S- 544 AN ORDINANCE- VACATING A PORTION OF SUMMIT AVENUE IN THE VILLAGE OF OAK BROOK, DU PAGE COUNTY, ILLINOIS i i WHEREAS, the President and Board of Trustees of the Village of Oak Brook have determined that the nature and extent of the public use and public interest to be served is such as to warrant the vacation of a portion of the street described herein; and WHEREAS, Section 11-91 -1 of the Illinois Municipal Code requires that an Ordinance vacating a street or alley must be passed by the affirmative vote of three fourths (3/4) of the trustees then holding office; and WHEREAS, it has been determined that the best interest of the Village would be served by the vacation of a portion of the street hereinafter described; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1 : That a portion of Summit Avenue in the Village of Oak Brook, as described on the Vacation Plat thereof, attached hereto labelled Exhibit "A" and hereby made a part hereof, be and the same is hereby vacated, subject to the reservation of permanent easements set forth below. The portion of Summit Avenue hereby vacated is legally described as: All of the right of way of Summit Avenue lying West of the East line of Block 3 as extended North, as dedicated on the Plat of River Bluff addition to Hinsdale, being a subdivision of part of Sections 35 and 36, Township 39 North, Range 11 , East of the Third Principal Meridian, according to the plat thereof recorded September 3, 1895 as Document 59511 , in the Recorder's Office of Du Page County, Illinois. Section 2: That the Village of Oak Brook hereby reserves and retains a permanent easement over all the property described in Section 1 for public utilities and drainage including any poles, wires, pipes, conduits, sewer mains, water mains or any other facility or equipment for the maintenance and operation of any public utility now or hereafter located in the above property. Section 3: That this Ordinance shall be in full force and effect from and after its passage and approval according to law. Section 4: That the Village Clerk is hereby authorized and directed to file with the Recorder of Deeds of Du Page County a certified copy of this Ordinance, together with the Vacation Plat, attached hereto, labelled Exhibit "A" and incorporated herein. SUBJECT: Hyatt House - Landscaping Plan I have reviewed the Landscaping Plan and Section Elevation which were received on July 2, 1984 and offer the following comments: 1. The present Landscaping Plan appears to provide a fairly dense planting of evergreen trees adjacent to the northeasterly parking area which should provide a substantial screen to the residential units across Salt Creek. The present plan provides more substantial screening than the previous plan dated May 10, 1984 and received June 13, 1984. 2. The Section Elevation sheet is not drawn to scale. Specifically, the 2.5:1 slope on the Hyatt side of Salt Creek does not extend the entire distance from the parking lot to the channel. Please note that IDOT's plans for the Salt Creek improvement does provide for 2.5:1 slope immediately adjacent to the channel, but that steep slope flattens out as it proceeds toward the Hyatt House parking area. SUBJECT: Hyatt House - Special Use Flood Plain I have reviewed drawings Al, A2, A3, Cl, and C2, all dated 7/02/84 and all received 7/02/84, and offer the following comments: 1. Sheets Cl and C2 are similar to sheets Cl and C2 which were dated revised 4/05/84 and received on 4/10/84. 2. The plan presently proposes to remove approximately forty (40') feet of the existing parking area near Salt Creek at the far northeast portion of the property. As you recall, the initial submittal removed approximately seventy (70') feet. 3. This plan contemplates a two and one-half (21j") inch asphalt overlay over the existing parking area which should not measurably effect the Salt Creek Flood Plain or high water elevations. 4. Surface parking directly under the parking structure will be inundated with flood waters from depths ranging between zero (0') feet at the far northwest corner to two (2') feet along the northeasterly edge of the parking structure. Additionally, this plan proposes a flood depth of approximately 0.8 feet along the southwesterly wall adjacent to the banquette facilities; the previous plan had zero (0') feet along this wall. 5. This plan shows a new retaining wall around an existing lower level opening which is southeasterly of the truck dock area. The previous plans did not incorporate this retaining wall. 6. A note within the plan sheet needs to be revised from nine (9") inches of compacted stone to fourteen (14") inches of compacted stone. 