Be it ordained by the President and Board of
Trustees of the Village of Oak Brook , DuPage
County Illinois , as follows :
ARTICLE I
SHORT TITLE
This document should be known and may be cited as the "Public
Works Construction Regulation Ordinance" of Oak Brook, Illinois .
ARTICLE II
PURPOSE , SCOPE, AND JURISDICTION
The purpose of this Ordinance is to set forth rules , regula-
tions , and standards to regulate and control construction in
public rights-of-way and all sewer, water distribution, street
and driveway approach construction in the Village of Oak Brook
in order to promote the tpublic

ARTICLE III
GENERAL
1 . Within the Village of Oak Brook all construction , altera-
tion, excavation, maintenance and repair within public
street or alley rights-of-way, other public ways or in
easements granted to the Village of Oak Brook, and all
sewer collection and water distribution construction shall
meet the requirements of and be carried out in compliance
with this Ordinance and shall be under the direction of
and subject to the approval and inspection of the Village
Engineer whether constructed or maintained by the Village
or by private firms , individuals or utilities , or by other
public agencies.

2. It shall be unlawful to proceed with any construction ,
alteration , excavation, maintenance or repair within public
street or alley rights-of-way, other public ways or in
easements granted to the Village of Oak Brook or with any
sewer or water distribution construction without first
having secured a permit therefore from the Village of Oak
Brook, with the exception of highway construction by the
highway agency having jurisdiction and maintainance respon-

sibility for the street or road in question .

ARTICLE VI
WATER
Section 1 . The construction , maintenance and repair of all
water mains and water service lines within the Village of Oak
Brook shall be under the direction of and subject to the
approval of the Village Engineer whether constructed or
maintained by the Village, by private firms , individuals ,
or utilities , or by other public agencies and no water supply
mains shall be constructed and no mains shall be placed in
service that do not meet the construction and design standards
of this ordinance.
A. It shall be unlawful to do any of the above work or place
any new installation in service without first having
obtained a permit therefore from the Village of Oak Brook
and without fully complying with the provisions of this
ordinance.
B. Tampering prohibited. It shall be unlawful for any person,
firm, corporation or other entity not authorized by the
Village Engineer to connect to, tamper with , alter, operate
or injure any part of the Village waterworks or supply
system, or any water meter or to introduce any substance
into any water pipes , lines or mains connected to or form-
ing a part of the system without written approval of the
Village Engineer. Operation of or connection to fire
hydrants shall be only by special permit or in accordance
with written rules and agreements with and pertaining to
the applicable fire protection district.

A. Connections required . The potable water distribution system
for al I bu; dings on premises abutting or within 250 feet
of village water di stri but i on system mains shall be connected
to such mains in conformity with all the provisions of this
ordinance.

C. Private Wells . .
1 . Private wells may be installed in the Village only with
the approval of the Village Board of Trustees .
Any such wells shall meet all of the requirements of
the -County of OuPage and State of Illinois , and if
their use is .discontinued they shall be sealed in
accordanc.-e with the State of Illinois requirements .
2. No connection between private well supplies and a
public water supply system is permitted.
0. Water Service Applications .
1 . Water SupRIX Application All applications for furnish-
ing water shall be in writing on forms furnished by the
Village.
(a) Areas in Oak Brook presentlz served with water by
the Vill'age. Applications for furnishiTg water
within Village of Oak Brook and where the water
1 mains are existing will be processed and approved
on meeting any other applicable requirements of
this ordinance and the payment of the required fees .
(b) Ar,,as in flak Brook presently served with water by
other agencies. Applications for permi for water
supply and distribution work in the Village of Oak
Brook , where another agency is supplying the water
will be issued on meeting the applicable ordinance
provisions , on approval of the Village Board of
Trustees and on payment of the required fees.

