S-345 - 10/28/1975 - VARIATION - Ordinances ORDINANCE NO. AN ORDINANCE GRANTING A VARIATION TO THE RULES AND REGULATIONS OF ORDINANCE NO. G-60, THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK, AS AMENDED WHEREAS, the owner of the hereinafter-described property has applied for a variation to Section V, F. of Ordinance No. G-60, the Zoning Ordinance-of the Village of Oak Brook, DuPage County, Illinois, and WHEREAS, the necessary public hearing pursuant to proper notice has been held on the application for variation by the Zoning Board of Appeals of the Village of Oak Brook, and WHEREAS, the said Zoning Board of Appeals has recommended that a variation be granted, and } WHEREAS, the President and Board of Trustees of the Village of Oak Brook have reviewed the findings and recommendation of the said Zoning Board of Appeals, and WHEREAS, the President and Board of Trustees of the Village of Oak Brook find that a variation should be granted. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, DuPage County, Illinois, as follows: SECTION 1: The provisions of the preamble hereinbefore set forth are restated herein as though herein fully set forth. SECTION 2: The provisions of Section V, F. are hereby varied to permit park- ing on the property herein described abutting Thirty-First Street in accordance with and as depicted on that certain Site Plan prepared by C. Edward Ware, A.I.A. , Architect, Rockford, Illinois, under Job No. 7427, Sheet No. SU-5 dated October 11, 1975, and revised October 16, 1975, a copy of which Site Plan is annexed hereto, identified as Exhibit A, and by this reference incorporated herein. SECTION 3: The real estate to which this variance is granted is legally described as follows, to-wit: The North 660 Feet of the East 880 Feet of the Northwest Quarter of Section 36, Township 39 North, Range 11, East of the Third Principal Meridian, in DuPage County, Illinois. The subject real estate is commonly known as Christ Church of Oak Brook, Thirty-First Street and York Road, Oak Brook, Illinois. SECTION 4: All ordinances, rules, and regulations of the Village of Oak Brook which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of the conflict and only as they apply to the property hereinbefore described. SECTION 5: If any section, sub-section, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid, such determination shall not affect the validity of any remaining portion of this Ordinance. } SECTION 6: This Ordinance shall be in full force and effect from and after its passage and approval as required by statute. CHRIST CHURCH OF OAK BROOK - VARIATIONS Mr. Bernie Cozette representing the Christ Church of Oak Brook and Reverend Arthur DeKruyter reviewed the revised site plan which was sub- mitted to the Village Board of Trustees on May 6 , 1976 . In summary, the new proposal provides for a 40 ft. setback before parking stalls begin on the south yard line in 100 ft . setback before parking stalls begin on the east property line . In both instances roadway paving would be within the required yards . Mr. Cozette stated .that .there was some question in his mind as to what material could be used as ground cover within the required front yard and side yard. He stated that his most recent proposal provides the following advantages to the site : (1) better traffic flow (2) maintaining a 100 yard setback free from parking stalls (3) maintain a 40 yard setback (south yard free from parking stalls. ) He mentioned that along the south yard, a five foot hedge screen would be provided within the 18 ft. of green space. Chairman Baschen asked for questions from the board. Mr. Lavery asked Mr. Cozette to locate the house to the south of Christ Church. Mr. Cozette proceeded to do so. Mr. Baroni then asked if construction has occurred within the required 40 ft . setback recently. Rev. DeKruyter said that it had not. Mr. Baroni asked for an explanation of the parking flow and Mr. Cozette proceeded to review the traffic flow patterns illustrated on the site plan. Mr. Baroni asked if the 18 ft. area would be planted. Mr. Cozette said it would be restored with grass and planted with five foot hedge plantings. Mr. Baroni asked if ground cover is in fact, inconclusive in the ordinance. He stated that in his judgement it was not and, in fact, drives which are required to service parking facilities should in fact be counted as part of the parking and not exempted from yard setback requirements . Mr. Baro.n,iasked if the drainage problem to the south has been corrected and if the retention ponds were installed to correct the problem. Mr. Cozette responded that while the retention ponds will help alleviate flooding problems downstream, outside detention was provided primarily to compensate for the increase run-off as a result of the paving areas of the Christ Church properties . Mr. Fuller then asked if there is an inlet to the detention ponds along 31st Street. Mr. Cozette said this was , in fact, the case. Chairman Baschen then called on the audience for those who wished to speak against the petition and Mr . John Novacek rose and made the follow- ing points : 1. That open space does not include paving which is necessary to service parking and should in fact be included as required parking area in zoning computations . 