S-333 - 06/24/1975 - LICENSE -ALCOHOL - Ordinances ORDINANCE NO. . 333 AN ORDINANCE AMENDING ORDINANCE NO. S-7 THE ORDINANCE REGULATING THE SALE OF ALCOHOLIC LIQUOR WITHIN THE VILLAGE OF OAK BROOK DU PAGE COUNTY, ILLINOIS WHEREAS, Chapter 432 Section 110, Illinois Revised Statutes (1973) authorizes the President and Board of Trustees to license establishments for the retail sale of alcoholic liquor, establish classifications of licenses, and determine the fees required for said licenses; and WHEREAS, pursuant to said Statute, the President and Board of Trustees enacted Ordinance No. S-7; and WHEREAS, the President and Board of Trustees deem the passage of this Ordinance to be in the best interest and in t furtherance of the general welfare of the Village of Oak Brook. NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Oak Brook, DuPage County, Illinois, that: SECTION 1: The provisions of the preamble hereinbefore set forth are hereby restated herein as though herein fully set forth. SECTION 2: Section 3 of Ordinance No. S-7 is hereby amended to read as follows: SECTION 3: Liquor license classification and fees: Retail liquor licenses issued under this Ordinance shall be divided into the following classes: CLASS ANNUAL FEE Initial Renewal A. Class "A" License 1 . A-1, Retail Sale of Alco- holic Liquors in restaurants $3, 000.00 $1, 500 .00 and bars. 2 . A-2, Retail Sale of Alco- holic Liquors in hotels, $5, 000.00 $3, 000 . 00 motels. CLASS ANNUAL FEE l Initial Renewal B. Class "B" License. 1 . Retail Sale of Alcoholic Liquors not for consumption on the premises where sold . Promotional activities in- volving the consumption of alcoholic liquors on the premises may be held once a month for a period not to exceed three (3) consecutive days. No licensee shall give, or offer to give, alcoholic liquor as a gift, gratuity, or tie-in with the sale of products, other than alcoholic liquors, or to induce the pur- chase of or promote the sale of products other than alco- holic liquors. $3, 000.00 $1, 500.00 C. Class "C" License. 1 . Retail Sales of Alcoholic Liquors for consumption on the premises of regularly organized clubs and semi- private golf courses. 1, 500.00 1, 000. 00 D. Class "D" License (Temporary) . 1 . Retail Sales of Alcoholic Liquors for consumption on, or adjacent to specified premises on a day-to-day basis for not more than 7 consecutive days. $ 50. 00 per day If an applicant conducts, or proposes to conduct, the retail sale of alcoholic liquor within a single building in ways which would require the issuance of more than one license to authorize all of the subject activities, the applicant shall be required only to obtain the single license with the highest annual fee of the licenses applicable to the subject activities. All of the subject activities must be listed on the appli- . cation for license, must be conducted within a single building and must be under the same ownership and control . SECTION 3: Section 9 of Ordinance No. S-7 is hereby _ amended to read as follows: SECTION 9: Term of Licenses - Proration of Fees: Each license issued under this Ordinance in Classes A, B and C shall terminate on the thirtieth (30th) day of June next following its issuance. The fee to be paid for such license shall be reduced in proportion to the full calendar months which have expired in the license year. l 2 - SECTION 4: Section 10 of Ordinance No. S-7 is hereby amended to read as follows: SECTION 10: Number of Licenses: The number of liquor licenses authorized to be issued in each classi- fication is: Class A-1, 7 licenses; Class A-2, 6 licenses; Class B, 3 licenses; Class C, 4 licenses. The number of Olass D licenses shall not be limited. SECTION 5: Section 13 of Ordinance No. S-7 is hereby amended by inserting the phrase " , B or C" between the words "Class 'A'" and "license" in the first line of the second para- graph of said Section 13 . SECTION 6: All ordinances, rules, and regulations of the Village of Oak Brook which are in conflict with the provisions of this Ordinance are hereby repealed solely to the extent of the conflict . SECTION 7: If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid, such determination shall not affect the validity of any remaining portion of this Ordinance. SECTION 8: This Ordinance shall be in full force and effect from and after July 1, 1975.
