McDonald's Improvement Plan - Phase 1-B (Jorie Boulevard): On July 15, 1985, per memo from Chairman Marcy, the Plan Commission recommended approval and on August 6, 1985, the Zoning Board of Appeals similarly recommended approval, per memo from Chairman Savino dated August 9, 1985, of Phase 1-B of the development which calls for the construction of a 260,000 square foot office building containing underground parking for 600+ cars, Lodge Building #3 with a swimming pool, and a maintenance building directly northwest of the Training Center. They further recommended approval of amendment to the Development Plan, regarding the location of maintenance building within bubble "F", clarification of structure height between Phase 1-A and Phase 1-B, and approval of the Flood Plain Special Use for the Phase 1-B reconstruction of service drive. 1. Improvement Plan Phase 1-B: Trustee Philip moved, seconded by Trustee Rush. .. S-564 AN ORDINANCE AMENDING A DEVELOPMENT PLAN AND A DEVELOPMENT PLAT IN ACCORDANCE WITH THE PROVISIONS OF SECTION X(D) OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK RELATIVE TO DEVELOPMENT OF THE PROPERTY COMMONLY KNOWN AS THE "G.H.Q. PROPERTY" WHEREAS, the Corporate Authorities of the Village of Oak Brook on May 31, 1978 passed Ordinance No. 5-409 wherein, a Development Plan. and Development Plat for the property commonly known, as "G.H.Q. Property" was approved; and WHEREAS, the owner of the G.H.Q. Property, McDonald's Corporation, has petitioned the Village for certain amendments to the approved Development Plan and Development Plat; and WHEREAS, on July 15, 1985 the Plan. Commission, of the Village held a public meeting concerning the propositions and has submitted its report and recommendations thereon to the Corporate Authorities; and WHEREAS, on August 6, 1985 the Zoning Board of Appeals of the Village, pursuant to statutory notice, held a public hearing concerning the application and has also submitted its report and recommendation, thereon to the Corporate Authorities; and WHEREAS, the Corporate Authorities of the Village have reviewed the proposed amendments to the Development Plan and have also considered the reports and recommendations of the Zoning Board of Appeals and the Plan Commission; and WHEREAS, the Corporate Authorities deem the passage of this Ordinance to be in the best interest and in furtherance of the public health, safety, and general welfare of the Village of Oak Brook. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTESS OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows: Section 1: The provisions of the preamble hereinbefore set forth are hereby incorporated herein, as though herein fully set forth. Section. 2: That the Development Plan adopted by Ordinance No. 5-409 is amended by deleting the last sentence of Section. 2 of the Development Plan, which sentence reads as follows: "No building in Phase 1 shall exceed four stories or 48 feet in height, whichever is less." Section 3: That the Development Plat adopted by Ordinance No. S-409 is amended by moving development area or bubble "F" fifty feet to the South of its current location on the Plat. Section. 4: That this Ordinance shall be in full force and effect from and after its passage and approval as provided by law. Section 5: All ordinances, rules and regulations of the Village of Oak Brook which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict but only as they apply to the property hereinbefore described. Kapff, Assistant to Village Manager SUBJECT: McDonald's ORA-3 Development Plan Amendment Ordinance No. S-409, approved by the Village May 31, 1978, approved a Development Plan and Plat for the total development of the McDonald's Office Campus. A copy of this ordinance and pertinent exhibits is included in the Improvement Plan Phase 1-B folder also on this agenda. Referring to page 1 of Exhibit B to Ordinance S-409, item #2 states in part "No building in Phase 1 shall exceed four stories or 48 feet in height, whichever is less". The proposed Phase 1-B office building will be approximately 53 feet in height and thereby fails to meet this requirement. I would further note that under item #8 on page 3 of that Exhibit B it states that "No office building shall have a structure height in excess of five stories or 60 feet in height". In reviewing the Phase 1-B proposal, it became clear that it really contains elements of both the first and second proposed phases of the office campus development. However, instead of referring to the proposed develop- ment as Phase 1-B, 2 which would have indicated elements of two phases being pro- posed, the applicant has chosen to modify the original development plan concerning the 