R— 401 A RESOLUTION APPROVING THE FINAL PLAT OF PHILIP'S SUBDIVISION WHEREAS, the Plan Commission of the Village of Oak Brook on September 16, 1985, recommended the approval of the proposed Philip's Subdivision; and WHEREAS, the Village President and Board of Trustees have considered the recommendation of the Plan Commission and concur with the same subject to certain conditions; NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the Final Plat of Subdivision of the subdivision known as Philip's Subdivision prepared by the Balsamo/Olson Group, Inc, as last revised September 12, 1985, be approved subject to the conditions enumerated in Section 2 of this Resolution. Section 2: That the approval of Philip's Subdivision as given in Section 1 hereof be and is hereby expressly subject to the following conditions: A. That the requirements of the Subdivision Regulations for the construction of land improvements are waived. B. That the requirement for a topography study be waived due to the fact that no land improvements are required or contemplated. Section 3: That all the requirements, conditions and standards of the Subdivision Regulations of the Village of Oak Brook, except as waived or limited by this Resolution, shall be applicable to the subdivision and development of said Philip's Subdivision. Kapff, Assistant to Village Manager SUBJECT: Philip's Subdivision - Final Plat Joan and Art Philip, as owners of the property at 3412, 3420 York Road, have proposed a two-lot resubdivision of their existing two properties. The purpose of this resubdivision is to accomodate proposed construction of a garage to the South of the existing residence which, based on current lot lines, would encroach into the 18-foot side yard. The irregular lot line separating the proposed lots is meant to accomodate the proposed garage providing the full 18-foot side yard as required. In the Plan Commission's discussion of this subdivision, a question was raised concerning whether or not a right of way existed along York Road. As noted on the Plat, in 1853, the York Township Highway Commissioners "dedicated" the York Road right of way. A retyped version of that document, as contained as page 8 of the folder, notes that by "order of the Commissioners of Highways" a certain right of way was relocated. Following a review of this document with our Village Attorney, it was determined that no formal dedication of right of way by the property owners was made to the County of DuPage pursuant to this 1853 document. It was further indicated at the hearing that the property owner's title report covers the entire property noted.on the Plat to the center line of York Road. I would also note that the Village Board, in the past, has determined that a formal dedication of York Road or 31st Street right of way might not be appropriate to the extent that it might encourage a future widening of these roadways by the County. I have enclosed portions of both the Melvin Subdivision and Pierce Court Preliminary Plat, as approved by the Village, neither of which required a formal dedication of roadway. o�D RE: Philip's Subdivision - Final Plat September 19, 1985 Page 2 In the event the Village Board chooses to approve the requested subdivision, it would be appropriate to direct the Village Attorney to prepare the necessary_ resolution approving same. The Plan Commission. recommends to the President and Board of Trustees approval of the requested-.subdivision based on the following conditions: 1) Waiver of the requirement for the applicant to provide topography.. 2) Waiver of the requirement for the applicant to construct any land improvements in conjunction with this Subdivision. This recommendation was made on a motion by Member Sandstedt, seconded by Member Haglund and approved on a Roll Call Vote of four (4) ayes: Members Doyle, Haglund, Sandstedt, Acting Chairman Beard; zero (0) nays; three (3) absent: Members Antoniou, Stachniak, Chairman Marcy. Beard Acting Chairman Plan Commission BFK/KHB/jr /w PLAN COMMISSION Minutes -3- September 16, 1985 V PHILIP'S SUBDIVISION - FINAL PLAT _(3412, 3420 York Road) Joan Philip, owner, was present representing this application. She noted that their basic desire is to construct a garage to the South of the existing residence on Lot 1, which would be too close to the existing lot line. Therefore, they have requested a resubdivision of their two properties slightly modifying the common lot line between Lots 1 and 2 in order to provide the required 18-foot side yard adjacent to the proposed garage. Acting Chairman Beard inquired as to the question. concerning York Road right of way. The Secretary explained that the 1853 document referenced on the Plat had been reviewed by the Village Attorney and found not to be a formal dedication of right of way. Therefore, the easterly boundary of the Subdivision follows the center line of York Road resulting in conforming lot acreages of 1.0 acre for Lot 1 and 3.159 acres for Lot 2. Joan Philip further noted that their title policies on both properties run to the center line of York Road and they have been paying taxes on that entire property since they purchased the land 18 years ago. Member Haglund inquired as to whether the Philips would be willing to formally dedicate the York Road right of way, eliminating the reed to pay taxes on a portion. of York Road. Joan Philip noted that Lot 1 would then fall below the one-acre minimum and Lot 2 , could not then be subdivided into three parcels, although not presently contemplated by this subdivision. Member Doyle noted that the proposed lot line between Lots 1 and 2 is somewhat irregular and, therefore, the proposed 6-foot side yard public utility easements also follow an irregular course. He further suggested that instead of following the proposed lot line, the public utility easement could, instead, follow a straight east/west line. Joan noted that no utilities presently occupy this area. Village Attorney Richard Martens stated that with reference to the 1853 document, it states that the Town of York was making a declaration concerning the York Road right of way, although it does not specifically state a road dedication by the property owners to DuPage County. Acting Chairman Beard suggested that the common lot line could be dropped directly South in order to make it straighter. Joan stated that such a reconfiguration would reduce the acreage of Lot 2 below 3 acres. The Acting Chairman noted that there were no members of the audience expressing support for or opposition to the proposed subdivision.. Kapff, Assistant to Village Manager SUBJECT: Philip's Subdivision - Final Plat Dale's memo of September 12, 1985, Item 1, broadly reviews the subject of York Road right of way. Dale specifically notes the question as to whether the York Road right of way was or was not actually dedicated in 1853. Following a review of this subject with both our Village Attorney and Village Manager, it is their opinion that the 1853 document was not a formal dedication of right of way and, therefore, the property line with respect to this Subdivision extends to the center line of York Road. As such, the respective acreages of Lot 1 and Lot 2 are 1.0 and 3.159 acres in conformance with the one acre minimum lot area requirements of this R-2 Zoning District. SUBJECT: Philip's Subdivision - Final Plat I have reviewed the above stated application and final plat and offer the following comments: 1. The plat depicts the statement "Centerline of Public Highway heretofore dedicated March 8, 1853 by York Township Highway Commissioners". There is some question as to whether the 1853 dedication was, in fact, binding and also whether a thirty-three (33') foot width was included (the document does not state a width) . This item is important because it directly relates to the available area for Lot 1. If a highway dedication was previously dedicated, that property cannot be included within a lot area and, is not specfically owned by the property owner. If, however, the dedication is not appropriate, the lot area would proceed to the centerline of the right- of-way.
