AN ORDINANCE GRANTING A VARIATION TO
THE RULES AND REGULATIONS OF "THE
ZONING ORDINANCE OF THE VILLAGE OF
OAK BROOK, ILLINOIS, OF 1966" AS AMENDED
WHEREAS, the owner of the property more particularly
hereinafter described has petitioned the corporate author-
ities of the Village of Oak Brook for a variation to the
rules and regulations of The Zoning Ordinance of the
Village of Oak Brook, Illinois, of 1966" , as amended, with
respect to special use requirements; and
WHEREAS.,-- .a public--hearing.-pursuant to-said request

NOW, THEREFORE, BE IT ORDAINED by the President and
Board of Trustees of the Village of Oak Brook, Du Page
County, _Illinois, as -follows:
Section- l.- That--the_ applicable-rules- and-regulations- -
of -"The Zoning Ordinance-of-the Village-of=Oak-Brook Illinois,
of 1966"- as- amended-,---contained--in VIII, C, 2, (b) , are hereby
varied to permit operation of activities of clubs, lodges,
fraternities and community centers including class activities
normally connected with YMCA programs.
This. grant of a special use is subject to compliance
with the life/safety requirements as outlined in the letter
-from the Village of Oak Brook to the Hinsdale/Oak Brook
YMCA dated July 3 , 1974 . Further, this special use permit
shall expire on December 31, 1975, if the lease by the YMCA
is not renewed, and if renewed, on December 31; 1977 .
Section 2 . The real estate effected hereby is legally

East of the Third Principal Meridian, Du Page County,
Illinois, also being a part of Lot 1 of Old Oak Brook
Assessment Plat No. 3 recorded January 27, 1965 as
Document No. R65-2793, described as follows: Commenc-
ing at the Southeast corner of the Southwest Quarter
of said Section 26: Thence North 89° 40' 30" West
along the South line of the Southwest Quarter of said
Section 26 . A distance of 279.05 feet for a place of
beginning; Thence North 0° 05 ' 40" West a distance
of 233. 00 feet; Thence North 890 40' 30" West along
a line parallel to the South line of said Southwest
Quarter of Section 26, a distance of 206. 00 feet;
Thence South 00 05' 40" East a distance of 233 .00

that the request for variation for the loading berths as granted
subject to compliance with the zoning ordinance when the
operation of the Hinsdale Sanitary District -Sewerage Treatment
Plant ceased and that the variation .expire within three years
of the sewage plant discontinuance .

presented be approved and that the Village Attorney draft

The meeting was convened by Acting. Chairman Edward S. Fraser at 7: 30 P.M.
in the T. A. Mohlman Board Room. Board Member Lavery moved that the'
minutes of July 2nd, 1974 be approved as presented. This motion was :4
seconded by Board Member Fuller. A voice vote was taken. Motion carried.
The next item on the agenda was the Hinsdale/Oak Brook YMCA variat'Ov <
request. �1
Acting Chairman Fraser proceeded to swear in Mr. James Urhausen and
Mr. James Gillespie representing the Hinsdale/Oak Brook YMCA.

Mr. Urhausen proceeded to explain the variation request and the ch�ralhter
istics of the property in question. Mr. Urhauseq noted that the lot in
question was in a B-1 zoning district comprised bf 44 , 000 square feet
with a building of roughly 2 ,500 square feet. The building had a multi-
purpose room of approximately 650 square feet . Mr. Urhausen explained
the request as one for a special use in B-1, specifically classified
as club, lodge, and/or fraternity. Mr. Urhausen noted that the building
would be and is being used for occasional classes . Mr. Urhausen also
noted that the Plan Commission had approved the variation subject to
the compliance of the Hinsdale/Oak Brook YMCA with the lifesaving codes.
Mr. Urhausen noted that a letter had been sent to Hinsdale/Oak Brook
YMCA on July 3rd from the Bureau of Inspection in the Village of Oak
Brook. This letter was read into the record. The letter indicated
that four improvements were necessary for the proposed use by the
Hinsdale/Oak Brook YMCA.
1) to install an approved fire alarm system. This system must include
heat_ detectors, pull boxes , and a direct hook-up to the Oak Brook
alarm board.