2 . In his judgement, Christ Church has proven no hardship since their last application. 3. Christ Church by the design of the parking facility, in fact, creates their own hardships . 4. The issue of handicapped parking is not well taken. 5 . Islands provided within the paved area could provide additional parking. 6. Mr. Novacek pointed out that there was an apparent disparity between the east 1 dimension as ow o o exhibit f f and of en n shown n one t o 611..85 t. I� shown on another as 660 . He asked the Village to take notice of same . 7. Since SU-5 was approved last fall for a building permit he could see no reason why it should not be complied with. Miss Etta Chapek, 3121 S. York Road, stated that progress had been made across from her lot and the improvement was in fact less of an eyesore. She stated, however, that she was sympathetic to the needs of Mr. Novacek and felt that waivement of the 40 yard required setback was an abuse of his rights. Mr. Novacek then stated that in his judgement, the detention areas could be put to the west of the site rather than in the center. Mr. Baroni then asked if the parking was in conformance with the zoning ordinance. Mr. Littleton stated that parking would be in conformance , provided wheel stops were installed along the south driveway. Mr. Ehle then noted that the ordinance does not mention . piggyback parking. Mr. Muschler then moved - seconded by Mr. Lavery. . . To recommend to the Village Board denial of the variation request for the south property line and recommend approval of the variation request for the east property line subject to the following findings of fact: 1. the subject variation will not alter the essential character of the locality. Roads Oak Brook, Illinois 60521 Re: Christ Church request for Dear Mr. Brown: parking area variation Unfortunately our presentation to the Zoning Board of Appeals on Tuesday night, May 4, 1976 took on a rather legalistic tone, which seemed to reduce the possibility of flexibility and compromise. As you may have gathered from the various plans presented by Mr. Ed Ware, our architect, we were really searching for an approach which might relieve some of our hardship and inconvenience, but yet preserve the spirit of the various ordinances which the Board considered important. i I would like to ask you to reconsider one of the suggestions that was made; however, was subsequently lost in legalistic discussion: Relevant points are as follows: I . All that would be in the 40 ft. area by the south line would be a 22 ft. wide one-way drive. Thus the 18 feet immediately adjacent to the south lot line would be green. We would assure that no parking would take place on this drive. 2. All that would be in the 100 ft. set back from York Road would be drives with no parking. 3. There is still some question as to what kind of ground cover is allowed in this set back area: grass vs. gravel vs. stone vs. blacktop, etc. 4. It does indeed work a hardship and inconvenience to our members. a. We incur an expense of several thousand dollars to rip up a drive that has existed since about 1970. b. We lose a number of parking spaces that are in a prime location to serve our handicapped and staff because of their ready access to the church. Mr. Fred Brown May 6, 1976 Page 2 C. By having the drive along the south lot line we 'reduce the confusion and possible auto accidents in exiting from, this area. 5. We have lost about 100 parking spaces close to the church on the west ! side of the building because of special flood control retension basins which we were required to build. I 6. Based on this compromise approach, it seems that the appearance of the i area has not been appreciably altered to render it unattractive or in poor keeping with our village. Attached you will find a drawing prepared by Ed Ware, outlining the 'modifica- Lions described and indicating what we are seeking. This, of course, is quite ` different from the variation which the Zoning Board rejected at their meeting. I`m not sure what the procedure is, Mr. Brown, for this reconsideration; however, perhaps you feel it has merit. We need your help and will appreciate your con- sideration. Nayes: None Abstain: President Howell So ordered. 