A RESOLUTION APPROVING GIRGIS' ASSESSMENT PLAT
BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF
OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
Section 1: That the assessment plat consisting of one sheet and entitled .
"Girgis' Assessment Plat" prepared by The Balsamo/Olson Group, Inc. dated
September 3, 1994, be and is hereby approved, subject to the conditions
enumerated in Section 2 of this Resolution.
Section 2: That the approval of Girgis' Assessment Plat as given in
Section 1 hereof be and is expressly subject to the following conditions:
A. That six foot (6' ) side yard and ten foot (10' ) rear yard public
utility easements shall be noted on the drawing where they are not
presently depicted;
B. That minor drafting revisions shall be made subject to the approval
of the Village's Engineering Department; and
C. That the applicant shall perform and submit a project specific flood
plain study per Section 15-132.3 of the County Stormwater Ordinance
to determine the 100-year flood plain elevation.

State law mandates how local government procures professional
engineering services and requires their negotiation on the basis of
demonstrated competence and qualifications for the type of services
required and at fair and reasonable compensation. State law also allows
a municipality to utilize a firm with which it has a satisfactory relationship
for such services. The Village has recently utilized Civiltech Engineering,
Inc., as our consultant for the York Road Bike Trail project. The
professional services required for these two new locations are very similar
to the services accomplished for the York Road project. On the York
Road project, staff noted Civiltech's competence and professionalism.
Motion by Trustee Payovich, seconded by Trustee Bartecki, to authorize
staff to negotiate two (2) separate contracts (pursuant to State law) for
each location, since a different agent is being utilized for the two different
sites, for preliminary engineering services with Civiltech Engineering, Inc.
Said contracts will be reviewed by the Village Board for their approval.

the Village Attorney to draft the necessary resolution for action at the
Regular meeting of November 22, 1994, subject to the following
conditions be incorporated into the resolution:
1. This is a compilation of two existing lots into one proposed lot. Six
foot side yard and ten foot rear yard public utility easements should be
noted on the drawing where they are not presently depicted;
2. Several minor drafting revisions need to be made to the plat; and
3. The plat depicts an existing flood plain on a portion of this property.
The flood plain maps depict this area as a 100-year flood plain;
however, base flood elevations and flood hazard factors have not
been determined. In order for an exact flood plain elevation and limit
to be determined, the applicant needs to perform and submit a project
specific flood plain study as per Section 15-132.3 of the County
Stormwater Ordinance. This study will then be reviewed by RUST,
our consultant. Without this project specific flood plain study, there is
no way to determine the 100-year flood plain elevation at this site.

Please see my earlier memo regarding this proposal (page 6 of this file).
The Plan Commission has reviewed this request and has recommended approval subject to the
conditions suggested by Engineer Durfey in his letter of October 10, 1994 (petition file number
8). There has been no public opposition and two of the neighbors have submitted letters of
support.
If it is your wish to proceed with this petition, it would be appropriate to authorize the attorney
to draft the necessary resolution for action at your meeting of November 22, 1994. The
following conditions should be included in your motion for incorporation into the resolution:
1. This apparently is a compilation of two existing lots into one proposed lot. Six

II. APPROVAL OF MINUTES
Member Aktipis moved, seconded by Member Mueller, to waive the reading of the July 18, 1994
Plan Commission Meeting minutes and to approve them as written.
VOICE VOTE: All in favor. Motion passed.
Chairman Savino announced that the items on the agenda will be taken out of order.
6) C',IRGIS - 506 WENNES COURT - ASSESSMENT PLAT
John Wagner introduced himself, Dr. Girgis and his wife Rita. He submitted to the Plan
Commission a support letter from Mrs. Baroni who resides at 413 Luthin which is contiguous
to the back of the Girgis' lot. Wagner reviewed the background of the lots in question and
explained the intent of the petitioner is to combine two lots into one conforming lot and by doing
so will enhance the buildable area. The lot at 506 Wennes is presently wide but very shallow.
The Girgis' have purchased property on Luthin which consists of two lots, Lot 14 and 15. They
want to combine 506 Wennes with Lot 14 on Luthin Road. This lot is presently unbuildable and
80% water, however, when combined with 506 Wennes it will allow a deeper buildable area.
Dr. Girgis stated that their four children and have outgrown their home. Instead of moving they
would like to build on the lot. They have discussed the plans with the surrounding neighbors
and they have no objections. There is so much vegetation between the lots that it will not disturb
them.

