WITNESSETH: WHEREAS, the STATE, in order to facilitate the free flow of traffic and ensure safety to the motoring public, is desirous of improving approximately 6;800 lineal feet of Illinois Route 83 (F.A.P. Route 872, STATE Section 543R-3(82), VILLAGE Section 84-00014-00-TL), from south of East-West Tollway north to north of Roosevelt Road separation in the Village of Oak Brook and the City of Oakbrook Terrace by reconstructing the present typical pavement width of two (2) twenty-four (24') foot to a width of two (2) thirty-six (36') foot and variable edge to edge, constructing an eighteen .(18') foot to thirty !� (30°) foot and variable barrier median, ten (10') foot bituminous shoulders, concrete curb and gutter and/or shoulders and ditches from south of East-West Tollway to north of 16th Street; widening and resurfacing from north of 16th Street to south of Butterfield Road to provide two (2) thirty-six (36') foot to two (2) twenty-four (24') foot transition. The STATE agrees to make the surveys, obtain all necessary rights of way, prepare plans and specifications, receive bids and award the contract, furnish engineering inspection during construction and i! cause the improvement to be built in accordance with the plans, specifications and contract. 2. The STATE agrees to pay all right-of-way, construction and engineering costs, subject to reimbursement by the VILLAGE as hereinafter stipulated. 3. The VILLAGE agrees to reimburse the STATE in the amount of the above i costs for modernization of the traffic signals at 22nd Street and 16th Street - $11,643.75 plus opticaa at 22nd Street, Hodges Road and 16th Street - $17,000 and water gain work - $51,175.00. The total cost to the VILLAGE is estimated to be $79,818.75. 5. The VILLAGE has past a resolution appropriating sufficient funds to pay its share of the cost of this improvement, a copy of which is attached hereto as Exhibit A and made a part hereof. Upon award of the contract for this improvement, the VILLAGE will pay to the Department of Transportation of the State of Illinois in a lump sum, from any funds allotted to the VILLAGE, an amount equal to 9* of its obligation incurred under this Agreement and will pay to said Department, the remainder of its obligation in a lump sum upon completion of the project, based upon final costs. The VILLAGE agrees to pass a supplemental resolution to provide necessary funds for its share of the cost of this innproveioent, if the amount appropriated herein proves to be insufficient to cover said II cost. 6. The VILLAGE has adapted and will put into effect prior to the STATE advertising for the work to be perfosad haearader, an ordinance requiring that pam be prohibited along Illinois *outs 83 and 22nd sk 9/k"3 s5 it WOMPINIIIMW Street within the limits of this improvement, within the VILLAGE it limits, a copy of which is attached hereto as Exhibit B and made a part hereof; and will in the future prohibit parking at such locations on or immediately adjacent to this improvement as may be determined by the STATE or be necessary from traffic rapacity studies. 7. The VILLAGE has adopted and will put into effect; prior to the STATE advertising for the work to be performed hereunder, an appropriate ordinance prohibiting the discharge of sanitary and industrial waste water into any storm sewers or drainage facility constructed as part of this improvement; a copy of which is attached hereto as Exhibit C and made a part hereof. 8. It is the understanding of the VILLAGE and the STATE that encroachments do not exist within Illinois Route 83 within the VILLAGE limits. The VILLAGE will not allow any future encroachment into the STATE right of way. 9. The VILLAGE agrees to adopt a resolution or send a letter; prior to the STATE advertising for the work to be performed hereunder, approving the plans and specifications as prepared, if deemed to be correct. 10. The VILLAGE agrees not to permit driveway entrance openings to be made in the curb as constructed, without the consent of the STATE. 11. The STATE shall cause private utilities to be relocated at no expense to the STATE or VILLAGE. Where a municipal utility has been installed (1) on right of way acquired by the STATE or (2) within ii defined limits of a route the STATE has accepted for maintenance responsibilities, subsequent to the date of such acceptance the j. municipality will bear all utility relocation or adjustment costs it made necessary by the construction of this improvement. 12. Upon completion of the improvement and so long as Illinois Route 83 and land Street (west approach) is used as a STATE highway, the STATE agrees to maintain, or cause to be maintained, the median, the through traffic lanes, the left-turn and right-burn lanes, and the NJ/R-31d curb Ind gutter or stabilized shoulders and ditches adjacent to those lanes. The STATE will be responsible for the maintenance of lane line and median line markings. 13. Upon completion of the improvement, the VILLAGE agrees to maintain, ii or cause to be maintained, along Illinois Route 83 within the VILLAGE limits all Village utilities and appurtenances and along the east leg of 22nd Street within the VILLAGE limits, those portions of the improvement which are not to be maintained by the STATE, including II parkways, storm sewers and storm sewer structures which drain into • the VILLAGE storm sewer system, all relocated light poles along the east approach of 22nd Street and further to supply electrical energy for said light poles. The VILLAGE will continue to maintain, or cause to be maintained, all of the 22nd Street east approach which is within the VILLAGE limits. The VILLAGE will not be responsible for maintenance of crosswalk and stopline markings since these will not be within 'the VILLAGE limits. 