AN ORDINANCE GRANTING A VARIATION TO SECTION VII.D, 8, b OF ORDI-
NANCE NO. G-60, AS AMENDED, THE ZONING ORDINANCE OF THE VILLAGE
OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, TO THE
TERRITORY COMMONLY KNOWN AS 617 WOOD STREET, OAK BROOK,
ILLINOIS
WHEREAS, the owner of the territory hereinafter described has
petitioned the Corporate Authorities of the Village of Oak Brook, Du Page and
Cook Counties, Illinois, for a variation to the rules and regulations of the
Zoning Ordinance of the Village relating to the R-2 District so as to permit
construction of an addition to a residence which encroaches on the required
side yard; and
WHEREAS, a public hearing to consider testimony on said petition
was held, pursuant to statutory public notice, before the Zoning Board of
Appeals of the Village of Oak Brook on July 5, 1977; and
WHEREAS, the said Zoning Board of Appeals, after said public
hearing, has recommended that the requested variation be granted; and
WHEREAS, the Corporate Authorities of the Village of Oak Brook
deem the passage of this Ordinance to be in the best interest and in furtherance
of the general welfare of the Village of Oak Brook.
NOW, THEREFORE, BE IT ORDAINED by the President and Board
of Trustees of the Village of Oak Brook, Du Page and Cook Counties, Illinois, as
follows:
SECTION 1: The provisions of the preamble hereinabove set forth are hereby
restated herein as though herein fully set forth.
SECTION 2: The provisions of Section VII D, 8, b of Ordinance No. G-60, as
amended, the Zoning Ordinance of the Village of Oak Brook, are hereby varied
to permit an addition to the garage on the territory described below, with a
resulting side yard of not less than seven feet (71) to the east side of the addition.
SECTION 3: The territory to which the above variation is granted is legally
described as follows:
Lots 3 and 4 in Block 4 in "Glendale Subdivision" of
Section 36, Township 39 North, Range 11, East of the
Third Principal quarter part of the east half of the
northwest quarter of Section 1, Township 38 North,
Range 11, East of the Third Principal Meridian and a
resubdivision of Lots 1 to 4 in Block 2 in the plat of
the Town of Fullersburg, according to the plat of said
"Glendale Subdivision" recorded September 8, 1926,
as Document 220961, in Du Page County, Illinois.
SECTION 4: The aforesaid variation is granted based on the findings of the
Zoning Board of Appeals set forth in said Board's records relating to this matter.
SECTION 5: This Ordinance shall be in full force and effect from and after its
passage and approval as by statute in such cases made and provided. This
Ordinance shall be published in pamphlet form.
SECTION 6: All ordinances, rules, and regulations of the Village of Oak Brook
which are in conflict with the provisions of this Ordinance are hereby repealed
to the extent of the conflict and only as they apply to the territory hereinbefore
described.
SECTION 7: If any section, subsection, sentence, clause, or phrase of this. ,
Ordinance is for any reason held to be invalid, such determination shall not
affect the validity of any remaining portion of this Ordinance.