(c) Areas outside Oak Brook within the accredited area

mains are existing will be processed and approved
on meeting any other applicable requirements of
this ordinance and the payment of the required fees . i
(d) Other areas outside Oak Brook. Applications for
urnishing water to areas outside Oak 'Brook not
within the accredited area of the Oak Brook Utility
Company, or where the necessary water mains do not
exist must first be acted on by the Village Board
of Trustees following a report by the Village
Engineer outlining the effect of the granting of
the permit on the system , and if favorably acted
on will be issued on meeting any other applicable
requirements of this ordinance, on payment of the
required fees , and on the applicant entering into
agreement with the Village covering the cost of any
water main extensions .

Applications for water service in areas of ak Brook
not presently served with water mains will not be
processed until such mains are installed.
The mains may be installed on direction of the Village
Board , normally following the instituting of Special
Assessment procedures or entering into a contract
with the Village covering the payment by proposed
users of their share of the installation costs.
2 . Cash deposit required .
(a) Use of deposit to satisf defaults . In case of failure
or thirty days to pay any charge made by the
Village in connection with furnishing water, the
Village may, at its option , apply the deposit pro-
vided for or so much thereof as may be necessary to
pay any amount due to the Village for water works
services .
(b) Refund of deposit. The deposit provided for will be
® refunded upon payment in full of all charges up to
and including the shutting off of the water supply.
3. Written agreement in lieu of deposit. In lieu of the
cash eposit required- by the previous section, the owner

,�.f the property being served may furnish a written
agreement , in form approved by the Village Attorney ,
to guarantee payment of all charges made by the Village
in connection with the furnishing of water to the
premises for which the application is filed .
E. Water Service Connections . A water service connection shall
consist o a water service and water service extension .
1 . A water service consists of a service pipe' exteriding
from the water main to and including a shutoff valve or
curb stop.
2 . A water service extension consists of a service pipe
from the water service pipe shutoff valve or curb stop
to the water meter located on the premises being served.
3. Permits required. When installation of a water service
or a water service extension is required , a permit for
each shall be obtained from the Village upon payment of
the required fee.
(a) The fees for the above permits shall be in accordance
with the schedule of fees approved by the Village
Board of Trustees and on file in the office of the
Village Clerk. Such fee shall cover the cost of
inspection of the service connection and any in-
stallation costs incurred by the Village.
4. Maintenance of extensions . Water service extensions are

of the owner of the property served.
(a) Repair of leaks and defects---Owner's responsibility.

shall be promptly repaired by the owners and if
leaks develop in an existing service extension not
meeting the requirements of this chapter it shall
be replaced with a line that does meet such require-
ments .
(b) Failure to repair leaks . In case any leaks in a
water service extension are not promptly repaired,
® the water supply shall be shut off by the water
department and not turned on again until such leaf
has been repaired and any expense incurred by the
Village in connection therewith has beea paid by
the owner, occupant or user.
(c) Liability of Village. The Village shall not be
liable for any damage caused by a leak or break in
any service pipe , or for damage caused by a failure
to repair the same promptly, nor shall the Village
be liable for any damage caused by the repair or
installation of such pipes , or resulting therefrom.
F. Turning on Water Supply.
1 . No water service line shall be turned on for service,
other than for construction purposes , until the building
department has inspected the water supply lines in the
building and certified that they comply with the plumb-
ing code requirements of the Village.
2. The water supply line serving any property shall not be
turned cn by anyone other than water department employees
or other persons authorized by the Village Engineer.
G. Resale of water. No water shall be resold or furnished by
the purchaser to any other premises or to buildings not
served by the Oak Brook Water System except in case of
emergency and on approval of the water superintendent.
Section 3. Construction Requirements .
A. Water service connection construction.
I . Installation of water main prerequisite to connection .
No water service connection may be made unless a water
main meeting the requirements of this ordinance has
been installed adjacent to the property to be served,
preferably in the street right-of-way.
2. Service connection pipe specifications .
(a) Service pipe material shall meet applicable American
Water Works Association specifications and shall be
either copper or cast-iron pipe.
(b) All service pipes shall be installed with a minimum
earth cover of four (4) feet six (6) inches .
(c) Trench backfill for at least six (6) inches over
j the top of the service pipe shall be sandy or fine
granular material free from large lumps or stones .
Within the street right-of-way it shall meet and be
installed in accordance with the standard require-
ments of the Village.

