AN ORDINANCE GRANTING VARIATIONS FROM CERTAIN PROVISIONS
OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK, ORDINANCE N0, G-60,
AS A14ENDED, RELATIVE TO COMPACT CAR PARKING REQUIREMENTS, LOADING BERTHS, AND
OFF-SITE PARKING

WHEREAS, on December 23, 1983 an application was filed with the Village of
Oak Brook requesting variations from certain provisions of the Zoning Ordinance
of the Village of Oak Brook to allow an increase in the number of allowable
parking spaces for compact cars, a reduction in minim,ym aisle width for aisles
adjacent to compact car spaces only, and a reduction in the number of required
loading berths and further requesting permission to locate required accessory
parking spaces off-site; and
WHEREAS, on January 10, 1984 the corporate authorities referred the
application to the Plan Commission for public hearing on the request for off-site
4-� parking and to the Zoning Board of Appeals for public hearing on the variation

p H WHEREAS, at the conclusion of its public hearing on January 16, 1984, the
PE Plan Commission recommended to the Village Board that the Applicant be allowed to
locate 61 required parking spaces off-site; and

o 1 WHEREAS, at the conclusion of.its public hearing pursuant to notice on
+- February 71 1984, the Zoning Board of Appeals recommended to the Village Board
o s". a o that the request for a loading berth variation be granted, but that the compact

,d requested variations to be consistent with the spirit and intent of the Oak Brook
pa Zoning Ordinance, in light of the unique circumstances attendant to the subject ,v

u, NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
-* THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as. follows:

_ Section 1: That the provisions of the preamble hereinabove set forth are
c:- hereby adopted as though fully set forth herein.
Section 2: That pursuant to Section XI (E)(2) of the Zoning Ordinance, 61
accessory parking spaces may be located on the 82.5 foot Northern Illinois Gas
�.5 property directly South of the proposed development on the subject property,
provided that the Applicant, Midwest Realty, develops this surface parking on the
Northern Illinois Gas property in substantial conformity with the site plan dated
February 6, 1984 prepared by Schipporeit, Inc. and provided that the Applicant
furnishes the Village with the Northern Illinois Gas Company's prior written
approval of said site plan. A copy of the site plan is attached hereto is
labelled Exhibit A, and is made a part hereof.

Section 3: That variations are hereby granted from Section XI (D)(7) and

Appendix I of the Zoning Ordinance of the Village of Oak Brook so as to allow for
_ a decrease in the required number of loading berths from 4 to 2 and further to
'U-1 allow for an increase in the permitted number of compact car parking spaces from
_ 5% of the total required parking spaces to 25% of the total required parking
spaces and to reduce the required minimum aisle width for those aisles adjacent
r,- n to compact car spaces only from 27 feet to 22 feet subject to the conditions
enunerated in Section 4 of this Ordinance.
Section 4: That the variations herein granted are specifically subject to
the follow conditions:
A. That if in the future the Village in its sole judgment shall determine
that the percentage of parking spaces designed for other than compact
cars is not adequate and must be increased to a maximum not to exceed
the percentage then required by the Code of Ordinances of the Village
of Oak Brook, the Applicant, its successors or assigns will
reconfigure their parking layout and construct, if necessary, a
parking structure so as to provide the then required parking spaces.

B. That the parking improvements on the Northern Illinois Gas property be
developed in substantial conformity with the February 5, 1984
Schipporeit Site Plan, attached hereto as Exhibit "A".
C. That if at any time the Applicant, its successors or assigns are
required to terminate their use of the Northern Illinois Gas property
for off-site parking, then the Applicant, its successors or assigns
shall forthwith furnish 61 parking spaces on the subject property,
building a parking structure if necessary. .
Section 5: That this Ordinance is limited and restricted to the property
located at 2221 Camden Court, Oak Brook, Illinois which property is legally
described as:
That part of Lot 1 in Butler Company M-1 Incorporated Assessment
Plat number 2, of part of the North half of Section 28, Township
39 North, Range 11, East of the Third Principal Meridian, DuPa�e
County, Illinois, as per plat thereof recorded July 8, 1954 as
Document R64-24069, described as follows: Beginning at the
Northeast corner of said Lot 1; thence westernly along the
Northerly line of said Lot 1, an Are distance of 380 feet, (said
Northerly line being a curved line, having a radius of 3,719.83
feet, having a chord length of 379.83 feet and said chord having a
bearing of South 820 12'36" West); thence_ South 110 13128" East a
distance of 736.88 feet, more or less, to a point on the Southerly m
line of said Lot 1 which point is 288.77 feet Westerly of the
Southeast corner of said Lot 1; thence Easterly along the _
Southerly line of said Lot 1, 288.77 feet to the Southeast corner
of said Lot 1; thence North 30 12108" West along the East line of w
said Lot 1, 674.52 feet, more or less, to the Northeast corner of co
said Lot 1 and the place of beginning, also known as: Lot 1 in
Penn Controls, Inc. Assessment Plat No. 1 of that part of Lot 1 in
Butler Company M-1 Inc. Assessment Plat i3o. 2 of part of the North
half of Section 28, Township 39 North, Range 11, East of the Third
Principal Meridian, according to the Plat thereof recorded
December 27, 1965 as Document R66-49445, in Du Page Count;,
Illinois.

Section 6: That this Ordinance shall be in full force and effect from and
