AN ORDINANCE GRANTING A FLOODPLAIN SPECIAL USE TO ALLOW
SURFACE PARKING WITHIN THE FLOOD PLAIN
PURSUANT TO' SECTION 10-34 OF THE CODE OF ORDINANCES
OF THE VILLAGE OF OAK BROOK, ILLINOIS
(2020 Clearwater Drive)
WHEREAS, on or about March 27, 1984 the corporate authorities passed
Ordinance No. S-521 entitled "An Ordinance Granting a Flood Plain Special Use to
Allow Construction of a Parking Structure and Additional Surface Parking within
the Flood Plain Pursuant to Section 10-34 of the Code of Ordinances of the
Village of Oak Brook, Illinois (2000 Clearwater Drive)"; and
WHEREAS, on or about March 27, 1984 the corporate authorities passed
Ordinance No. S-522 entitled "An Ordinance Granting Variations from the
Provisions of Appendix I of the Zoning Ordinance of the Village of Oak Brook,
Ordinance No. G-60 as Amended, Relative to Compact Car Parking Requirements (2000
Clearwater Drive)"; and
WHEREAS, the owner of 2000 Clearwater Drive, Oak Brook, Illinois,
Official Airline Guides (OAG) , has recently contracted to purchase adjacent
property commonly known as 2020 Clearwater Drive located to the south and west of
OAG's present property, subject to receiving certain zoning relief; and
WHEREAS, the availability of the adjacent property has caused OAG to
revise its plans for expansion of its office building and its parking facilities
by temporarily deferring construction of the proposed building addition and
parking structure at 2000 Clearwater Drive contemplated in Ordinance Nos. S-521
and S-522 and constructing additional surface parking facilities on the adjacent
parcel at 2020 Clearwater Drive; and
WHEREAS, OAG has petitioned the corporate authorities of the Village of
Oak Brook, DuPage and Cook Counties, Illinois for a flood plain special use
permit under Section 10-34 of the Code of Ordinances of the Village of Oak Brook
relating to flood plain and wetland regulations to permit the additional surface
parking; and
WHEREAS, the Plan Commission of the Village of Oak Brook has submitted
its recommendation to the Zoning Board of Appeals and to the President and Board
of Trustees; and
WHEREAS, a public hearing on such petition has been conducted by the
Zoning Board of Appeals of the said Village on February 5, 1985 pursuant to due
and appropriate legal notice; and
WHEREAS, the proposed use is consistent with the best use of the flood
plain; and
WHEREAS, the proposed use satisfies the requirements of and is
consistent with each of the factors set forth in Section 10-34(c) of the Code of
Ordinances of the Village of Oak Brook; and
WHEREAS, the corporate authorities of the Village of Oak Brook deem the
passage of this Ordinance to be in the best interest and in furtherance of the
general welfare of the Village of Oak Brook;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.

Section 2: That pursuant to Section 10-34 of the Code of Ordinances of
the Village of Oak Brook a flood plain special use permit is hereby granted to
allow construction of additional surface .parking within the Salt Creek Flood
Plain on property located at 2020 Clearwater Drive, Oak Brook, Illinois which
property is legally described as:
Lot 7 in Butler Company - M-1 Inc. Assessment Plat No. 3,
being a subdivision of part of the Southeast Quarter of
Section 23 and part of the Southwest Quarter of Section 24,
Township 39 North, Range 11 East of the Third Principal
Meridian, according to the Plat thereof recorded July 18, 1964
as Document No. R64-24070 in DuPage County, Illinois.

To be known as:
Official Airline Guides Resubdivision, being a resubdivision
of the Southwest Quarter of Section 24, Township 39 North,
Range 11, East of the Third Principal Meridian, in DuPage
County, Illinois.
Section 3: That the flood plain special use permit herein granted in
Section 3 of this Ordinance is expressly subject to the condition that the
improvements authorized herein be constructed in substantial conformance with
the Site Plan (Sheets l and 2) prepared by Smith & Stephens Architects, Inc.
dated February 21, 1985 a copy of which is attached hereto labeled Exhibit A and
made a part hereof.
Section 4: That this Ordinance shall be in full force and effect from
and after its passage and approval pursuant to law.

APPROVING PLAT OF ABROGATION DATED DECEMBER 14, 1983
WHEREAS, on or about April 24, 1984 the corporate authorities passed
Resolution No. R-366 entitled "A Resolution Approving the Final Plat of
Subdivision Known as Official Airline Guides Resubdivision"; and
WHEREAS, the said final plat prepared by Webster, McGrath and Carlson,
Ltd. , surveyors, and adopted by Resolution No. R-366 was not recorded with the
DuPage County Recorder of Deeds; and
WHEREAS, on or about December 17, 1984, Official Airline Guides (OAG)
applied for approval of a substantially different final plat prepared by Webster,
McGrath and Carlson, Ltd. , which encompasses property which Official Airline
Guides has recently contracted to purchase subject to receiving certain zoning
relief; and
WHEREAS, OAG wishes to withdraw the earlier plat; and
WHEREAS, an January 21, 1985 the Plan Commission of the Village of Oak
Brook recommended approval of the later final plat prepared by Webster, McGrath
and Carlson, Ltd. of the proposed Official Airline Guides Resubdivision; and
WHEREAS, OAG wishes to abrogate a six-foot utility easement which is
located along the southwesterly lot line separating the OAG property from the
adjacent property which OAG has contracted to purchase from the Butler Company;
and
WHEREAS, the Village President and Board of Trustees have considered
the recommendation of the Plan Commission and concur with same, subject to
certain conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows:
Section 1: That Resolution No. R-366 which approved the Final Plat of
Subdivision known as Official Airline Guides Resubdivision prepared by Webster,
McGrath and Carlson, Ltd. , surveyors, as revised and dated April 4, 1984 is
hereby repealed it its entirety.
Section 2: That the Final Plat of Subdivision known as Official
Airline Guides Resubdivision prepared by Webster, McGrath and Carlson, Ltd. ,
surveyors, as rOVIsed and dated February 20, 1985 be and is hereby approved
subject to the conditions enumerated in Section 3 of this Resolution.
Section 3: That the approval of the Final Plat of Subdivision of
Official Airline Guides Resubdivision as given in Section 2 hereof be and is
hereby expressly subject to the following conditions:
A. That the requirements of the Subdivision
Regulations for sidewalks and street lights are
waived in consideration for grant to the Village
of Oak Brook of the public bicycle and
pedestrian easements noted on the plat.
B. That the developer shall provide a .five-foot
wide strip for screening adjacent to the public
bicycle and pedestrian easement located along
the southwesterly property line.

