S-421 - 01/09/1979 - SPECIAL USE - Ordinances ORDINANCE N0. _A L AN ORDINANCE GRANTING A SPECIAL USE PERMIT UNDER ORDINANCE NO. G-217, FLOOD PLAIRN AND WETLAND REGULATIONS, FOR CONSTRUCTION OF A PARKING FACILITY ON PROPERTY COMMONLY KNOWN AS 711 JORIE BOULEVARD, OAK BROOK, ILLINOIS. WHEREAS, the owner of the property described in Exhibit "A", which is attached hereto and by this reference incorporated herein, has petitioned the Corporate Authorities of the Village of Oak Brook, DuPage and Cook Counties, Illinois, for a Special Use Permit under Section 2.04 of Ordinance No. G-217 relating to flood plain and wetland regulations; and WHEREAS, the Zoning Board of Appeals of the Village of Oak Brook has held a public hearing pursuant to statutory notice on the proposed use and has submitted its recommendations to the President and Board of Trustees; and WHEREAS, the-Plan Commission of the Village of Oak Brook has submitted its recommendations to the President and Board of Trustees; and WHEREAS, the proposed use is consistent with the best use of the flood plain; and WHEREAS, the proposed use satisfies the requirements of Ordinance No. G-217 and is consistent with each of the factors set forth in Section 2.04 paragraph (c) of that Ordinance and WHEREAS, the Corporate Authorities of the Village of Oak Brook deem the passage of this Ordinance to be in the best interest and in furtherance of the gen- eral welfare of the Village of Oak Brook. 1QW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, DuPage and Cook Counties, Illinois, that: SECTION 1: The provisions of the preamble hereinabove set forth are hereby restated eras though herein fully set forth. SECTION 2: Pursuant to Section 2.04 of Ordinance No. G-217, a Special Use Permit is hereby granted for construction of a parking facility in the flood plain on the property described in Exhibit "A" hereto and commonly known as 711 Jorie Boulevard, Oak Brook, Illinois. SECTION 3: The special use hereby authorized is expressly conditioned upon comple- tion of proposed use in substantial conformity with the Site Plan dated October 23, 1978, and the Water Detention Plan dated November 3, 1978, prepared by. Fujikawa, Conterato, Lohan and Associates, and attached hereto as Exhibit "B" and by this reference incorporated herein. Ordinance No. Page -2- SECTION 4: This Ordinance shall be in full force and effect from and after its passage and approval as by Statute in such case made and provided. This Ordinance shall be published in pamphlet form. SECTION S: All ordinances, rules, and regulations of the Village of Oak Brook which are in conflict with the provisions of this Ordinance, are hereby repealed to the extent of. the conflict, and only as they apply to the property hereinbef ore described. SECTION 6: If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid, such determination shall not affect the validity of any remaining portion of this Ordinance.
