAS)guidelines.
After a careful and thorough review of the existing document by the Fire Chiefs of both
communities and Oak Brook's Village attorney, the only specific changes throughout the
document were the updating of emergency contact names and telephone numbers. The
document is also consistent with other similar agreements of neighboring communities.
Recommendation:
That the above motion be presented to the board for approval.

RESOLUTION 2014-FD-AID-IGA-R-1416
A RESOLUTION APPROVING AN AUTOMATIC AID AGREEMENT BY AND BETWEEN THE VILLAGE
AND THE VILLAGE OF DOWNERS GROVE
WHEREAS, cooperation between and among governmental agencies and entities through
intergovernmental agreements is authorized and encouraged by Article VII, Section 10 of the Illinois
Constitution of 1970 and by the Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq.; and
WHEREAS, the Village and the Village of Downers Grove have had a long-standing automatic
aid agreement for the fire departments of each village to aid the other in times of emergency; and
WHEREAS, the current automatic aid agreement is ending; and
WHEREAS, the Village and the Village of Downers Grove desire to enter into a new automatic
aid agreement, which agreement is attached hereto as Exhibit A ("Agreement"); and
WHEREAS, the Village President and Board of Trustees hereby find and determine that it is in
the best interest of the Village to approve and enter into the Agreement with the Village of Downers
Grove;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: Recitals. The foregoing recitals are incorporated into, and made a part of, this
Resolution as the findings of the Village President and Board of Trustees.
Section 2: Approval of the Agreement. The President and Board of Trustees hereby
approve the Agreement by and between the Village and the Village of Downers Grove in substantially the
same form as attached hereto as Exhibit A.
Section 3: Authorization and Execution of the Agreement. The Village President and Village
Clerk shall be, and hereby are, authorized to execute the final Agreement on behalf of the Village after
receipt of the final Agreement executed by the Village of Downers Grove.
Section 4: Effective Date. This Resolution shall be in full force and effect upon passage and
approval in the manner provided by law.

AGREEMENT

Automatic Aid Agreement
The Village of Oak Brook("Oak Brook") and the Village of Downers Grove ("Downers Grove")
are entering into this Automatic Aid Agreement ("Agreement") this day of
, 2014.
Purpose of Agreement
To provide, in the case of an emergency, a squad company, engine company, truck company,
medic unit and/or Chief Officer, to be dispatched simultaneously with equipment and personnel
to the community experiencing an emergency to predetermined areas.
Definitions
A. Stricken Department. A fire department which is experiencing an emergency.
B. Aiding Department. A fire department furnishing equipment, personnel and/or services
to a Stricken Department.
C. Emergency. An occurrence or condition in a Stricken Department's territorial
jurisdiction which results in a situation of such magnitude and/or consequence that it
cannot be adequately handled by the Stricken Department.
D. Automatic Aid. The automatic dispatch of an Aiding Department to a Stricken
Department in a predetermined area upon the receipt of a report of an emergency
E. Party or Parties. Oak Brook and/or Downers Grove.
F. MABAS. Mutual aid box alarm system.
Dispatching
A. Downers Grove Incidents:
The Downers Grove Village Operations Center (VOC) shall direct all requests for Automatic
Aid from Oak Brook to DuComm via IFERN. If unable to contact on IFERN after two (2)
attempts, the VOC shall utilize an emergency phone line (630-260-7512), to make notification.
The VOC shall identify specific vehicles requested by Downers Grove. The VOC will advise
responding Oak Brook personnel of the Downers Grove Fire Department Incident Command
designation. Responding Oak Brook personnel will communicate directly with the VOC for the
duration of the incident.
B. Oak Brook Incidents:
Oak Brook shall direct all requests for Automatic Aid from Downers Grove to DuComm, via
IFERN. If unable to contact on IFERN after two (2) attempts, DuComm shall utilize an
emergency phone line (630-968-2121), to make notification. DuComm shall identify specific
vehicles requested by Oak Brook. DuComm will advise responding Downers Grove personnel
of the Oak Brook Fire Department Incident Command designation. Responding Downers Grove
personnel will communicate directly with DuComm for the duration of the incident.
Cancellation of Aiding Department
In the event that the Stricken Department's first arriving company determines as a result of their
investigation that there is no Emergency, the Stricken Department's Incident Commander shall
cancel and/or return the Aiding Department as soon as possible.
Areas of Response
Response to Downers Grove by Oak Brook for all reported emergencies will be with a Squad
Company, Engine Company, Truck Company, Medic Unit, and/or Chief Officer as specified in
the most current version of the running orders and MABAS Box Alarm cards for the Downers
Grove Fire Department, with a minimum of three (3)personnel responding on all apparatus.
Response to Oak Brook by Downers Grove for all reported emergencies will be with a Squad
Company, Engine Company, Truck Company, Medic Unit, and/or Chief Officer as specified in
the most current version of the running orders and MABAS Box Alarm cards for the Oak Brook
Fire Department, with a minimum of three (3)personnel responding on all apparatus.
Unavailability of Aiding Department
In the event that an Aiding Department is not available to respond in its designated area, the
Aiding Department shall not be required to substitute apparatus from another location, but shall
be required to make sure the Stricken Department is promptly notified that no assistance will be
given.
Training
Each Party will be responsible for familiarization with all areas of response within the
boundaries of the other Party. Interdepartmental training of each Party's personnel will be
conducted on a regular ongoing basis.
Maps and Pre-Plans
Each Party will furnish the other Party with current maps and pre-plans for each Party's
respective areas of response.
Indemnification
Each Party hereto agrees to waive all claims against the other Party hereto for any loss, damage,
personal injury or death occurring as a consequence of the performance of this Agreement;
provided, however, that such claim is not a result of gross negligence or willful misconduct of
the other Party hereto or its personnel. Each Party requesting Automatic Aid pursuant to this
Agreement (the Stricken Department) hereby expressly agrees to hold harmless, indemnify and
defend the other Party rendering aid (the Aiding Department) and its personnel from any and all
claims, demands, liability, losses, suits in law or in equity which are made by a third party;
provided, however, that such claims made by a third party are not the result of gross negligence
or willful misconduct on the part of the Party rendering the Automatic Aid (the Aiding
Department). This indemnity shall include attorneys' fees and costs that may arise from
providing Automatic Aid pursuant to this Agreement; provided, however, that all employee
benefits, wage and disability payments, pensions, worker's compensation claims, damage to or
destruction of equipment and clothing, and employee medical expenses of the Party rendering
Automatic Aid (the Aiding Department) shall be the sole and exclusive responsibility of the
Party rendering Automatic Aid (the Aiding Department).
Cancellation of this Agreement
In the event that a Party wishes to terminate this Agreement, it must notify the other Party in
writing at least ninety (90) days prior to the specified date of termination.
MABAS Agreement
The MABAS Agreement adopted in 1989 by all Member Units thereto, including Oak Brook and
Downers Grove, as amended from time to time, is hereby made a part of this Agreement as if
fully set forth herein. If there is a conflict between the MABAS Agreement and this Agreement,
this Agreement shall govern as between Oak Brook and Downers Grove.