McGrath and Carlson, Ltd. , surveyors, dated December 14, 1983 has been executed
by the utility companies, the Village President and Village Clerk are authorized
and
directed to execute said Plat of Abrogation, which Plat of Abrogation is hereby
approved.
Section 5: That all resolutions, rules and regulations of the Village
of Oak Brook which are in conflict with the provisions of this Resolution are
hereby repealed to the extent of such conflict.

The Village Board, at its meeting of February 26, 1985, gave final approval
to the OAG Resubdivision Plat, Flood Plain Special Use Permit and Plat of
Abrogation.
As I am sure you are aware, DuPage County will not record Plats following
issuance of property tax bills until such tax bills are paid in full. Therefore,
I feel it would be in both our interests to finalize all of the necessary
documents on a timely basis.
According to my records, the following is the status with respect to each of
the particular documents:
1) Subidivision Plat - The Village Board approved the Plat last revised
February 20, 1985 of which you have the Mylar. Please have this fully
executed and forwarded to this office.
2) Plats of Abrogation - Two Plats of Abrogation have now been approved by
the Village. The first one abrogated two separate 10-foot drainage and
utility easements located within the existing OAG property and was last
revised April 19, 1984. The second one approved at the February 26, 1985
meeting abrogated an existing 6-foot easement between the OAG property and
Lot 7 of the Butler Company M-1 Inc. Assessment Plat No. 3. Since the
Mylars for both of these plats are in your possession, please finalize all
necessary signatures and forward to this office for execution by the Village.

Dear President and Board of Trustees:
The Zoning Board of Appeals, at its regular meeting of February 5, 1985,
considered the application of Official Airline Guides for a Flood Plain
Special Use Permit for construction of a surface parking lot within the
Salt Creek Flood Plain. The property in question is presently occupied
by the former Hinsdale Sanitary District sewage treatment plant directly
South of the current Official Airline Guide property.
The Zoning Board of Appeals recommends to the President and Board of
Trustees approval of the requested Flood Plain Special Use Permit based
on the applicant's satisfortory response to the eleven factors contained
in the Village's Flood Plain Ordinance as well as testimony presented
indicating that the proposed improvements:
1) are so designed, located and proposed to be operated that the public
health, safety and welfare will be protected, and
2) will not cause substantial injury to the value of other property in
the neighborhood in which they are located.
This recommendation was made on a motion by Member Savino, seconded by
Member Crouch and approved on a Roll Call Vote of five (5) ayes: Members
Crouch, Fullan, Savino, Winters, Acting Chairman Bartecki; zero (0) nays.

Chairman Baroni noted his potential conflict of interest with this application
since the owner of Official Airline Guides, Dun & Bradstreet, is a client of his
accounting firm. Chairman Baroni then appointed Garry Bartecki as acting Chairman
for consideration of this application.
The Secretary noted that the required legal notice had been published in the Oak
Brook Doings January 17, 1985 and the surrounding property owners were notified of
this hearing on January 10, 1985.
David M. Gooder, Attorney for the applicant, made the following comments:
1 ) The property in question, which is the site of the old Hinsdale Sanitary
District Sewage Treatment Plant, is located directly Southwest of the current
Official Airline Guides parking lot.
2) The application is to construct surface parking and detention areas providing
adequately for all required compensatory and developmental storage.
3) A detention pond will also clear up existing ponding at the Clearwater curve.
4) The entire propertry is located within the fringe and not the floodway.
5) Official Airline Guides, in 1979, previously received a Flood Plain Special
Use permit from the Village for surface parking located directly North of the
subject parcel.
Mr. Pat Lynch, of Smith & Stevens architectural firm noted that the surface parking
lot will contain 389 standard size spaces and provide adequate space for
landscaping and a bike path along the Southerly edge of the property.
Mr. Bill Lindley, of Lindley & Sons, engineering firm, stated that an existing
storm sewer brings storm waters from properties East of York Road through the
Official Airline Guides property to Salt Creek. He noted that during storm
conditions, this storm sewer system presently causes ponding at the Clearwater
curve and also overflows into the existing Official Airline Guides parking lot. He
noted that the new parking lot will be constructed approximately 1 foot higher than
the existing lot and that the proposed detention pond will alleviate ponding caused
by the storm sewer back-up.
Acting Chairman Bartecki inquired as to the flood water depth in the proposed
parking lot.
Mr. Lindley stated that the existing parking lot, with no improvement to the
system, during a 100 year flood would result in a flood depth of 1 foot 1 inch and
would require 45 hours to drain. The proposed parking lot, as part of the overall
improvement, during a 100 year flood will exhibit flooding of 1 foot 1 inch and

require 32 hours to drain.
In response to Member Crouch, Mr. Lindley noted that the total storage volume of
the detention pond is approximately 2.06 acre feet.
In response to Member Savino, Mr. Lindley noted the following floodwater depths in
the detention pond for given storms: 6 month, 1 .2 feet; 1 year, 1 .4 feet; 2 year,
2.1 feet; 5 year, 2.7 feet; 10 year, 3.3 feet; 100 year storm, 3.9 feet (the
maximum pond depth).
In response to Member Winters, Mr. Lindley stated that the proposed pond would
first overflow into the old parking lot before backing up into Clearwater Drive,
noting that the new parking lot and Clearwater Drive will be established at
approximately the same elevation with the old lot being approximately 1 foot lower.
In response to Member Winters, Mark Kuntz noted proposed landscaping to include sod
along the five-to-one slopes of the detention pond with the bottom covered with
rock or a non-erodable material. The proposed detention pond will be approximately
90 to 130 feet in width.
Mr. Gooder noted that the present application is based on the alternate 2 site plan
which includes the 15 foot wide bike/landscaping area along the South property line
and also alleviates ponding on Clearwater Drive.
In response to Mr. Gooder, Mr. Lindley reconfirmed the responses to the eleven
factors contained in the Village's Flood Plain Ordinance, as attached to Mr.
Gooder's January 18, 1985 letter. He further noted that the previously noted
flooding of the parking lot is directly related to the gradual rise of Salt Creek
elevation following a storm noting that there would be advance warning of the
creek's rise and therefore adequate time to move cars parked in the lot.
In response to Acting Chairman Bartecki, Mr. Lindley stated that the proposed
State's dredging of Salt Creek would result in a minimum 1 foot reduction in the
High Water Level if the improvement is done to a point South of 22nd Street, and
therefore the Official Airline Guides parking lots would be flood free.
In response to Member Crouch, Lawrence Honeywell and Homer Brethauer, corporate
executives of Official Airline Guides, stated that their firm is presently leasing
50 off-site parking spaces and plans to utilize the proposed parking lot for future
expansion as well as current needs.
The Acting Chairman noted that there were no members of the audience expressing
support for or opposition to the proposed Flood Plain Special Use Permit.
Member Savino suggested that the creation of another detention pond might be unsafe
based on the Village' s recent experience with drownings in such ponds.