4/13/76 -4- (continued) rage 2 of 4 pages ZONING BOARD OF APPEALS MINUTES - April 6, 1976 CHRIST CHURCH OF OAK BROOK - VARIATION Mr. Nicholas Kitsos represented the Christ Church of Oak Brook and stated that he requested a variation to permit the south yard asphalt pavement to remain in the required forty foot side yard, and that the sixty foot setback line (existing) be permitted to remain in the York Road required front yard. Mr. Kitsos stated that his reasons for hardship were: (1) the Church's expense in removing the asphalt in re-installing an acceptable asphalt covering where permitted. (2) that 5.5 years ago the ordinance did not require a 100 ft. setback along York Road. . New construction lost 2j acres to a retention-detention pond that was needed for parking and for that the church does not get the variation more parking spaces will be lost. He further noted that curbing will be installed on the south asphalt line of the Christ Church parking area to guide water, and he noted that the home immediately south of the Christ Church is buffered by a hedgerow. Mr. Kitsos further noted that with one exception, a 100 ft. required yard setback is not required by Ordinance G-60. His last comment stated that parking was critical only to Sunday mornings before 1:00 P.M. He then noted Mr. Bernie Cozette, the building committee, and a trustee of the church, was also present. Mr. Baschen asked Mr. Kitsos if parking would be permitted on the south perimeter of the parking lot. Mr. Kitsos stated that he does not want parking along the south perimeter line and that although the exhibit attached submitted with his application did illustrate parking spaces along the property line, he would obliterate the south parking. Mr. Kitsos stated that he hereby amended his drawing by deleting all markings along the south property line that related to parking. Mr. Baroni then asked if the entire drawing is void. Mr. Kitsos stated that the asphalting is accurately shown. Mr. Baroni then asked why is a variation requested inasmuch as the plan submitted for a building permit provided ample parking within required yards. Mr. Fraser then asked if the staff approved the plan that was submitted for a building permit. Building Commissioner Ehle stated that he did in fact, and the number of spaces provided without encroaching on required yards would be greater than those proposed by Mr. Kitsos leaving the asphalt pavement in. Mr. Fraser then advised Mr. Kitsos that all new construction must meet the require- ments of the zoning ordinance. Mr. Bernie Cozette, trustee for the Church stated that the south parking was a non- conforming use which was voluntarily deleted from the site plan when an application for building permit was received. Chairman Baschen then asked for questions from the audience. Mr. Novacek stated that several years ago former Manager Urhausen stated that a 40 ft. setback was required and that a gravel asphalt driveway was only provided on a temporary basis. He further noted that he counted cars on the Butler Annex lot and found on two different Sundays. 42 cars and 48 cars were parked. Attorney Bianucci pointed out that the special use permit refers to a specific site plan which depicts the maintenance of the 40 ft. 100 yard setback lines. Miss Edith Chapek said that she was opposed to these parking lots because the headlights from the church detract from the property value and her lifestyle. Mrs. Barbara Reynolds representing the Fullersburg Woods Association stated that the Fullersburg Woods Association would rather go on record prior to the Zoning Board of Appeals taking action although she would hold in abeyance any comment on the proposal if the matter will be continued. Mr. Kitsos said that he formally requests a continuance to the May, 1976 meeting. Mr. Fraser noted that the petitioner must come up 'with a better'case. , Mr Lavery stated that the petitioner should consider Section XII of the Zoning Ordinance. In an effort to meet the demands, the church has acquired the use of an additional six acres of property. A variance will allow the church to park an addi- tional 52 cars in close proximity to the church. This parking need occurs primarily on Sunday mornings. Presently, the adjoining neighbor has a very dense and high hedgelike growth along the entire south line. The church will install a curb along this driveway to prevent surfact water from running onto the neighbor's property. The church is also providing a water retention reservoir of approximately 2-1/2 acres. In our opinion, the location of this driveway and parking spaces, as existing, does not cause a traffic hazard or create noise, nor is it aesthetically undesirable. This 46 foot wide strip will be used in the same manner as used during the last approximate 5-1/2 years. It meets the requirements of the ordinance for open space. The ordinance is silent on the matter of access driveways. It does not define drive- ways as parking. We believe this is a unique application of the zoning ordinance and that a variance will not cause injury to the adjacent property owner. The ordinance requires a 100 foot set-back from the property line along York Road. With one other exception, this is the most rest- rictive requirement, and the only such requirement, in the village. The church plans to provide more than the required plantings and trees between the streets and the interior drives. Unless the variance is granted, the church will be required to remove part of a paved