48-foot structure height maximum for buildings within Phase 1. The second part of this application concerns development bubble F which is proposed to contain a one-story maintenance building. The proposed location of the maintenance building extends South of the originally proposed bubble F and, therefore, application has been made to relocate the boundary of bubble F to the South. Marcy, Chairman Plan Commission BFK/HOM/jr PLAN COMMISSION Minutes -7- October 21, 1985 VII McDONALD'S SPRING ROAD RESUBDIVISION #1 - FINAL PLAT David Gooder, attorney; and Seymour Greenman, corporate attorney for McDonald's, were present representing this application. Mr. Gooder stated that McDonald's owns all of the property bounded by 22nd Street, Spring Road, Commerce Drive and McDonald's Drive, but for the small parcel at the northeast corner occupied by the drive-in bank. He stated that McDonald's primary desire was to expand existing surface parking adjacent to the one-story office building located at the southeast corner of the property in order to serve both their regional and corporate headquarters, and in reviewing this desire with the Village's Building Department, ran into the zoning requirement that parking be prohibited between the building and the adjoining street as required by Section XI(E)(7) (ii) . In response to Member Haglund, Mr. Gooder stated that they will be constructing 120-130 additional spaces on this lot. Member Haglund noted that approximately one month ago, in conjunction with the Village's review of parking requirements, Mr. Gooder told the Village that office buildings in Oak Brook did not need so many parking spaces and, therefore, should reduce its requirement, and that now McDonald's is planning on building additional parking spaces above and beyond those required by the Village. Mr. Gooder stated that this requirement for additional parking is due to the delayed construction of the new corporate headquarters along Jorie Boulevard and that, on a temporary basis, the existing parking lot is overcrowded. In response to Commission members, Mr. Gooder stated that the Amoco station has four more years on its lease and Colby's has eight years remaining plus an option for an additional ten years. Mr. Gooder further noted that the surface parking will be provided with significant landscaping along the western side of the lot as required by the Zoning Ordinance. He also stated a willingness to construct a sidewalk adjacent to Spring Road which would be in conformance with the Village's bicycle path plan. The Chairman noted that there were no members of the audience expressing support for or opposition to the proposed resubdivision. As noted on the attached maps, the existing easterly lot contains a one-story office building with surface parking. The southwesterly lot is occupied by the Amoco gas station, and the northwesterly lot is presently vacant. The proposed reconfiguration would add a 50-foot wide strip. along Spring Road to the Amoco lot and transfer the remaining portion of the vacant parcel to the lot containing the one-story office building. I have been advised by Mr. Gooder that the proposed utilization of this vacant property. is for the construction of additional surface parking potentially to be used as overflow parking for McDonald's office building on the East side of McDonald's Drive. SUBJECT: McDonald's Spring Road Resubdivision #1 - Final Plat I have reviewed the final plat received on September 23, 1985 and offer the following comments: 1. The Subdivision Code states "Very irregular lots should be avoided." Consideration should be given by the Plan Commission as to whether they perceive the proposed subdivision as being "very irregular" regarding proposed lot configurations. I am not aware of any other areas within the Village which have similar lot configurations as the ones proposed within this subdivision. 2. Consideration should be given to requiring the applicant to construct a concrete sidewalk along Spring Road as a condition of approval of this subdivision. A sidewalk presently exists on the east side of Spring Road north of Commerce Drive. If the subject subdivision constructed its share of the sidewalk, only the piece in front of Colby's would remain. Since this is a missing link within our bicycle and pedestrian pathway system, it would be appropriate to have the applicant construct it at this time, or at the time of any building or site improvements. 3. Several minor drafting revisions remain to be made to the plat. 4. Consideration should be given to waiving the requirement of providing topography and the requirement of constructing land improvements except for the above discussed sidewalk.
