dedication of York Road right-of-way and that a ten (10) foot wide
Pedestrian/Bicycle Path Easement be added to the Plat to be constructed
by Christ Church as a public improvement.

2. Special Use gnd Tard Variation:
On,April 1, 1986, the Zoning Board of Appeals recommended approval of
an amendment to the Special Use Permit that would allow for an addition
to the existing church. Proposed plans showed no encroachment into the
100-foot side yard abutting York Road, consequently the request for a
variation was withdrawn.

To concur with the recommendation of the Zoning Board of Appeals and
direct the Village Attorney to prepare the necessary document to amend
the Special Use Permit in accordance with plans prepared by C. Edward
Ware Associates, Inc., Architects, Sheets S-7, 3-8 and SD-1 dated as
last revised March 24, 1986 and Job 1185-184, dated December 18, 1985,
prepared by Edmund M. Burke & Associates, Ltd., Consulting Engineers.

No one was present representing the Church in this application.
Commission members proceeded to discuss the review items contained in Dale Durfey's
March 13th memo. There was general agreement that the Church should dedicate York
Road right-of-way adjacent to the Novacek parcel and should grant a bicycle path
easement along the West side of York Road.
Member Doyle indicated that the Church should be required to build the bicycle path
in exchange for its expanded development into a residential area, and for the fact
that the bicycle path construction would constitute only a small part of their
overall development cost.
In answer to Commission questioning, Staff noted that the requirement 'to construct
bicycle paths is generally made in lieu of the Subdivision requirement for
sidewalks.
The Chairman noted that there were no members of the audience expressing support
for or opposition to the proposed application.
A motion was made by Member Beard, seconded by Member Antoniou to recommend to the
President and Board of Trustees approval of the Subdivision Plat as presently drawn
which includes a 50-foot dedication of York Road adjacent to the Novacek parcel
subject to the following conditions:
1) Addition of a 10-foot wide bicycle path easement along the easterly lot line
along York Road.
2) The bicycle path along the easterly lot line be constructed in conjunction with
the Church's development of the property.
3) Conformance with all other review items as required by the Village Engineer.

SUBJECT: Christ Church Resubdivision - Final Plat
The Plan Commission, at its February 17, 1986 meeting, recommended approval of the
Church's proposed construction which, among other things, included additional parking
on the Novacek property at 3202 York Road directly adjacent to the Christ Church parcel.
That earlier application for a Special Use Permit has yet to be acted upon by either
the Zoning Board of Appeals or the Village Board.
In conjunction with the proposed development of the properties, Christ Church has made
application for a Final Plat of Subdivision which would consolidate both the existing
Church property with the Novacek parcel into one lot.

SUBJECT: Christ Church Resubdivision - Final Plat
I have reviewed the final plat received on February 28, 1986 and offer the following
comments:
A. MAJOR ISSUES
1. The Village Board must decide whether they will require a dedication of
York Road within the southerly portion of the subject subdivision. Until
that happens, the plat cannot be finalized.
2. Consideration should be given to requiring the applicant to grant a ten
(10') foot bicycle easement along the easterly lot line.
The DuPage County Division of Transportation has informed us that the
improvements to the intersection of 31st/York could move the existing
ditch line on York Road westerly toward the right-of-way line. If this
should happen, it would then be difficult to construct the bike trail
strictly within the right-of-way. Therefore, it appears appropriate
that the applicant grant the ten (10') foot wide bicycle easement so
that the bicycle trail can be constructed in the most feasible location.
3. Consideration should be given to having the applicant construct the bike
trail. This would be in keeping with the most recent subdivision submittal
of the McDonald's Spring Road Resubdivision #1 in which the Village
required that the applicant construct a sidewalk as the only public
improvement.
B. MINOR ITEMS
1. Many minor drafting items remain to be revised on the plat.
2. The boundary survey information of the plat does not correlate with two (2)
surveys which the applicant submitted with his application.
You and I discussed these issues with Rev. DeKruyter and his architect, Ed Ware,
on Monday, March 10, 1986.

A long time source of worry has been the constant
threat of the widening of York Road, and with the
pedestrian-bicycle path about to be completed on the

SUBJECT: Christ Church - Special Use and Yard Variation
(501 Oak Brook Road)
Christ Church of Oak Brook has proposed construction of two building additions and
additional surface parking adjacent to the existing Church. Since a church is a
permitted special use within a residential district, any modifications to the
property require review and approval by the Village.
As can be seen on the Site Plan, a new parking area is proposed directly South of
the existing Church extending onto what is now occupied by the Novaceks, who
presently reside at 3202 York Road. The Church is in the process of purchasing the
Novacek parcel and based on this plan, will construct surface parking within the
rear two-thirds of the Novacek parcel. Plans are for the Novaceks to have a life
estate permitting them to continue their residence on the property. One of the
plans also shows future plans to construct additional surface parking to within
100 feet of York Road once the Novaceks leave the property, although such is not
proposed at this point in time.
The Church is also planning on constructing two building additions to the East of
the existing Church as shown on both the Site Plans and the proposed Floor Plans.
These additions extend up to 43 feet into the required 100-foot setback adjacent
to York Road. In this regard, the Church has also applied for a setback variation.
Directly East of these additions is a new roadway/turnaround area which will provide
additional access to the Church.
The Zoning Board, in its review of the requested setback variation, should determine
that the proposal meets the standards of the Zoning Ordinance as contained in
Section XIII(G), pages 966-969. The specific standards relative to the granting of
a Special Use Permit are contained in Section XIII(J) , pages 971-973.
The Plan Commission, at its meeting of February 17, 1986, recommended approval of
the requested Special Use Permit as noted by Chairman Marcy's letter contained in
the Special Use file.

NOTICE IS HEREBY GIVEN that a public hearing before the Zoning Board of Appeals
of the Village of Oak Brook, DuPage and Cook Counties , Illinois , will be held
on March 4 , 1986 at 7 : 30 P .M. in the Oak Brook Village Hall , 1200 Oak

Three (3) companies were solicited to submit bids per specifications
and two (2) proposals were received.

To award the contract for the refurbishing and repainting of Aerial
Unit #914 to the lowest qualified contractor, Speciality Vehicle
Service, Inc., in the amount of $18,600.00 and waive the bidding

SUBJECT: Christ Church - Request for Fee Waiver
I
Christ Church has made application for an amendment to their existing Special Use
Permit, a Subdivision Plat, as well as a Yard Variation all related to certain
proposed modifications to their property.
Their requested waiver of all associated fees would be permitted pursuant to
Section 2-226 of the Village Code, copy attached. It is, therefore, recommended
that the Village Board consider waiving the special use fee of $400.00, the final
plat fee of $100.00 and the variation fee of $300.00 as requested.

rights-of-way or easements and not covered by

(5) Resubmissions.Upon resubmission of any final plat which
has not been recorded because of noncompliance with
the provisions of Section 6 of Article VI of the Subdivi-
sion Regulations, the fees enumerated under subsections
(2), (3) and (4) hereof shall be paid, notwithstanding

Sec. 2-226. Waiver of Fees.
Any governmental unit or any charitable organization as
defined in "an act to regulate solicitation and collection of

Illinois Revised Statutes 1979, Sections 5101, et sequitur,
may request waiver of any fees established in this article.
Upon such request the president and board of trustees may,
in its discretion, waive any such fees imposed pursuant to

Sec. 2-227. Other fees.
The fees established herein shall be in addition to any
other fees or charges otherwise established by ordinances of
