RESOLUTION NO. R-348
A RESOLUTION APPROVING THE FINAL PLAT OF SUBDIVISION KNOWN AS
ALEX NIED'S DIVISION
BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF
OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows:
Section l: That the Final Plat of Subdivision known as Alex Nied's
Division prepared by Webster ar.d Associates, Inc. as revised and dated March 11,
1983 be and is hereby approved subject to the conditions enumerated in Section 2
of this Resolution.
Section 2: That the approval of the Final Plat of Subdivision of Alex
Nied's Dior. as given in Section 1 hereof be and is hereby expressly subject
to the following conditions:
A. That the requirements of the Subdivision Regulations
for the installation of sidewalks and street lights
are waived.
B. That the Subdivider and all of the necessary parties
execute a written committment, in form and substance
acceptable to the Village, to complete all necessary
land improvements for the proposed Subdivision in
accordance with the Subdivision Regulations of the
Village and in accordance with the provisions of this
Resolution.
C. Correction of the Final Plat of Subdivision as follows:
1. Removal of the public utility easements from the plat
where the proposed storm sewer is to be constructed due to
the private nature of the proposed storm sewer.
2. Correction of the easement along the east side of the
property immediately west of the area dedicated as
right-of-way to read "easement hereby granted to the Village
of Oak Brook for public bicycle and pedestrian path".
D. Execution by the Subdivider and/or all of the necessary
parties of all accompanying easement grants, covenants
and other proposed documentation as reasonably required
by the Village for the property subdivided pursuant to
this Resolution, said documents to be acceptable in form
and substance to the Village of Oak Brook as approved by
its Village Attorney. Said documentation shall include
but not be limited to:
1. Covenants running with the land constituting a
binding obligation on the part of the owners of the
property subdivided to maintain on-site and off-site
downstream drainage.
2. An agreement by the owners of the property sub-
divided to contribute Two Thousand Dollars (A2000.00)
per lot to the Village of Oak Brook for the exclusive
purpose of downstream drainage improvements if and
as when determined necessary by the Village.
3. Approval by the Hinsdale Sanitary District of the
proposed storm sewer on its property immediately west
of the proposed Subdivision hereby approved.
Section : That all the requirements, conditions and standards of the
Subdivision eg ations of the Village of Oak Brook except as waived or limited
by this Resolution shall be applicable to the subdivision and development of said
Alex Nied's Division.
