ORDINANCE NO. S-545
AN ORDINANCE GRANTING VARIATIONS FROM CERTAIN PROVISIONS
OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK, ORDINANCE NO. G-60,
AS AMENDED, RELATIVE TO COMPACT CAR PARKING REQUIREMENTS, AND
OFF-SITE PARKING, AND REPEALING A •VARIATION PREVIOUSLY GRANTED,

WHEREAS, on December 20, 1983 an application was filed with the Village
of Oak Brook requesting variations from certain provisions of the Zoning
Ordinance of the Village of Oak Brook -to allow an increase in the number of
allowable parking spaces for compact cars, a reduction in minimum aisle width for
aisles adjacent to compact car spaces only, and further requesting permission to
locate required accessory parking spaces off-site; and
WHEREAS, on January 10, 1984 the corporate authorities referred the
application to the Plan Commission for public hearing on the request for off-site
parking and to the Zoning Board of Appeals for public hearing on the variation
requests; and
WHEREAS, at the conclusion of its public hearing on January 16, 1984,
the Plan Commission recommended to the Village Board that the Applicant be
allowed to locate 37 required parking spaces off-site; and
WHEREAS, at the conclusion of its public hearing pursuant to notice on
March 6, 1984, the Zoning Board of Appeals recommended to the Village Board that
the request for the compact car and aisle width variation requests be denied; and
WHEREAS, the corporate authorities have considered the recommendations
of the Plan Commission and the Zoning Board of Appeals and deem all of the
foregoing requested variations to be consistent with the spirit and intent of the
Oak Brook Zoning Ordinance, in light of the unique circumstances attendant to the
subject property as set forth in the applicant's letter dated January 29, 1984
which is attached hereto and made a part hereof as Exhibit E;
WHEREAS, the variation which the corporate authorities granted pursuant
to Ordinance No. G-205 passed on January 11 , 1977, to permit a floor area ratio
of .3414 for the property commonly known as 1909 Spring Road, Oak Brook,
Illinois, is no longer required.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1 : That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That pursuant to Section %I (E)(2) of the Zoning Ordinance,
37 accessory parking spaces may be located in the Citicorp Savings (formerly
First Federal Savings) parking lot across Spring Road from the subject property,
provided that should the applicant, its successors or assigns for any reason be
unable to use this off-site parking area, the applicant, its successors or
assigns shall provide 37 spaces on-site in substantial conformity with the
Supplemental Site Plan (Sheet A2) prepared by Smith and Stephens Architects,
Inc. , as last revised July 2, 1984, a copy of which is attached hereto and made a
part hereof as Exhibit A, or such other on-site parking plan approved by the
corporate authorities.
Section 3: That variations are hereby granted from Appendix I of the
Zoning Ordinance of the Village of Oak Brook so as to allow for an increase in
the permitted number of compact car parking spaces from 5% of the total required
parking spaces to 33% of the total required parking spaces and to reduce the
required minimum aisle width for those aisles adjacent to compact car spaces only
from 27 feet to 22 feet subject to the conditions enumerated in Section 4 of this
Ordinance.
Section 4: That the variations herein granted are specifically subject
to the following conditions:

A. That the intial parking improvements on the subject property be
developed in substantial conformity with Site Plan (Sheet Al )
prepared by Smith and Stephens Architects, Inc. , as last revised
July 2, 1984, which Site Plan is attached hereto and made a part
hereof as Exhibit B.
B. That the portion of the parking area adjacent to Salt Creek be
landscaped in accordance with the landscape plan (Sheet 1 ) dated
July 2, 1984 and Section Elevation of Parking Lot Planting Screen
(Sheet 2) dated July 6, 1984, by Theodore Brickman Company, copies
of which are attached hereto, collectively labelled Exhibit C and
made a part hereof.
C. That if in the future the Village in its sole judgment shall
determine that the percentage of parking spaces designed for other
than compact cars is not adequate and must be increased to a
maximum not to exceed 95% of the total required parking spaces, the
Applicant, its successors or assigns will enlarge the proposed
parking structure pursuant to the Supplemental Site and Parking
Structure Plans (Sheet A3) prepared by Smith and Stephens, Inc. , as .
last revised July 2,1984,a copy of which is attached hereto and
made a part hereof as Exhibit D. Petitioner certifies that the
initial parking structure will have structural capacity for said
enlargement.
Section 5: That the property which the above variations are granted is
limited and restricted to the property commonly known as 1909 Spring Road, Oak
Brook, Illinois which property is legally described as follows:
Lot 1 in Oak Brook Hotel Company
Subdivision, being a subdivision
of part of Section 23, Township 39
North, Range 11 , East of the Third
Principal Meridian, in Du Page
County, Illinois.
Section 6: That Ordinance No. G-205 entitled "An Ordinance Granting a
Variation to Section X,(C)(3) of Ordinance No. G-60, As Amended, The Zoning
Ordinance of the Village of Oak Brook, Du Page and Cook Counties, Illinois To The
Territory Commonly Known as 1909 Spring Road, Oak Brook, Illinois" be and is
hereby repealed.
Section 7: That this Ordinance shall be in full force and effect from
and after its passage and approval pursuant to law.