area which has existed on the property since the initial church was built in 1968. The major portion of the driveway areas were on drawings prior to the enactment of Ordinance G 136 on June 22, 1971. The proposed variance will allow parking for an additional 16 parking spaces on the site owned by the church. This could amount to as many as 30 cars since the church double parks within the site on Sunday to meet the demand. I The use of this parking area is critical on Sunday mornings. At other times, these areas are, or will be, seldom used. The church will be meeting or exceeding the requirements for landscaping and green areas. This 40 foot wide strip will be used in the same manner as used during the last approximate 5-1/2 years. It meets the requirements of the ordinance for open space. The ordinance is silent on the matter of access driveways. It does not define drive- ways as parking. We believe this is a unique application of the zoning ordinance and that a variance will not cause injury to the adjacent property owner. The ordinance requires a 100 foot set-back from the property line along York Road. With one other exception, this is the most rest- rictive requirement, and the only such requirement, in the village. The church plans to provide more than the required plantings and trees between the streets and the interior drives. Unless the variance is granted, the church will be required to remove part of a paved area which has existed on the property since the initial church was built in 1968. The major portion of the driveway areas were on drawings prior to the enactment of Ordinance G 136 on June 22, 1971. The proposed variance will allow parking for an additional 16 parking spaces on the site owned by the church. This could amount to as many as 30 cars since the church double parks within the site on Sunday to meet the demand. The use of this parking area is critical on Sunday mornings, At other times, these areas are, or will be, seldom used. The church will be meeting or exceeding the requirements for landscaping and green areas. Christ Church of Oak Brook and the Butler Company - Variation and Special Use Mr. David Gooder, Mr. Ware, and Rev. DeKruyter spoke on behalf of the petitioner. Mr. Gooder stated that the requests of the Butler Co. before the Zoning Board of Appeals, were side yard variations to the south and west of the Butler property and the set-back variations from Oak Brook Road (31st Street) . Additionally, there would be a Special Use Request for the use of the parking lot as a parking facility. The Christ Church application requests relief on the York Road set back and has dropped their side yard line set back request from the application. After a brief presentation Mr. Rush asked for Questions from the Board. Mr. Lavery asked for clarification on the retention earthen dam, which was provided by Mr. Ware. Chairman Rush then asked for persons in the audience in favor of the development. Rev. DeKruyter, 20 Windsor Drive, Oak Brook, stated that the Butler Company requests to use the parking lot facilities on an emergency basis negotiated by the Church and was a good faith effort to assist the Butler Company in exchange for the free use of their property. Chairman Rush then asked for those speaking against the development. Mr. Leon Leaf of Lincoln Road, Oak Brook, spoke against the development, he felt that additional paving would aggravate flooding in his neighborhood. Miss Edith Chapek, 3121 York Road, spoke against the petition because she wanted no more traffic exiting onto York Road across from her home. Mr. Novacek objected to the 40 foot side yard set back waiver request on the south yard line (which had been dropped by the petitioner) . He additionally spoke against increased paving as aggravating flooding problems on his property, and objected to Butler Company using the church parking lot on various occasions. Mr. Jerry Hjerpe of Lincoln Road, Oak Brook, that the parking spaces were not required, that the parking lot was being provided in an area designated as a flood hazard area, and that an air polution problem would result, and because of these reasons was against the development. Chairman Rush then asked Mr. Gooder for a rebuttal. Mr. Gooder responded to the storm water management program, the traffic control and the driveway egress/ingress points. Building Commissioner Ehle then asked if the required parking for the church property would be met. Mr. Ware stated that it would be met if the driveways were used for parallel parking. Mr. Littleton noted that the outlet to the storm tention reservoir must be 27 inches. Mr. Lavery then moved that both petitions be DENIED because they have not satisfied the requirements of the ordinance. That motion failed for lack of a second. Both drives (existing drive on Oak Brook Road and relocated drive on York Road) are properly located. The Oak Brook Road drive lines up with Coolidge Drive on the north creating a four way intersection. It also is located on a