Gentlemen and Mr. Carmignani:
The undersigned represents the Franciscan Tertiary
Province of the Sacred Heart, which owns and manages the
Mayslake Village Housing for the Elderly complex located south
of 35th Street and which is currently receiving fire protection
service from the Oak Brook Fire Department.
The Franciscan Tertiary Province of the Sacred Heart,
Inc. requests the continuance of the fire protection service
for additional period to July 31st, 1982, or the date of
annexation of this property of the Village of Westmont, which-
ever is earlier.
Hearings on the proposed pre-annexation agreement be-
tween the Franciscans and Village of Westmont were held before
the Plan Commission, Zoning Board and Village Board. The only
remaining issue of any substance appears to be resolution of the
method of water service to the Mayslake Village complex and the
vacant property owned by the Franciscans that will be annexed
at the same time.
The Village of Westmont has requested that an agreement
be reached between the Franciscans and the Epstein Company to
complete a fire protection water loop south of 35th Street
between Oakwood Drive on the west and a Pasquinelli Drive
extension on the east. The Franciscans have retained a
consulting engineer who has met with the Epstein engineering
staff and with the Westmont Village engineer. As of this date,
the engineering questions have not as yet been resolved,
although, I anticipate that an agreement will be forthcoming
shortly.

Discussion ensued relative to covenants affecting "The Drake Oak Brook,
Inc. Addition to York Woods", joining with the York Woods Homeowners
Association, making it a part of the existing York Woods Covenants.

E. Time Limit-Filing of Plats
On May 17, 1982, the Plan Comeission recommended approval of an amendment to
Article VI, Subdivision Regulations, establishing a time limit of six (6)
months after Board approval of a Final Plat to submit all documentation
required for completion of the recording process.
Trustee Watson moved - seconded by Trustee Listecki ...
To approve the proposed amendment as recommended by the Plan Commission
with the inclusion of a retroactive provision for those Plate on file, and the
attorney be directed to prepare the required ordinance.
Voice vote: all present, in favor. So ordered.

Action postponed on this matter at the Regular Meeting of May 11, 1982.
Discussion ensued on the operation of the wended Special•Use conditionally
granted by DuPage County, should the Village grant approval of the request
to allow required parking on N.I. Gas property located within the Village
limits. Possible disconnection of the W.Y. Gas property was also discussed.
Resident petitions were submitted objecting to any Village participation.
Trustee Rush moved - seconded by Trustee Marie ...
To deny the request for disconnection of the subject N.Y. Gas property for
the required parking related to the use and operation of one hundred (100)
coin or token operated amusement devices in conjunction with the restaurant
operation; and further that the request for parking on N.I. Gas property
within the Village limits be denied; and that the County be so advised of
this denial.
Roll call vote: Ayes: Trustees Congreve, Marie, Philip and Rush.
Nays: Trustees Listecki and Watson.
President Cerne indicated approval. So ordered.

Re: Mayslake Fire Protection

Dear Mr.. Carmignani:
On September 20th, 1982, the Westmont Village Board
passed a resolution authorizing the Westmont Fire Department to
provide primary fire protection to the Mayslake village Housing
for the Elderly effective October 1st, 1982 pursuant to the
terms of the written agreement. We understand that Oak Brook ;!
will provide secondary fire protection under a mutual aid
agreement with Westmont.
I am hopeful that the Annexation Agreement between
Westmont and the Franciscan Fathers will be concluded at an !!
October meeting of the Westmont Village Board.
Under an agreement ancillary to the Annexation Agree-
ment, I,
the Epstein Company and the Franciscans will construct; a
water main loop from Westmont's water main at 35th Street and
Oakwood Drive easterly to the water mains to be constructed in
the Epstein Oakmont Centre project. Upon completion of this
water main loop, it is anticipated that the Mayslake Village
Complex will be disconnected from the Oak Brook water system and
connected to the Westmont water system. The construction of !!
this water main loop will be timed to coincide with the
construction of the water system in the Oakmont Centre.
When the above plans have been completed, I will ask
that John Ezzi of Cook Leder Engineering Group sche. ule a
meeting with your water department to coordinate chang ver.

A RESOLUTION TO PROVIDE FIRE PROTECTION
SERVICES TO MAYSLAKE VILLAGE

WHEREAS, the Village of- Oak Brook has heretofore
been providing fire protection service for the area known as
the Mayslake Village, which is located South of 35th Street,
• West of Route 83 and East of Midwest Road; and
• WHEREAS, said fire protection shall cease. September
30, 1982; and
WHEREAS, the owners of said complex, the Franciscan
Tertiary Province of the Sacred Heart, Inc. have requested
the Village of Westmont to continue such service; and
WHEREAS, the corporate authorities of the Village of
Westmont desire to honor this request and provide :-yid fire

this Resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND
BOARD OF TRUSTEES OF THE VILLAGE OF WESTMONT, DuPage County,
Illinois as follows:
Section 1: That the provisions of the preamble !' -

fully set forth herein.
Section 2: That the Village of Westmont agrees to
provide fire protection service to the property known Ii

provided, however, that such service sJiall not include '!

shall cease upon the first to occur of:
a. December 30, 1982; or
b. The annexation of the property or any portion

WESTMONT) and the FRANCISCAN TERTIARY PROVINCE OF THE SACRED
HEART, INC. , an Illinois- not-for-profit corporation (here-

WHEREAS, the FRANCISCAN TERTIARY PROVINCE has here-
tofore . filed with WESTMONT an application for approval of an
Annexation Agreement relating to its real property consisting
of approximately 37.64 acres more or less, commonly known as
1801 35th Street in York Township, DuPage County, Illinois
which pre;:::..° ty is presently improved with 630 dwelling units of
housing designed for occupancy by elderly persons, known as
"Alayslake Village", ard
WHEREAS, a public hearing on the proposed Annexation

Agreement was held by the Westmont Plan Commission on January
12 ,• 1982 , which Annexation Agreement was approved with recom-
mended modifications, and
WHEREAS, it 'lie anticipated by the parties that the
proposed annexation of the property owned by the FRANCISCAN
TERTIARY PROVINCE will be completed within 90 days hereof,and
WH REAS, the Village Board of the Village of Oak Brook
has by resolution voted to terminate their primary fire pro-
tection to the property of the FRANCISCAN TERTIARY PROVINCE

WHEREAS, it is deemed desirable by the parties that the
Village of Westmont provide primary fire protection on an
interim basis effective• Octobcr 1st, 1982, subject however to
the terms and conditions of this agreement ;
NOW THEREFORE, for and in consideration of the mutual
covenants contained herein, and for other valuable consid-
eration, receipt and sufficiency of which are hereby . 1

expressly acknowledged, the parties agree as follows:
I. That effective October Ist, 1982, WESTMONT will
provide primary fire protection to the housing for the elderly
complex owned by the FRANCISCAN TERTIARY PROVINCE at 1801 35th
Street in York Township, DuPage County, known as "Mayslake
Village
2. That for each fire call at the subject premises,
responded to by the Westmont Fire Department, FRANCISCAN
TERTIARY PROVINCE shall :ay to WESTMONT the sum of $150.00.
3. The provisions of this agreement shall not be a
limitation upon the rights , privileges, and immunities of the
Village of Westmont under the law or the Statutes of the State
of Illinois in regards to the provision of or performance of
fire protection services to the property described herein.
4.. That this agreement shall terminate on the earliest
to occur of the annexation of the subject property into the
VILLAGE OF WESTMONT . or December 31st , 1982.