Chief Clark stated that a pond 4 feet in depth would not be a severe hazard due to
the gentle slopes involved. He further noted that landscape screening including
larger trees could be placed between the street and the pond to further increase
its safety.
Member Crouch noted that a small number of parking spaces at the Northwest corner
of the existing lot were located within the floodway.
Mr. Gooder explained that the original parking lot was constructed long before the
Village's Flood Plain regulations.
In response to Member Crouch, Village Attorney Dick Martens stated that the Village
could require removal of the existing spaces within the floodway if there was some
evidence presented that their location in the floodway was in some way injurious to
the public's health, safety and welfare.
Mr. Brethauer noted that there had never been any flooding of the parking spaces in
question.
Village Engineer, Dale Durfey stated the floodway boundary is a calculated boundary
line containing the moving portion of the flood and that it would be very difficult
to calculate the effect on the flood's velocity caused by parked cars.
A motion was made by Member Saving, seconded by Member Crouch, that the Zoning
Board of Appeals recommend to the President and Board of Trustees approval of the
requested Flood Plain Special Use Permit based on the applicant's satisfactory
response to the eleven factors contained in the Village's Flood Plain Ordinance
including statements to the effect that the proposed parking area, 1 ) is so
designed, located and proposed to be operated, that the public health, safety and
welfare will be protected, and, 2) will not cause substantial injury to the value

Plat of Abrogation
HISTORY
As you may recall, Official Airline Guides, in early 1984, received Village approval
of a Subdivision Plat and Flood Plain Special Use Permit for their property located
at 2000 Clearwater Drive. The map attached to my January 18, 1985 memo to the Plan
Commission notes that original parcel as well as the additional parcel to the South
which is presently under consideration.
Official Airline Guides has since purchased the old sewage treatment plant property
to be utilized for surface parking. The addition of this extra property results in
the need for a modified Subdivision Plat as well as additional flood plain relief.
SUBDIVISION PLAT
The modified Subdivision Plat, the most recent of which was received January 16,
1985, creates the consolidation of the existing OAG lot with the former sewage
treatment plant parcel.
The Plan Commission, at its January 21, 1985 meeting, recommended approval of this
Plat subject to provision of a 10-foot wide bicycle path easement overlaying the
public utility easement along the southwesterly and westerly borders of the property
as presently noted on the Plat. They further indicated that the required parking
lot landscaping along the southwesterly lot line be provided within a 5-foot wide
landscaping strip adjacent to the bike path and that no on-site perimeter land-
scaping be required adjacent to the Creek.
In the event the Village Board desires to approve this Subdivision Plat, it would
be appropriate to direct the Village Attorney to prepare the necessary resolution
containing any specific conditions for future consideration by the Village Board.

Both the Plan Commission at its January 21st meeting and the Zoning Board of Appeals
at its February 5th hearing recommended approval of the requested Flood Plain Special
Use Permit based on evidence presented indicating that the proposed parking lot is
designed so as not to negatively impact either surrounding property or the level of
Salt Creek during a flood.
In the event the Village Board desires granting of the requested permit, it would
be appropriate to direct the Village Attorney to prepare the necessary ordinance
for future consideration by the Board.

property. The enclosed Plat of Abrogation received February 7, 1985 proposes to
abrogate that easement. To my knowledge, Dale has yet to review this Plat and,
additionally, it has yet to be executed by NI Gas, Com. Ed. and the Hinsdale
Sanitary District. The Village's past practice has been to hold off on approving
such plats until such time as other effected utilities have executed the plat.

Gentlemen:
This will confirm that I have delivered to you on be-
half of Official Airline Guides, Inc. , eighteen (18) copies of
a second plat of abrogation entitled "Plat of Abrogation of the
6 Foot Drainage & Utilities Easement Described as the Southerly
6 Feet" of Lot 1 in OAG Subdivision recorded January 16, 1980,
as Document No. R80-04175.
This plat would abrogate an existing and unused utility
easement running along the southwesterly boundary of the present
OAG property between Clearwater Drive and Salt Creek. This plat
would supplement the Plat of Abrogation approved earlier which
abrogates certain easements along the line between the original
OAG property and the 1. 7 acre parcel acquired from the Butler
Company in 1979 .

RE: Official Airline Guides Resubdivision - Final Plat and Flood Plain Special Use
Dear President and Board of Trustees:
The Plan Commission, at its regular meeting of January 21, 1985, considered the
application of Official Airline Guides for the following:
1) One-lot Resubdivision Plat consolidating their existing parcel with the
lot directly to the southwest containing the former Hinsdale Sanitary
District sewage treatment plant.
2) Flood Plain Special Use Permit for construction of a surface parking lot
on the former sewage treatment plant parcel.
The Plan Commission recommends to the President and Board of Trustees approval
of the Resubdivision Plat as presented subject to the following:
1) Provision of a 10-foot bicycle path adjacent to the west side of the
property along Salt Creek with no requirement to provide screening.
2) Provision of a combination bicycle path/utility easement 10 feet in width
plus 5 feet of screening adjacent to the southwesterly property line.
3) Waiver of the requirement to install sidewalks in exchange for granting of
the above noted bicycle path easement.
This recommendation was made on a motion by Member Marcy, seconded by Member
Bushy and approved on a Roll Call Vote of four (4) ayes: Member Bushy, Marcy,
Sandstedt, Chairman Reynolds; zero (0) nays; three (3) absent: Members Antoniou,
Beard, O'Brien.

The Plan Commission further recommends to the President and Board of Trustees
approval of the requested Flood Plain Special Use Permit on the condition that
the Village approve the Subdivision Plat as recommended by the Plan Commission,
and based on the findings of fact that the proposed improvements:
1) are so designed, located and proposed to be operated that the public health,
safety and welfare will be protected, and
2) will not cause substantial injury to the value of other property in the
neighborhood in which they are located,
as evidenced by the applicant's response to the eleven factors contained on pages
635 and 636 of the Village Code.
This recommendation was made on a motion by Member Bushy, seconded by Member
Sandstedt and approved on a Roll Call Vote of four (4) ayes: Members Bushy, Marcy,
Sandstedt, Chairman Reynolds; zero (0) nays; three (3) absent: Members Antoniou,
Beard, O'Brien.

