S. 4,w4 6-150 IRS -L-Z to 14q S - 2.52) All ORDINANCE CREATING A, FIRE DEPARTIME14T IN ADM FOR THE VILLAGE OF OAKBROOK., DU PAGE COUNTY, ILLINOIS., DES IG-NATING7 THE PERSONNEL THEREFOR AND ESTABLISHING RULES A14-D REGULATIONS WITH RESPECT TO ThE Fl`HTIN`z OF FIRES AND PREVENTION THEREOF, AND DEFININ�Gl THE DUTIES OF VARIOUS MEMBERS OF THE FIRE DEPARTMENT BE IT ORDAINED by the President and Board of Trustees of the Village of Oakbrook: Section 1. Creation, There is hereby created a fire department,, an administrative department of the Village of Oakbrook. This department shall consist of a fire chief appointed by the President, with the approval of the Board of Trustees, who shall be the head of the department, and three firemen appointed by the Board of Fire and Police Commissioners in accordance with the statutes of the State of Illinois and the rules and regulations of such Commission. Section 2. "16mbers--Appointment, The members of such fire, department shall be considered officers of the Village as de- fined and determined by the statutes of the State of Illinois; they need not be residents of the Village at the time of their original appointment. The fire chief shall not hold any other village office, elective or appointive, except he may complete any term of office he may be holding when appointed fire chief,, and provided further that he does not seek or accept any other pelit Scat office, elective or appointive, during his term as fire chief. Section 3. Compensation: Members of the fire department, including the chief, shall receive such compensation as the President and the Board of Trustees shall from time to time determine. Section 4. Fire Chief--Powers and Duties, A. Attendance at Fires. The fire chief shall, if in his power, attend all fires occurring in the Village, or in such other areas as may hereinafter be designated, and, in the case S- i44 of his absence from any fire, the officer in command of the fire company first on the ground at said fire shall take charge of the department, and during the absence of the fire chief shall have and exercise all the powers of the fire chief. B. Administrative Duties. The fire chief shall have sole and absolute control and command over all persons connected with the fire department of the Village, while on duty; he shall possess full power and authority over its organization, govern- ment and discipline, and to that end he may prescribe and establish, from time to time, such rules and regulations as he may deem advisable, consistent with and subject to such rules and regulations as may be adopted by the Board of Eire and Police Commissioners and by the President and Board of Trustees. He shall establish and maintain a comprehensive training program to the end that all firemen become thoroughly familiar with and capable of operating all the equipment of the department. C# Custody of Property. The fire chief, subject to the direction of the Village President, shall have the custody of and full responsibility for the pumpers, tankers, trucks, ladders, and all property and equipment belonging to the fire department. D. Investigation of_Fires* The fire chief shall in- vestigate the causes of all fires which may occur in the jurisdiction of the department as soon as may be after they occur, and shall make and keep a record of his investigation and of the circumstances of each case, and shall render a monthly report of the department activities to the Village Board. E. Inspection and Repair of Apparatus. The fire chief shall frequently examine into the condition of the fire house, and all of the fire apparatus and equipment, and shall report - 2 - all defects and needs for repair to the Village President. F. .Annual Report. The fire chief shall, on the first day of June each year, make a full and complete report which shall show, as nearly as can be ascertained, the number of fires, the causes thereof, all accidents by fire:, the number of and a description of the buildings destroyed and damaged, together with the names of the owners or lessees, and shall contain such other data and suggestions as he may deem appropriate, lie shall file this report with the Village. President. F. Inspection of Premises. The fire chief shall make or cause to be made regular inspections, with sufficient frequency to secure efficient supervision, of all buildings, structures and places used for manufacturing; or commercial purposes, or occupied or frequented by large numbers of people, and of all school buildings, public halls, churches, institutional buildings, theaters, and all places of amusement, recreation or employment in order (1) to determine the safety of the occupants of such buildings, structures, or pleces in the event of fire, panic or accident; (2) to examine the working order and state: of repair of all doors, fire escapes and fire fighting appliances, the condition and freedom from obstruction of exits, corridors, stair- ways, fire escapes and their approaches, the disposition, arrange- ment and protection of stock, combustible material and rubbish, heating devises and ovens, inflammable liquids and explosives, and the protection of hazardous machinery, appliances and apparatus ; and (3) to ascertain whether the applicable fire regulations are being efficiently carried out. No person shall exclude the fire chief or any one of his deputies or assistants from any such building, structure or premises. 3 .S_44 H, Prescribing Limits at Fires. The fire chief or other officers in command at any fire may prescribe limits in the vicinity of the fire within which no persons, excepting those who reside therein, firemen, policemen, officers of the Village and those admitted by any officer of the fire department, shall be permitted to go, I. Removal of Property. The fire chief shall have power to cause the removal of any property whenever it shall become necessary for the preservation of said property from fire, or to prevent the spreading of fire, or to protect adjoining properties. J. Destruction of Buildings. The fire chief, or, in his absence, the acting fire officer in command at any fire, may direct the members of the fire department to tear down and re- move any building, structure or fence for the purpose of check- ing the progress of any fire, and in case of need may blow up or cause to be blown up, with powder or otherwise, any building or erection, during the progress of a fire, for the purpose of extinguishing or checking the same. Section 5, Hindering Firemen--Damaging Apparatus. No person shall offer any hindrance to any officer or fireman in the performance of his duty at a fire, or in any manner destroy, damage or deface any engine or other fire apparatus belonging to the Village. Section 6. Driving over Hose. No wagon, automobile, motor truck, or other vehicle shall be driven over any unprotected hose of the fire department of the Village, when laid down by order of the fire dhief'1or other officer or member in charge of said hose. Section 7. Obstructing Fire Hydrants. No person shall in any manner obstruct the use