AN ORDINA\'CE GRANTING A VARIATION TO THE RULES
AND REGULATIONS OF ORDINANCE NO. G-60, THE ZONING
ORDINANCE OF THE VILLAGE OF OAK BROOK AS AMENDED
`THEREAS, the owner of the hereinafter described property has
applied for a variation to Section X, B, 5, 'b and Section MI, B, 2, a of Ordi-
nance No. G-60, the Zoning Ordinance of the Village of Oak Brook, DuPage
County, Illinois, and
WHEREAS, the necessary public hearing pursuant to proper .
notice has been held on the application for variation by the Zoning Board
of Appeals of the Village of Oak Brook, and
WHEREAS, the said Zoning Board of Appeals has recommended
that the requested variation be granted, and
WHEREAS, the President and Board of Trustees of the Village of
Oak Brook have reviewed the findings and recommendation of the said Zoning
Board of Appeals, and
WHEREAS, the President and Board of Trustees of the Village of
Oak Brook find that the requested variation should be granted.
NOIV, THEREFORE, BE IT ORDAINED by the President and
Board of Trustees of the Village of Oak Brook, DuPage County, Illinois, as
follows:
SECTION 1: The provisions of the preamble hereinbefore set forth are restated
herein as though herein fully set forth.
SECTION 2: The provisions of Section X, B, 5, b and Section MI, B, 2, a
are hereby varied to permit the construction of a two-car garage measuring
twenty-four (241) feet on each side as indicated on the survey submitted with
the application for this variation.
SECTION 3: Construction of the above garage shall conform with all ordinances,
rules and regulations of the Village of Oak Brook other than the provisions of
the Zoning Ordinance from which a variance has been granted by this Ordinance.
SECTION 4: The real estate to which this variance is granted is legally described
as follows, to-wit;
Lot 1, Vegter.'s Assessment Plat, recorded June 13, 1953 as
Document 68536 7, in DuPage County, Illinois lying in Section
24 of the following described property: Commencing at the
Southeast corner of the Southeast fractional Quarter of Section
23, Township 39 North, Range 11 East of the third principal
meridian, South of the Indian Boundry Line, thence South
88 1/20 1`est along the Section Line 739. 86 feet to the
Indian Boundry Line; thence South 50 1/20 'Vest along the
Indian Boundry Line 32. 34 feet; thence South 860 43' West
482. 19 feet to a stone; thence North 00 17' West 1025. 9 feet
to an iron stake for a place of beginning; thence continuing
North 00 17' West 724. 10 feet to an iron stake in the center
of Harger Road; thence Northeasterly along the center of
said road, 724. 65 feet to an iron pipe at angle in road; thence
South 890 35' East along the center of road 760.35 feet to
an iron pipe at angle in road; thence North 860 East 477. 75
feet to an iron pipe which is South 860 West 462. 0 feet from
the Northwest corner of Torode's Quarry Lot; thence South
160 East 997. 26 feet to a stone in the Westerly line of
cemetery lot; thence South 420 West along cemetery line
84. 3 feet to an iron stake; thence westerly, parallel with the
South line of Section 24, Township 39 North, .Range 11 East
of the third principal meridian, 2132 feet to the place of
beginning.
The subject real estate is commonly known as 607 Harger Road,
Oak Brook, Illinois.
SECTION 5: All ordinances, rules, and regulations of the Village of Oak Brook-
which are in conflict with the provisions of this Ordinance are hereby repealed
to the extent of the conflict and only as they apply to the property hereinbefore
described.
SECTION 6: If any section, sub-section, sentence, clause, or phrase of this
Ordinance is for any reason held to be invalid, such determination shall 'not
affect the validity of any remaining portion of this Ordinance.
SECTION 7: This Ordinance shall be in full force and effect from and after
its passage and approval as required by statute.
PASSED and APPROVED by the President and Board of Trustees
of the Village of Oak Brook this 26th day of August 1975.
