will note,this issue originally was discussed as far back as 1986. It has been commented on over many years since then.
It does appear to me that the original problems began when Mr. Dressler created "flag" lots in lieu of constructing a
road to meet Village standards.
Although our Office did feel that an address change would be easily accomplished,it now does not appear to be the
case. As Oak Brook does have many "flag"lots, the precedent that could be set could have significant ramifications.
At this time, we recommend that the York Road address continue to be used and that proper address signage be
installed at York Road. You many also wish to further discuss past history with the Developer, Dressler Builders.
Please feel free to further discuss this letter or any of the attached with Mr.Dressler. You may also feel free to further
discuss with either myself, the Village Engineer, Dale Durfey, or our Planning/Zoning Director,Tom Hawk.

SUBJECT: 3500/3502 York Road
As per your request, I have reviewed the letter dated April 26, 1995 from the
Hennessy's and the Lovelace's and note the following:
1. These two lots were created by the Old Mill Subdivision by Resolution R-412
on May 13, 1986. These two lots are flag lots off of York Road.
2. The Old Mill Subdivision did not create any new streets and "Mill Gate Lane"
does not exist. What does exist is one driveway off of York Road which is
being utilized by two homes.
3. The subdivider, Phil Dressler, wished to create a roadway designation after
the plat was approved as stated within his letter of October 23, 1990, copy
attached. My reply letter of October 26, 1990, copy attached, replied that
Mill Gate Lane was not part of the subdivision and that a surveying mistake
did not take place since the plat did not include any new street.
4. The attached sketch of a four lot development has apparently been offered by
Phil Dressler to potential buyers. Unfortunately, this layout does not exist
as the Village of Oak Brook has not approved of a four lot subdivision.
Additionally, street access in the sketch fashion does not exist and has not
been approved by the Village.
I am also attaching a copy of my memo of July 1, 1991 to John Brechin dealing
with this subject.
5. The second sentence of the Hennessy letter states that they were originally
designated as 1 and 2 Mill Gate Lane. I do not believe that this is a
correct statement. Since the plat did not include a Mill Gate Lane, I
believe the developer provided this incorrect address to the homeowners. The
third sentence in the Hennessy letter states that the Village corrected that
mistake of the developer and assigned proper addresses to the two lots.
6. The fourth sentence in the Hennessy states that they were changed back to 1
and 2 Mill Gate Lane and a street sign was erected. I am unaware as to who
changed the addresses back and I assume that the homeowners erected the
incorrect street sign.
7. Item number 1 within the Hennessy letter states that they are set well back
off of York Road. This is not uncommon since there are two other similar
flag lots along this section of York Road and many other flag lots throughout
other sections of the Village. The Hennessy's statement that ". . .it makes
no sense to give us a York Road address when we do not live on it" is
incorrect since each lot of the Old Mill Subdivision fronts onto York Road
and the homes are serviced from York Road by a driveway.
8. Item number 2 within their letter falls within the flag lot situation. In
reality, the 3500 and 3502 York Road address should easily be able to be
found since they were logically derived from the Village's address map.
9. Item number 3 relates to the incorrect information apparently provided by the
developer. The Village has attempted to correct this.
10. Item number 5 states "We maintain the road. . .". Apparently the two
homeowners incorrectly perceive their driveway as being a road. The
subdivision plat is quite clear that these are two flag lots which actually
go out and touch York Road and no road was created by the plat.
I believe an underlying item is the developer's long range goal of utilizing these
private driveways as street access to additional properties within this area. I do
not believe that is appropriate and goes against both the Zoning Ordinance and
Subdivision Regulations.
I also believe that this could set a dangerous precedent of any resident giving his
driveway a roadway classification. Conceivably, every flag lot could request a
roadway designation for his driveway which would result in, I believe, additional
confusion.
I stand ready to review these items with you at your convenience.

As per your request of June 20, 1991 , I have reviewed this matter w
Hawk. We recently discovered Section V (P) of the Zoning Ordinance which
states " . . .or any land used, by easement or other means , for vehicular
access which may be developed in any zoning district in the Village of Oak
Brook, shall meet all requirements of the subdivision regulations of the
Village. . . " . It appears to me that the two (2 ) lots within the Old Mill
Subdivision which presently have one ( 1 ) driveway for the two (2) lots
would have to improve that driveway to the Village ' s street standards in
order to serve as access for multiple lots .
Please keep in mind that the two (2) lots within the Old Mi11 .Subdivision
are both flag lots and both lots actually come out and touch York Road.
Apparently the two (2) lot owners have come to some agreement so as to
build only one ( 1 ) common driveway for the two (2) lots straddling both
lots near York Road.
The question of providing access to additional lots is , in my opinion,
inappropriate short of the construction of a Village standard street .
Questions of proper Village planning for any transportation system as well
as appropriate paving strength and turn around capabilities for emergency
vehicles come to mind. It seems that this request is a case of the tail
wagging the dog rather than going through the proper planning process of
providing access to lots first .
I fully concur that one ( 1 ) access point onto York road is preferable to
three or four (3 or 4) , but I believe a full review of the access needed
and the construction ramifications need to be reviewed and approved by the
Village.
For your information, I am also aware that Mr . Dressler has an interest in
the single lot south of the Nied Subdivision, which would become the 5th
lot utilizing this proposed access .

