WHERM, the Plan commission of the Village of Oak Brook on April 16,
1990 recommended approval of the plat of subdivision entitled "Porterfield &
Urban`s Resubdivision"; and
WHEREAS, the Village President and Board of Trustees have considered the
recommendation of the Plan commission and concur with the same including the
conditions recommended therein;
NOT, THEREFORE, BE IT RESOLVED By THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAM AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the Final Plat of Subdivision known as Porterfield & ,
Urban's ReResudivision prepared by Richard C. Field, Illinois Registered Land
Surveyor, dated February 6. 1990, be and is hereby approved subject to the
condition enumerated in Section 2 of this Resolution.
Section 2: That the requirements of the Subdivision Regulations for the
provisions of land improvements are hereby waived.

SUBJECT: Porterfield & Urban's Resubdivision - Final Plat
Urban - Lot Area Variation
55 Glendale
These two applications relate to the properties at 55 and 111 Glendale Avenue
in 'the R-2 one-acre zoning district. These two properties are comprised of
smaller lots originally created by the Glendale Subdivision in 1926. Referring
to the proposed subdivision plat, the current separation between 55 and 111
Glendale is halfway through Lot 13 of the Glendale Subdivision. The current
proposal is to shift this line approximately 17' to the west, such that
proposed Lot 1 will still contain the one-acre requirement and Lot 2 will
increase in size from approximately .57 acres to .64 acres. Although, as a
result of this subdivision, Lot 2 will come closer to the one-acre requirement,
a lot area variation is also required since the Village is not able to approve
a subdivision which does not meet all of its zoning requirements even though,
in this case, the Urban property (Lot 2) is becoming less non-conforming as a
result of the resubdivision.
The Plan Commission, at its April 16 meeting, on a vote of 5 to 0, recommended
approval of the resubdivision subject to correction of drafting revisions and
approval of the necessary lot area variation.
The Zoning Board of Appeals, at its June 5 hearing, on a vote of 6 to 0,
recommended approval of the lot area variation based on the following findings
of fact:
1. The application is unique due to the fact that the property is actually
becoming less non-conforming as a result of the request.
2. Approval of the variation will not alter the character of the area since
no new construction is proposed.

3. The specific hardship indicated in this case is that the property owner
would be precluded from obtaining the additional acreage to make his
property less non-conforming if the variation were denied.
To approve the requested relief, appropriate documents should be prepared by
the Village Attorney for review at the Board's July 10 meeting.

The Plan Commission, at its regular meeting of April 16, 1990, considered the
applicant's request for a two-lot resubdivision.
A motion was made by Member Doyle, seconded by Member Beard, to recommend to
the Village Board approval of the requested resubdivision subject to the
drafting revisions referred to in Village Engineer Durfey's memo of April 11,
1990 and further subject to the applicant receiving the necessary lot area
variation.
This motion was approved on a roll call vote of five ayes, Members Beard,
Doyle, Haglund, Skinner and Chairman Marcy; zero nays, and two members absent,
Members Krafthefer and Sandstedt.

Mr. Waite, a neighbor in the area, recommended that the Plan Commission
proceed with extreme caution in allowing development of this area.
In response to a question from Mr. Dudek, Village Engineer Durfey responded
that none of the property is within a flood plain.
In response to a request from Chairman Marcy, Mr. Gooder stated that his
client would be acceptable to a tabling of this matter until the next
regularly scheduled Plan Commission meeting in which his client could discuss
the possible purchase of the property with the neighbors.
A motion was made by Member Haglund, seconded by Member Doyle, to table this
matter to the next regularly scheduled Plan Commission meeting.

Final Plat

proposed subdivision plat, the current separation between 55 and 111 Glendale
is halfway through Lot 13 of the Glendale Subdivision. The current proposal
is to shift this line approximately 17' to the west, such that proposed Lot 1
will still contain the 1-acre minimum requirement and Lot 2 will increase in
size from approximately .57 acres to .64 acres. Although as a result of this
subdivision, Lot 2 will come closer to the 1-acre minimum requirement, it is
necessary for the applicant to request a lot area variation which will be
heard by the Zoning Board of Appeals.
The Plan Commission should review the subdivision based on the subdivision
regulations and based on the assumption that the lot area variation would be
approved by both the Zoning Board and the Village Board.

I have reviewed the final plat and application received on March 23, 1990 and offer
the following comments:
1. The proposed subdivision calls for two (2) lots, one at 1.00 acres and one at
0.636 acres. Since the zoning district calls for 1 acre minimum lots size,
I understand that the applicant will be so informed by you and a variation
request may be forthcoming.
2. Several drafting items need to be made to the plat.
3. Since the proposal reconfigures existing small lots into two (2) larger lots,
my understanding is that the applicant is asking that all land improvements
be waived.