The shutoff valve or curb stop shWIl be 1 cated on the
street side of the street right-of-way line and not more
than seven and one-half (7;1) feet therefrom, and shall
be installed with a valve vault or valve box of design
approved by the Village Engineer.

to enter the building to be served by the most direct
route from the main.
5. Reconstruction of existing connection . Where an exist-
ing property ii served by a water service connection
extending past adjacent property, such service connection
shall be reconstructed at the expense of the owner of
the property served b such service connection to con-
form to Section 3A (4} above within one year after the
placing in service of a water main adjacent to said
property or, if such main already exists , within one
(1 ) year following the passage of this Ordinance.
6. Persons authorized to make connections . All water ser-
vice c6nnections- shall be made by water department
employees or by contractors employed by the Village
and supervised by the Engineering or Water Departments .
7 . Conduction of connections extensions to ad oinin

to extenda water service connection or extension across
a lot to adjoining premises to avoid an extension of a
water main to serve his lot.

9. Extensions to be tested. Each service extension shall
be testa prior to Fackfilling in the presence of a
Village inspector and shall show no leakage under full
water pressure.
10. Proximity of extensions to sewer line. No water service
or water service extension shall e ocated closer than
ten (10) feet, horizontal measurement, to a sanitary
sewer line.
li . Fire protection lines. Separate services shall be in-
stalled for the omestic water system and for fire
protection systems.
B. Water Mains .
1 . Water distribution system mains shall be designed and
constructed to conform with the long range water plans
of the Village of Oak Brook with respect to size and
general location . Dead end mains should not be con-
structed unless plans call for the main to be a part
of a future loop system and an approved flushing device
installed at the dead end.
2. All mains shall have a minimum diameter of six (6) inches
and shall be ductile iron pipe with a cement mortar or
equal lining as approved by the Village En ineer. The
depth of mains shall be four (4) feet six M inches
minimum below grade and shall not exceed seven (7) feet
below grade except in unusual cases and then only with
the approval of the Village Engineer..
• 3. Fire hydrants shall meet Village Standards , shall be
spaced at intervals not to exceed three hundred (300)
feet and located not less than four (4) feet from the
edge of the street pavement.
All hydrants shall have one 5 inch diameter and two,
2 1/2 inch diameter hose connections with National
Standards threads and shall be equipped with auxiliary
gate valves and valve boxes .
4. Ca2acity. Water mains shall be designed to provide for
a flow of at least one thousand ( 1000) gallons per minute
from any fire hydrant in the system, while maintaining
positive pressure at that hydrant.
5. Gate valves shall be provided at all junction points in
the system and at intervals of not to exceed twelve
hundred ( 1200) feet to provide for isolating small
sections of main. All valves in existing or proposed
street pavement areas shall be in valve vaults of
adequate size to permit work on the valves and of design
to be approved by the Village Engineer. Valves in yard
areas may be buried with cast iron valve boxes provided.
6. Poured concrete thrust blocks of design to be approved
by the Village Engineer shall be provided at all bends
in the mains , at all ends of lines , and behind every
hydrant. Specially designed bolted fittings may be
used in lieu of thrust blocks if approved by the Village
Engineer.
Section 4. Permits required. It shall be unlawful to construct,
remove, alter, repa r or p ace in service any water main, water
service connection or water service extension without first
having secured a permit therefore from the Village of Oak Brook
Engineering and Building Department and paying the required
fees in accordance with Article VIII of this Ordinance.
Section 5 Water Billing and Meters .
A. Meter Requirements .

