AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS
OF SECTION (1) (b) (3) OF APPENDIX II OF THE ZONING ORDINANCE
OF THE VILLAGE OF OAK BROOK, ORDINANCE G-60 , AS AMENDED,
RELATIVE TO NONRESIDENTIAL ACCESS DRIVEWAY WIDTH REQUIREMENTS
(SPORTS CORE)
WHEREAS , an application has been filed requesting a
variation from the provisions of Section (1) (b) (3) of Appendix II
of the Oak Brook Zoning Ordinance, Ordinance G-60 , as amended; and
WHEREAS , a public hearing on said application has been
conducted by the Zoning Board of Appeals of the Village of Oak Brook
on May 4 , 1982 pursuant to due and appropriate legal notice ; and
WHEREAS, a recommendation has been made by the said Zoning
Board of Appeals that the variation requested be granted; and
WHEREAS , the said Zoning Board of Appeals made explicit
findings of fact that the variation requested meets the applicable
standards set forth in Section XIII (G) (4) of the said Oak Brook Zoning
Ordinance; and
WHEREAS, the present Board of Trustees of the Village of Oak
Brook concur with the recommendation and findings made by the said Zoning
Board of Appeals ;
NOW, THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES .,
ILLINOIS as follows :
Section l : That the provisions of the preamble hereinabove
set forth are hereby adopted as fully set forth herein.
Section 2 : That a variation is hereby granted from the pro-
visions of Section (1) (b) (3) of Appendix II of the Zoning Ordinance of
the Village of Oak Brook so as to allow the construction of a thirty six
(36) foot wide driveway on the property described in Section 3 hereof.
Section 3 : That this Ordinance is limited and restricted to
the property known as the Village of Oak Brook Sports Core specifically
for the construction of one (1) two-way driveway thirty six (36) feet in
width on Oak Brook Road approximately four hundred (400) feet West of
Grant Street. Said property is legally described as :
Lot 1 of the Sports Core Subdivision, being
part of Sections 25 and 26 , Township 39 North,
Range 11 East of the Third Principal Meridian,
according to the plat thereof recorded April 9 ,
1979 as Document R79-27848 , in DuPage County
Illinois . Permanent Parcel Number : 06- 25-300-017
Section 4 : That this Ordinance shall be in full force and
effect from and a -ter its passage and approval pursuant to law.

section driveway to the Sports Core from Oak Brook Road. Bids to be re-
ceived on Monday, May 24, 1982 at 11:00 A.M.

F. Timber Trails/Merry Lane Gateway Improvement
Discussed at the Committee-of-the-Whole Meeting of February 9, 1981 and since
that time the Homeowners Association has been attempting to reconcile the
exact improvements to be made at the intersection.
Trustee Congreve moved - seconded by Trustee Philip .. .
To authorize a permit to be issued for the improvements as outlined in letters
dated May 5, 1982 from Tom Millon for the Merry Lane "Entrance Way" with said
improvements to be maintained by the Timber Trails/Merry Lane property Owners
Association as per letter from Charles Rysdon dated April 27, 1982.
Roll call vote: Ayes: Trustees Congreve, Imrie, Philip, Listecki, Rush and
Watson
Nays: None So ordered.
Trustee Congreve moved- seconded by Trustee Philip
To waive any permit fee for this improvement.
Voice vote: all present, in favor So ordered.
G. AGREEMENT BETWEEN THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS,
A MUNICIPAL CORPORATION, AND THE WESTERN GOLF ASSOCIATION.
Agreement approved on April 27, 1982 with the deletion of paragraph VI (C).
Western Golf Association has submitted two alternative counter-proposals.
Trustee Philip moved - seconded by Trustee Rush . . .
To amend the Agreement as approved on April 27, 1982, to reduce the considera-
tion Western Golf Association would pay pursuant to paragrap}" VI (B) from
$10,000.00 to $5,000.00.
After discussion, Trustee Rush withdrew his second. Motion failed.

The Zoning Board of Appeals at its May 4, 1982 Regular Meeting considered the petition
of the Village of Oak Brook for a Variation from the requirements of Appendix 2,
Section .(1)(B)(3) of the Zoning; Ordinance to permit the construction of a 36-foot wide
driveway in the Sports Core.
The Zoning Board of Appeals recommends to the Village Board of Trustees approval of the
requested Driveway Variation for reasons that the Variation is justified by the unique
circumstances surrounding its use and location, and that it is being proposed in order
to serve the best interests of the Village.
This motion was approved on a Roll Call Vote of six (6) ayes: Members Crouch, Fullan,
Hodges, Muschler, Savino, Chairman Baroni; one (1) nay: Member Reynolds.

SUBJECT: Village of Oak Brook - Driveway Variation
The Village has made application for a Variation from the requirements of
Appendix II, Section '(1) (b) (3) of the Zoning Ordinance to permit the construction
of a 36-foot wide driveway on the Sports Core. The Zoning Ordinance permits
driveways for non-residential uses to be not less than 24 feet nor more than
30 feet in width. The primary purpose for the driveway will be to provide a
safe means of access to the Sports Core from 31st Street both during the
Western Open week and the remainder of the year.
As you may know, the Village is required to provide the Southerly fields of
the Sports Core for parking during the Western Open week, as required by the
Purchase Agreement for the Sports Core.
The existing driveways to this area are very substandard, and it is for this
reason that the Village has proposed to make this improvement. The 36-foot
width will permit three lanes of 12 feet in width, allowing the flexibility
to have two lanes in/one out, three in, three out or other variations based
on the current need.
DLring the remainder of the year, this driveway will be used by the Village
for maintenance traffic.