2) to install adequate exit lights and battery powered emergency lights
to sufficiently illuminate all exits and means of egress ,
3) to install a Class B fire door and frame at the top of the stair
well that leads to the basement and,
4) to install approved panic hardware on the rear door.
Acting Chairman Fraser asked Mr. Urhausen whether they intended to
comply with the requests outlined in the letter. Mr. Urhausen noted
that the Hinsdale/Oak Brook YMCA fully intended to comply and that
the only stipulation that the YMCA wished to make was that the schedule
of completion be over a twelve month period so that the costs may be
amortized. Mr. Urhausen indicated that these requests would be complied
with within the twelve month period. Mr. Urhausen noted that the
Y' s Mens Association was being requested to provide some financial
assistance. However, in the event that the Y' s Men are unable to assist
the Hinsdale/Oak Brook YMCA, Mr. Urhausen said that the requests of the
Bureau of Inspection would still be complied with.
Acting Chairman Fraser read the motion of the Plan Commission to approve
this variation into the record of the Zoning Board of Appeals . The
motion was as follows : Plan Commission Member Scott moved that the
Plan Commission recommend that the Special Use Permit be granted to
the Hinsdale/Oak Brook YMCA to expire on December 31 , 197E when the lease.
for the building expires , to waive the fee with the stipulation that
life safety codes be complied with to the satisfaction of the Bureau
of Inspection and the Fire Chief, and that the Village continue to monitor
parking availability. Plan Commission Member Scott emphasized the fact
that. this special use permit is granted contingent upon the fulfillment
of requirements noted by the Fire Chief for safety to the building
occupants . This motion was seconded by Plan Commission Member .Gravelle.
The vote was unanimous.
Zoning Board of Appeals Member Fuller asked if the listing of safety
code features was in order of importance for completion. Acting Chairman
Fraser proceeded to swear in Chief Arthur Ehle of the Oak Brook Bureau
of Inspection.
Chief Ehle noted that the listing of the safety features was not
necessarily in order of importance. Chief Ehle explained that the order
of importance would be dependent upon the type of participant in the
activities of the YMCA. In the case of children, the panic bars for
exiting and the exiting requirements in general would be most important
whereas in the case of adults the alarm system might be considered more
important.
Chief Ehle suggested that the order of priority could be based on the
financial capability of the Hinsdale/Oak Brook YMCA if viewed within
reasonable time perimeters . Mr. Urhausen suggested that the last three
items could be done immediately.

Acting Chairman Fraser noted that the key seemed to be the number of
people in the building at any one time and that the Plan Commission
dealt with the number of people in the building in some detail. Acting
Chairman Fraser asked whether Chief Ehle would be able to stipulate
a maximum number of people in the building at any one time. Chief Ehle
indicated that it would be possible to post the building according to
appropriate capacities .
Acting Chairman Fraser asked whether there was anyone else to appear
in behalf of the petitioner. No one appeared. Acting Chairman Fraser
asked whether there was anyone here to oppose the petitioner. No
one appeared.
Board Member Lavery moved to recommend to the Board of Trustees that
the special use permit be granted subject to the safety requirements
outlined by the Village Inspector in the July 3rd, 1974 letter and that
this variation be granted due to the fact that the speical use would
not alter the essential character of the locality or damage the property
value in the neighborhood and that the variation would be so designed,
located and proposed that the public health, safety and welfare would
be protected. This motion was recommended with the caveat that this
variation would expire at the time of the lease expiration of the
building on December 31st, 1975 subject to the continued monitoring of
parking related to the building activity as presented by the Hinsdale/
Oak Brook YMCA representatives . The motion was seconded by Board Member
Roysdon. Acting Chairman Fraser asked Chief Ehle whether this motion
and the stated compliance by the Hinsdale/Oak Brook YMCA representatives
would satisfy the Village ' s safety requirements . Chief Ehle answered
affirmatively. There were four affirmative votes. The variation would
be recommended to the village board at the next regularly scheduled
meeting.