7. The calculations on Sheet C2 state 0.23 acre feet of* excess compensatory storage provided with this plan. 8. Should a special use in the flood plain be granted, it should be conditioned upon the applicant applying for and receiving a permit from the State of Illinois concerning same. The Brickman plan is significantly different than the Lindley plan, dated 10/28/83. As you know, the Lindley plan was submitted last October and was presented to various Village Boards as evidence to show that the Hyatt House will provide significant screening of its proposed improvements from the residences across the creek. The present Brickman plan does not provide the level of screening as contemplated within the previous Lindley plan. 2. I note that the Brickman plan contains many proposed large shade trees. Please note that shade trees do not provide any screening within the winter months. 3. Since screening of the hotel improvements was an important aspect of the overall plan, and since the Brickman plan does not contain the amount of screening as originally contemplated within the Lindley plan, I suggest that you revise the Brickman plan to provide for additional screening. I understand that a covenant is being generated to insure that the Hyatt House properly installs and maintains the necessary screening along Salt Creek. I will review that covenant along with the Brickman landscaping plan with Bruce Kapff when he returns from vacation next week. S e ely, Dale L. After careful consideration the Village Board directed the Village Attorney to: 1. Draft the necessary ordinance to rezone the North 9 acres to ORA-2; and 2. Draft the necessary ordinance to rezone the Easterly parcel from R-3 to ORA-2. The Board noted at this time that it will take final action on the applicant's offer to withdraw the FAR applications (variation and text amendment) and would appreicate a written declaration of your intent in regards to this offer. . The Village Attorney was also directed to draft an ordinance to grant the parking variations with conditions regarding the accommodation of full-size cars and, the off-site parking spaces, as well as a condition regarding the requirement for a covenant for landscaping and the maintenance thereof to shield the development site from residential properties. With regard to the Final Plat, the Attorney was directed to draft a resolution approving this plat, subject to removal of the house from the Northerly 9 acres within three (3) years or the issuance of a Certificate of Occupancy, whichever occurs first; the grant of a conservation easement to cover the entire North 9 acres and the Easterly .71 acres; the provision of bicycle path ease- ments as per the May 24, 1984 Plan Commission recommendation; the grant of an acceptable watercourse maintenance easement and other minor drafting items noted by the Village Engieer. Dear President Cerne and Trustees : The Board of Trustees adopted the following motion on March 27, 1984: "To advise the applicant to file a plat consolidating the subject property with the abutting nine (9) acre parcel to the North, providing a Conservation/Recreation easement on same, and further that the applicant file the necessary documents relative to rezoning the North nine (9) acre parcel plus the easterly portion of the subject property from R-3 to ORA-2, and provide for the maintenance of land- scaping. " In response to this advice a consolidating plat of sub- division and a request to rezone the easterly tip of the original Hyatt property were filed on March 30 , 1984. In order to clarify a rather complicated record let me first summarize the actions which my client, Oak Brook Hotel Company, and the land trust holding title to the original Hyatt parcel are respectfully requesting that the Village take: 1. Approval of the plat of subdivision which would create a one lot subdivision, as recommended by the Plan Com- mission. The plat consolidates into one lot the original Hyatt lot and the 9 acre parcel which adjoins it on the north. Applicant has submitted a revised instrument granting the usual drainage easement and also establishing a perpetual conservation covenant requiring that the northerly 9 acres and the easterly tip remain in naturally wooded condition. Kapff, Assistant to Village Manager SUBJECT: Hyatt Applications (1909 Spring Road) The Hyatt Hotel presently has four applications for specific zoning relief before the Village, these being: 1) Text Amendment to increase the floor area ratio for B-2 type uses from .3 to .5. 2) Special Use Permit for construction within the Flood Plain relating to the proposed development. 3) Parking Variations increasing the percent of compact cars from 5 percent to 33 percent and reducing the required aisle width adjacent to aisles only accomodating compact cars from 27 feet to 22 feet. 4) In the alternative to theabove proposed Text Amendment regarding FAR, a Variation regarding FAR permitting construction of up to .5 FAR based on the current proposal. The Zoning Board of Appeals, at its meeting of September 6, 1983, previously reviewed the proposed Text Amendment regarding FAR and Special Use Flood Plain permit in addition to an application for the rezoning of the northerly property owned by the Hyatt located North of 16th Street and East of Spring Road and recommending denial of all three applications. At the Village Board's request, the Hyatt has since withdrawn it's application for the rezoning of the northerly parcel. The Plans which should be reviewed with respect to the various applications are six sheets prepared by Smith & Stevens Architects, last revised December 20, 1983. As noted on sheet A-1 of those Plans, the legend on the right side of that sheet notes two levels of .development. That noted in the left column, as last revised October 25, 1983, is, essentially, identical to the plan reviewed by the Zoning Board of Appeals last September. The right-hand column, shown as revised December 20, 1983, was generated following a Board meeting in order to reduce the scale of the proposed development. Items which have been reduced since the Zoning Board last reviewed these plans include the following: 1) 12,700 square feet banquet room has been reduced to 7,500 square feet. 2) 120 additional guest rooms has been reduced to 47 rooms. ktE: Hyatt Applications • . Floor area calculations for the existing and proposed development are as follows: 1) Existing .building - 198,083 square feet. 2) Addition (revised 12-20-83) - 80,000 square feet. 3) Total 4 278,083 square feet. The previous scale of development reviewed by the Zoning Board in September showed an addition of 139,170 square feet resulting in a total building of 337,253 square feet. The floor area ratio calculations based on the above figures are as follows: 1) Floor area ratio based on ORA-2 property: existing building - .351 proposed structure (October, 1983) - .597 proposed building (December, 1983) - .4926 2) Floor area ratio figured on ORA-2 and existing R-3 property along Harger Road: existing building - .33 proposed building (October, 1983) - .566 proposed building (December, 1983) - .466 The floor area ratio figured on ORA-2 property for the existing building is .351. Re: 1909 Spring RoadADMINISTRAT10N Zoning Variation Request Oak Brook Hotel Company Dear Chairman Baroni and Members: Oak Brook Hotel Company, owners of the Hyatt Oak Brook Hotel, has requested in conjunction with its planned expansion of the hotel, a zoning variation regarding parking which contains two elements - increasing the percentage of compact spaces permitted and reducing the compact bay aisle width. Additionally, .it has presented to the Plan Commission a request for off-site parking for 37. cars (5% of the total required parking. ) This request is similar to the ones that have come before this Board recently from the John Buck Company and Official Airlines Guide,. Inc. , which were recommended by you for approval. Based on the actual experience of the Hyatt which will be presented to you, and the automotive information generally available which you reviewed in the prior presentations, we are requesting favorable consid- eration of the following: 1. To permit 33% of the required parking (rather than 5%) to be designated for compact cars. It is proposed that all of the spaces for these cars would be included in the proposed parking structure 2. To reduce the minimum aisle widths from 27' to 22' in parking bays designated exclusively for compact cars. The proposed changes are consistent with the actual pattern of usage of compact cars at the Hyatt, and the turning radius required for compact cars. Furthermore, the requested variation would allow a reduction in the size of the proposed parking structure by approximately 15.4%, thereby allowing the proximity of the structure to be almost 50, farther back from the neighbors. The hardship arises from the following: a. The property is a corner and triangular lot adjoining residential property which results in over 22% of the lot to be located in the required front, side and rear yards. b. Screening a larger structure from the view of the neighbors becomes extremely difficult because of the restricted availability of adequately sized trees for planting. c. The Plan Commission recommends to the President and Board of Trustees approval of the Hyatt's request to locate up to 37 required parking spaces on First Federal property based on the following conditions: 1) The Hyatt obtain a renewable lease with First Federal of a minimum term of one to three years. 2) The Hyatt execute a covenant indicating their willingness to construct the 37 parking spaces on site either as surface or structure parking in the event that their lease with First Federal should, at some time in the future, expire. This recommendation was made on a motion by Member Bushy, seconded by Member Ramm and approved on a Roll Call Vote of four (4) ayes: Members Beard, Bushy, Ramm, Acting Chairman Marcy; zero (0) nays; three (3) absent: Members Antoniou, O'Brien, Chairman Reece. Respectfully submitted, Henry 0. 