Thank you for your letter of April 27, 1983 detailing the g proposed scope of work for the safety impruvements of Illinois Route 56 (Butterfield Road) at 22nd Street;. These proposed improvements should be helping in improving the safety aspect of the intersection; however, additional actions should be taken to reduce motorist con- fusion. These additional items include: • 1. The green balls in the traffic heads mounted on the mast arms-, which control the westbound traffic on 22nd Street and the eastbound traffic on Butterfield Road, should be replaced by straight thru green arrows. ri •2e The traffic standards for westbound and eastbound t;-affic located on the south- west corner and northeast corner of the intersection are equipped with five ' (5) section heads, one (1) head of which is a left turn arrow. - The location and positioning of these signals directly designate them as left turn signs, controllers; therefore, the present five (5) section heads should be replaced • with three (3) section heads. The three (3) section should be a green left turn arrow, a yellow arrow, and a red arrow. • 3. The signals on the northeast and southwest corners should be designated left turn signals punted as !, finals With •a sign. The Village of Oak Brook believes that these additional intersection revisions will substantially diminish motorist confusion, illegal left turn violations, and traffic accidents. SUBJECT: 22nd Street/Butterfield Road/Camden Court Traffic Improvements IDOT Cost Participation Request RECOMMENDATION: That the Village Board do the following: 1) Endorse this proposed project. 2) Agree to a funding obligation of 2k% of a traffic signal modernization cost ($2,750+) and 23% of the engineering cost `$413+). 3) Condition our cost participation on the traffic signal modernization incorporating our previous suggested revisions. 4) Condition our cost participation on our assuming the maintenance costs of only items which pertain to Camden Court. Village Manager Carmignani previously sent me a copy of a letter from Edward F. Kramerz, Program Development Section Chief, IDOT, dated September 9, 1983 to President Cerne requesting the Village's ftelings' toward the project as well as the Village's cost participation as per present IDOT policies. The project includes pavement and signal modifications with an estimated cost of $150,000.00. This improvement will be paid for with 90% Federally funding and 102 State and/or Local finding. Since the Village of Oak Brook presently maintains one leg of the intersection (Camden Court) the State is requesting that the Village participate in 252 of the 10% cost regarding pavement and signal modifications and engineering; hence the $2,750.00 and $413.00 request. As you recall, the Village has previously forwarded suggested revisions to the State regarding the existing traffic signals at this location. In trying to ascertain whether our suggestions will be incorporated in the traffic signal modernisation, I have been informed by IDOT that the final engineering plans regarding this subject won't be started and completed for several months. They further recommended granting the reduction of of loading berths. On January 16, 1984 the Plan Commission recommended approval of locating required parking on NIGas property. The • letter requested that we execute the agreements contained with that letter. We would note at the outset•tbat the Village Board authorized participation with IDOT for this improvement pursuant to Resolution No. R-359 which was trans- mitted to Ken Macander of your office by letter dated March 2, '1984. Specif i- cally the, Resolutior calls for acceptance of the conditions contained in the , Resolution by execut On of one of the copies of the Resolution. To date no { such acceptance has been received by the .Village of Oak Brook. We believe that IDOT's acceptance of our Resolution is a necessary precondition for consideration . of the agreement. As to the agreement itself, it should contain some indication j • of the acceptance of the conditions of our Resolution. Those conditions would necessitate certain other changes in the agreement as can be seen by comparing the agreement with the conditions contained in Resolution No. R-359. Finally, the agreement calls for the Village of •Oak Brook to pay for utility relocation • (paragraph 11). We .question why the Village should be asked to 1,!!,i p q by g pay for these relocations, and further question whether any such relocations are• required under the plans developed for this improvement. Moreover, we question th± wording of . paragraph 13 since it appears that the only utilities to be maintained by the Village of Oak Brook it question include a public.watermain and facilities within the right-of-way of Camden Court. . • ii I' We would appreciate if you could review your file on this matter to ascertain its ' 1 status including your acceptance of the Resolution previously passed by the ii Village of Oak Brook. I Village of Oak Brook/State Agreement Dear Mr. Sifrer: I Enclosed please find a xerox copy of the agreement you previously forwarded to President Cerne under your letter dated April 12, 1984. Please note that I have amended the agreement as follows: 1. Page 1 - The lengthening of the left-turn lane is I understand, on Butter- field Road, not 22nd Street. 2. Village Resolution R-359, previously accepted and returned by the State, 1i states that "...upon receipt of a request for payment from IDOT subsequent • to commencement of construction of the proposed improvement...". I have, therefore, revised the agreement accordingly within Paragraph 5 on the bottom of Page 2. 3. I have removed Paragraph 8 on Page 3 since I believe that encroachments do not exist within the subject site; therefore, this paragrph is unnecese.ary. 4. Within Paragraph 11 on Page 4, I have removed the provisions whereby the muiicipal utility will bear all utility relocation or adjustment costs made necessary by the construction of this improvement. Based_ upon past practices between the State and the Village, any and all costs associated with a project within a public right-of-way should be borne by the improvement, not by the municipal utility. 5. Within Paragraph 13 on Page 4, I have deleted the first sentence stating that the Village will maintain all items not to be maintained by the State. 1i The Village of Oak Brook does not desire to be burdened with additional maintenance costs which it does not presently assume. I have also added that the Village will continue to maintain the municipal water system within Camden Court, 22nd Street, and Butterfield Road within the last sentence of Paragraph 13. The STATE agrees to make the surveys, prepare plans and specifications, receive bids and award the contract, furnish engineering inspection during construction and cause the improvement to be built in accordance with the plans., specifications and contract.