Mr. David Gooder, Attorney, was present representing this application.
Mr. Gooder noted that the Official Airline Guides property had, in 1979, received a
Flood Plain Special Use Permit for construction of additional surface parking on
their existing lot. In 1984, OAG applied for and received an additional Flood
Plain Special Use Permit and Subdivision Plat for various proposed additions to the
property. The documents relative to that application were finalized and ready to
be recorded. In the Fall of 1984, OAG purchased the old Hinsdale Sanitary District
sewage treatment plant property located directly southwest of OAG's property thus
requiring a resubmittal for both the Flood Plain Special Use Permit, for
construction of surface parking on this additional parcel, as well as a modified
Subdivision Plat.
Dale Durfey reviewed the various items contained in his memo of January 17, 1985
concerning the Plat and flood plain issues. With reference to the Plat, he made
the following comments:
1) The policy question concerning provision of a bike path easement along the
southwesterly and westerly borders of the property. Mr. Gooder noted that the
Butler Company owns Salt Creek and the adjacent creek banks and suggested that
it would be preferable to use the Salt Creek bank the entire distance from 22nd
Street to Harger Road for a bicycle path as opposed to using Clearwater Drive
and then cutting back along the edge of the OAG property to get back to the
Creek. Mr. Gooder further noted the negative impact created by a bicycle path
located on the western border negatively affecting existing landscaping and
parking in that area. Mr. Gooder further indicated the lack of need for
utility easements along the southwesterly and westerly borders, since all
properties are presently served by utilities. He noted that should utility
easements be required, his client would request permission to plant trees on
the utility easements, and if necessary, based on the condition that the owner
remove such trees at his own expense if the easement is required in the future.
He noted that the Village's Owners Certificate on a Subdivision Plat prohibits
the location of trees and other large structures in utility easements.
2) Necessary bike path easement documents will be resubmitted.
3) Iron pipes are in the process of being placed at all lot corners.
4) Relates to the placement of trees on utility easements.
Mr. Gooder related the particulars with respect to the Flood Plain Special Use
Permit request as follows:
The Flood Plain Special Use Permit has been applied for to enable construction of a
surface parking lot in place of the existing sewage treatment structures. Mark

Kuntz, engineer for the project, noted that the existing high water level at this
point is 657.8 and presently covers the majority of the property. Mr. Kuntz
proceeded to describe the proposed dry retention basin to be located between
Clearwater Drive and the parking area. This retention basin will also take care of
existing ponding both on Clearwater Drive and within the current parking lot.
In response to Mr. Gooder, Mr. Kuntz noted that the proposed parking improvements
are so designed, located and proposed to be operated that the public health, safety
and welfare will be protected and, further, that there will be no substantial
injury to the value of other property in the neighborhood in which these
improvements are located.
At Mr. Gooder's request, Chairman Reynolds directed that the applicant's response
to the eleven factors contained in the Village's Flood Plain Ordinance, as attached
to Mr. Gooder's letter of January 18, 1985, be physically included in these
minutes.
OFFICIAL AIRLINE GUIDES ("OAG")
MEMORANDUM IN SUPPORT
OF
REQUEST FOR SPECIAL USE FLOOD PLAIN
As required by Subsection(c) of Section 10-34 of the Oak Brook Code, OAG
urges that favorable findings be made as to each of the 11 factors specified in
Subsection(c) for the following reasons:
Factor #1. There will be no danger to life and property due to increased
flood heights or velocities caused by the planned parking lot and
regrading because on-site developmental and compensating flood
storage will be provided, the release rate will not exceed the
maximum rate permitted by the Hinsdale Sanitary District and the
existing flood stages of Salt Creek will remain unchanged.
Factor #2. There will be no danger that materials may be swept onto other
lands, or cross-stream, up-stream or downstream to the injury of
others because required flood storage will be provided and there
will be no storage of materials that could be floated or moved by
flood waters. The velocity of such waters in the direction of
stream flow will be zero.

Factor #3. No new water supply or sanitation systems are proposed and the
proposed parking lot development will have no effect on existing
water supply and sanitation systems, the level of which will be
maintained at or above the level of the 100-year flood.
Factor #4. The proposed facility, i.e. the proposed parking lot, has minimal
susceptibility to flood damage and there will be sufficient
warning so that vehicles temporarily parked can be moved in
adequate time to preclude any damage.
Factor #5. Development and use by OAG of the proposed parking facility will
make it possible for OAG to add additional office space outside
the flood plain and to defer constructing the parking structure
which was earlier planned to be constructed along with the next
expansion of the existing office facilities.
Factor #6. There is no other land on which OAG can build substantial
additonal parking except on land within the flood plain.
Factor P. The development of parking on Lot 7 will be compatible with
existing and future development in the area since (a) the OAG
development will be merely an extension to the south of OAG's
present parking; (b) at its south line it will abut the parking
area around the building now owned by Inland Real Estate; (c)
across Clearwater Drive to the east is the busy off-street loading
area serving Babson Bros. facility; and (d) to the southeast is
the parking area serving the office building at 2200 York Road.
Factor #8. The proposed use will become an integral part of the comprehensive
plan and flood plain management program for the area.
Factor #9. Safety of access in times of flood will not be a matter of concern
since no structures or buildings will be constructed on the site
which will require access during flooding and there will be
adequate time to move all vehicles prior to flooding.
Furthermore, there will be no interference with emergency service
to the office building since access to the building is not through
the site.
Factor #10. With regard to expected heights, velocity, duration, rate of rise
and sediment transport of flood water expected at the site, the
applicant states as follows:
(a) Flood heights - see information on Sheet 2.

(b) Velocity - there will be no change in stream velocity and
there will be zero velocity of flood waters on site in
direction of stream flow.
(c) Duration - since existing storm water storage will not be
diminished there will be no change in duration except in
the possible detention portions of the site which are to
be designed for the storage of flood water in a 100-year
flood. The parking areas will remain inundated for a
matter of hours as opposed to days.
(d) Rate of rise - This is dependent on the waterway opening
which will remain unchanged. In any event, there will be
adequate warning to provide time to remove all parked
vehicles. The site is not subject to flash flooding.
(e) Sediment transport - the development of the site will not
provide any additional transportable sediment since all
areas planned for development will be paved with an all-
weather hard surface or covered with well established
turf or non-erodable, soil stabilizing material.
Factor #11. In addition to providing adequate on-site storm water storage, the
development will provide an improved drainage system to the storm
water detention basin so as to relieve the present backwater
condition on Clearwater Drive during high storm water runoff
periods.
Mr. Kuntz made the following comments to Dale's points contained on page 2 of his
January 17, 1985 memo concerning the flood plain proposal:
1) Information.
2) Required information has yet to be submitted concerning connection of the
proposed storm sewer to the existing storm sewer in the northerly parking lot.
3) The storm sewer outfall will be sized based on Village requirements.
4) Parking area plans will be modified based on Village direction concerning the
bike trail/screening issue.

