AN ORDINANCE GRANTING A SPECIAL USE PERMIT PURSUANT TO ORDINANCE G-60 FOR A TELEPHONE TRANSMISSION BUILDING AND EQUIPMENT IN AN ORA-1 DISTRICT SOUTH OF HARGER ROAD AND EAST OF SPRING ROAD Whereas, the owner of property, more particularly hereinafter described, has petitioned to the corporate authorities of the Village of Oakbrook for a Special Use Permit for the construction of a tele- phone transmission portion of a proposed building; and Whereas , the said property has been heretofore and is now zoned and classified "ORA-1" Office-Research-Assembly District; and Whereas, pursuant to the provisions of Section X, B, 2, b) , (3) , of "The Zoning Ordinance of the Village of Oakbrook, Illinois , of 1966" , as amended, the construction and operation of such facility is permitted as a special use; and Whereas, after due publication of notice as by statute and said ordinance required, the Zoning Board of Appeals of the Village of Oakbrook did on February 4, 1969 , conduct a public hearing on said application; and Whereas , thereafter the said Zoning Board of Appeals of the Village of Oakbrook recommended that said special use be granted subject to certain conditions; and Whereas, the Plan Commission of the Village of Oakbrook has also considered this matter and made its recommendations to the President and Board of Trustees that the special use be granted subject to certain conditions; and Whereas , the President and Board of Trustees of the Village of Oakbrook concur in said recommendations; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oakbrook: t Section 1. That there be granted to the owner of the following described property a Special Use Permit for the construction and operation of a telephone transmission portion of a proposed building, the remaining portion of the proposed building to be office use. Section 2. That pursuant to the recommendations of the Zoning Board of Appeals and the Plan Commission and the provisions of Section XIII , J, 6 , of "The Zoning Ordinance of the Village of Oakbrook, Illinois, of 1966" , as amended, -the grant of said Special Use Permit is conditioned to require the owner or its successors in interest to comply with the following: A. �,To file a site plan; B. To file a landscaping plan; C. To file a plat showing building elevations; D. To file an architect' s rendering of the proposed building. Upon submission and approval of the above documents by the President and Board of Trustees , the Special Use Permit shall be in full force and effect. y R 2 - iSection 3. The Special Use Permit is further restricted to require that the method of vehicular ingress and egress to the subject building be by way of Commerce Drive. Ingress and egress to the building by way of Harger Road is Limited to emergency vehicles only in the preservation of Life or property. Any violation of this provision will be cause for termination of said Special Use Permit. Section 4. Said Special Use Permit shall be Limited solely and exclusiveLy to the following described real estate, to-wit: Lot 2 and the Westerly 370 feet , measured at right angles to the Westerly Line thereof, of that part of Lot L in Butler Company M-L Inc. Assessment PLa-' No. L, of parts of Sections 23 and 24, Township 39 North, Range LL, East of the Third Principal Meridian, according to Plat thereof recorded July 8, 1964 as Document No. R64-24068 , in DuPage County, ILLinois , Lying North of the Northerly Line of Commerce Drive as dedicated by Document No. R68-27679 recorded June 28 , 1968 , in DuPage County, ILLinois . Section 5 . The provisions and conditions of said Special Use C Permit shall not be altered or varied excep- by ordinance duly adopted by the President and Board of Trustees of the Village of Oakbrook. Section 6. This ordinance shall be in full force and effect from and after its passage, approval and publication as by statute in such cases made and provided .