of any fire hydrant, or have or place any material or vehicle in front thereof, or within fifteen feet from either side thereof, under the penalty as hereinafter provided; and in addition to such penalty any and all materials or vehicles - 4 - found as an obstruction as aforesaid may be forthwith removed by any member or members of the fire department cost and expense of ' and at the risk, the owner or claimant Section 8;1rs'opersonati Firemen. Section 11. Police Power of Firemen. The fire chief and any member of the fire department shall have the power and authority during the time of a fire to arrest any suspected person or persons or any person hindering, resisting or conducting himself in a disorderly manner, or refusing to obey any such firemen while acting in the discharge of their duties and, as soon as their duties in relation to the extinguishment of the fire will permit, to take such person before a magistrate to be dealt with according to law. Such volunteers may elect from their own membership an assistant chief, a fire captain, and a fire lieutenant, who shall exercise such Jurisdiction over the volunteers as the chief shall direct, provided, however, that such officers shall not exercise nor be granted any authority over the firemen in the regular department. D. Such volunteers shall, as directed by the chief, assist the regular department in the discharge of its duties as prescribed herein. E. Such volunteers shall work only on a part-time basis and shall be compensated for services actually rendered upon an hourly rate as from time to time established by the President and Board of Trustees. F. Such volunteers shall be appointed by the President subject to the approval of the Board of Trustees and shall serve at the pleasure of the President and Board of Trustees. They shall not be subject to the jurisdiction of the Fire and Police Commission of the Village of Oakbrook. Section 13. Territory. The fire department of the Village of Oakbr*ek shall answer all f1re salt's Witl the Village of Oakbrook, and in addition thereto, pursuant to contract with the Oakbrook Volunteer Firemen's Association, dated the 7th day of November, A. D. 1962, answer all fire calls in that portion of the following described territory not located within the Village of Oakbrook free of charge for a period of twenty years from said date 87CGept that if any portion of the said territory shall, within said _ 6 - period of time, become a part of, or be annexed to, any city, village or organized fire protection district, then in such event such territory shall be excluded from the following described territory located outside the village limits and receiving fire protection as herein described: The Oakbrook Volunteer Firemen's Association District is the area included within the following boundaries: Starting at the DuPage-Cook County line and the center of 22nd Street which point is the northeast corner of Section 25; thence proceeding west along 22nd Street to the intersection of Salt Creek; thence in a general direction north and west, following Salt Creek to a point where Salt Creek would meet an extension of Spring goad; thence south along an extension of Spring Road and Spring Road to 22nd Street; thence west along 22nd Street to the intersection of Butterfield Road; thence southwest along Butterfield Road to the intersection of Meyers Road; thence south along Meyers Road to the north line of the south- west one-quarter of Section 289 extended; thence west along the north line of the southwest one-quarter of Section 28 to a point 570' east of the west line of the southwest one-quarter of Section 28; thence south to the north line of Section 33; thence west to the west line of Section 33; thence south to the south line of the north one-half of the northwest one-quarter of Section 33; thence east to Meyers Road; thence south on Meyers Road to a line 500' south of 35th Street; thence east along said line to Cass Avenue; thence north on Cass Avenue to 35th Street; thence east on 35th Street to the west line of Section 35; thence south along the west line of Section 35 to Ogden Avenue; thence following Ogden Avenue east and north to Madison Street; thence north on Madison Street to 39th Street; thence east on 39th Street to an extension of Grant Street of Hinsdale, which is the east end of iron fence; thence south along said extension of Grant Street to Ogden Avenue; thence following Ogden Avenue east and north to Washington Street; thence in a general direction north on Washington Street to 39th Street; thence east on 39th Street to a point 1600 feet west of the DuPage County Line; thence north from said point parallel to the DuPage-Cook line to an intersection with Salt Creek; thence following Salt Creek north and east to the DuPage County line; thence north on the DuPage-Cook County line to 31st Street; (the above described property# all- lying within DuPage County) ; thence east along 31st Street to the east line of the southwest one-quarter of the southeast one-quarter of Section 309 Township 39; thence north to the north line of the northwest one-quarter of the southeast one-quarter of Section 309 Township 399 which is 28th Street extended; west on said line to the DuPage-Cook County line; thence north on the DuPage-Cook County line to 22nd. Street; the point of the beginning (the latter described property lying within Cook County) ; ALSO Place of beginning - SE 1/4 Sec. 24, T. 39 N, Range 119 E of 3rd P.M. The center line of 22nd Street (Route 55) and the Cook County-DuPage County line north 2655.151 , thence due west along one-quarter Section 24 line 20001 , then,-due south 466.18' , then west 660' to the center line of York Road, proceeding west across York Road 1125' into the southwest one-quarter of Section 249 Township 39 North, Range 11, East of the Third Principal Meridian to the center line of Salt Creek, then southerly along the center line of Salt Creek to the center line - 7 - of Route 55 (22nd Street),, which is located on the south line of the above mentioned southwest one-quarter of ;section 24, then due east 46001 along said one:-quarter section line across York Road, and along the south line of the southeast one-quarter of Section 24 to the Cook County-DuPage County line; the place of beginning, all in the Village of Oakbrook, DuPae County, Illinois. Section 14, Fees--Outside Territory, On all fire calls outside the Village limits of the Village of Oakbrook and the above described territory answered by the Oakbrook fire Department except mutual aid calls there shall be a service charge of One Hundred and no/100ths Dollars (4100.00). which said charge shall be collected from the property owner or the person requesting the service, as the case- may be., and which said charge shall be billed promptly to said person by the Village Clerk. Section 15. Penalty, any person, firm or corporation violating any of the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be fined a sum of money not less than One Dollar nor more than Two Hundred Dollars for each such offense.