In response to Chairman Reynolds, Mr. Gooder noted that the previously approved
Variation permitting up to 30 percent compact cars with 22-foot aisles only applies
to the North lot.
In response to Member Bushy, Mr. Gooder noted that between 4-5 feet of fill will be
placed in the existing sludge pits, areas which require compensatory storage.
The Chairman noted that there were no members of the audience expressing support
for or opposition to the proposed applications.
A motion was made by Member Marcy, seconded by Member Bushy to recommend to the
President and Board of Trustees approval of the Resubdivision Plat as presented
subject to the following:
1) Provision of a 10-foot wide bicycle path adjacent to the west side of the

Flood Plain Special Use
I have reviewed the recently submitted documents and offer the following comments:
A. FINAL PLAT
1. The plat proposed a ten (10') foot strip adjacent to the westerly and
southwesterly lot line as a public bicycle} and pedestrian path easement,
which is in line with past Village Board recommendations on the previous
resubdivision application. As you know, this ten (10') foot strip is
usually allocated for parking lot screening materials; hence a conflict
with proposed bike trail construction. Along Salt Creek, this conflict
would be minimized should the Village receive an additional bike trail
easement from a property owner who owns the lot which contains Salt Creek.
However, on the southwesterly lot line, an adjoining commercial development
effectively eliminates additional room for a bike path due to its parking
lot screening and landscaping. Consideration should be given to either
deleting the bike path easement along the 'southwesterly lot line or negotia-
ting with the applicant a plan which would place the ten (10') foot area
adjacent to the lot line for bike trail construction and then additional
areas adjacent to that as parking lot screening, which would place the
parking lot edge at least fifteen (15') feet away from the lot line.
2. The public bicycle and pedestrian path easement document remains to be
submitted.
3. The plat should state that iron pipes are placed at all lot corners and
curve points.
4. David Gooder's letter of Janaury 16, 1985 requests that the reference
to the planting of trees as a restriction within the owner's certificate
be eliminated. The present subdivision code owner's certificate requires
this restriction that trees not be allowed within public utility easements;
hence the applicant's request so that he could plant trees within these
areas.
Regarding Mr. Gooder's reference to the 1 .11 22nd Street plat, I understand
that a major reason that the Village perm tted the removal of the tree
restriction was due to the elevated natur of the Tollway, which would

effectively rendor ground screening inadequate. In the present application,
elevated structures adjacent to the property do not exist.
B. FLOOD PLAIN SPECIAL USE
1. The applicant's calculations state that 8.96 acre feet of flood plain
exist on the property and 11.157 acre feet will exist .on the property
under proposed regrading.
2. The proposed storm sewer for the subject property is shown as being
connected to the existing storm sewer within the parking lot to the north.
This may present detention inadequacies; documentation must be submitted
regarding this connection.
3. The proposed six (6") inch storm sewer outfall appears to be too large
in relation to the detention characteristics of the site.
4. The limits of the parking area may be revised on the drawing when the
bike trail/screening conflict is addressed.
5. The applicant needs to address the eleven (11) points for flood plain
consideration.
6. The 100 year high water level of Salt Creek within this area is 657.8.
The proposed parking area will be approximately between the elevations of
656.0 and 654.8.

Gentlemen:
Since my client, OAG, was granted certain zoning vari-
ations by Ordinance No. S-522 adopted on March 27, 1984 , a special
use permit under the Village flood plain regulation by Ordinance
S-521 adopted on March 27, 1984 , and approval of a plat of resub-
division by Resolution R-366 adopted on April 24, 1984 , adjoining
land has become available on the `south of the west end of OAG' s
present property.
This property is presently owned by the Paul Butler
Estate and was formerly used by the Hinsdale Sanitary District
for a back-up sanitary treatment facility. OAG has made arrange-
ments, now being put in final form, to purchase this property.
The availability of this land has caused OAG to revise
its plans for expansion of its parking facilities. At the same
time the availability of office space in the new office building
at the south end of Swift Drive has made it possible for OAG to
defer the planned expansion of its office space. Thus OAG cur-
rently wishes only to construct additional parking facilities
on the land being acquired from the Butler Estate.
To make such construction possible, OAG has filed (a)
an application for a Special Use (Flood Plain) since substantially
all of the land being acquired is in the flood fringe of the Salt
Creek 100 year flood plain and (b) a Plat of Resubdivision to
consolidate the land to be acquired with the land presently owned

In support of the Special Use Application, OAG has

memorandum with regard to the 11 factors required to be considered

requirements where only one lot is to be created.

MEMORANDUM IN SUPPORT
OF
REQUEST FOR SPECIAL USE FLOOD PLAIN
As required by Subsection(c) of Section 10-34 of the
Oak Brook Code, OAG urges that favorable findings be made as to
each of the 11 factors specified in Subsection (c) for the following
reasons:
Factor #1. . There will be no danger to life and property
due to increased flood heights .or velocities
caused by the planned parking lot and regrading .
because on-site developmental and compensating
flood storage will be provided, the release rate
will not .exceed the maximum rate permitted by
the Hinsdale. Sanitary District and the existing
flood stages of Salt Creek will remain unchanged.
Factor #2 . There will be no danger that materials may be
swept onto .other lands, or cross-stream, up-
stream or downstream to the injury of others
because required flood storage will be provided
and there will be no storage of materials that
could be floated or moved by flood waters. The
velocity of such waters in the direction of
stream flow will be zero.
Factor #3. No new water supply or sanitation systems are
proposed and the proposed parking lot development
will have no effect on existing water supply and
sanitation systems, the level of which will be
maintained at or above the level of the 100-year
flood.
Factor #4 . The proposed facility, i.e. the proposed parking
lot, has minimal susceptibility to flood damage
and there will be sufficient warning so that
vehicles temporarily parked can be moved in ade-
quate time to preclude any damage.
Factor #5. Development and use by OAG of the proposed
parking facility will make it possible for OAG
to add additional office space outside the flood
plain and to defer constructing the parking struc-
ture which was earlier planned to be constructed
along with the next expansion of the existing office
facilities.