2cy Acting Chairman Plan Commission BFK/HOM/3r PIAN COMMISSION Minutes -7- January 16, 1984 VIII HYATT - REQUEST FOR OFF-SITE PARKING - TEXT AMENDMENT RE: FAR - SPECIAL USE FLOOD PLAIN 1909 Spring Road Mr. Jim Smith, architect, was present representing these applications. Mr. Smith noted that, plans have been revised downward since the last time the Plan Commission had reviewed the subject. He noted that the parking structure, although still containing three levels, has been reduced in size, as well as a reduction of the addition's square footage from 139,000 to 80,000 square feet. The current plan also calls for the location of 33 percent compact cars totally within the parking structure which requires a Variation to be heard by the Zoning Board of Appeals in February. He also noted that the plans indicate 37 of the required parking spaces will be located off site at First Federal. He noted that, they presently do not have an agreement with First .Federal due to CitiCorp's pending acquisition of First Federal . However, indications are that the agreement with First, Federal will be finalized satisfactorily.. He noted that the design of the parking structure allows . for future expansion in the event that they, at some time in the future, lose the use of the First Federal lot. He also noted that the Hyatt has performed surveys of their parking needs and have determined that, greater than 50 percent of the cars parked were compact in size and that, not once in 1982 or 1983 has the existing parking lot been filled. Members Antoniou and O'Brien noted that due to their previously indicated potential conflicts of interest, they would absent themselves from the remainder of the meeting. In response to Member Ramm, Mr. Smith indicated that should they lose the lease for the 37 off-site spaces, the parking structure could be expanded. In response to Acting Chairman Marcy, Mr. Smith stated that there is no substantial change to the Special Use Flood Plain application, since the elevations shown are the same as on earlier plans and , to an extent, the situation is improved due to the increased horizontal room for flood flow. Acting Chairman Marcy noted the Village's requirement for either ownership of or a long-term lease for any property utilized for required off-site parking. Village Attorney Martens stated that a covenant could be required such that, Hyatt would be required to add additional parking in the event the lease were lost. Mr. Smith indicated First, Fed eral' s opposition to a long-term lease as such would tend to be a cloud on their property. Member Beard stated that the parking structure should be designed in order to accomodate the additional 37 parking spaces in the event that the lease were lost. Acting Chairman Marcy stated that the Plan Commission would hold off taking any action with respect; to the off-site parking request following a further discussion concerning Hyatt's revised plans for expansion. Mr. Smith requested that the Plan Commission take no action with respect to that Text Amendment, since it would not permit the expansion as presently proposed. He further indicated his belief that the Hyatt had or will in the near future file a revised application requesting a Variation permitting up to .492 FAR. The Plan Commission established a concensus that they would take no action concerning the requested Text, Amendment, based on the applicant's plans to file for the necessary Variation to Floor Area Ratio. Discussion followed concerning the applicant's requested Special Use Flood Plain Permit, based on the modified expansion. Mr. Smith noted that with regard to Dale's memo of January 12, 1984 the information noted in Items #2 and #6 concerning existing and proposed flood plain volumes and a revised landscape plan will be submitted. He noted that the only changes to the flood plain actually provide more storage under the current proposal than previously. Member Beard inquired as to the flood plain effect if the applicant does not, receive a 33 percent compact car variation. Mr. Smith indicated that the parking structure would increase in width from 110 to 130 feet, although there would be no effect on the flood plain since the parking structure sits on stilts. Previous plans indicated that 150 required spaces would be located to the South of the Hyatt on Commerce Plaza property. The current 37 spaces will be located on First Federal property located at the northwest corner of Harger Road and Spring Road. Section XI(E) (2) of the Zoning Ordinance requires that "Required accessory off- street parking spaces shall be located on the same lot as the principle use or structure except when the Plan Commission recommends and the Board of Trustees authorizes for a specific use, the location of all or part of the required off- street parking spaces on a lot that does not contain the principle use or structure." This section also states that such off-site parking must also comply with the provisions of Section XI(E) (10) which further requires that the owner of both the principle property as well as the off-site property be one and the same. Previous legal advice has indicated that for purposes of ownership under this subsection, a long-term lease indicating control of the off-site