Dear Mr. Rhodes:
On May 3, 1974 the Hinsdale-Oak Brook YMCA formally filed
a special use request so. as to allow.the use of the building at-1308
Oak Brook Road to be used as the headquarters building for the newly
formed Hinsdale-Oak Brook riiCA which is a branch of the Metropolitan
YMCA of Greater Chicago.
The application for special use relief was filed after a
recent inspection by the Village of Oak Brook wherein they determined
that the use of the former Y's Mens.Association building (which we are
occupying by virtue of lease until 1975) had changed significantly to
warrant consideration of a special use permit. Specifically, relief
is sought under applicable provisions of the zoning ordinance to allow
us to conduct occasional classes., 'seminars, and other activities general-
ly affected with the public interest as incidental and accessory uses to
the principal use -of the building as an office.
Our application for a special use permit was considered by
the President and Board of Trustees and referred out to the Plan Com-
mission for hearing on June 17, 1974 and hearing by the Zoning Board of
Appeals on July 2, 1974. We appeared before the Plan Commission as a-
forementioned and, after considering testimony that evening, the Plan
Commission recommended unanimously to recommend to the Board of Trustees
that the special use permit be issued subject to compliance with the
Life SafetX Code and on going monitoring by. the Village of the parking

Due to prior business commitments and a conflicting meeting
schedule, the request is respectfully made that our hearing before the
Zoning Board of Appeals be continued until their August meeting. Con-
currently, we are requesting continued permission to use the facility as
outlined in our summer program brochures with the understanding that we
will comply with all the requirements of the Inspection and Fire Depart-
ments regarding the Life Safety Code. To that end, we have already met
with the Fire Chief an will continue to work with him during the hear-
ing process on the special use request.

'emit Request. Mr. James Urhausen, representing YMCK, presented the history
this request for a special use permit. Mr. Urhausen noted that this was
B-1 zoning area and had been since 1957. Mr. Urhausen noted that a special
.se under B-1 was specified on page 27, Paragraph 8, 2(b) in regard to clubs".
Jr. Urhausea suggested that the building in question conformed to the requirement!
)f this paragraph of the zoning ordinance, Mr. Urhausen cited the findings of
-act required on Page 78 and noted that the building was so designed and located
o that operation would not impair the public health, safety and welfare.
.'r. Urhausen suggested that the YMCA was in the public interest and convenience
•f the Village of Oak Brook and that it would not cause substantial injury
_o the value of other property in the neighborhood in which it is located.
•ir. James Gillespie, the executive director of the Hinsdale/Oak Brook YMCA
-xplained the four areas of programming in the YMCA that would be located at
Lhis address. 1) would be clubs, father/son, father/daughter type, 2) would
fe camping, 3) would be classes informal adult and youth classes, and. 4) would
e community extension programming such as counselling a kind of "drop in" center.
ir. Gillespie noted that only 50% of these activities would be conducted in
;,his building. Mr. Urhausen noted that the special use requirements were met
y the building in question.. Plan Commission Member Scott asked how much
arking space was available at the site. bIr. Urhausen noted that approximately
1.4 spaces were available. Mr. Urhausen noted that clubs or lodges , as indicated
in the previously cited paragraph in the zoning ordinance, required only one
arking space be available per five seats. fir. Urhausen noted that, at most,
0 seats could be placed in the utility area for possible classes in the
uilding in question.

istrict was primarily designed for office use and that the request that is
-wing made by the YMCA would substantially alter this original use. Mr.

pool for information distribution in regard to_ the International Y'S
ans Association and Mr. Gravelle's understanding of the use of this facility-
.s primarily office space was correct. Chairman Barton noted that he saw no
ejection to the special use in B-1 but that there was some question a-s. to
-hether or not there would be adequate parking. Chairman Barton asked whether
_here were any plans for expansion on the site. Mr. Gillespie indicated that
here were no such plans.

his kind of activity. Oak Brook Fire Chief Ehle indicated that there were
.ot adequate fire exits, espaeiaUy in consideration of the fact that as many

hat the safety standards were not met if the principle. use of the building
s office space were abandoned for replacement by recreational and for
ducational use. Mr. Urhausen agreed with Chief Ehle but asked that the
.aprovements that would be required to make this building conform to the
afety standards be amortized over a twelve month period because of the high
ost involved and the newness of this organization which preempted the i
ossibility of large. expenditures at this time.