Chairman Savino questioned the use of Lot 15 and was informed that Lot 15 is a separate lot and
will continue to exist the way it currently is.
Hawk said that in most other cases the requested change could have been accomplished without
the hearing process. However, this particular case involves two lots in two different subdivisions
on two different streets. There will be no physical change in the rear yard because it is in the
lake. The only lot that could be affected would be the Baroni lot, and Mrs. Baroni does not view
it as having a detrimental effect. They will gain 20+ feet of buildable area.
Durfey said that once the lots are combined, 506 Wennes will become a flood plain lot. Member
Mueller moved, seconded by Member Pequet to recommend approval of the Girgis' Assessment
Plat to combine the two lots subject to engineering approval and the conditions set forth in
Durfey's memo dated October 10, 1994 (petition file index number 8).

IV. OAK BROOK PARK DISTRICT - 1300 FOREST GATE ROAD - SPECIAL USE
AMENDMENT
Harlan Spiroff introduced himself as the attorney representing Oak Brook Park District in this
petition and introduced William Greeve,traffic engineer and Mike Hughes. Spiroff said that they
are seeking an amendment to the Site Plan that was granted in 1984 by Ordinance G-342.
Spiroff said that the recreational center is intended to provide gymnasium meeting room space
and additional administrative office space. The Park District programming has increased and so
has the need for additional offices. The need for the recreational center has been determined by
years of surveys of program participants and interest in the programs. Some of these needs
include child care so that parents can participate in various programs. It will be located in
Central Park on a 60-acre site surrounded on the west and south by residential and on the north
and east by office research. The building is proposed to consist of 54,000 square feet,
containing, a gymnasium, various meeting and activity rooms, and administrative offices. There
is a proposed Phase II shown on the plan with a proposed swimming pool. The building will
be built compatibly to existing buildings, will meet all building code requirements, and all the
stormwater requirements of both the Village and County Stormwater Ordinance.
Mr. Greeve identified access and discussed the traffic impacts. By analyzing the intersection
of Jorie and Forest Gate it was determined that the recreation center can be constructed while still
maintaining the existing operation at that key intersection. The intersection at Jorie and 31st is
stacked during rush hour. When 31st Street was reconstructed several years ago the optimization
was to have the right turn move almost like a merge lane. The design is not quite consistent with
that. The County Highway Department has been contacted and they are going to be taking a
look at the area to see if some sort of remedial measure can take place to assist that traffic.
Accessibility will be excellent in and out of the building. The site plan provides for 200 parking
spaces which is believed to be more than adequate, except for an occasional event.

This lot consolidation is taking place in order to provide a larger buildable area for a home
fronting on Wennes Court than the present lot configuration allows.
Lot 14 in Luthin's Subdivision which fronts on Luthin Road has little or no buildable area due
to the pond and flood plain that cover much of the lot. With the proposed lot consolidation, this
area will provide the rear yard area for the home fronting on Wennes Court.
I do not perceive any real detrimental effects if this request is approved. The flood plain in this
area is currently designated as an Unnumbered A Zone. Engineering requirements will call for
the establishment of the estimated 100 year flood levels for this area.
This information should prove helpful to all the nearby property owners.

construction of any building, structure, or improvement to
land or any lot (a) within a subdivision, as defined herein,
prior to recording of the final plat therefor, or (b) within a
tract for which an improvement plan is required, prior to
certification of the approval of the improvement plan by the

ARTICLE XI. OCCUPANCY PERMIT
No occupancy ,permit shall be granted by any official for
the use of any structure within a subdivision approved for
platting or re-platting until required utility facilities have
been installed and made ready to service the property, and
that roadways providing access to the subject lot or lots
have been constructed or are in the course of construction
and are suitable for vehicular traffic.

ARTICLE XI-A. ASSESSMENT PLAT
_ PROCEDURES*
Section 1. Purpose.
The purpose of these provisions is to provide a method
and procedures for the platting of property into lots not
involving a subdivision as defined by the Subdivision J
Regulations of the Village of Oak Brook, Illinois. (Ord. No.
G-259, § 2, 12-11-79)
Section 2. Jurisdiction.
The provisions of this article shall not be utilized to evade
the intent and purpose of the Subdivision Regulations of the
Village of Oak Brook, but are applicable only to the platting
of single lots legally created prior to November 9, 1971, or
the consolidation of such lots.

