THE RULES AND REGULATIONS OF "THE
ZONING ORDINANCE OF THE VILLAGE OF 1 6 S. yoP K
OAK BROOK, ILLINOIS, OF 1966" AS AMENDED
WHEREAS, the owner of the property more particularly herein-
after described has petitioned the corporate authorities of the
Village of Oak Brook for a variation to the rules and regulations
of "The Zoning Ordinance of the Village of Oak Brook, Illinois, of
1966" as amended, with respect to the size of loading berth require-
ments; and
WHEREAS, a public hearing pursuant to said request has been held
by the Zoning Board of Appeals of the Village of Oak Brook; and
WHEREAS, the President and Board of Trustees of the Village of
Oak Brook have reviewed the proceedings and are of the opinion that
a variation should be granted.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Oak Brook, DuPage County, Illinois, as
follows:
Section 1. That the applicable rules and regulations of "The
Zoning Ordinance of the Village of Oak Brook, Illinois, of 1966" as
amended, contained in XI, D, 2 are hereby varied to permit construction
of a loading berth of a length of 40 feet as opposed to 55 feet on
the Clearwater Drive side of the property and from Section XI, D, to
permit an unenclosed loading berth adjacent to the exterior lot line.
This variation is subject to the owners removing the loading
berths and complying with the Ordinance within a reasonable time
after the Hinsdale Sanitary District phases out its facility on
Clearwater Drive adjacent to the petitioners property, but in no
event to exceed three years after such phase out. Phase out as used
herein shall mean the removal of the primary and secondary tanks and
the chemical treatment tank from the Hinsdale Sanitary District
facility located on Clearwater Drive across from the property.
Section 2. The real estate effected hereby is legally described
as, to-wit:
Part of Lot 2, 3 and 4 of Hoehnes Assessment Plot in
the Southeast Quarter of the Southwest Quarter of
Section 24, Township 39 North, Range 11, East of the
Third Principal Meridian.
The common location is 2100 S. York Road, Oak Brook, Illinois.
Section 3. This ordinance shall be in full force and effect
from and after its passage and approval as by statute in such case
made and provided.
PASSED AND APPROVED by the President and Board of Trustees of
the Village of Oak Brook, DuPage County, Illinois, this /,0 t day
