S-340 - 09/23/1975 - WATER CHARGES - Ordinances ORDINANCE NO. AN ORDINANCE AMENDING ORDINANCE NO. 5-277 SETTING THE RATES TO BE CHARGED FOR WATER AND RELATED SERVICES PROVIDED BY THE VILLAGE OF OAK BROOK, DU PAGE COUNTY, ILLINOIS WHEREAS, the Village of Oak Brook provides water to certain areas within and without the Oak Brook -Village boundaries; and WHEREAS, the Village maintains, installs, and operates certain waterworks in order to provide the said water; and WHEREAS, the costs of providing said water have increased sub- stantially since the establishment of the water rates, fees, and charges now in effect; and WHEREAS, the President and Board of Trustees deem a revision of such rates, fees, and charges and the passage of this Ordinance to be `- in the best interest and pursuant to the general welfare of the Village; and WHEREAS, pursuant to the provisions of Section 11 - Division 150-1 of the Illinois Municipal Code and all laws amendatory thereof and supplementary thereto, the Village of Oak Brook is authorized to assess a connection charge against new or additional users of its water system to provide funds for the construction, expansion, and extension of said system, NOW, THEREFORE, BE IT ORDAINED by the President and Board l of Trustees of the Village of Oak Brook, DuFage County, Illinois, as follows: SECTION 1: The provisions of the preamble hereinbefore set forth are restated herein as though herein fully set forth. SECTION 2: The first paragraph of Section 2. C. 3 (b) of Article VIII of Ordinance No. 5-277, as amended, is hereby amended to read as follows: "(b) Water supplied by Oak Brook - This fee includes a connection fee and a fee for inspection of all lines. The meter charge includes the cost of the meter and installation to connections installed by the owner. It does not include the actual cost of the installation of the lines or fittings. Example - Days of Operation Per Week Value 5. 0 21. 67 5. 5 23. 83 6. 0 26. 00 7. 0 30. 33 (ii) The fee determined pursuant to Paragraph (i) above shall be recomputed by the Village upon the expiration of a period of thirty-six (36) months after the first full month of usage as determined above, as follows: �... Fee = $1. 90 x gallons used per meter reading for the last 12 months of stated 36-month period. Number of days of operation in the last 12 months of stated 36-month period. The fee so recomputed shall then be adjusted by the amount determined and paid pursuant to Paragraph (i) above, and any additional amount resulting from said recomputation shall be paid when billed and any reduction resulting therefrom shall be reimbursed by the Village. (iii) In the event there is a substantial change in the use of the premises subject to the fee hereinabove provided at any time during the thirty-six (36)-month term described above, the fee provided in Paragraph (i) hereof shall be recom- puted in accord with Paragraph (ii) hereof as though the month in which the change in use occurs were the last month of the thirty-six (36)-month term provided in Paragraph (ii) hereof. (iv) Meter charges shall be the same as those charges for residential purposes. " SECTION 3: The first paragraph of Section 2. C. 8 of Article VIII of Ordinance No. S-277, as amended, is hereby amended to read as follows: "8. Water Consumption Charges Water Usage Per Month Up to 4, 000 gallons $5. 94 Over 4, 000 gallons per month $0. 94 per 1, 000 gallons Minimum Monthly Billing Size of Meter Water Charge 5/8" and 3/4" $ 5. 94 1" 10. 66 1-1/2" 15. 40 • �� 31t 27. 80 68. 45 6" and over 280. 89 An additional charge of 5 percent (511) is hereby added to bills not paid within twenty-one (21) days of billing date. " SECTION 4: Section 2. C. of Article VIII of Ordinance No. S-277, as amended, is hereby further amended by the addition of the following as Paragraph 9 thereof: 119. Water Main Expansion and Extension Connection Fee. A Water Main Expansion and Extension Connection Fee is hereby established to partially reimburse the Village for the cost of extending water lines to serve new and additional users and to increase its capacity to produce and transport water. This fee shall be in addition to any and all other fees provided in this Ordinance No. 5-277, as amended. The Village of Oak Brook may provide, at its own initial expense, for the drilling of wells and the construction of expansions and extensions of its water supply system to certain areas within the Village and in areas outside the Village, but within the accredited area of the Oak Brook Utility Company. In so doing, the Village seeks to provide a material benefit to the property owners abutting such improvements. To partially reimburse the Village for such costs, the Village creates a Water Main Expansion and Extension Connection Fee. Such fee shall be equal to forty-five percent (451o) of the capital cost to the Village involved in the expansion or extension of the system determined on a per-lot basis, if paid in the year in which the expansion or extension of the system is accepted by the Village. Such capital cost shall include all costs incurred by the Village in such expansion or extension of the system, including, but not limited to, engineering fees, supervision, legal fees, land costs, material costs, and construction. In the event said fee is not paid in full at the time described above, the fee shall increase at the'rate of six percent (616) per year for each and every subsequent year or fraction thereof until paid, commencing with the year following the year in which the expansion or extension of the system is accepted by the Village. The Village, in lieu of a lump sum payment, shall consider payment of such fee over a period not to exceed three (3) years, if the same is requested in writing. The revenue received by the Village from the Water Main Expansion and Extension Connection Fee shall be used by the Village for its general corporate purposes, with primary application thereof being made to the necessary expansion of the system to meet the requirements of new or additional users thereof; such fund shall be placed, until they are used, into a fund which shall be known as the "Water System Expansion Connection Fund". The monies to the credit of such fund may be invested from time to time by the Treasurer of the Village as provided by law. All accrued interest on any investments shall be credited to such fund. The Village may accept a donation of construction, expansion, or extension of the works of its system in lieu of all or part of the connection fees established by this Ordinance. " SECTION 5: Section 2. C. of Article VIII of Ordinance No. 5-277, as amended, is hereby further amended by the addition of the following as Paragraph 10 thereof: - 3 - K Construction Water. Unmetered water during construction, as provided pursuant to Section 5 D of Article VI of Ordinance No. S-277, as amended, �., Up to and including 1" service $ 35. 00 1-1/2" to 3" service inclusive 70. 00 4" and larger service 140. 00 Water used in excess of sixty (60) days and water used on a temporary basis, whether metered or not, will be billed at the rate of $1. 49 per 1, 000 gallons. " SECTION 6: Section 2. C. of Article VIII of Ordinance No. S-277, as amended, is hereby further amended by the addition of the following as Paragraph 11 thereof: ill. Water' Rate and Connection Fee - -Premium. Water used from the Village system and all line connections at premises not located within the Village or not located within the accredited area of the Oak Brook Utility Company shall be paid for as required hereunder at a rate or fee equal to one hundred fifty percent (15016) of the rate or fee then applicable relative to usage or con- `-- nection within the Village or within the accredited area of the Oak Brook Utility Company, except in those instances wherein a separate agreement has been approved by the Village or the same is otherwise provided for. '► SECTION 7: All ordinances, rules, and regulations of the Village of Oak Brook which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of the conflict. SECTION 8: If any section, sub-section, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid, such determination shall not affect the validity of any remaining portion of this Ordinance. SECTION 9: This Ordinance shall be in full force and effect from and after its passage, approval, and publication in pamphlet form as provided by law.