1 . All premises using water from the Village water system
must be equipped with an accurate water meter obtained
from the Village on payment of the required fees as
established by the Village Board of Trustees and in-
stalled by the water department or by a licensed plumber
in a place of easy access and shall , where possible, be
located within three (3) feet of the point where the
water service enters the building. No branch supplies
shall be connected between the meter and the main. The
water meter is and shall remain the property of the
Village of Oak Brook .
2. Meter Maintenance and Repair. Subsequent to installation ,
t e water meter s a e ma ntained , or if necessary re-
placed, by the water division at the Village 's cost and
expense, except in case a water meter is damaged as a
result of negligence or fault of the property owner, his
agent or servant, the owner shall pay. the cost of repairs
or replacement of the meter.
3. Meter Testing. In case of a disputed bill and request
on t e part of the customer for testing of the meter for
accuracy no charge will be made if the meter needs repair
through normal use. If the meter is found to be accurate
the customer will be charged a fee for the removal and
testing as listed in Article VIII of this ordinance.
B. Billing and Meter Reading
1 . Payment liability. In every case, the owner of the
premii'ses ,the occupant thereof and the user of the ser-
vice shall be jointly and severally liable to pay for

the service on such premises and the service is furnished
to the premises by the Village of Oak Brook only upon
the condition that the owner of the premises , occupant
and user of the service are jointly and severally liable
therefore to the Village of Oak Brook. Liability is for
payment for all water used on the premises until written
notice has been received at the department office that
the use of water is no longer desired and the water ser-
vice turned off. Customers are liable for all water
shown to have passed through the meter and consumed on
the property whether by use, wastage leakage or any other
cause.
2. Billing Period. Bills for metered service shall be ren-
dered monthly and shall show the readings of the meter
at the beginning and end of the period for which the bill
is rendered. The basis for computing such bill shall be
the same as indicated by the meter readings.
(a) In case the meter cannot be read for any causer the
Village will require a payment on account equal to
the average bill for the prior six (6) months ( )n-
sumption.
(b) Where a meter has ceased to register or is register-
ing improperly, the quantity of water for which the
bill will be rendered will be determined by using
meter readings for comparable prior months consump-
tion.
3. Time of Payment. Bills for water service will be mailed
or delivered to the customer's last address as shown by
the records of the department when due, but failure to
receive a bill will not relieve the customer from the
obligation to pay the same. All bills and other accounts
must be paid at the office of the department. All bills
for water service become delinquent fifteen (15) days
after the date of bill . Service may be discontinued
fifteen (15) days after notice by the department that the
bill is delinquent unless the bill is paid according to
said notice.
The amount shown to be due by any bill (without penalty)
. will be accepted if mailed within fifteen (15) days of the
date of the bill . When the last day for payment falls on
a Sunday or a legal holiday, the time for payment of the
bill will be automatically extended to include the first
following full business day.

4. Contested Bills . In case a customer files written
ob!ections to any bill within fifteen (15) days of the
dd ) thereof the department will accept payment (without
penalty) within ten (10) days after the customer has
been notified of the results of the departments investi-
gation. Thereafter, a penalty will be payable on the
amount billed at the rate provided for in the rate
schedule.
5. Water Shutoff - Non Reading of Meter. In' cases' where
or any cause the meter cannot 5ie read for a period of
three (3) months the department will turn off the water
upon due notice unless the customer provides access to
the meter immediately.
C. Non Payment of Bills. The water supply may be shut off from
any p~'remises��or which the water meter bill , repair bill or
any other bill remains unpaid thirty (30) days after the
date of such bill . When the water has been shut off, the
supply shall not be turned on except upon payment of the
delinquent bill , any other outstanding charges , and the fee
specified for turning on water.
1 . In the event any water bills or charges for service are
not paid within thirty (30) days after rendition of the
bill for such service, such charges shall be deemed and
are hereby declared to be delinquent, and thereafter
such delinquencies shall constitute liens upon the real
estate for which such service is supplied, and the Village
Collector is hereby authorized and directed each month
to file sworn statements showing such delinquencies in
the office of the Recorder of Deeds of DuPage County,
Illinois , and the filing of such statements shall be
deemed notice of a lien for the payment of such charges
for such service.
D. Su ply of water to premises durins construction. Premises
may be supplied with unmetered water during construction at
a flat rate for a period not to exceed sixty (60) days or
until it is physically possible to install a water meter,
whichever period is less .

