S-549 - 12/11/1984 - AGREEMENT - Ordinances ORDINANCE NO. S- 549 AN ORDINANCE DECLARING THE POLICY OF THE VILLAGE OF OAK BROOK AGAINST DISCRIMINATION ON THE BASIS OF HANDICAPPED STATUS WHEREAS, the Revenue Sharing Act of 1972, as amended in 1976, included the handicapped discrimination prohibitions of Section 504 of the Federal Rehabilitation Act of 1973; and WHEREAS, pursuant to said legislation, local governments receiving. $25,000.00 or more in revenue sharing funds are required to make an initial notification to the public that they have a policy against handicapped discrimination, and that they have designated one individual or office to be responsible for coordinating the local efforts to comply with the local handicapped discrimination regulations, and WHEREAS, said legislation also requires local governments to adopt a grievance procedure to ensure the prompt and equitable review of handicapped discrimination complaints; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That the Village of Oak Brook hereby restates and reaffirms its policy that it does not discriminate on the basis of handicapped status in admission or access to, or treatment or employment in, its programs and activities. Section 3: That the Assistant to the Village Manager is hereby designated as the Village's contact to coordinate efforts to comply with those requirements of Section 51.55 of the Revenue Sharing Regulations which were published in the Federal Register on October 17, 1983. Section 51.55 prohibits discrimination against qualified individuals because of their handicapped status. Section 4: Complaints by any person alleging discrimination on the basis of handicapped status in admission or access to, or treatment or employment in the Village's programs and activities, shall be filed in writing with the Village Manager. The Village Manager shall investigate the complaint and attempt to concilate it. If concilation is not possible, the Village Manager shall, upon notice to all parties, convene a hearing within twenty-one (21) days from the date the complaint is filed. The complainant and the Village may present evidence and testimony at the hearing and may cross examine witnesses. A tape recording or verbatim transcript of the hearing shall be kept at the Village' s expense. Not later than fifteen (15) days after the conclusion of the hearing, the Village Manager shall make findings of fact and render a decision in writing. The manager shall notify all parties of this decision by mailing to them a copy of the findings of fact and decision by certified mail, return receipt requested. Within thirty (30) days of the date of said mailing, the complainant may appeal in writing the Village Manager' s decision to the President and Board of Trustees stating in detail the reasons for the appeal.. The President and Board of Trustees shall review the record of the hearing and shall render a decision in writing within thirty (30) days of the notice of appeal. The decision of the President and Board of Trustees shall be final. Section 5: That the Village Manager or his designee is hereby authorized and directed to initiate all steps necessary for compliance with the handicapped discrimination prohibitions of Section 504 of the Federal Rehabilitation Act of 1973, including but not limited to conducting a self- evaluation of the Village's programs, services, activities and policies to determine whether they comply with the handicapped discrimination regulations and preparing a transition plan to evaluate what, if any, structual alterations may be necessary to make programs accessible to handicapped persons.
