S-335 - 07/22/1975 - VARIATION - Ordinances ORDINANCE NO. 335 AN ORDINANCE GRANTING A VARIATION TO THE RULES AND REGULA- TIOl\TS OF THE OAK BROOK ZONING ORDINANCE WHEREAS, the owner of the property hereinafter more particularly described has petitioned the Corporate. Authorities of the Village of Oak Brook, DuPage County, Illinois, for a variation to the rules and regulations of the Zoning Ordinance of the Village of Oak Brook so as to permit in the ORA1 Office-Research-Assembly District zoning classification in which the said property is presently classified the operation of a smoke and newspaper shop within the confines of the building located on said territory at 2625 'Butterfield Road, Oak Brook, Illinois; and WHEREAS, a public hearing pursuant to said request has been held by the Zoning Board of Appeals of the Village of Oak Brook; and WHEREAS, the said Zoning Board of Appeals has recommended a variation in the manner hereinafter described be granted; and WHEREAS, the President and Board of Trustees of the Village of Oak Brook concur with said recommendation of the Zoning Board of Appeals and are of the opinion that a variation in the manner hereinafter described should be granted. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK AS FOLLOWS: SECTION 1: The applicable rules and regulations of the Zoning Ordinance of the Village of Oak Brook, Illinois, adopted in 1966, as Amended, con- tained in Section X B 1 are hereby varied to permit the operation within the building located at 2625 Butterfield Road, Oak Brook, Illinois, of a smoke and newspaper shop to primarily service the tenants of said building, their employees, customers, and guests, upon the following terms and conditions: (a) Location of Shop. The shop shall be located within the confines of a typical office occupancy area in the building. The exact location of said shop shall be subject to the approval of the Village of Oak Brook. (b) Physical Size of Shop. The total floor area shall not exceed 250 square feet. The physical layout of the shop shall be subject to the approval of the Village of Oak Brook. (c) Items to be Sold in the Shop. Items to be sold in the shop shall consist of the following: Tobacco Items: An assortment of cigarettes, cigars, pipe tobacco, as well as tobacco related items such as pipes, cigarette lighters, tobacco pouches, lighter fluid (small quantities), flints, ashtrays. i I Candy: Most all types of candy bars, gum, hard candy, and gift-type candy packages. Snacks: All prepackaged for consumption elsewhere. Items such as peanuts, crackers, potatoe chips, pretzels. All inventories to be kept in small quantities. Personal Grooming: Items such as combs, brushes, shaving cream, toothbrushes, tooth- paste, razors, hair spray, handkerchiefs, nylons, sunglasses,. and nailclippers. Sundries: Items such as aspirin, Alka Seltzer, adhesive bandages, first aid cream, Kleenex, other related non-prescription items, and playing cards. Newspapers and Magazines: Various publica- tions of newspapers, magazines, and paper- back books. Selection subject to removal by Village's written request if considered porno- graphic by the Village. Greeting Cards: An assortment of general greeting cards, including special event cards such as anniversaries, birthdays, Mother's Day, Father's Day, and seasonal cards. Small assort- ment of gift wrappings. Office Supplies: Small selection of pens, pencils, typewritter ribbon, and scratch pads. . Catalog sales for more extensive line and/or large quantities. Photographic Products: Film, flashcubes, batteries, cameras. Film processing service.. Lottery Tickets: Illinois State-Lottery tickets. Future lottery-type sales, licensed and legally recognized by the State of Illinois. Gift Items: Small selection of items such as costume jewelry, stuffed animals, golf balls, umbrellas, flowers, or potted plants, and pen and pencil sets. SECTION 2: The property affected hereby is described as follows, to-wit: That part of Lot 1 in Butler Company - M-1 Inc. Assessment Plat No. 2 of part of the North half of Section 28, Township 39 North, Range 11, East of the Third Principal Meridian, DuPage County, Illinois, as per plat thereof recorded July 8, 1964, as Document No. R64-24069, described as follows: Commencing at the Northeast corner of said Lot 1, thence Westerly along the Northly line of said Lot 1, an arc-distance of 746. 57 feet to the place of beginning; (said part of said Northerly line being - 2 - a curved line, having a radius of 3719. 83 feet, having a chord length of 745. 32 feet and said chord having a bearing of South 79 0- 231-13" West); thence South 16°-21'-45" East, a distance of 788. 34 feet to a point on the Southerly line of said Lot 1; thence South 650- 271-37" West along said Southerly line of said Lot 1, 481. 921; thence North 240-32'-23" West at right angles to last-described line, a distance of 817. 57' to a point on the Northerly line of said Lot 1; thence Easterly along said Northerly line of said Lot 1, an arc-distance of 595. 85' to the place of beginning, (said part of said Northerly line being a curved line, convex to the North, having a radius of 3719. 83' and having a chord length of 595. 22' and having a bearing of North 69°-021-55" East); containing 10. 000 acres, and is commonly known as the Butterfield Office Plaza, 2625 Butterfield Road, Oak Brook, Illinois. SECTION 3: All ordinances, rules, and regulations of the Village of Oak Brook which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of the conflict and as they apply to the property herein- before described. SECTION 4: If any section, sub-section, .sentence, clause, or phrase of this Ordinance is for any reason held to be invalid, such determination shall not affect the validity of any remaining portion of this Ordinance. SECTION 5: This Ordinance shall be in full force and effect from and after its passage and approval as by statute in such case made and provided.