APPENDIX B—SUBDIVISIONS Art. XI-A, § 4
Nothing contained herein shall otherwise permit the
subdivision of property under the jurisdiction of the
Subdivision Regulations of the Village of Oak Brook from
being so subdivided except in accordance with the terms of
said subdivision regulations. No assessment plat shall be re-
corded in the office of the Recorder of Deeds for DuPage
County, Illinois until such assessment plat has been proper-
ly reviewed and officially approved by the president and
board of trustees of the Village of Oak Brook. (Ord. No.
G-259, § 2, 2-1.1-79)
Section 3. Definitions.
Assessment plat. A plat of property prepared in accord-
, ance with the Plat Act, Chapter 109 of the Illinois Revised
Statutes, which describes property as a single lot other
than by a metes and bounds description and as referred to
in paragraph 516 of Chapter 120 of the Illinois Revised
Statutes, which plat does not involve a subdivision as
defined in the Subdivision Regulations of the Village of Oak
Brook.
Legally created lot. A lot created pursuant to the
provisions of the Plat Act, Chapter 109 of the Illinois
Revised Statutes or created pursuant to an exception
thereto. (Ord. No. G-259, § 2, 12-11-79)
Section 4. Procedure.
(A) The owner shall file an application for approval of the
assessment plat with the village clerk. Such application
shall be accompanied by the original ink tracing on linen or
mylar, seventeen (17) prints of the assessment plat and four
(4) copies of all required supporting data, drawings and
documents.
(B) Within sixty (60) days from the date of filing the last
required document or other paper or, within sixty (60) days
from the date the application for approval of the assessment
plat was filed with the village clerk, whichever date is later,
the president and board of trustees shall approve such plat.
Upon approval of an assessment plat, the village clerk shall

certify such approval and affix the corporate seal of the
village on the assessment plat.
(C) Upon approval by the president and board of trustees
and receipt of any remaining required documents, the
village clerk shall have the plat as approved by the
president and board of trustees recorded and on its return to
the village have one mylar or equal transparency made and
deliver a copy of the assessment plat or transparency to the
owner. The cost of recording and the transparency shall be
paid by the owner.
(D) On recording, one copy of the recorded plat and one
set of supporting data shall be retained in the clerk's files,
two (2) sets by the village engineer and one approved set
returned to the owner. (Ord. No. G-259, § 2, 12-11-79)
Section 5. Assessment plat requirements.
The requirements for an assessment plat shall be the
same as those established for an final plat of subdivision as
detailed in Article VI, Section 2(A) through 2(D), inclusive,
of the subdivision regulations of the village. In addition to
all of the requirements herein contained, the assessment
plat shall clearly delineate any dedications or grants of
easement to the village as required by the president and
board of trustees including, but not limited to, public bicycle
and pedestrian path easements, dedication for roadways,
and easements for public utilities and shall depict all other -
existing easements of dedications. (Ord. No. G-259, § 2,

Section 6. Fees.
No filing fee shall be required for any assessment plat, —
provided that the applicant for approval of an assessment _
plat shall pay the village all recording fees associated with

Re: Girgis Assessment Plat.
Dear Chairman Savino,
I would like to express to the Plan Commission the reasons why the Girgis family has filed
an Assessment Plat with the Village. Sam and Rita Girgis have resided at 506 Wennes
Court for several years and their family continues to grow, they now wish to construct a
new home to replace the existing home. After investigating the requirements of the Zoning
Ordinance they found that their lot did not have adequate buildable depth in the existing
lot to accommodate the new home. The existing lot at 506 Wennes measures
approximately 132 feet in depth and 340 feet in width, after applying the required front
and rear setbacks a depth of 32 feet remains. To alleviate the problem Sam purchased
additional property at 321 Luthin Road which is made up of two separately plated lots.
Lot 15 has a home on the property and the lot conforms with the R2 district
requirements. Lot 14 is vacant and does not contain any structures, and is 75% covered by
water. Combining 506 Wennes Court and lot 14 on Luthin Road creates an L-shaped lot
which is depicted in the Assessment Plat. This new lot then will meet the R2 district
requirements and the buildable depth of the lot is increased by 22 feet to a total of 54 feet
which will accommodate the design of the new home. The Girgis's will then move into 321
Luthin while the new home is constructed at 506 Wennes Court. Upon completion of the
new home Sam hopes to move his parents into 321 Luthin Road.
We have been working with Tom Hawk on this project and he has suggested that we use
the Assessment Plat process to accomplish this new lot configuration. This recombination
of lots will create two conforming lots under the R2 district requirements and solve the
setback problems for the Girgis family without having to request a variation to
accommodate the new construction. The Village engineer has also requested that we
provide Public Easements around the perimeter of the property which are shown on the
Assessment Plat.

Additionally we have found that the Subdivision Regulation calls for public improvements
to be installed. We would request that these be waived.The area is now served by rural
streets that exist and there is no increase in the number of homes being serviced. This
process is simply to try and recombine lots to meet the setback requirements of the Zoning
Ordinance. We will provide additional drawings and sketches at the October 17th meeting
to illustrate this issue further and answer any questions at that time. We are looking
forward to meeting with the Plan Commission to discuss this project.