four lane section of pavement permitting turning movements without blocking traffic. Both drives are located far enough from the intersection to provide adequate stacking with- out backing traffic thru the intersection. Both drives are at locations where headlights of departing traffic will not shine directly into homes . The York Road drive is opposite aside lot line. It meets the requirements of the ordinance for open space. The ordinance is silent on the matter of access driveways. It does not define driveways as parking. During the discussion preceding the vote, there was concern expressed as to the size of the parking facility and the. need for adequate architectural landscaping such as a berm and plantings extending between 31st Street and the parking facility, a screen of natural trees at the south boundary- shielding the lot from the bridle path in the forest preserve, interior landscaping islands and compliance with Section XI E 9 (i) (page 59) of the Zoning Ordinance relating to a pedestrain walkway at intervals not to exceed 200 feet. While these matters may not have been properly the subject of decision making by the Plan Commission, they are matters that the Plan Commission recommends to the Zoning Board of Appeals and the Village Board in the procedural steps that will follow. Mr. Gooder pointed out that the property in question is on the southwest corner of 31st Street and York Road. Mr. Gooder stated that what they are asking for is a variation inthe R-2 zone to have a special use that will permit parking on this property as an accessory use to the Church property on the adjoining parcel. Mr. Gooder stated that the Butler Company has leased this property to the Christ Church for 5 yearsorent free, with an optiontto purchase after 5 years. Mr. Gooder stated that he has sought the advice of Mr. Bianucci as to how to proceed. He stated thataretention area plan has been submitted to the Village and that this area is more than adequately being taken care. Mr. Gooder stated that they are asking for variations on lot lines on the southern and western sides. It was pointed out that the Forest Preserve engineers designed the Church parking lot. Member Reynolds stated that excavation is going on at this location the permission for which was given by the Chief Ehle. It was stated that the berm should be replaced. It was pointed out that a resident in the area is concerned about the parking setback. Mr. Gooder stated that this problem was to the process of being worked out with Mr. Novacek. Member Listejzki stated the Village Ordinance provides for pedestrian walkway in parking lots and their plan does not show them. Mr. Gooder stated that the requirements of the Zoning Ordinance will be met. Member Reynolds stated that this corner is a prime visual corner of Oak Brook and was concerned about it being a big parking lot. Mr. Gooder stated that they plan to put in plantings. Chairman Barton asked for those people in the audience who wish to speak in favor to do so. No one did. Mr. Hjerpe stated that he lives on Lincoln Road, directly north of the proposed parking lot. He wanted to know how far from the center line of 31st Street the parking lot was . Mr. Gooder stated he did not feel that the Zoning Ordinance applies to this use. Mr. Hjerpe was also concerned with water run-off. Mr. Gooder stated that the proposed retention area should alleviate this problem. Mr. Hjerpe stated that one of his neighbors., who was unable to attend the meeting this evening, was concerned with lights shining into his home.. It was pointed out that the Village' s lighting requirements would be met. Concerned with ingress and egress, he wondered if there was an entrance proposed for the west. Mr. Gooder stated that they are just as shown. Mr. Okmark also lives on Lincoln Road. He stated that he has talked to most of his neighbors about this matter and they are all opposed to the leveling of trees and putting in. asphalt. He was also concerned about traffic. Mr. Gene Baroni stated that heisconcerned with setbacks and lighting. He stated that he and some of the neighbors that he has talked to are concerned with the setbacks. Mr. Baroni stated that he is talking a s •President of the Fullersburg Woods Association. He stated that the Church has activities going on almost every evening, which does cause a noise factor. Mr. Listecki stated that he would like to see it buffered from view from traffic on York Road and 31st Street, and against the residential property it should meetthe Zoning Ordinance. Chairman Barton stated that if this request is granted that it should be made contingent upon their staying within the requirements of the Ordinance. Member Noyes moved that the Plan Commission recommend to the Village Board approval of the special use request by the Butler Company for a parking lot to be used as an accessory use to an adjoining principal special use (Christ Church) . The project lies directly east of the property recently donated by Mr. Butler to