Article VII , Section 2(B) ( 1 ) of the Subdivision Regulations states "lots
shall abut on a street" . I think a common assumption is made from this
statement that means that access shall be on the street which the lot
fronts. Since the only street , public or private, which exists in the Old
Mill/Alex Nied area is York Road, I don' t believe the Subdivision
Regulations will allow any other access point . Article VII , Section 3(A)
states "A paved street system designed and constructed in accordance with
Village of Oak Brook standards shall be installed to serve lots in the
subdivision. " The paragraph further says "Street layout shall be in
accordance with the official plan of the Village of Oak Brook. . . " . It also
says that roadway pavements in cul-de-sacs shall have a minimum diameter of
120 ' and curb and gutters are required.
It appears to me that the only street in this area is York Road and,
because of that , access should be taken from York Road. However, I would
encourage Mr . Dressler to construct a Village standard street (a resubdi-
vision may be necessary) in order to provide access for these lots and
decrease the access points on York Road down to one location.

Dear Dave:
Thank you for your letter of October 23, 1990 in which you state that the surveyor
made a mistake by omitting the name of the street from the final plat of the Old
Mill Subdivision and requesting specific addresses for your two lots. In my
review of the plat, I find that the surveyor did not make a mistake since the
plat did not include any new street. The two (2) lots within the Old Mill
Subdivision front directly onto York Road and a new street, either public or
private was not created with the plat. As such, a street called Mill Gate Road
does not exist.
As we have discussed in the past, should you wish to construct a road to service
both the two (2) lots within the Old Mill Subdivision as well as the other three (3)
lots which front onto York Road, you must submit a resubdivision plat of the area
for review by the Village of Oak Brook. Until that is done which would create a
road, no roadway exists within this area except for York Road.

We are writing as we were instructed to do in order to preserve our captioned addresses, rather than have
them changed to 3500 and 3502 York Road, Oak Brook. The history of our address is really quite
frustrating in that originally we were designated One (1) and Two (2) Millgate Lane. For some
unexplained reason the Village unilaterally changed our addresses to 3500 and 3502 York Road causing
much confusion. Shortly thereafter, we were changed back to One (1) and Two (2) Millgate Lane and
a street sign was erected entitled "Millgate Lane". We have now remained One(1)and Two (2)Millgate
Lane for approximately two and one half years. Recently, we were notified that our addresses would
again be changed to 3500 and 3502 York Road, Oak Brook.
This is unacceptable to us for the following reasons:
1. We are set well back off of York Road with three (3) lots in front of us,
which are bermed from York Road, so it makes no sense to give us a York Road
address when we do not live on it.
2. This will cause much confusion because once the three (3) lots in front of
us are built upon, you will not be able to see our homes and no one will
know where 3500 and 3502 York Road are located.
3. We are now well established in our current addresses and it would require
another complete address change for our family, friends, business associates,
or anyone else attempting to contact or find us.

4. We are experiencing no problems presently with visitors or deliveries, so
that everyone knows where we are located.
5. We maintain the road and receive no village services, plowing,
surfacing, etc...

Over the past several years , there has been an ongoing discussion
between the Village and the property owners of 3500 & 3502 York
Road. There is some disagreement as to the proper address for these
two homes, 3500/3502 or 1/2 Mill Gate Lane. In an attempt to solve
this matter, we have asked the owners to decide, and formally ask
for an address that we can all agree with.
Attached is a letter recently received from the two owners of the
only two homes currently existing, the Henessy' s and the Lovelace' s.
As you will note, they would like their addresses to be One and Two
Mill Gate Lane. I have reviewed their request and am in agreement
with their reasoning.
Please review this matter, and advise me as to your thoughts. If
I do not hear from you, I will assume that you can agree with this
request. The main item needing attention will be the "911" matter,
and FD & PD response maps , as well as the "official" Village Map.

BUILDINGS AND BUILDING REGULATIONS § 5.5
Sec. 5-5. Numbering of buildings.
(a) Except as otherwise passed by the board approval, on
the recommendation of the building commission, building
numbers within the village shall correspond with the grid
lines established on the annexed plat of the village, which
said plat is hereby incorporated by reference. Such numbers i
shall progress uniformly to meet the number designation on
the next succeeding grid line.
(b) All houses or buildings located on the north and west
sides of respective streets shall bear even numbers and all
houses or buildings located on the east and south sides of
respective streets shall bear odd numbers.
(c) It shall be the duty of the office of the building
commissioner, upon request, to issue and designate numbers
for all buildings within the village in accordance with the
system hereby adopted.