his building. Chief Ehle noted that there were two major inadequacies (l) was

-_11aQe of Oak Brook might monitor the situation and that a special use might
a granted for the period concurrent with the term of the least for the building

Chairman Barton asked about the possibility of a limit on the number of people
that could be inside the building at any one time. Mr. Urhausen suggested
that if improvements were made, he would not like to have any kind of limit on
the number of people that could be in the building. Chairman Barton asked
if the limit could be placed for the period of the improvement. Chief Ehle
suggested that there would be some difficulty in enforcement. Chairman
Barton agreed to the extent that good faith compliance would ,have to be
expected but that this was generally true for all laws of this type. Chairman
Barton asked how many people had attended the YMCA at ony onetime at this to
location. Mr. Gillespie noted that on the first night forty-six people attended.
This was the most at any one time. He noted that the average weekly attendance
ti.;as one hundred thirty to one hundred fifty people divided by five nights , in
other words, twenty to twenty-five people in a day. Air. Urhausen noted that
it was the YMCA' s wish to find out whether or not there was enough support for
the YtiICA in this area.

Plan Commission Gravelle asked how many parking places would be required
if twenty people were in the building at any one time. Manager Carmignani
noted that it would require thirty to thirty-five vehicle spaces because
of the shift change characteristics of having one class after another.
Mr. Urhaussn noted that there is a compliance with the letter of the law
i.e. , that there is one parking space per five seats. Chairman Barton
asked if there were anyone else to appear. Plan Commission Member Scott
asked whether it would be possible to table this issue for a month for
Chief Ehle to review the building and determine how many people could
safely attend classes in the present condition of the building. Manager
Carmignani noted that this delay, because of the number of boards this
recommendation must go through, would push the special use permit back
several months.
Chairman Barton noted that the decision could only be inade contingent upon
compliance with the Fire Chief's requirements because of- the potential health
and safety hazards involved. Plan Commission Member Scott moved that the
Plan Commission recommend that the special use permit be granted to the . . .
Hinsdale/Oak Brook YMCA to expire on December 31, 1975 when the lease
for that building expires, to waive the fee with a stipulation that life
safety codes be complied with to the satisfaction of the Bureau .of
Inspection and the Fire Chief, and that the Village continue to monitor
parking availability. Plan Commission Member Scott emphasized the fact
that this special. use permit is granted contingent upon the requirements
of the Fire Chief for safety to the building occupants. This motion: was
seconded by Plan Commission Member Gravelle. The vote was unanimous-

indicated that he wished to subdivide this lot in order to have a second
lot on which to build an additional house in the future to re-coup some
of the cost of the original investment in property and construction on
this property. Mr. Vaivada noted that Tract I would be the tract upon
which he would build his own house. Plan Commission Member Gravelle asked
if this subdivision were not improved, if Mr. Vaivada would still build
on the property. Mr. Vaivada answered . affirmatively.
Plan Commission Member Gravelle asked whether this property, had been
purchased within the last year. Mr. Vaivada answered affirmatively.
Plan Commission Member Gravelle. noted that in order to approve this plat
of subdivision the Zoning Board of Appeals would, if the property were
to be made buildable, have to eventually allow for a variation on width
for both of the tracts. Mr. Vaivada indicated that he had understood
this but that he felt that the design of the homes would enhance the area
if the plat of subdivision were approved.
Chairman Barton asked whether there was any one there in favor of or
in opposition to this matter. Mr. Fred Brown, an Oak Brook Trustee,
asked where the houses that were to be built would be located on the
tracts. Mr. Vaivada pointed out the locations on the plat that he provided.
Plan Commission Member Scott asked what detriment there would be to adjacent

and then the application could be submitted for the regular
board meeting of June 11, 1974 for referral to the Plan Commission

