AN ORDINANCE GRANTING A VARIATION TO SECTION VII E 8 a OF
ORDINANCE NO. G-60, AS AMENDED, THE ZONING ORDINANCE OF THE
VILLAGE OF OAK BROOK, ILLINOIS, TO PROPERTY COMMONLY KNOWN AS
921 MERRY LANE,OAK BROOK, ILLINOIS
WHEREAS, the owner of the subject property described in Section 7
below has petitioned the Village of Oak Brook, Du Page and Cook Counties, Illinois,
for a variation to the regulations of Section VII (E) (8) (a) of Ordinance No. G-60, as
amended, as applied to the subject property; and
WHEREAS, the Boards, Commissions, and Agencies of the Village of
Oak Brook have held all required hearings pursuant to statutory public notice and
have submitted all required reports and recommendations; and
WHEREAS, the President and Board of Trustees of the Village of Oak
Brook deem the passage of this Ordinance to be in the best interest and in
furtherance of the general welfare of the Village of Oak Brook.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Oak Brook, Du Page and Cook Counties, Illinois, as
follows:
SECTION 1: The provisions of the preamble hereinabove set forth are hereby -
restated herein as though herein.fully set forth.
SECTION 2: The provisions of this Ordinance shall apply to the property legally
described as:
Lot 30 in "Merry Lane Subdivision," being a subdivision of part of
the East half of Section 23, Township 38 North, Range 11, East of
the Third Principal Meridian, according to the Plat thereof
recorded December 15, 1954, as Document No. R 64-46791, in Du
Page County, Illinois.
and commonly known as 921 Merry Lane, Oak Brook, Illinois.
SECTION 3: The applicable rules and regulations of Section VII (E) (8) (a) of
Ordinance No. G-60, as amended, the Zoning Ordinance of the Village of Oak
Brook, Illinois, of 1966, requiring a front yard of not less than 40 feet in depth,are
hereby varied, reducing said front yard requirement to a depth of not less than 38
feet as measured from the North line of the property heretofore described in
Section 2 hereof, in order to permit the construction of a single-family residence
upon said property.
SECTION 4: This Ordinance shall be in full force and effect from and after its
passage and approval as by Statute in such case made and provided. This Ordinance
shall be published in pamphlet form.
SECTION 5: All ordinances, rules, and regulations of the Village of Oak Brook
which are in conflict with the provisions of this Ordinance are hereby repealed to
the extent of the conflict, and only as they apply to the premises hereinabove
described.
SECTION 6: If any section, subsection, sentence, clause, or phrase of this

Ordinance is for any reason held to be invalid, such determination shall not affect
the validity of any remaining portion of this Ordinance.

I�fx. Michael Stramaglia, representing himself, stated that he was seeking a side
� and frant yaxd variation for his pxoperty i.n �he l�Terry Lane Subdivision (Lot 30�.
He presented to the Zoning Board copies of a survey shas�rin.g the exact amount and
loca.tion of variation rec{uired. This survey was accepted ir!to the reeoxd as
petitioner's Exhibit 1. Mr. Stramaglia noted that on the east side of the build-
ing no variation was needed; that on the west side a 2� variation was required;
and that in the front at the face of the gaxage up ta a 2� variation was needed.
He stated that this survey was taken after the foimdation had been laid, and
that when it was reviewed by the Building Department the need for the variation
became apparer�t_ He noted that while the faundatian itself did not violate the
build.ing setback lines, the eaves ti��o�:ld overhang the setback lines and viola�e
the ordinance. He stated that this problem was not discovered until after the
foundatian had been paured. . .
� Building Co�ni.ssioner, James Clark, stated that fihe Bui�ding Department had in-
structed the petitioner that he could continue to buiid the hc�m.e, but could not
install the eave overhangs without a variation approvaZ.
Member Hodges- asked whether the original plans submitted to the Building Depart- �
m�nt showed the overhang. Mr. Strama.glia indica.ted that they did.
Member Hodges asked whether those plans had been approved. Mr. Stramaglia indi-
ca.ted that they had been approved, tvith a note about the overhangs on the side
having to comply with the side yard requirement. Mr. Stramaglia then shrnJed the
Board Members the plat of survey submitted. with the plans and the building plans
from the building permit application. Member Hvdges asked whether the notations
an the plans were on tliere before the fotm.dation had been poured. Nir. Stramaglia
noted that part of the notation had been on there before the fo�dation had been
poured. He noted that when the permit was issued on Uctober 31, 1977, he was .
made aware af the difficulty involving the eaves on the side of the house. He-
indica.�ed that he did not find out about the need. far a front yard variation .
until after the foundation had be�n poured., on about Decenb�r 29, I977.
Member Nfuschler noted that the issue of side �yard setbacks ��ras particulariy
crztical and sensitive in the area of the Village where the subject property is
. located. PSr. Stramaglia noted that the side yard variations tieere not essential
to hiri but that. the front yard overhang could not naw be appropriately adjusted.
He noted that he was willina to withdraiv his rec{uest for side yard variaticros. �
Member Niuschler noted that would satisfy his objection to the petition.
Chairman pro tem. Lavery asked i+rhether the.petitioner had had any discuss3on with
his neighbors. h�1r. Stramaglia said that he had not, since he was not sure who
they were yet. :
