ORDINANCE NO. S- 546
AN ORDINANCE VACATING A PORTION OF THURLOW STREET AND ALL OF
NIAGARA STREET IN THE VILLAGE OF OAK BROOK, DU PAGE COUNTY, ILLINOIS
WHEREAS, the President and Board of Trustees of the Village of Oak
Brook have determined that the nature and extent of the public use and public
interest to be served is such as to warrant the vacation of a portion of Thurlow
Street and all of Niagara Street; and
Whereas, Section 11-91-1 of the Illinois Municipal Code requires that
an Ordinance vacating a street or alley must be passed by the affirmative vote of
three fourths (3/4) of the trustees then holding office; and
Whereas, it has been determined that the best interest of the Village
would be served by the vacation of the portion of Thurlow Street described herein
and all of Niagara Street;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE-VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That a portion of Thurlow Street in the Village of Oak
Brook, as described on the Vacation Plat thereof, attached hereto labelled
Exhibit "A" and hereby made a part hereof, be and the same is hereby vacated,
subject to the reservation of permanent easements set forth below. The portion
of Thurlow Street hereby vacated is legally described as:
That part of Thurlow Street as now platter and recorded ling South of
the Northerly line extended Easterly of Lot 5 in Wendel Woods
Resubdivision according to the Plat of said resubdivisior_ re--ord d June
4, 1976 as document No. R76-34909.
Section 2: That all of Niagara Street in the Village of Oak Brook, as
described on the Vacation Plat thereof, attached hereto labelled Exhibit "A" and
hereby made a part hereof, be and the same is hereby vacated, subject to the
reservation of permanent easements set forth below. Niagara Street hereby
vacated is legally described as:
Niagara Street lying West of the Easterly line of Lot 3 extended
Southerly in O'Brien's Resubdivision according to the Plat of said
resubdivision recorded July 17, 1970 as document No. R70-24259•
Section 3: That the Village of Oak Brook hereby reserves and retains a
permanent easement over all the property described in Sections 1 and 2 for public
utilities and drainage including any poles, wires, pipes, conduits, sewer mains,
water mains or any other facility or equipment for the maintenance and operation
of any public utility now or hereafter located in the above property.
Section 4: That this Ordinance shall be in full force and effect from
and after its passage and approval according to law. N m�
