S-376 - 05/31/1977 - ELECTIONS - Ordinances ELSCT %0QS" APB:djb 5/31/77 RCCR ATtOhl SoND r1 .191C. 1*0N Fop, 5-37 SPORTS CORE PkRcHASE 191'1 ORDINANCE NO. 376 AN ORDINANCE CALLING A SPECIAL ELECTION TO BE HELD IN AND FOR THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, ON TUESDAY, THE 21ST DAY OF JUNE, 1977 WHEREAS, it is deemed advisable and necessary and in and for the best interests of the Village of Oak Brook, Du Page and Cook Counties, Illinois (hereinafter referred to as the "Village"), that the property consisting of ap- proximately 269 net acres generally bounded by Cermak Road on the North, York Road on the East, Oak Brook Road on the South, and the center line of Salt Creek on the West, exclusive of the property commonly referred to as the Butler National Golf Course, otherwise and commonly referred to as the Butler International Sports Core, and all existing improvements thereon and appurtenances thereto (hereinafter referred to as the "Properties and Improvements"), be purchased by the Village to provide for natural open space, sports and recreational facilities, and flood control and storm water management facilities for the Village, and WHEREAS, it has heretofore been estimated by the President and Board of Trustees of the Village that it will cost not more than NINE MILLION FOUR HUNDRED TWENTY THOUSAND DOLLARS ($9, 420, 000) to purchase the Prop- erties and Improvements; and WHEREAS, the President and Board of Trustees of the Village and its agents and employees have negotiated the terms of a purchase agreement whereby the parties thereto would agree to sell and purchase in accordance with its stated terms and provisions the Properties and Improvements for a price not to exceed NINE MILLION FOUR HUNDRED TWENTY THOUSAND DOLLARS ($9, 420, 000), subject, however, to approval of the electors of the Village voting at an election as hereinafter provided; and I, WHEREAS, the President and Board of Trustees of the Village have considered and deem it advisable and in and for the best interest of the Village that should the Properties and Improvements be purchased as herein described, that portion of the Properties and Improvements commonly referred to as the Executive Golf Course, presently consisting of a nine-hole golf course, be expanded, redeveloped, and improved to an 18-hole, not less than 6, 000-yard, regulation golf course (hereinafter referred to as the "Executive Course Re- development"); and WHEREAS, it has heretofore been estimated that the Executive Course Redevelopment would cost not less than SEVEN HUNDRED THOUSAND DOLLARS ($700, 000) to complete; and WHEREAS, sufficient funds are not available to enable the Village to (i) purchase the Properties and Improvements for natural open space, sports and recreational facilities, and flood control and storm water management facilities and (ii) undertake the expansion and redevelopment of the Executive Golf Course, as hereinbefore described, and it shall therefore be necessary for the Village to borrow money and in evidence thereof issue bonds of the Village for the purpose of paying the cost thereof; and WHEREAS, before bonds of the Village can be issued for such purposes the question of issuing such bonds must be submitted to the electors of the Village and be approved by a majority of the electors voting on said question at an election called and held for that purpose. APB:djb 5/31/77 (D NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, Du Page and Cook Counties, Illinois, as f ollows: SECTION 1: That the provisions of the preamble are hereby incorporated herein as though herein fully set forth. SECTION 2: That it is hereby determined to be for and in the best interests of the Village of Oak Brook, Du Page and Cook Counties, Illinois, that (i) the property consisting of approximately 269 net acres generally bounded by Cermak Road on the North, York Road on the East, Oak Brook Road on the South, and the center line of Salt Creek on the West, exclusive of the property commonly referred to as the Butler National Golf Course, otherwise and commonly referred to as the Butler International Sports Core in Oak Brook, Illinois, and all existing improvements thereon and appurtenances thereto be purchased by the Village pursuant to and in accord with the terms, provisions, and conditions of such agreements of purchase and attendant documents as the President and Board of Trustees of the Village and their duly authorized agents and employees shall in the exercise of their discretion deem prudent and advisable to implement the purchase herein contemplated and (ii) that should the Properties and Improvements hereinbefore described be so purchased, that portion thereof commonly referred to as the Executive Golf Course be expanded, redeveloped, and improved to an 18-hole, not less than 6, 