Factor #6. There is no other land on which OAG can build
substantial additional parking except on land
within the flood plain.
Factor V. The development of parking on Lot 7 will be com-
patible with existing and future development in
the area since (a) the OAG development will be
merely an extension to the south of OAG's present
. . parking; (b) at its south line it will abut the
parking area around the building now owned by
Inland Real Estate; (c) across Clearwater Drive
to the east is the busy off-street loading area
serving Babson Bros. facility; and (d) to the
southeast is the parking area serving the office
building at 2200 York Road.
Factor #8. The proposed .use will become an integral part
of the comprehensive plan and flood plain manage-
ment program for the area.
Factor #9. Safety of access in times of flood will not be a
matter of concern since no structures or buildings
will be constructed on the site which will re-
quire access during flooding and there will be
adequate time to move all vehicles prior to
flooding. Furthermore, there will be no inter-
ference with emergency service to the office building
since access to the building is not through the site.
Factor #10. With regard to expected heights, velocity, duration,
rate of rise and sediment transport of flood water
expected at the site, the applicant states as fol-
lows:
(a) Flood heights - see information on Sheet 2.
(b) Velocity - there will be no change in
stream velocity and there will be zero
velocity of flood waters on site in di-
rection of stream flow.
(c) Duration - since existing storm water
storage will not be diminished there will
be no change in duration except in the
possible detention portions of the site
which are to be designed for the storage
of flood water in a 100-year flood. The
parking areas will remain inundated for
a matter of hours as opposed to days.
(d) Rate of rise - This is dependent on the
waterway opening which will remain un-
changed. In any event, there will be
adequate warning to provide time to re-
move all parked vehicles. The site is not
subject to flash flooding.

(e) sediment transport - the development of
the site will not provide any additional
transportable sedimnt since all areas
planned for development will be paved with
an all-weather hard surface or covered
with well established turf or non-erodable,
soil stabilizing material.
Factor #11. In addition to providing adequate on-site storm
water storage., the development will provide an
improved drainage system to the storm watef:;detention
basin so as to relieve the present backwater con-
dition on Clearwater Drive .during high storm water
runoff periods.

Delivered herewith are eighteen (18) copies of an
alternate Sheet 2 for the site plan filed with the Village which
varies from the earlier site plan in the following respects:
1. The outlet for storm water to Salt Creek instead of
being through a 6" tile on Lot 7 is now through the
36" tile located on the present Official Airline Guides
property. The interconnection of the detention basin
and the 36" tile also makes it possible to drain storm
water run-off from the corner of Clearwater Drive.
This corner floods 2 or 3 times a year as a result of
heavy run-off of rain water from the Sunbeam property
and the Babson Bros. property. The change has been
engineered, however, so as to control the rate of dis-
charge into Salt Creek not to exceed the maximum
established by the Hinsdale Sanitary District.
20 The parking area at the south end of Lot 7 has been
adjusted to provide a 15 ' area to accommodate 5' of
landscaping and 10 ' for a utility/bicycle path ease-
ment.
3. The compact car parking initially provided in the second
aisle from the south has been converted to standard car
parking with 18 ' depth for each parking space and a 27'
aisle. All minor modifications in the parking area have
been made to accommodate these changes.

Dear President and Board of Trustees:
The Plan Commission, at its regular meeting of January 21, 1985, considered the
application of Official Airline Guides for the following:
1) One-lot Resubdivision Plat consolidating their existing parcel with the
lot directly to the southwest containing the former Hinsdale Sanitary
District sewage treatment plant.
2) Flood Plain Special Use Permit for construction of a surface parking lot
on the former sewage treatment plant parcel.
The Plan Commission recommends to the President and Board of Trustees approval
of the Resubdivision Plat as presented subject to the following:
1) Provision of a 10-foot bicycle path adjacent to the west side of the
property along Salt Creek with no requirement to provide screening.
2) Provision of a combination bicycle path/utility easement 10 feet in width
plus 5 feet of screening adjacent to the southwesterly property line.
3) Waiver of the requirement to install sidewalks in exchange for granting of
the above noted bicycle path easement.
This recommendation was made on a motion by Member Marcy, seconded by Member
Bushy and approved on a Roll Call Vote of four (4) ayes: Member Bushy, Marcy,
Sandstedt, Chairman Reynolds; zero (0) nays; three (3) absent: Members Antoniou,
Beard, O'Brien.

The Plan Commission further recommends to the President and Board of Trustees
approval of the requested Flood Plain Special Use Permit on the condition that
the Village approve the Subdivision Plat as recommended by the Plan Commission,
and based on the findings of fact that the proposed improvements:

Mr. David Gooder, Attorney, was present representing this application.
Mr. Gooder noted that the Official Airline Guides property had, in 1979, received a
Flood Plain Special Use Permit for construction of additional surface parking on
their existing lot. In 1984, OAG applied for and received an additional Flood
Plain Special Use Permit and Subdivision Plat for various proposed additions to the
property. The documents relative to that application were finalized and ready to
be recorded. In the Fall of 1984, OAG purchased the old Hinsdale Sanitary District
sewage treatment plant property located directly southwest of OAG's property thus
requiring a resubmittal for both the Flood Plain Special Use Permit, for
construction of surface parking on this additional parcel, as well as a modified
Subdivision Plat.
Dale Durfey reviewed the various items contained in his memo of January 17, 1985
concerning the Plat and flood plain issues. With reference to the Plat, he made
the following comments:
1) The policy question concerning provision of a bike path easement along the
southwesterly and westerly borders of the property. Mr. Gooder noted that the
Butler Company owns Salt Creek and the adjacent creek banks and suggested that
it would be preferable to use the Salt Creek bank the entire distance from 22nd
Street to Harger Road for a bicycle path as opposed to using Clearwater Drive
and then cutting back along the edge of the OAG property to get back to the
Creek. Mr. Gooder further noted the negative impact created by a bicycle path
located on the western border negatively affecting existing landscaping and
parking in that area. Mr. Gooder further indicated the lack of need for
utility easements along the southwesterly and westerly borders, since all
properties are presently served by utilities. He noted that should utility
easements be required, his client would request permission to plant trees on
the utility easements, and if necessary, based on the condition that the owner
remove such trees at his own expense if the easement is required in the future.
He noted that the Village's Owners Certificate on a Subdivision Plat prohibits
the location of trees and other large structures in utility easements.
2) Necessary bike path easement documents will be resubmitted.
3) Iron pipes are in the process of being placed at all lot corners.
4) Relates to the placement of trees on utility easements.
Mr. Gooder related the particulars with respect to the Flood Plain Special Use
Permit request as follows:
The Flood Plain Special Use Permit has been applied for to enable construction of a
surface parking lot in place of the existing sewage treatment structures. Mark

Kuntz, engineer for the project, noted that the existing high water level at this
point is 657.8 and presently covers the majority of the property. Mr. Kuntz
proceeded to describe the proposed dry retention basin to be located between
Clearwater Drive and the parking area. This retention basin will also take care of
existing ponding both on Clearwater Drive and within the current parking lot.
In response to Mr. Gooder, Mr. Kuntz noted that the proposed parking improvements
are so designed, located and proposed to be operated that the public health, safety
and welfare will be protected and, further, that there will be no substantial
injury to the value of other property in the neighborhood in which these
improvements are located.
At Mr. Gooder's request, Chairman Reynolds directed that the applicant' s response
to the eleven factors contained in the Village's Flood Plain Ordinance, as attached
to Mr. Gooder's letter of January 18, 1985, be physically included in these
minutes.

