It is hereby declared to be the policy and purpose of the Board of Trustees of the Village of Oak Brook Illinois, to extend to the eligible employees thereof, effective as of October L , 196 7 , the benefits of the Federal Old Age, Survivors, and Disability Insurance provisions of the Federal Social Security Act and amendments thereto. In pursuance of said policy, and for that purpose,. the Village President of the (Head of Governing Body - Show Title Only) . Village of Oak Brook shall take such action as may (Name of Political Subdivision be required by applicable State and Federal laws or regulations. SECTION 2. The Village President of the Village of Oak Brook Head of Governing Body) Illinois, is hereby authorized and directed to execute an agreement with the Social Security Unit of the State Employees' Retirement System of Illinois to secure coverage of eligible employees as provided in Section 1 hereof. SECTION 3. withholdings from salaries or wages of employees for the purpose provided in Section 1 hereof, are hereby authorized to be made in the amounts and at such times as may be required by applicable State and Federal laws or regulations, and shall be paid over to the STATE AGENCY in such amounts and at such times as are designated by State laws or regulations. SECTION 4. Employer contributions and administrative expense shall be paid to the STATE AGENCY in accordance with applicable State laws and regulations from amounts appropriated for such purposes. Fricek (By Custodian of Records) ' Title: Village Clerk d 3 33 (Certification on reverse side must be executed by Custodian of Records.) 4 R11T(" THTS COM FORM SS-3 TO STATE AGENCY SOCIAL SECURITY COVERAGE AGREEMENT By action of the governing body in the adoption of a Resolution or Ordinance (certified copy attached), and in accordance with authority vested in it by the State of Illinois, the Village of Oak Brook , Illinois, hereafter designated as the Political Subdivision, enters into this agreement with the Social Security Unit of the State Employees' Retirement System of Illinois, hereafter designated as the State Agency, for the purpose of extending to its employees, the benefits of the Federal Old ilge, Survivors, and Disability Insurance provisions of the Federal Social Security Act. THE POLITICAL SUBDIVISION HEREBY AGREES: (1) To be bound by all applicable provisions with respect to social security coverage as are contained in the Federal Social Security Act, Title II, as amended; the Social Security Enabling Act of the State of Illinois, as amended; the present Rules and Regulations of the State Agency or those hereafter promulgated; and the Resolution or Ordinance of the governing body. The foregoing shall be a part of q this agreement as if set forth in their entirety herein. (3) The approximate total number of employees to be covered by this agree- ment is 8 (This figure must include all appointed full-time and part-time employees and officials, except all members of those classes specifically excluded in clause (2) above.) Upon request to the State Agency this plan of coverage may be modified to cover classes of officials or positions not now included. } (4) Coverage under this agreement shall be effective with the calendar quarter beginning October_ Lst , 1987 . See Section I of the Resolution or Ordinance as adopted by the Political Subdivision. ) (5) To pay to the State Agency, at the times specified, for deposit in the Social Security Contribution Fund, an amount equivalent to employer and employee contributions due as determined on the basis of quarterly reports of total wages paid to covered employees and filed with the State Agency. (6) To reimburse the State Agency, for the benefit of the State Treasury, its pro rata share of the total annual administrative expenses as determined by the State agency. (7) That the following fund will be drawn upon to meet the financial obliga- tions incurred under this agreement , and assures that this source will be adequate for such purposes: General Corporate Pund (Insert the title of the fund from which social security contributions and pro rata administrative expenses are to be paid.) h k (8) That in accordance with Section 5 of its Resolution or Ordinance, the following official, as a part of his duties, shall be responsible to the State Agency for receipt , execution, and submission of the quarterly wage reports and payment of contributions at the times specified. Lorraine E, Frieek trk - (Name) (Official Title) Oak Brook and Spring Roads 654-2 20 Address) _ Telephone Number) (The State Agency shall be notified immediately of any change to name or address. ) (9) To establish such internal wage disbursement, record keeping, payroll accounting practices, and other matters relating to administration of the plan as may be found by the State Agency to be necessary for proper and efficient adminis- tration of the plan, and to make -reports in such form and containing such information as the State Agency or the Secretary of the Department of Health, Education, and Welfare of the United States may from time to time find necessary to assure correct- ness and verification of such reports. (10) If the State Agency finds the Political Subdivision has failed to comply substantially with any provisions contained in such plan, it may terminate this agreement in its entirety as set forth in Section 6 of the Social Security Enabling Act of the State of Illinois. Upon signatures of the respective officials being affixed hereto, the State Agency accepts the proposed agreement for inclusion in a modification of the agree- ment between the State of Illinois and the Department of Health, Education, and Welfare. The agreement shall not operate to vest the Political Subdivision with legal authority to withhold social security contributions from wages of covered employees until it receives official potice of approval by the State Agency and an employer identification number issued by the Federal Authority.