000-yard, regulation golf course, all to provide for natural open space, sports and recreational facilities, and flood control and storm water management facilities for the Village. SECTION 3: That there be borrowed for, by, and on behalf of the Village the sum of TEN MILLION TWO HUNDRED SEVENTY THOUSAND DOLLARS ($10, 270, 000) for the purpose of paying the cost of (i) purchasing the Properties and Improvements and (ii) implementing the Executive Course Redevelopment, and that to evidence said loan, negotiable bonds of the Village be issued and that each of said bonds be designated "Recreation Bond", and bear interest from date at the rate of not to exceed seven per cent (716) per annum. SECTION 4: That the question of purchasing the Properties and Improvements in accord with such agreements of purchase and attendant documents, implementing the Executive Course Redevelopment, and issuing TEN MILLION TWO HUNDRED SEVENTY THOUSAND DOLLARS ($10, 270, 000) in Recreation Bonds, as herein- above described in Sections 2 and 3 hereof, be submitted to the legal voters of the Village at a special election, which is hereby called to be held in and for the Village on Tuesday, the 21st day of June, 1977, between the hours of 6:00 a.m. and 6:00 p.m. of said day. SECTION 5: That for the purpose of said election the corporate limits of the Village shall constitute one (1) election precinct, and the polling place therefor shall be located at the Village Commons, 1200 Oak Brook Road, Oak Brook, Illinois. SECTION 6: That the Village Clerk of the Village be and she is hereby ordered and directed to cause notice of said election to be given by publishing notice thereof once in THE DOINGS, being a newspaper having a general circulation in the Village, there being no newspaper published in the Village. The date of publication of said notice shall be not more than thirty (30) days nor less than fifteen (15) days prior to the date set for said special election, and said notice as published shall be in substantially the following form: NOTICE OF SPECIAL ELECTION IN AND FOR THE VILLAGE OF OAK BROOK DU PAGE AND COOK COUNTIES, ILLINOIS - 2 - AP13:djb 5/31/77 Public Notice is hereby given that a special election will be held in and for the Village of Oak Brook, Du Page and Cook Counties, Illinois, on Tuesday, the 21st day of June, 1977, at which time there will be submitted to the electors of said Village the following question: Shall the Village of Oak Brook, Du Page and Cook Counties, Illinois, purchase the property consisting of approximately 269 net acres generally bounded by Cermak Road on the North, York Road on the East, Oak Brook Road on the South, and the center line of Salt Creek on the West, exclusive of the property commonly referred to as the Butler National Golf Course, otherwise and commonly referred to as the Butler International Sports Core in Oak Brook, Illinois, together with all existing improvements thereon and appurtenances thereto, pursuant to and in accord with the terms, provisions, and conditions of such agreements of purchase and attendant documents as the President and Board of Trustees of the Village and their duly authorized agents and employees shall in the exercise of their discretion deem prudent and advisable to implement the purchase herein contemplated, and expand, improve, and redevelop the properties and improvements known as the Executive Golf Course to an 18-hole, not less than 6, 000-yard, regulation golf course, all to provide for natural open space, sports and recreational facilities, and flood control and storm water management facilities for the Village, and issue its bonds in the amount of TEN MILLION TWO HUNDRED SEVENTY THOUSAND DOLLARS ($10, 270, 000) to pay the cost of the purchase of said properties and improve- ments and said expansion, improvement, and redevelopment of the Executive Golf Course, all as hereinbefore described, said Recreation Bonds to bear interest at the rate of not to exceed seven per cent Mo) per annum? and the polling place designated therefor shall be as follows: ELECTION PRECINCT NUMBER 1 The entire corporate limits of the Village of Oak Brook, Illinois. Polling Place: Village Commons 1200 Oak Brook Road Oak Brook, Illinois. The polls at said election will be opened at 6:00 a.m. and will be closed at 6:00 p.m. on the date of the election. All persons qualified to vote at regular Village elections are qualified to vote on said question, and voters must vote at the polling place designated for the election precinct within which they reside. SECTION 11: That the results of said election shall be canvassed in the manner provided by law. SECTION 12: This Ordinance shall be in full force and effect from and after its passage and approval as by Statute in such case made and provided. This Ordinance shall be published in pamphlet form.
