S-508 - 07/26/1983 - VARIATION - Ordinances ORDINANCE NO. S- SQ8 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF APPENDIX I TO THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK, ORDINANCE G-60 AS AMENDED RELATIVE TO COMPACT CAR PARKING REQUIREMENTS (1111 - 22ND STREET) . WHEREAS, an application has been filed requesting a variation from the provisions of Appendix I of the Zoning Ordinance of the Village of Oak Brook to allow an increase in the number of allowable parking spaces for compact cars; and WHEREAS, alternatively the applicant requested a text amendment to the Zoning Ordinance to accomplish such purpose; and WHEREAS, a public hearing on such applications was conducted by the Zoning Board of Appeals on June 7 and July 5, 1983 pursuant to due and appropriate legal. notice; and WHEREAS, said Zoning Board of Appeals recommended the granting of the requested text amendment and the denial of the requested variation; and WHEREAS, the corporate authorities have considered such a recommendation and deem the denial of the request of text amendment and granting of the request of variation to be consistent with the spirit and intent of the Oak Brook Zoning Ordinance in light of the unique circumstances attendant to the subject property. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. s Section 2: That the variation is hereby granted of Appendix I of the Zoning Ordinance of the Village of Oak Brook so as to allow for an increase in the permitted number of compact car parking spaces from five percent of the total required parking spaces to thirty percent of the total required parking spaces, subject to the conditions enumerated in Section 3 of this Ordinance. Section 3: That the variation herein granted is specifically subject to the following conditions: A. That the proposed off-street parking structure be designed in such a way so as to accommodate any expansion necessary in the sole judgement of the Village of Oak Brook to reasonably accommodate any need for additional parking on the subject property. B. That no ground level parking be permitted to the front of the parking structure and principal building between it and 22nd Street. Section 4: That this Ordinance is limited and restricted to the property locat at 1111 22nd Street, Oak Brook, Illinois, which property is legally described as: Lot 5 in Oak Brook Investment Company Assessment Plat No. 4, of part of the East 1/2 of Section 26, Township 39 North, Range 11, East of the Third Principal Meridian, according to Plat thereof recorded July 8, 1964 as Document No. R 64-24072 in DuPage County, t Illinois. s Also: Ordinance No. S- 5QR Page 2 That part of the East 1/2 of Section 26, Township 39 North, Range 11, East of the Third Principal Meridian described as follows: Commencing at the Northwest Corner of the East 1/2 of said Section 26, thence Southerly along the Half Section Line a distance of 7.78 feet to the South Right of Way Line of 22nd Street, thence N. 890-37'38" East, a distance of 85.91 feet for a Place of Beginning, thence South 00-4112211 East, a distance of 180.38 feet; thence South 130-4015211 East, a distance of 140.12 feet; thence South 620-51'3211 East, a distance of 100.07 feet; thence North ' 00-4112211 West, a distance of 362.97 feet to a point on the South Right of Way Line of 22nd Stteet, thence South 890-37'38" West along said South Right of Way Line, a distance of 120.00 feet to the Place of Beginning, all in DuPage County, Illinois.