property and the ability to use same for parking purposes is sufficient. VOICE VOTE: All present, in favor. So ordered. III Oak Brook Hotel Company - Hyatt - 1909 Spring Road: 1) Rezone R-3 to ORA-2; 2) Text Amendment - FAR; and 3) Special Use Flood Plain. Trustee Watson introduced the item and recapped the history and the prior actions that had been taken on the Oak Brook Hotel Company requests by both the Plan Commission and the Zoning Board of Appeals. Approximately 26 people from the Timber Trails area were in attendance at the meeting. A .representative from the Hyatt Hotel, Mr. Don West, presented a brief summary of the Special Use Flood Plain request. Engineer Lindley reviewed the flood plain issues and the solutions to the various problems. He also reviewed the items contained in the Oak Brook ordinance and their compliance with the various pro- visions. There was considerable discussion regarding the 2 alternative plans for the parking area: 1) having the parking on the North parcel presently zoned Residential; and 2) consolidating the parking on the primary parcel of property owned by the hotel to the South. The expansion of the hotel would be to convert the existing meeting rooms which are on the current 2nd floor of the existing hotel to sleeping rooms and to construct an area which would incorporate approximately 139,000 square feet encompassing a 12,500 square foot ballroom, additional meeting rooms, and an expansion of total sleeping rooms from 325 rooms to 500 rooms. An approximate increase of 33% in the sleeping rooms and an increase in the ballroom of 4 times the current size. The parking structure would be needed to accommodate the additional activities. The .rezoning of the Residential property was not an acceptable solution and the utilization of that property for parking was questionable. 2. That the parking structure should be reevaluated to attempt to reduce the height of the parking structure by some form of redesign and distribution over a wider area. 3. That share parking should be investigated as another alternative, perhaps utilizing the property to the West, Northwest, or the North for overflow parking. 4. A modification of the proposed expansion of the hotel should be made. The 12,500 square foot ballroom is excessive in comparison to the demands for the 500 sleeping rooms and the developers should reevaluate the necessity for the expansion of the hotel and reduce that expansion which would in turn reduce the demand for parking on the site. 5. Screening is of considerable concern and should be adequately provided to maximize the protection to the residential area immediately Northeast of the hotel site. 6. The architectural design of the parking structure should be provided such that it blends with the existing hotel design. All of these items should be reviewed by the developer and the developer was directed to meet with the staff to attempt to resolve these major concerns so that a report could be made to the Village Board at the November Committee-of-the-Whole Meeting and the Board reevaluate the proposal and then attempt to make a decision. IV Oakbrook Terrace/Drury Lane - Timber Trails/Frontage Road: The Village Board reviewed the information provided by the Timber Trails property owners in terms of their requested option. The conclusion was that the staff is to prepare a survey form to resu vey the,--` area giving them a choice of the 2 permitted options which would be orTtly Optio #2 or Option #3 in an attempt to solicit the decision of the majorit of the property owners so a report could be made back to the Village Board at the earliest possible date. The following plans have now been submitted: 1) 5-sheet set of Site Plans containing sheets A-1, A-2, A-3, C-1 and C-2, revised July 2, 1984. 2) Landscape Site Plan prepared by Theodore Brickman Company, revised July 2, 1984. 3) Cross-sectional Plan noting the relationship between the proposed parking structure, proposed landscaping, Salt Creek, and Timber Trail residence, dated July 2, 1984. SUBJECT: Hyatt House — Landscaping Plan I have reviewed the Landscaping Plan and Section Elevation which were received on July 2, 1984 and offer the following comments: 1. The present Landscaping Plan appears to provide a fairly dense planting of evergreen trees adjacent to the northeasterly parking area which should provide a substantial screen to the residential units across Salt Creek. The present plan provides more substantial screening than the previous plan dated May 10, 1984 and received June 13, 1984. 2. The Section Elevation sheet is not drawn to scale. Specifically, the 2.5:1 slope on the Hyatt side of Salt Creek does not extend the entire distance from the parking lot to the channel. Please note that IDOT's plans for the Salt Creek improvement does provide for 2.5:1 slope immediately adjacent to the channel, but that steep slope flattens out as it proceeds toward the Hyatt House parking area. SUBJECT: Hyatt House - Special Use Flood Plain I have reviewed drawings Al, A2, A3, Cl, and C2, all dated 7/02/84 and all received 7/02/84, and offer the following comments: 1. Sheets Cl and C2 are similar to sheets Cl and C2 which were dated revised 4/05/84 and received on 4/10/84. 