MEMORANDUM IN SUPPORT
OF
REQUEST FOR SPECIAL USE FLOOD PLAIN
As required by Subsection(c) of Section 10-34 of the Oak Brook Code, OAG
urges that favorable findings be made as to each of the 11 factors specified in
Subsection(c) for the following reasons:
Factor #1. There will be no danger to life and property due to increased
flood heights or velocities caused by the planned parking lot and
regrading because on-site developmental and compensating flood
storage will be provided, the release rate will not exceed the
maximum rate permitted by the Hinsdale Sanitary District and the
existing flood stages of Salt Creek will remain unchanged.
Factor #2. There will be no danger that materials may be swept onto other
lands, or cross-stream, up-stream or downstream to the injury of
others because required flood storage will be provided and there
will be no storage of materials that could be floated or moved by
flood waters. The velocity of such waters in the direction of
stream flow will be zero.

Factor #3. No new water supply or sanitation systems are proposed and the
proposed parking lot development will have no effect on existing
water supply and sanitation systems, the level of which will be
maintained at or above the level of the 100-year flood.
Factor #4. The proposed facility, i.e. the proposed parking lot, has minimal
susceptibility to flood damage and there will be sufficient
warning so that vehicles temporarily parked can be moved in
adequate time to preclude any damage.
Factor #5. Development and use by OAG of the proposed parking facility will
make it possible for OAG to add additional office space outside
the flood plain and to defer constructing the parking structure
which was earlier planned to be constructed along with the next
expansion of the existing office facilities.
Factor A. There is no other land on which OAG can build substantial
additonal parking except on land within the flood plain.
Factor P. The development of parking on Lot 7 will be compatible with
existing and future development in the area since (a) the OAG
development will be merely an extension to the south of OAG's
present parking; (b) at its south line it will abut the parking
area around the building now owned by Inland Real Estate; (c)
across Clearwater Drive to the east is the busy off-street loading
area serving Babson Bros. facility; and (d) to the southeast is
the parking area serving the office building at 2200 York Road.
Factor #8. The proposed use will become an integral part of the comprehensive
plan and flood plain management program for the area.
Factor #9. Safety of access in times of flood will not be a matter of concern
since no structures or buildings will be constructed on the site
which will require access during flooding and there will be
adequate time to move all vehicles prior to flooding.
Furthermore, there will be no interference with emergency service
to the office building since access to the building is not through
the site.
Factor #10. With regard to expected heights, velocity, duration, rate of rise
and sediment transport of flood water expected at the site, the
applicant states as follows:

(b) Velocity - there will be no change in stream velocity and
there will be zero velocity of flood waters on site in
direction of stream flow.
(c) Duration - since existing storm water storage will not be
diminished there will be no change in duration except in
the possible detention portions of the site which are to
be designed for the storage of flood water in a 100-year
flood. The parking areas will remain inundated for a
matter of hours as opposed to days.
(d) Rate of rise - This is dependent on the waterway opening
which will remain unchanged. In any event, there will be
adequate warning to provide time to remove all parked
vehicles. The site is not subject to flash flooding.
(e) Sediment transport - the development of the site will not
provide any additional transportable sediment since all
areas planned for development will be paved with an all-
weather hard surface or covered with well established
turf or non-erodable, soil stabilizing material.
Factor #11. In addition to providing adequate on-site storm water storage, the
development will provide an improved drainage system to the storm
water detention basin so as to relieve the present backwater
condition on Clearwater Drive during high storm water runoff
periods.
Mr. Kuntz made the following comments to Dale's points contained on page 2 of his
January 17, 1985 memo concerning the flood plain proposal:
1) Information.
2) Required information has yet to be submitted concerning connection of the
proposed storm sewer to the existing storm sewer in the northerly parking lot.
3) The storm sewer outfall will be sized based on Village requirements.
4) Parking area plans will be modified based on Village direction concerning the
bike trail/screening issue.

In response to Chairman Reynolds, Mr. Gooder noted that the previously approved
Variation permitting up to 30 percent compact cars with 22-foot aisles only applies
to the North lot.
In response to Member Bushy, Mr. Gooder noted that between 4-5 feet of fill will be
placed in the existing sludge pits, areas which require compensatory storage.
.., The Chairman noted that there were no members of the audience expressing support
for or opposition to the proposed applications.
A motion was made by Member Marcy, seconded by Member Bushy to recommend to the
President and Board of Trustees approval of the Resubdivision Plat as presented
subject to the following:
1) Provision of a 10-foot wide bicycle path adjacent to the west side of the

SUBJECT: Official Airline Guides Resubdivision - Final Plat and
Flood Plain Special Use
As you may recall, Official Airline Guides, in early 1984, received Village approval
of a Subdivision Plat and Flood Plain Special Use Permit for the property indicated
on the attached map as the "original property". That application included con-
struction of a parking deck and surface parking within the Salt Creek Flood Plain.
Subsequent to the Village's approval of that previous application, Official Airline
Guides purchased the old sewage treatment plant located directly southwest of the
original property to be utilized for surface parking. The addition of this extra
property resulted in the need for a modified subdivision plat as well as additional
flood plain relief for construction of a surface parking lot on this new piece of
property.