the Forest Foundation of Du Page County. The construc- tion will obviously have a. visual , as well as water drainage affect, on District property. I would like to express my appreciation to Mr. Butler, yourself, and Reverend DeKruyter for your cooperative efforts in designing a functional and visually acceptable parking area. As you are aware, the plan being used is basically the one suggested by Mr. Edward Shalkey, Landscape Architect for the District. (Christ .Church) Special Use Mr. David Gooder, attorney for Butler Co. was the only one present and since the representatives of the Church did not appear it was suggested that this matter be continued until the next Plan Commission meeting. Mr. Gooder stated that the 6 acres to west of the Church property, Mr. Butler has agreed to lease to the Church for parking purposes for a period of 5 years. Butler has the legal title to the land and for this reason they are the applicant. Chief Ehle stated that he met with representatives from the Church today and informed them that the parking layout does not comply with the Ordinance. Chief Ehle stated that they were going to go back and discuss the plan. Chairman Barton asked if there was anyone present who wishes to comment on this development. Mr. J-ohn Novacek stated that his property is south of the Church. He stated that they have a flooding problem_ on the rear of his property due to the construction of the Church -parking lot. Chairman Barton asked that Mr. Gooder take Mr. Novacekts problem back to the Church. Mr. Littleton, the Village Engineer, has looked at Mr. Novacek's property. Mr. Novacek stated that he is not against this project, but does expect his flooding problem to be taken care of. He suggested that this could be accomplished by widening she channel. Chairman Barton asked Mr. Gooder to ask the Church to get in touch with Mr. Littleton. Stl rpeter For SUPPLEMENTARY ATTACHMENT A TO APPLICATION FOR PUBLIC HEARING We respectfully request a variation be granted to Section XI E-7 of the zoning ordinance to permit the existing asphalt driveway along the south property line to remain. See enclosed plot plan. The parking requirements set forth by the zoning ordinance can be met within the setback lines. However, parking for the church is very critical. In an effort to meet the demands , the church has acquired the use of an additional eight acres of property. A variance will allow the church to park an additional 52 cars in close proximity to the church. This parking need occurs primar- ily on Sunday mornings. Presently, the adjoining neighbor has a very dense and high hedgelike growth along the entire south line. His residence is not visible from the church property. The church will install a curb along this driveway to prevent surface water from running onto the neighbor' s property. In our opinion, the location of this driveway does not cause a traffic hazard or create noise, nor is it aesthetically undesir- able. This 40-foot wide strip will be used only as access space. It meets the requirements of the ordinance for open space. The ordinance is silent on the matter of access driveways. It does not define driveways as parking. We believe this is a unique application of the zoning ordinance and that a variance will not cause injury to the adjacent pro- perty owner. Streeter for Cnr-'s = " f1,i.arr1, r••; 0 a '; u!•c0� SUPPLEMENTARY ATTACHMENT B TO APPLICATION FOR PUBLIC HEARING We respectfully request that a variance be granted to setback requirements of Section V, paragraph F, of the Zoning Ordinance to allow existing parking and driveways to remain and to permit the construction of certain new driveway and parking modifications as shown on the accompanying plot plan. The ordinance requires a 100-foot setback from the property line along York Road and. a 110-foot setback from the center line of Oak Brook Road (Thirty- first Street) . With one other exception, these are the most restrictive requirements, and the only such requirements, in the village. The church plans to provide more than the required plantings and trees between the streets and the interior drives. Unless the variance is granted, the church will be required to remove part of a paved area which has existed on the property since the initial church was built in 1968. The major portion of the driveway areas were on drawings prior to the enactment of Ordinance G 136 on June 22, 1971 . The proposed variance will allow parking, for an additional 16 parking spaces on the site owned by the church. This could amount to as many as 30 cars since the church double parks with- in the site on Sunday to meet the demand. The use of these parking areas is critical on Sunday mornings. At other times , these areas are, or will be, seldom used. The church will be meeting or exceeding the requirements for landscaping and green areas. In our opinion, the requested variance does not present any adverse effect on the surrounding environment, nor will it cause congestion in the area.