2. The plan presently proposes to remove approximately forty (40') feet of the existing parking area near Salt Creek at the far northeast portion of the property. As you recall, the initial submittal removed approximately seventy (70') feet. 3. This plan contemplates a two and one-half (2�") inch asphalt overlay over the existing parking area which should not measurably effect the Salt Creek Flood Plain or high water elevations. 4. Surface parking directly under the parking structure will be inundated with flood waters from depths ranging between zero (0') feet at the far northwest corner to two (2') feet along the northeasterly edge of the parking structure. Additionally, this plan proposes a flood depth of approximately 0.8 feet along the southwesterly wall adjacent to the banquette facilities; the previous plan had zero (0') feet along this wall. 5. This plan shows a new retaining wall around an existing lower level opening which is southeasterly of the truck dock area. The previous plans did not incorporate this retaining wall. 6. A note within the plan sheet needs to be revised from nine (9") inches of compacted stone to fourteen (14") inches of compacted stone. 7. The calculations on Sheet C2 state 0.23 acre feet of excess compensatory storage provided with this plan. 8. Should a special use in the flood plain be granted, it should be conditioned upon the applicant applying for and receiving a permit from the State of Illinois concerning same. The Brickman plan is significantly different than the Lindley plan, dated 10/28/83. As you know, the Lindley plan was submitted last October and was presented to various Village Boards as evidence to show that the Hyatt House will provide significant screening of its proposed improvements from the residences across the creek. The present Brickman plan does not provide the level of screening as contemplated within the previous Lindley plan. 2. I note that the Brickman plan contains many proposed large shade trees. Please note that shade trees do not provide any screening within the winter months. 3. Since screening of the hotel improvements was an important aspect of the overall plan, and since the Brickman plan does not contain the amount of screening as originally contemplated within the Lindley plan, I suggest that you revise the Brickman plan to provide for additional screening. I understand that a covenant is being generated to insure that the Hyatt House properly installs and maintains the necessary screening along Salt Creek. With regard to the Final Plat, the Attorney was directed to draft a resolution approving this plat, subject to removal of the house from the Northerly 9 acres within three (3) years or the issuance of a Certificate of Occupancy, whichever occurs first; the grant of a conservation easement to cover the entire North 9 acres and the Easterly .71 acres; the provision of bicycle path ease- ments as per the May 24, 1984 Plan Commission recommendation; the grant of an acceptable watercourse maintenance easement and other minor drafting items noted by the Village Engieer. Dear President Cerne and Trustees : The Board of Trustees adopted the following motion on March 27, 1984 : "To advise the applicant to file a plat consolidating the subject property with the abutting nine (9) acre parcel to the North, providing a Conservation/Recreation easement on same , and further that the applicant file the necessary documents relative to rezoning the North nine (9) acre parcel plus the easterly portion of the subject property from R-3 to ORA-2, and provide for the maintenance of land- scaping. " In response to this advice a consolidating plat of sub- division and a request to rezone the easterly tip of the original Hyatt property were filed on March 30 , 1984. In order to clarify a rather complicated record let me first summarize the actions which my client, Oak Brook Hotel Company, and the land trust holding title to the original Hyatt parcel are respectfully requesting that the Village take: 1. Approval of the plat of subdivision which would create a one lot subdivision, as recommended by the Plan Com- mission. The plat consolidates into one lot the original Hyatt lot and the 9 acre parcel which adjoins it on the north. Subsequent to the Village Board's last review of this subject, Hyatt has modified its application for a Text Amendment regarding Floor Area Ratio. The earlier application was for an amendment from the current .3 to .4 which would have permitted the presently proposed development only if the northerly property had been included in the floor area ratio calculations. At the Village Board's request, Hyatt has removed from consideration the northerly property and, therefore, their requested Text Amendment to the Floor Area Ratio standard