Flood Plain Special Use
I have reviewed the recently submitted documents and offer the following comments:
A. FINAL PLAT
1. The plat proposed a ten (10') foot strip adjacent to the westerly and
southwesterly lot line as a public bicycle and pedestrian path easement,
which is in line with past Village Board recommendations on the previous
resubdivision application. As you know, this ten (10') foot strip is
usually allocated for parking lot screening materials; hence a conflict
with proposed bike trail construction. Along Salt Creek, this conflict
would be minimized should the Village receive an additional bike trail
easement from a property owner who owns the lot which contains Salt Creek.
However, on the southwesterly lot line, an adjoining commercial development
effectively eliminates additional room for a bike path due to its parking
lot screening and landscaping. Consideration should be given to either
deleting the bike path easement along the southwesterly lot line or negotia-
ting with the applicant a plan which would place the ten (10') foot area
adjacent to the lot line for bike trail construction and then additional
areas adjacent to that as parking lot screening, which would place the
parking lot edge at least fifteen (15') feet away from the lot line.
2. The public bicycle and pedestrian path easement document remains to be
submitted.
3. The plat should state that iron pipes are placed at all lot corners and
curve points.
4. David Gooder's letter of Janaury 16, 1985 requests that the reference
to the planting of trees as a restriction within the owner's certificate
be eliminated. The present subdivision code owner's certificate requires
this restriction that trees not be allowed within public utility easements;
hence the applicant's request so that he could plant trees within these
areas.
Regarding Mr. Gooder's reference to the 1111 22nd Street plat, I understand
that a major reason that the Village permitted the removal of the tree
restriction was due to the elevated nature of the Tollway, which would

effectively rendor ground screening inadequate. In the present application,
elevated structures adjacent to the property do not exist.
B. FLOOD PLAIN SPECIAL USE
1. The applicant's calculations state that 8.96 acre feet of flood plain
exist on the property and 11.157 acre feet will exist .on the property
under proposed regrading.
2. The proposed storm sewer for the subject property is shown as being
connected to the existing storm sewer within the parking lot to the north.
This may present detention inadequacies; documentation must be submitted
regarding this connection.
3. The proposed six (6") inch storm sewer outfall appears to be too large
in relation to the detention characteristics of the site.
4. The limits of the parking area may be revised on the drawing when the
bike trail/screening conflict is addressed.
5. The applicant needs to address the eleven (11) points for flood plain
consideration.
6. The 100 year high water level of Salt Creek within this area is 657.8.
The proposed parking area will be approximately between the elevations of
656.0 and 654.8.

Gentlemen:
Since my client, OAG, was granted certain zoning vari-
ations by Ordinance No. ' S-522 adopted on March 27, 1984 , a special
use permit under the Village flood plain regulation by Ordinance
S-521 adopted on March 27, 1984 , and approval of a plat of resub
division by Resolution R-366 adopted on April 24, 1984, adjoining
land has become available on the south of the west end of OAG' s
present property.
This property is presently owned by , the PaUl. Butler
Estate and was formerly used by the Hinsdale Sanitary District
for a back-up sanitary treatment facility. OAG has made arrange-
ments, now being put in final form, to purchase this property.
The availability of this land has caused OAG to revise
its plans for expansion of its parking facilities. At the same
time the availability of office space in the new office building

at the south end of Swift Drive has made it possible for OAG to
defer the planned ,expansion of its office space. Thus OAG cur-
rently wishes only to construct additional parking facilities
on the land being acquired from the Butler Estate.
To make such construction possible, OAG has filed (a)
an application for a Special Use (Flood Plain) since substantially
all of the land being acquired is in the flood fringe of the Salt
Creek 100 year flood plain and (b) a Plat of Resubdivision to
consolidate the land to be acquired with the land presently owned

In support of the Special Use Application, OAG has
filed the necessary plats and plans and has attached hereto a
memorandum with regard to the 11 factors required to be considered

parking area around the 'building now owned by
Inland Real Estate; (c) .4cross Clearwater Drive
to the east is the busy off-street loading area
serving Babson Bros. facility; and (d) to the
southeast is the parking area serving the office
building at 2200 York Road.
Factor #8. The proposed use will become an integral part
of the comprehensive plan and flood plain manage-
ment program for the area.
Factor #9 . Safety of access in times of flood will not be a
matter of concern since no structures or buildings
will be constructed on the site which will re-
:quire access during flooding and there will be
adequate time to move all vehicles prior to
flooding. Furthermore, there will be no inter-
ference with emergency service to the office building
since access to the building is not through the site.
Factor #10. With regard to expected heights, velocity, duration,
rate of rise and sediment transport of flood water
expected at the site, the applicant states as fol-
lows:
(a) Flood heights - see information on Sheet 2.
(b) Velocity - there will be no change in
stream velocity and there will be zero
velocity of flood waters on site in dir.
rection of stream flow.
(c) Duration - since existing storm water
storage will not be diminished there will
be no change in duration except in the
possible detention portions of the site
which are to be designed for the storage
of flood water in a 100-year flood. The
parking areas will remain inundated for
a matter of hours as opposed to days.
(d) Rate of rise - This is dependent on the
waterway opening which will remain un-
changed. In any .event, there will be
adequate warning to provide time to re-
move all parked vehicles. The site is not
subject to flash flooding.

(e) Sediment transport - the development of
the site will not provide any additional
transportable sediment since all areas
planned for development will be paved with '
an all-weather hard surface or covered
with well established turf or non-erodable, ,
soil stabilizing material.
Factor #11. In addition to providing adequate on-site storm
water storage, the development will provide an
improved drainage system to the stormn.,water_.detention
basin sous to relieve the present backwater con-
dition on Clearwater Drive during high storm water
runoff periods.

NOTICE IS HEREBY GIVEN that a public hearing before the Zoning Board of Appeals
of the Village of Oak Brook, DuPage and Cook Counties , Illinois , will be held
on February 5 , 1985 at 7 : 30 P.M. in the Oak Brook Village Hall , 1200 Oak

Variation is limited to• the minimum change necessary to overcome the inequality

1. A Variation recognizes that the same district ,requirements do not affect all

erties to enjoy equal opportunities with properties similarly zoned. You must
prove that your land is affected'by: special citcumstances or unusual conditions.
These must result in uncommon hardship and unequal treatment under the strict ap-

erties a Variation cannot be granted. The remedy for general hardship is a change
of the map or"the text of the Zoning Ordinance. ..
2. You must prove that the combination of the Zoning Ordinance and the uncommon
conditions of your property prevents you from making any reasonable use of .your
land as permitted by your present zoning district. Since zoning regulates land and
not people, the, following conditions cannot be considered-pertinent to the applica-
tion for a Variation: (1) Proof' that a Variation would increase the financid1 re-
turn from the land, (2) Personal hardship, (3) Self-imposed hardship. In the last
case, the recognition of conditions created after the enactment of the Zoning Ordi-
nance would encourage and condone violation of the law.
3. No Variation may be granted which would adversely affect surrounding property
or.the general neighborhood. All Variations must be in harmony with the intent and
purposes of the Zoning Ordinance.
