WHEREAS, the DuPage Water Commission has adopted a resolution which
provides for the submission to the voters of DuPage County on November 5, 1985 of
the questions summarized as follows:
Shall the DuPage Water Commission, Counties of DuPage, Cook
and Will, Illinois, issue general obligation bonds for the
purpose of paying a part of the cost of providing a etymon
source of supply of water from Lake Michigan in the sum of
$150,000,000, and Impose sales taxes of the kinds and at the
rates as follows:
a County Water Commission Retailers' Occupation Tax upon all
persons engaged in the business of selling tangible personal
property at retail in the territory of the County Water
r CoEmission at the rate of 114% of;the gros receipts from such
sales made``in the-course of such business,within the
territory; a`tax open-all persons engaged, in the territory of
the County Water Commission, in the business of making sales
of service, whet as•an incident to making such sales of
service; transfer'tangible personal property within the
territory at the rate of 1/4% of the cost price of tangible
. personal property so transferred within the territory; and a
tax upon the privilege o(using, in the territory of the
County Water:Commission, any item of tangible.personal
property which is purchased outside the territory at retail
from a retailer, and which is titled or registered with an
agency of the State of Illinois, at the rate of 1/4$ of the
selling price of such tangible personal property within the
territory, as "selling price" is defined in the Illinois "Use
Tax Act"; and
WHEREAS, it is imperative that.the.Village of Oak Brook and other
DuPage County Communities receive Lake Michigan water as quickly as feasible,
because well water which is currently being used by Oak Brook and other
communities is rapidly being depleted; and
WHEREAS, the DuPage Water Commission, a•bgdy..coaiosed of municipal and
county representatives, proposed to construct a $350,000,000 pipeline system to
Lake Michigan; and
WHEREAS, the $150,000,000 million dollar benMaassue 'and 1/0 ;county
.sales tax referred to in the November 5, 1985 rtferend00 gill be used to f n oe
the initial stages of the project; and
WHEREAS, the DuPage Water Commission has resolved to use 100% of-the
annual revenue derived from the sales tax to abate.the increase in property tat
required to finance the bond issue; and
WHEREAS, it is planned that the remaining $200,000,000 required to
build the distribution system within the•oeurity will be nuanced by revenue blonds
backed by water use charges; and
WHEREAS, the corporate authorities of:tho Ullage of Oak wok deem
passage of this-Resolution to be in the best intore1a of tOa village of Oak
Brook and its residents;