ARTICLE VIII
PERMITS AND FEE. SCMEDULES
Section 1 . Permit requirements .
A. Permits are required for all work in accordance with Article
III , Section 2 of this Ordinance and applicable subsequent
sections .
B. Applications .
1 . Applications for all permits shall be on blanks furnished
by the Village for that purpose and shall include a de-
scription of the nature and location of the work to be
done, the name of the person contracting to have the work
done , the owner of the property, and the name of the
person who is to do the actual work.
2. Detail scale drawings are required to be submitted with
the application for all work. These shall include plans
adequately and accurately showing the location and details
of the proposed construction and the location and sizes
of all existing underground utility lines and structures
involved in the construction or in the vicinity of the
work. For all work involving grading , culverts or ditch-
ing and sewer or sewer service construction existing and
® proposed grades shall be accurately shown. The slope of
all sewer lines shall be shown .
3. Bond required. Each applicant for a permit required by
this article for work within street rights-of-way shall
file a bond in the amount of ten thousand ($10,000)
dollars , with surety to be approved by the Village ,
conditioned to indemnify the Village for any loss or
damage resulting from the work undertaken or the manner
of doing the same.
C. Insurance---Required. Each applicant for a permit required
by this Ordinance for work Within street rights-of-way shall
carry adequate liability and property damage insurance to
indemnify the Village in case of any accident or damage
occurring in conjunction with or as a result of the work
done under such permit. The Village shall be named as co-
insured in any policy.
1 . Same---A royal of form. The form of insurance required
herein shall be subject to the approval of the Village
Attorney.

2. Same---Amount. Limits of liability shall be at least
one—hu" nn red thousand ($100,000) dollars for injury to
any one person and five hundred thousand ($500,000)
dollars for injury resulting from any one accident and
fifty thousand ($50,000) dollars for injury to any
property.
3. Cancellation or lapse. The insurance required herein
may not be cance ec until completion of the work for
which a permit is issued and following find"1 inspection
and approval of the work by the Village Engineer or his
designated assistants . Cancellation or lapse of the
insurance required shall result in the termination of
any permit for which the policy provides coverage.
4. Insurance in connection with any structure of a permanent
nature and requiring an annual permit shall run for the
year which the permit is granted.

C. Water Supply and Inspection Fees .
1 . Water supply construction not built as a part of the
required improvements of a new subdivision.
Water mains : inspection fee 10t per lineal foot with
a $25.00 minimum fee.
2. Inspection fee for water main construction and water
service lines 4" in diameter or larger.
10t per lineal foot with a minimum charge of $25.00.
This fee is in addition to any other required fees.
3. Water Service Connection Fees .
(a) Water supplied by other agencies - $25.00
(inspection fee only)
(b) Water supplied by Oak Brook - This fee includes a
connection fee and inspection of lines less than 4"
in diameter. The meter charge includes the cost of
the meter and installation in connections installed
by the owner. It does not include the actual costs
of the installation of the lines or fittings .

for each ose cabinet over 4 and an additional $250 for

8. Turning on water following interruption in service -

ARTICLE IX
VALIDITY
If any section, subsection , sentence, clause, or phrase of
this Ordinance is for any reason held to be invalid, such
decision shall not affect the validity of the remaining por-
tions of this Ordinance.

ARTICLE X
VIOLATION PENALTY
Any person , firm or corporation violating any of the provisions
of this Ordinance shall be fined, upon conviction, not less
than $25.00 or more than $500 for each violation , plus the costs
of the action, and each day that such vi-oiation continues shall
r be deemed to be a separate offense,,
ARTICLE XI
REPEAL OF CONFLICTING ORDINANCES
All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed, to the extent
of such conflict.