is for a modification from .3 to .5. In the alternative, Hyatt has also applied for a Variation from the Floor Area Ratio standards to permit construction up to a .5 FAR. He noted that the Zoning Board of Appeals had previously reviewed portions of the current Hyatt applications, and that the current review has been requested by the Village Board due to the changed nature of portions of the development. He noted that the Plans prepared by Smith & Stevens, last revised December 20, 1983, notes a reduced scale of development including a reduction in ballroom size from 12,500 square feet to 7,500 square feet, total guest rooms reduced from 500 to 420, total addition reduced from 139,000 square feet to 80,000 square feet, total required parking reduced from 820 to 680 cars, reduction from 446 cars to 227 cars located in a parking structure. He also noted that the proposed parking structure, due to the reduced scale of development, has been brought back from the residential properties and since the parking structure has been lowered, enables a greater degree of screening of the parking structure. He noted that since the Zoning Board of Appeals had last reviewed this subject, an application had been filed for a Variation permitting an increase in compact car percentage from 5 percent to 33 percent and a reduction in aisles adjoining such compact cars to be reduced from 27 feet to 22 feet. Mr. West then made reference to his March 6, 1984 submittal which noted the particular parking history at the Hyatt indicating that approximately 53 percent of cars parked on the site are compact with a range from 40 percent to 68 percent for selected dates between September 7, 1983 and February 5, 1984. The current plans also indicate the location of 5 percent of the required parking spaces off site at First Federal. Although negotiations for the utilization of First Federal property for same have yet to be completed, plans are for a 3-year renewable lease. Furthermore, the proposed parking structure will be designed in order to handle those additional 37 parking spaces should the lease with First Federal ever expire. He noted that with regard to the Special Use Flood Plain application, the current plans note a lesser encroachment than those previously submitted. At the request of the Chairman, Mr. West read into the record portions of his January 29, 1984 letter which supports his requested Parking Variations. The Chairman requested, from the Secretary, a clarification regarding the provisions of Section VI(B) (2)(c) . The Secretary noted that such section governs " the application of zoning standards on a parcel of property divided by a Zoning District boundary line and, specifically, the current Hyatt property being split by a district boundary line separating ORA-2 from R-3 areas would be governed by such standard. He noted that previous variations had been granted to the Hotel including parking in front of the building adjacent to Harger Road and an FAR Variation increasing the permitted development from .3 to .3414. The Chairman noted that there were no members of the audience indicating support for the proposed applications. The following members of the audience indicated their opposition to the development: Roger McNider - 370 Forest Trail - Mr. McNider submitted a copy of the County Zoning Map dated April, 1957 which notes the Hyatt property as being zoned R-2. He noted that the Timber Trails Subdivision was being built in the 50's and that when the Hyatt property was joined to Oak Brook in 1958, it was zoned commercial. He noted that other hotels, including Stouffers and Marriott, are totally surrounded ' by commercial developments and, therefore, have no negative impact on residential properties as is the case with the Hyatt. The Drake Hotel only will touch residential properties as a result of the recently constructed York Woods Unit 5 development and, therefore, any persons buying a lot in the York Woods 5 development would be well aware of the neighboring commercial development. He noted that contrary to Village standards for a Variation, the Hyatt has proposed this expansion in order to "make more money" . Furthermore, the Hyatt has had various types of zoning relief in the past and, therefore, the present applications should be denied. He noted that he represents a majority of property owners in Timber Trails and made reference to a previously submitted petition noting opposition to the proposed expansion. The Secretary confirmed that such a technique could be utilized as was done by the Plan Commission on January 16. A motion was made by Member Bartecki to recommend to the President and Board of Trustees denial of the requested Special Use Flood Plain Permit due to the lack of pertinent engineering information as noted in Engineer Durfey's memo of January 12, 1984. Member Hodges suggested that perhaps the other applications should be handled first which would then make granting of a Special Use Flood Plain Permit a moot question.
