RELATING TO ACCMIULATION OR RUNOFF OF STORM OR
- FLOOD WATER IN THE VILLAGE OF OAK BROOK,
DuPAGE AND COOK COUNTIES, ILLINOIS
BE IT ORDAINED by the President and Board of Trustees of the
Village of Oak Brook, DuPage and Cook Counties, Illinois, that :
.. S ECTION 1. The President and Board of Trustees find that hazards to
persons and damage to property within the Village of Oak Brook are
being created and increased by the changes in accumulation or runoff
of storm or flood water resulting from the activities to be regulated
under SECTION 2 hereof.
SECTION 2. SECTION 2 of Ordinance No. S-210 is hereby amended by
addition of subsection 2(c) , as follows:
Subsection 2(c) . No excavation, dumping, filling
or movement of 12 cubic yards or more of organic or non-
organic matter shall be permitted without a permit issued
by the Village Engineer. The Village Engineer shall issue
such a permit if the applicant has provided sufficient
safeguards to prevent hazards to persons and damage to
property resulting from the proposed work, and the proposed
work presents no danger to the public health or welfare . .
The application for such a permit shall include diagrams
of the existing and- proposed resulting ground elevations.
SECTION 3. SECTION 3 of Ordinance No: S-210 is hereby amended by
addition of subsection 3(d) , as follows:
Subsection 3(d) . During the time, and so long as,
the acts for which a permit is required under SECTION 2
of this Ordinance, as amended, are occurring, the
,appropriate permit must be posted on the affected property,
in plain view, in a location determined by the Village
Engineer.
SECTION 4 . All ordinances, rules, and regulation of the Village of
Oak Brook which are in conflict with the provisions of this Ordinance
are hereby repealed solely to the extent of the conflict .
SECTION 5. If any section, subsection, sentence, clause or phrase
of this Ordinance is for any reason held to be invalid, such determina-
tion shall not affect the validity of any remaining portion of this
Ordinance .
SECTION 6. This Ordinance shall be in full force and effect from
and after its passage, approval and publication as provided by law.
This Ordinance shall be published in pamphlet form.
