S-282 - 07/24/1973 - ZONING -VARIATION - Ordinances awn buurir �iIllt; YARD VART ITION ORDINANCE NO. __.S-2,29 AN ORDINANCE GRANTING A VARIATI©N TO THE RULES AND REGULATIONS OF "THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK, ILLINOIS, OF 1966" , AS AMENDED Whereas, the owner of the property more particularly hereinafter described has petitioned the corporate authorities of the Village of Oak Brook for a variation to the rules and regula-. tions of "The Zoning Ordinance of the Village of Oak Brook, Illinois, of 1966" , as amended, with respect to side yard require- ments; and Whereas , a public hearing pursuant to said request has been held by the Zoning Board of Appeals of the Village of Oak Brook; and Whereas, the President and Board of Trustees of the Village of Oak Brook have reviewed the proceedings and are of the opinion that a variation should be granted: NOW,THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, DuPage County, Illinois, as follows. Section 1. That the applicable rules and regulations of "The Zoning Ordinance of the Village of Oak Brook, Illinois,, of 1966" as ammended, contained in Section VII, E, 8, 2, are hereby varied to permit a side yard of eight (8) feet instead of 12 feet to allow the construction of a s��,irming pool and walk as shown-on the plans prepared by Eilrich Pool Construction, Inc.-, for property described in Section 2 hereof. 'Sectiori 2. The real estate effected hereby is legally described as , to-wit: Lot 166 in Brook Forest, a subdivision of part of Section 27, Township 39 forth, Range 11 East of the Third Principal meridian, according to the Plat thereof recorded July 26, 1965, as Document R65-,27092 in the recorder' s office of DuPage County, Illinois. The common location of the property is Brook Forest Subdivision, Unit I , Oak Brook, Illinois . Section 3. This Ordinance shall be in full force and effect from and after its passage and approval as by statute in such case made and provided.
