ORDINANCE INTO.
AN ORDINANCE ANNEXING CERTAIN TERRITORY,
COMMONLY REFERRED TO AS "SADDLE BROOK",
TO THE VILLAGE-OF OAK BROOK, DU PAGE COUNTY, ILLINOIS
WHEREAS, a certain Annexation Agreement by and between the
Village of Oak Brook, a municipal corporation of DuPage County, Illinois,
LaSalle National Bank, as Trustee under Trust No. 46630; LaSalle National
Bank, as Trustee under Trust No. 20851; LaGrange State Bank, as Trustee
under Trust No. 1472; Chicago Title and Trust Company, as Trustee under
Trust No. 60256; The Roman Catholic Diocese of Joliet, a trust; 35th Street
Enterprises, an Illinois Limited Partnership; and Saddle Brook Development
Corporation, Inc. , a Delaware corporation, was, pursuant to a certain
Ordinance numbered _ 3; ? and passed by the Corporate Authorities of
the Village of Oak Brook under date � ,� � 1975, entered into
under dates 1975, in accordance with the provisions of
Division 15. 1 of Article ll of the Illinois Municipal Code, as amended,
the said Annexation Agreement having reference to the annexation to and re-
zoning by the Village of Oak Brook of the territory hereinafter described
in accordance with the terms, covenants, provisions, and conditions therein
prescribed; and
WHEREAS, there has been filed with the Village Clerk of the
Village of Oak Brook a petition under oath in form: and content as prescribed by
the provisions of Section 7 71-8 of Division 1 of Article 7 of the Illinois Municipal
Code, as amended, requesting that the hereinafter-described territory be
annexed to the Village of Oak Brook, the said territory being part of that
which is the subject matter of the aforesaid Annexation Agreement; and
WHEREAS, said petition has been executed by the represented owners of
record of the territory therein described; and
WHEREAS, there are no electors residing within the said territory; and
WHEREAS, the said territory is contiguous to the Village of Oak Brook
and is not within the corporate limits of any other municipality; and
WHEREAS, the said territory is within the Downers Grove Fire
Protection District and the Trustees of said District have been notified of the
proposed annexation of the territory hereinafter described by the Village of
Oak Brook, as provided under the provisions of Section 7-1-1 of Division 1 of
Article 7 of the Illinois Municipal Code, as amended; and
WHEREAS, a copy of said notice has been recorded in the Office of
Recorder of Deeds of DuPage County, Illinois; and
WHEREAS, the Statutes of the State of Illinois provide that upon the
filing of such a petition the Corporate Authorities of the Village of Oak Brook
may pass an ordinance annexing such territory to said Village; and
WHEREAS, all petitions, documents, and other necessary legal

requirements are in full compliance with the terms of said Annexation
.Agreement and with the laws of the State of Illinois, specifically
Section 7-1-8 of Division 1 of Article 7 of the Illinois Municipal Code,
as amended; and
WHEREAS, the Corporate Authorities of the Village of Oak Broo':
deem the passage of this Ordinance and the annexation of said territory to
the Village of Oak Brook to be in the best interest and in furtherance of the
General Welfare of the Village of Oak Brook,
NOW, THEREFORE BE IT ORDAINED BY THE PRESIDENT AND
BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE
COUNTY, ILLINOIS, THAT:
SECTION 1: The provisions of the preamble hereinbefore set forth are
hereby restated herein as though herein fully set forth.
SECTION 2:. The territory, the legal description of which is set forth in
Exhibit A hereto, which by this reference is incorporated herein, be and
the same hereby is annexed to the Village of Oak Brook, DuPage County,
Illinois.
SECTION 3: The Village Clerk is hereby directed to certify copies of this
Ordinance and together with an accurate map or plat of the territory described
in Exhibit A hereto record the same with the Recorder of Deeds of DuPage
County, Illinois, and to file the same with the County Clerk of DuPage
County, Illinois, as by statute in such cases made and provided.
SECTION 4: All ordinances, rules, and regulations of the Village of Oak Brook
which are in conflict with the provisions of this Ordinance are hereby repealed
solely to -the extent of the conflict and only as they apply to the territory
hereinbefore described in Section 2.
SECTION 5: If any section, subsection, sentence, clause, or phrase of this
Ordinance is for any reason held to be invalid, such determination shall not
affect the validity of any remaining portion of this Ordinance.
SECTION 6: This Ordinance shall be in full force and effect from and after
its passage, approval, and publication in pamphlet form, as provided by law.
