ORDINANCE NO.
AN ORDINANCE ASCERTAINING THE PREVAILING RATE OF WAGES FOR LABOR-
ERS, WORKMEN AND MECHANICS EMPLOYED ON PUBLIC WORKS IN THE VILLAGE
OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS
WHEREAS, the State of Illinois has enacted "AN ACT regulating wages of
laborers, mechanics and other workmen employed in any public works by the State,
County, city or any public body or any political subdivision or by any one under contract
for public works, " approved June 26, 1941, as amended, Chapter 48, Sections 39s-1
through 39s-12, Illinois Revised Statutes, (1975); and
WHEREAS, the aforesaid Act requires that the Board of Trustees of the
Village of Oak Brook investigate and ascertain the prevailing rate of wages as defined
in said Act for laborers, mechanics and other workmen in the locality of said Village,
employed in performing construction of public works for said Village, exclusive of
maintenance work.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Oak Brook, Du Page and Cook Counties, Illinois, as follows:
SECTION 1: The provisions of the preamble hereinabove set forth are hereby restated
herein as though herein fully set forth.
SECTION 2: To the extent and as required by Chapter 48, Sections` 39s-1 through 39s-12,
Illinois Revised Statutes (1975), the general prevailing rate of wages in this locality for
laborers, mechanics and other workmen engaged in the construction of public works com-
ing under the jurisdiction of this village is hereby ascertained to be the same as the
prevailing rate of wages for construction work in the Du Page.County area as determined
by the Department of Labor of the State of Illinois as of December 7, 1976. A copy of
that determination is attached as Exhibit A hereto and by this reference incorporated
herein. The definition of any terms appearing in this Ordinance which are also used in
the aforesaid Act shall be the same as in said Act.
SECTION 3: Nothing herein contained shall be construed to apply said general prevailing
rate of wages as herein ascertained to any work or employment except public works
construction of this Village to the extent required by the aforesaid Act.
SECTION 4: The Village Clerk shall publicly post and keep available for inspection by
any interested party in the Village Hall this determination of such prevailing rate of wage.
SECTION 5: The Village Clerk shall mail a copy of this determination to any employer,
and to any association of employers and to any person or association of employees who
have filed, or file, their names and addresses, with a request that copies of any
determination stating the particular rates and the particular class of workmen whose
wages will be affected by such rates be mailed to them.
SECTION 6: The Village Clerk shall promptly file a certified copy of this Ordinance with
both the Secretary of State of the State of Illinois and with the Department of Labor of
the State of Illinois.
SECTION 7: The Village Clerk shall cause to be published in a newspaper of general
circulation within the Village a notice of the determination made hereby, and such
publication shall constitute notice that the determination is effective and that this is the
determination of the President and Board of Trustees of the Village of Oak Brook.
SECTION 8: This Ordinance shall be in full force and effect from and after its passage
and approval as by Statute in such case made and provided. This Ordinance shall be
published in pamphlet form.
SECTION 9: All. ordinances, rules, and regulations of the Village of Oak Brook which
are in conflict with the provisions of this Ordinance are hereby repealed to the extent
of the conflict.
SECTION 10: If any section, subsection, sentence, clause, or phrase of this Ordinance
is for any reason held to be invalid, such determination shall not affect the validity
of any remaining portion of this Ordinance.

PREVAILING RATES OF WAGES

Notice is hereby given that the general prevailing rates of wages in the
Village of Oak Brook, Illinois, for work under construction contracts, have been
determined by the President and Board of Trustees of the Village of Oak Brook pursuant
to Chapter 48, Sections 39s-1 through 39s-12, and such determination is effective by
Ordinance No. .371 , of said Village, passed A-1 4, ?A , 1977.
Copies of said Ordinance are available for inspection by any interested
party in the Office of the Village Clerk, 1200 Oak Brook Road, Oak Brook, Illinois,
during normal business hours.