Pursuant to provisions of Section XIII, sub-section J of the Oak
Brook Zonin& Ordinance of 1966, as amended, application is hereby -m-a-Te
on behalf of e 'male-Oak Brook YMCA for consideration and approval
of a special use perntit which will allow the premises located at 1308
Oak Brook Road to be used in accordance with special use zoning district
regulations 2(b) of the B-1 Local Shopping Center District.
The facility in question was constructed in 1968 by the International
Y's Mens Association and is presently owned by them. In December 1973, the
West Suburban YMCA and the YMCA of Metropolitan Chicago jointly entered
into a lease agreement with the owners of the building (which lease extends
until December 31, 1975) which provides for the use of the structure for
the new offices of the newly founded Hinsdale"-Oak Brook YMCA.
Recently, this writer was advised by the Building and Inspection
Department of the Village of Oak Brook that it was their opinion that the
YMCA use of the building for the conduct of incidental classes in the
structure would require special use zoning relief.
Although we are inclined to believe that the present use of the build-
ing for the conduct of occasional and incidental classes tends to be acces-
sory to the principal use of the building as an office (which is a permitted
use in the B-1 district) we, as a new service organization in Oak Brook,
obviously desire to comply fully with both the spirit and intent of all
Village regulations. Accordingly, we would appreciate referral of our
application for scheduling of requisite hearings. At the same time, we
respectfully request consideration on waiving of the normal filing of
$150.00 for the processing of said special use application.

This permit is hereby granted with the understanding that the Contractor shall construct the work in accordance with the des-
cription set forth in the application, plans and specifications; and that all general and detail work connected with such instal-
lation, alteration or repair of any such plumbing, shall be done in strict compliance with the ordinances of the Village of
Oak Brook.
It is hereby required that the plumbing contractor shall have completed the roughing in of the plumbing and shall have tested
his work before requesting a plumbing inspection. The request for the inspection shall be made at least 24 hours in advance of
such requested inspection. It shall be the duty of the plumbing contractor or his authorized agent to be in attendance at the
time of inspection of the plumbing by the Building Inspector.
Should it be deemed necessary for the plumbing contractor to request an inspection other than the final inspection, such in-
spection shall be requested as outlined above. A fee of five dollars ($5.00)shall be charged for each such added inspection,
which fee shall be payable to the Building Inspector direct.

INSTRUCTIONS FOR SEEPAGE TEST
Seepage test results shall be reported in the space provided. The following
test procedure shall be followed:
1. Number and location of tests. - Six or more tests shall be made in
separate test holes spaced uniformly over the proposed absorbtion
'field site.
2. Type of test hole. Dig or bore a hole, with horizontal dimensions of
from 4 to 12 inches and, vertical sides, to the Depth of the proposed
absorbtion trench. In order to save time, labor, and volume of water
required per test, the holes can be bored with a 4 inch auger.
3. Preparation to test hole. Carefully scratch the bottom and sides of
the hole with a knife blade or sharp pointed instrument, in order to
remove any smeared soil surfaces and to provide a natural soil inter-
face into which water'may percolate. l:eniove all loose material from
the hole.
4. Saturi;tion and swelling of the soil. - Carefully fill the hole with clear
water to it minimum depth of 12 inches. By refilling if necessary, or
by. supplying a surplus reservoir of water, such as an automatic
syphon, keep water in the hole for at least 4 hours and preferably
overnight. Allow the soil to swell overnight. This saturation procedure
insures that the soil is given the opportunity to swell and approach
the condition that it will be in during the wettest season of the year.
Thus, the test will give comparable results in the same soil whether
made in a dry or wet season.
5. Percolation rate measurement. - Percolation rate measurements shall
be made on the day following the procedure described under Item 4,
above.
a. If no water remains in the hole after the overnight swelling period,
add clear water to bring the. depth of water in the hole to approxi-
mately 6 inches. From a fixed reference point, measure the drop in
water level at approximately 30 minute intervals for .1 hours, re-
filling to a depth of 6 inches as necesr ary. The drop that occurs dur-
ing the final l hour period is used to calculate the percolation rate.
b. In sandy soils (or other soils, in which the first 6 inches of water
seeps Rway in less than 30 minutes, after the overnight swelling
period) the time interval between measurements shall be taken at 10
minutes and the test run for I hour. The total percolation during I
hour shall then be reported.

