S-426 - 05/25/1979 - SPECIAL USE - Ordinances ORDINANCE NO. S-426 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK, ORDINANCE G-60 , AS AMENDED AND GRANTING A A SPECIAL USE PERMIT (Midwest Club Subdivision) WHEREAS, an application has heretofore been filed requesting a Special Use Permit for a recreation center in a R-3 Single-Family Detatched Residence District; and WHEREAS, a public hearing thereon has been con- ducted on May 1 , 1979 by the Zoning Board of Appeals of the Village of Oak Brook pursuant to due and appropriate notice ; and WHEREAS, a recommendation has been made by said Zoning Board of Appeals that the special use be granted subject to certain conditions ; and WHEREAS, the Plan Commission of the Village of Oak Brook has submitted its report on the subject petition to the President and Board of Trustees ; and WHEREAS, the President and Board of Trustees concur with the recommendation of the Zoning Board of Appeals and deem the passage of this Ordinance to be in the best interest and in further- ance of the general welfare of the Village of Oak Brook NOW, THEREFORE, BE IT ORDAINED By THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows : SECTION 1: The provisions of the preamble herein- above set forth are hereby adopted as though fully set forth herein. SECTION 2 : That the Zoning Ordinance of the Village of Oak Brook, Ordinance G-60, as amended be and is hereby further amended so as to grant a special use permit to the property described in Section 4 hereof to permit the development of a recreational center, including tennis and swimming facilities , pursuant to Sections VII (C) (2) (e) (9) and VII (C) (2) (e) (14) of the Zoning Ordinance of the Village of Oak Brook. SECTION 3 : That the special use permit herein be granted pursuant to Section 2 of this Ordinance is expressly subject to compliance with the following condition : a) That the development and use of the property be in substantial compliance with the site plan dated March 9, 1979 prepared by Erickson and Stevens , Inc . , Architects , 950 Lee Street , Des Plaines , Illinois , a copy of which is attached hereto, labelled Exhibit "A", and made a part hereof. SECTION 4 : That this Ordinance is limited and restricted to that property legally described as : Ordinance No . S-:426 Midwest Club Page two All that part of The Midwest Club Phase 1, being a subdivision of part of the north half of Section 33 and the north- west quarter of Section 34 , all in Town- ship 39 North, Range 11 East of the Third Principal Meridian, in the Village of Oak Brook , Du Page County, Illinois , according to the plat thereof recorded as Document Number R78- 116577 in the Recorder 's Office of Du Page County, Illinois , shown as Lot 221 ; also all that part of the The Midwest Club Phase 2 , being a subdivision of part of the northeast quarter of Section 33 and the northwest quarter of Section 34 all in Township 39 North, Range 11 East of the Third Principal Meridian in the Village of Oak Brook, Du Page County, Illinois , according to the plat thereof recorded as Document Number R79-03596 in the Recorder ' s Office of Du Page County, Illinois , shown thereon as Lot 221; excluding those portions designated for private roads . SECTION 5: That this Ordinance shall be in full force and effect from and after its passage and approval pursuant to law. Passed this r day of ` 1979.