14. Upon acceptance by the STATE of the traffic signal work included herein, the financial responsibility for the maintenance and electrical energy charges for the operation of the signal(s) shall be proportioned as follows: Intersection Level-of Maintenance Electrical Maintenance Energy, 22nd Street Ioril STATE Share 100% 100% VILLAGE Share 0% p% City of Oakbrook •Terrace Share 0% 0% 16th Street IorII STATE Share . . . . . . . . . . . 100% 0% VILLAGE Share OK 100% VAVR qo It is agreed that the actual signal maintenance will be performed by the' STATE either with its own forces or through an ongoing contractual agreement. It is further agreed that the signals shall be maintained to at least the Level of Maintenance shown above and specified in the attached Exhibit E made a part hereof. It is understood that Level of Maintenance II exceeds the minimum requirements of the Illinois Manual on Uniform Traffic ( ntrol Devices for Streets and Highways and is prescribed for these signals that the District Engineer, with the concurrence of the Engineer of Traffic determines to require a higher level of service for adequate operation of the highway system at these locations. II, it Payment by the STATE of any or all of its share of maintenance and energy costs is contingent upon the STATE receiving adequate funds in its annual appropriation. The parties hereto agree that the traffic signal maintenance and energy provisions of this Agreement shall remain in effect for a period of twenty (20) years from the date of its execution, or so long as the traffic signals covered by the terms of this Agreement or any amendment hereto remain in place either in their current or some modified configuration, whichever is the shorter peiod of time. Such an effective term shall apply unless otherwise agreed in writing by the parties hereto. The STATE agrees to make arrangements with the local power company to furnish the electrical energy for the operation of the traffic signals. The VILLAGE agrees to pay its proportionate share of this cost as billed by the local power company. The STATE retains the right to control the sequence and timing of the traffic signals. Inspect the traffic signal installation(s) a minimum of once every two (2) weeks for proper alignment of signal heads, lamp failures, and general operation of the traffic signals. 2. Keep signal posts, controller pedestals, and foundations in alignment at all times. 3. Keep signal posts and controller cabinets tight on their foundations. 4. Keep signal heads securely mounted to their posts and properly adjusted. 5. Keep detector equipment in proper working order at all times. 6. Check all controllers every four (4) weeks, which will include visual inspection of all timing intervals, relays, detectors, and all components of any form of pre- ; emption equipment to insure .that they are functioning properly. Make all neces- sary repairs and replacements. 7. Provide immediate corrective action to replace burned-out lamps or damaged sockets. When lamps are replaced, the reflector and lens shall be cleaned. All replacement lamps shall equal the wattage and type of the existing lamp. 8. Provide immediate corrective action when any part or parts of the system fail to function properly. Two far-side heads facing each approach shall be considered the minimum acceptable signal operation pendinb permanent repairs. When the dis- tance from the stop line to the far-side signal exceeds 120 feet, a near-right signal must also be maintained. When repairs at a signalized intersection require that the controller be disconnected and power is available, the traffic signal instal- lation shall be placed on flashing operation, or a flasher installed if none is provided in the controller cabinet. The signals shall flash RED for all directions unless a different indication has been specified in the sequence of operations and a stop sign (R1-1-36) placed at each approach to the intersection as a tempo- rary means of regulating traffic. Stop signs will not be required at approaches where a Yellow Flashing indication is included in the sequence of operations. 9. Keep interior of controller cabinets in a neat and workmanlike manner at all times. 10. Clean reflectors, lenses, and lamps once every six (6) months. 11. Repaint all signal components exposed to weather at least once every three (3) years. 12. Group relamp traffic signal heads at the expiration of the average-rated lamp life. 13. Upon notification of a malfunction in the traffic signal sequence of operation, and if the proper sequence with full detection cannot be obtained immediately, a controller which will provide the proper sequence and full detection shall be installed within twelve (12) hours or removal of the original controller. 14. Remove to clean, test, lubricate, and overhaul as required, each electrical , mechani- cal, and electromechanical component of each installation, at intervals not ex- ceeding twelve (12) months, except service installations, magnetic detectors, and Exhibit E .. . - • TRAF i I (continued) pressure detectors.