Your letter in reference to the ]wilding located at 1308 Oak Brook
Road has been sent to the appropriate departments and their comments
are as follows:
1) BUREAU OF INSPECTIONS:
Beauty Parlors are a Permitted Use,.
For the approximate 3,000 square feet of building area, (15)
parking spaces are required and only (11) spaces are provided.
All interior remodeling must comply with City of Chicago Code,
1975 edition.
An automatic sprinkler system is to be installed in the basement
area and stairwell. Also, a fire detection system on the first
floor.
It is recommended that you consider- installing sprinklers through-
out the entire building which would eliminate the necessity of
installing a fire detection' system on the first floor.
Install exit signs and emergency battery powered lights.
The alarm system is to be supervised by the Oak Brook Police Dept.
Enclose the wall above the ceiling in the basement stairwell, all
the way' to the bottom of the roof deck.

2) ENGINEERING DEPARTMENT:
There is insufficient width to accornodate a driveway bet=ripen the
north side of the building and the required (10) foot landscaping
setback from the rear lot line, therefore, the curb cut for
access to Jorie Boulevard would not be approved.
3) PUBLIC WORKS DEPARTMENT:
Public Works Ordinance requires connection to village water dis-
tribution system. Existing well could be used for lawn sprinkling
only.
4) DuPAGE COUNTY HEALTH DEPARTMENT:
Requires connection to Hinsdale Sanitary District sewer line and
Village of Oak Brook water system. (As per letter dated 12/2/75
from DuPage County Health Department.

We represent the International Association of Y's
Mens Clubs which owns the premises at 1308 Oakbrook Road.
The Y's Men are presently considering leasing this building .
to Gazebo, Inc. which would like to operate a beauty salon
in the building.
Before leasing this building, we would like to
determine from you and each of your departments what will be
necessary in order to insure that this tenants occupancy
will comply with all of the Village ordinances.
Specifically, we would like to know what must be
done concerning fire and safety, building code regulations,
water and any other applicable Village regulations.
In addition, we are interested in knowing what
we should do to obtain permission to put in a curb cut on the
east side of Jorie Boulevard on to our property. We had
previously expressed our interest in a curb cut when we
granted an easement on the southeast corner of the property
to you.
Please refer this letter to the appropriate de-
partments in the Village and furnish me with a response as j
soon as possible.

The road is basically in two (2) sections:

They will widen and pave the road prior to July 1, 19681
however, if we so direct, the cost of the paving from
their northerly boundary to the residence will be paid to
Butler Company in cash.
The Y's Men's Clubs agree to maintain and repair the road,
and keep it free of snow and will hold Butler Company harm-
less in connection with said road.

Dear Mr. Littleton:
Pursuant to our phone conversation, I am
sending you this letter regarding the easement for the
road widening project involving the property of the
International Association of Y's Mens Clubs at 1308 Oak
Brook Road.
The Y's Men have asked me to receive word from
you on two items before they will execute the easement
documents. First, the Y's Men wish to receive an amount
sufficient to cover their expenses. On the phone I
mentioned $50.00 as an adequate amount. On reviewing
the time and expenses on this matter, I think that $70.00
would be a more accurate figure concerning the expenses
involved to the Y's Men.
Secondly, there is the matter of the curb line.
The Y's Men would very much like to have a break in the
curb for a road to the back of their property. Corres-
pondence from the Y's Men indicates that they received
some word earlier that this might be done.
Please let me know if a break in the curb fine
can be arranged and of your agreement to pay the expenses
relating to obtaining this easement.

2. Licensee agrees at its sole expense to improve said road
from 31st Street to the residence occupied by Julius W. Butler in the
manner and to the extent set forth in Exhibit B attached hereto and made
a part hereof.

! during the coarse of the work, to properly maintain and repair said road

all claims arising out of, connected with or resulting from the improving,
maintaining and repairing, failure to properly maintain and repair, or use

3. This license shall terminate without giving rise to any obliga-
tion on the part of Licensor to reimburse Licensee for the cost of improve-
meats on the happening of either of the following events;
j (a) Licensee's breach of this Agreement if said breach is not

cured within thirty (30) days after Licensor gives Licensee
notice of said breach,
(b) Licensee's provision of some other means of access to the,

by the giving of notice to Licensee, specifying the date of termination which
i4 any event shall not be earlier than six (6) months after the giving of said
notice. On said date of termination, Licensor shall reimburse Licensee

costs to be amortized over a period of ten (10) years.

of Licensor or Licensee or when mailed, postage prepaid, certified or registered
