OF FIRES AND MIXENTION THEREOF, AND DEFINING THE

BE IT ORDAINED by the President and Board of Trustees of the Village
of Oak Brook:
Section 1. Creation. There is hereby created a fire department, an
administrative department of the Village of Oak Brook. This department
shall consist of a fire chief, who shall be the head of the department, an
assistant fire chief, a fire captain, a fire lieutenant, and such fireaen
and other members as the President and Board of Trustees shall from time to
time provide.
Section 2. Chief Assistant Chief Captain, Lieutenant-A aintment--
Term. The fire chief, assistant fire chief, fire captain and fire lieutenant
shall not be considered officers of the Village as defined and determined by
the Statutes of the State of Illinois, and need not be residents of the
Village. The fire chief shall not hold political office, elective or
appointive, except he may complete any term of office he may be holding When
elected fire chief, and provided further that he does not seek or accept any
other political office, elective or appointive, during his term as fire chief.
Said officials shall be elected by the members of the fire department and their
selection shall be subject to the approval of the President and Board of
Trustees. They shall hold office following their election and approval by
the Village Board until the 30th day of June following, their appointment and
until their successors shall be appointed and qualified.
Section 3. Members of Fire Ds artment--A intment--Term. All other
members of the fire department shall likewise not be considered officers of
the Village of Oak Brook and need not be residents thereof. Such membiere shall
be appointed by the President subject to the approval of the hoard of Trustaea,
and shall hold office until the 30th day of Juno following their appointment.

gectior 5. Dire Chief--Powers and Duties.
A. Attendance at Fires. The fire chief shall, If ita his power,
attend all fires occurring in the Village, or to such other areas as may
hereinafter be designated, and, in the case of hit absence free say fire, the
officer in command of the fire company first on the ground at said fire *bell
take charge of the department, and during the absence of the fire chief, shall
have and exercise all the powers of the fire chief.
B. Administrative Duties. The fire chief shall have sole and absolute
control and command over all persons connected with the fire department of the
Village, while on duty; he shall possess full power and authority over its
organization, government and discipline, and to that end he may prescribe Bad

C. Custody of Pro ert . The fire chief, subject to the direction of

D. Investigation of Fires. The fire chief shall investigate the
causes of all .fires which may occur in the jurisdiction of the departmaaant as
soon as may be after they occur, and shall mske and steep a record of his
Investigation and of the circumstances of each case, and shall render a
monthly report of the department activities to the Village Board.
B. Inspection and Re air of Apparatus. The fire chief shall fre$aammrntly

G. Inspection of Premises. The fire chief shall sake or cause to

be made regular inspections, with sufficient frequency to secure efficient
supervision, of all buildings, structures and places used for ", nufacturin;
or commercial purposes, or occupied or frequented by large wxibers of people,
and of all school buildings, public halls, churches, institutior_al buildings,
theaters, and all places of amusement, recreation or employment to order (1)
to determine the safety of the occupants of such buildings, structures, or

places in the event of fire, panic, or accident, (2) to examine the working
order and state of repair of all doors, fire escapes and fire fighting
appliances, the condition and freedom from obstruction of exits, corridors,
stairways, fire escapes and their approaches, the disposition, arrangement
and protection of stock, combustible material and rubbish, heating devices
and ovens, iaflammable liquids and explosives, and the protection of haxardous
machinery, appliances and apparatus; and (3) to ascertain whether the
applicable fire regulations are being efficiently carried ouL. No parson
shall ex^lude the fire chief or any one of his deputies or assistants :fxoin
any such building, structure or premises.
H. Prescribina Limits at Fires. The fine chief or other officers in
command at any fire may prescribe limits in the vicinity of the fire within
which no persons, excepting those who reside therein, fireman, policeman,
officers of the Village and those admitted by any officer of the fire depsrta>ant,
shall be permitted to go.
I. Re=aval oProperty. The fire chief shall have power to emus* the
removal of any property whenever it shall become necessary for the
preservation of said property from fire, or to prevent the spreading of fire,
or to protect adjoining properties.

Section 6. Hinderin Firemou Damo in A aratus. no person shall
N offer any hindrance to any officer or fireman in the performance of his
ditty at a :ire, or in any manner destroy, damage or 41face any engine or
other fire apparatus belonging to the Village.
Section 7. Urivin Over Hose. No Wagon, automobile, motor truck, or
other vehicle shall be driven over any unprotected hose of the fire department
Of the Village, when laid down by order of the fire chief or other officer
or member in charge of said hose.
Section 8. Obstructing Fire drants. No person shall in any manner
obstruct the use of any fire hydrant, or have or place any material or
vehicle in front thereof, or within fifteen fact from either side thereof,
under the penalty as hereinafter provided; and in addition to such penalty
any and all materials or vehicles found as an obstruction as aforesaid, may
be forthwith removed by any member or members of the fire department, and at
the risk, cost and expense of the owner or claimant.
Section 9. Personates Firemen. No person not a member of the firs
department shall personate a fireman or officer of the fire departaeentsoam

any other way.
Section 10. 8alva&ed ProjertX. No person shall take away anv property
in the possession of the fire department and salvaged from any fire until
proof of ownership be made satisfactory to the fire chief or acting fire chief.
Section 11. Uniform and Bad s. The fire chief, subJect to the approval
of the Board, shall make suitable regulations under which the officers and
lien of the department shall be required to weer an appropriate uniform or
badge, by which, in came of fire, tha authority of such officers end man in
said department may be known.

Section 13. Territory. The mire department of the Village of Oak
Ar
Brook shall answer all fire calls within the Villagft of Oak Brook, and in
addition thereto, pursuant to contract with the Oak Brook Volunteer Firemen's
Association, dated the 7th day of November; A. D. 1962, answer all fire calls
in that portion of the following described territory not located within the
Village of Oak Brook free of charge for a period of twenty years, excapt that
if any portion of the said territory shall, within said period of time, became
a part of, or be annexed to, any city, village or organized fire protection
district, then in such event such territory shall be excluded from the
following described territory located outside the village limits and receiving
fire protection as herein described:

of the provisions of this ordinance shall be guilty of a nisdeaftwor, and upon,
conviction thereof, shall be fined a sum. of money not lass than. One Dollar
nor more than Two 'Hundred Dollars for each such offense.

State of Illinois, on the 7th day of November, 1462, by the OAK P OOK
VOLUI'TEER FIRMM'S ASSOCIATION, an existing Illinoiae non-profit
corporation (heroin called the "First Party"j and the VILLWZ Ox OAK BROOK,
an Illinois municipal corporation (herein called the "Second Party"},
WITNESSITH:
WHEREAS, the First Party desires to transfer unto the Second Party
all of its fire fighting equipment including the fire house and its lease-
hold in the real estate therein;
NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLTAWS:
1. That the First party hereby sells, assigns, transfers, and sets
over to the Second Party all of its title, right and interest in and to 811
of the aforementioned fire fighting equipment and leasehold, as mere fully
described in the inventory attached hereto, and forming part and parcel of
this agreement.
2. That the First Party will cause to be executed all necessary
documents to legally effect the transfer and control of said assets,
exclusive of cash funds.
3. That in consideration of the foregoing, the Second Party agrees
, • to maintain, add to, and keep said fire house and all fire fighting equipment j

in good repair and to maintain a fire department and to render for a period
of twenty years commencing with the transfer of said assets, the usual fire
