AN ORDINANCE ESTABLI,HING RATES AND l9�3
CHARGES FOR THE USE OF SERVICE OF THE
WATERWORKS SYSTEM OF THE• VILLAIGE OF
OAK BROOK, DU PAGE COUNTY, ILLINOIS
WHEREAS, the Village of Oak Brook, DuPage County, Illinois
has heretofore by ordinance duly adopted provided for the
acquisition of c waterworks system in and for said Village and
for the issuance of Waterworks Revenue Bonds to defray the cost
of acquiring and constructing improvements to such system pursuant
to and in compliance with the provisions of Division 129,
Article 11 of the Illinois Revised Statutes of the State of Illinois,
and all laws amendatory thereof and supplementary thereto; and
WHEREAS, pursuant to the terms of the Act above referred i
to and the ordinance heretofore passed authorizing the acquisition
and improvements to such system and the issuance of said Bonds, it
is necessary that the Village establish rates and charges for the
use of such waterworks system and provide for the collection thereof;
NOW THEREFORE, Be It Ordained by the President and Board
of Trustees of the Village of Oak Brook, DuPage County, Illinois,
as follows:
Section 1. That there shall be and there are hereby
establishe rates or charges for the use of and for the service
supplied by the waterworks system of the Village of Oak Brook,
DuPage County, Illinois, based upon useage of the waterworks system,
and minimum monthly billing, as follows:
Up to 4,000 gallons 5.94
Next 26,000 gallons .94 per 1000 gallons
Next 70,000 gallons .54 per 1000 gallons
Next 400,000 gallons .40 per 1000 gallons
All Over 500,000 gallons .35 per 1000 gallons

Section 2. Said rates or charges for service shall be
payable monthly on the first day of each month. The owner of the
premises, the occupant thereof and the user of the service shall
be jointly and severally liable to pay for the service on such
premises and the service is furnished to the premises by the
Village of Oak Brook only upon the condition that the owner of
the premises, occupant and user of the service are jointly and
severally liable therefor to the Village of Oak Brook. All bills
for service shall be rendered monthly in the month succeeding
the period for which the service was rendered, and shall be payable
not later than the 15th day following billing date. If payment of
the full amount of the bill is not made within said period then a
penalty of five per cent (57.) of the amount of the bill shall. be
added thereto.
Section 3. In the event the charges for service are not
paid within t icy (30) days after rendition of the bill for such
service, such charges shall be deemed and are hereby declared to
be delinquent, and thereafter such delinquencies shall constitute
liens upon the real estate for which such service is supplied, and
the Village Collector is hereby authorized and directed each month
to file sworn statements showing such delinquencies in the office of
the Recorder of Deeds of DuPage County, Illinois, and the filing of
such statements shall be deemed notice of a lien for the payment
of such charges for such service.
Section 4. If the rates or charges for such services are
not paid whit x' ilnxty (60) days after the rendition of the bill
for such services, such services shall be discontinued without
further notice and shall not be reinstated until all past due bills
including the penalties thereon are paid in full, together with
payment made of $10.00 for reinstating such service.
Section 5. It is hereby made the duty of the Village
Collector of the Village of Oak Brook to render bills for service
and for all rates and charges in connection therewith and to collect
all moneys due therefor.
Section 6. All revenues and moneys derived from the
operation of the waterworks system shall be held by the Village
Collector separate and apart from his private funds. and separate
and apart from all other funds of the Village, and all `of said
sum, without any deductions whatever, shall be delivered to the
Village Treasurer not more than ten (10) days after receipt of the
same, or at such more frequent intervals as may from time to time
be directed by the President and Board of Trustees.
Section 7. The Village Treasurer shall receive all such
revenues from the waterworks system and all other funds and moneys
incident to the operation of such system as the same may be paid
to him and deposit the same in a separate fund designated as the
Waterworks Fund of the Village of Oak Brook, and said Treasurer
shall administer such fund in every respect in the manner provided
by the provisions of Division 129 of Article 11 of the Illinois
Revised Statutes of the State of Illinois and all laws amendatory
thereof and supplementary thereto and as provided in the ordinance
heretofore adopted on the loth__ day of ave jjcer ,1972`
and authorizing the issuance of $3,300,000 Waterworks Revenue
Bonds of said Village.
Section 8. The Village Treasurer shall establish a
proper system of accounts and shall keep proper books, •records
and accounts in which complete and correct entries shall be made
of all transactic,ns relative to the waterworks system, and at
regular annual intervals he shall cause to be made an audit by an
independent auditing concern of the books to show the receipts and
disbursements of the said waterworks system.
Section 9. That a copy of this ordinance, properly
certified byby te illage Clerk, shall be filed in the office of
the Recorder of Deeds of DuPage County and shall be deemed notice
to all owners of real estat(: of their liability for service
supplied to any user of the ser\.;.;u of the waterworks system of
said Village on their properties.
Section 10. All ordinances and parts of ordinances in
conflict herewith arr hereby repealed in so far as the conflicting
portions thereof are concerned.
Section 11. This ordinance shall be in full force and
effect upon its and publication as provided by law.

That this ordinance after its passage and approval shall
within ten (10) days thereafter be published in the Oak Brook
Doings, a newspaper published in and having a general circulation
in the village of Oak Brook, and this ordinance shall become
effective ten (10) days after such publication, as provided by
law.
