AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF
SECTION XI(E)(7)(ii) OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK,
ORDINANCE G-60, AS AMENDED, RELATIVE TO PERMITTED PARKING
IN FRONT OF THE BUILDING
(Evangelical Health Systems - 2025 Windsor Drive)
WHEREAS, an application has been filed requesting a variation from the
provisions of Section XI(E)(7) (ii) of the Oak Brook Zoning Ordinance, Ordinance
G-60, as amended, which section pertains to the number of parking spaces
permitted in front of the building; and
WHEREAS, the Zoning Board of Appeals, on January 15, 1985, recommended
denial of the applicant's request to construct 38 additional parking spaces in
front of the building in addition to the six permitted spaces resulting in a
total of 44 parking spaces in front of the building; and
WHEREAS, the applicant amended its application by reducing the number of
additional parking spaces in front of the building from 38 to 9 and by
withdrawing its request for a variation to permit off-street parking closer to
the street line than permitted by ordinance; and
WHEREAS, the evidence presented indicates that the building on the subject
property has been readapted to its present office use and further that the
subject property is an irregularly shaped triangular parcel which is generally
bounded by public rights-of-ways on all three sides; and
WHEREAS, the corporate authorities find that the amended variation requested
meets the applicable standards of Section XIII(G)(4) of the Oak Brook Zoning
Ordinance and that the unique configuration of the subject property poses a
genuine hardship to development of the property in strict compliance with the Oak
Brook Zoning Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are
hereby adopted as if fully set forth herein.
Section 2: That a variation is hereby granted from the provisions of
Section XI (E)(7) (ii) of the Zoning Ordinance of the Village of Oak Brook so as to
allow the construction of nine (9) additional parking spaces in front of the
building at 2025 Windsor Drive, Oak Brook, Illinois, thereby making a total of
fifteen (15) parking spaces in front of said building, provided that the nine (9)
new spaces are constructed with a stall depth of `18 feet and an aisle of 27 feet
and otherwise constructed in substantial conformity with the Plans drawn by Legat
Architects as dated May 7, 1985 (Sheets C-1,L-1, A-1 and A-2) which is attached
hereto as Exhibit A and incorporated by reference, including the installation of
earth berms and plantings.
Section 3: That this Ordinance is limited and restricted to the property
located at 2025 Windsor Drive, Oak Brook, Illinois, which property is legally
described as:
Lot 1 in Packard Instrument Company, Inc. , Assessment Plat,
being a Subdivision in the Southeast Quarter of Section 24,
Township 39 North, Range 11 East of the Third Principal
Meridian, according to the Plat thereof recorded February 14,
1962 as Document R62-4169 in DuPage County, Illinois.

Section 4: That this Ordinance shall be in full force and effect from and
after its passage and approval as provided by law and supercedes Ordinance No.
S-553.

building.
As directed by the Board, I have forwarded a copy of the revised Site Plans,
received May 7, 1985, to Trustee Joe Rush for his further review of this subject.
As of this date, Joe has yet to indicate the adequacy of these plans.

On January 15, 1985, the Zoning Beard of Appeals recommended denial of the
parking variation as presented, and at the petitioner's request, this
matter was tabled at the Regular Meeting of January 22, 1985 to allow for
time for the applicant to rework their parking proposal.

To approve the request for a Variation to locate nine (9) additional
parking spaces for a total of fifteen (15) spaces in front of the building,

SUBJECT: Evangelical Health Systems - Parking Variation
RECOMMENDATION: That the Village Board consider the modified Parking Layout.
The Village Board, at its meeting of January 22, 1985, tabled this matter for a
period of sixty .days based on the applicant's desire to rework their parking pro-
posal.
The revised site plan and letter received March 19, 1985, describe their proposed
modifications. Specifically, the previous application had been for construction of
44 parking spaces in front of the building, 38 spaces more than the six permitted.
Furthermore, these spaces were located to within 10 feet of the Windsor and Bliss
Drive rights-of-way, whereas, a 25 foot separation is required.
The current proposal calls for an additional 9 spaces for a total of 15 spaces in
front of the building. This parking area has also been relocated further from the
rights-of-way in order to conform with the 25 foot required separation.
In the event the Village Board decides to grant the requested variation permitting
9 additional parking spaces in front of the building, the site plan should be modi-
fied to indicate an 18 foot stall depth and a 27 foot aisle.

Re: Evangelical Health Systems Parking Variation
Dear Mr. Rapff:
Evangelical Health Systems wishes to revise their
submittal regarding their application for a variance to
the parking ordinances.
The present submittal adds 38 parking spaces to the six
existing in front of the building resulting in a total of
44 spaces. These spaces are located 10 feet from the
Windsor and Bliss Drive rights-of-way.
The revised submittal adds only nine parking spaces to the
six resulting in a total of fifteen spaces in front of the
building. These spaces are located 30 feet from the
Windsor and Bliss Drive rights-of-way, in order to meet
the 25 foot required setback.
In addition, �various berming and landscaping features will
be added in front of the building, screening the proposed
parking.) Also, if the variation is granted, Evangelical
intends to bring other areas of the existing parking lot
up to the Village Code including the installation of a
concrete curb around the existing pavement as well as
leasing a 10 foot wide strip from the Tollway along the
rear of the property in order to provide the required 10
foot separation between the parking lot and the rear lot
line.
At the scheduled Village Board Meeting on March 26, 1985,
Evangelical Health Systems will present the revised layout
as summarized above. Attached are twenty copies of the
revised submittal. Please forward a copy of the new
submittal to each of the Board Members for review.

was given for the denial was based on the fact that we could not show
a hardship and/or uniqueness regarding our present parking situation.

request a continuance to review any and all options that we may wish
to pursue regarding this issue. We are considering several redesigns
and layout changes as well as several other possible alternatives.
We would appreciate your cooperation regarding this matter and would
be very grateful if a sixty (60) day continuance would be granted.

I would refer you to my memo of January 10, 1985 to the Zoning Board of Appeals
for more specifics as well as history concerning this property and the variations
being requested.
As noted in that memo, this property has previously requested a similar variation
and was initially turned down by both the Zoning Board of Appeals and the Village
Board. Subsequently, the Village Board voted to reconsider its denial and re-
referred the matter back to the Zoning Board of Appeals. The applicant later
withdrew the application for various unstated reasons.
The current proposal as well as justification for the variations presented at
the January 15, 1985 ZBA hearing were basically identical to that presented in
1981.
In the event the Village Board decides to grant the requested variations, it
would be appropriate to direct the Village Attorney to prepare the necessary
ordinance for approval by the Board at a subsequent meeting.

The Zoning Board of Appeals, at its Special Meeting of January 15, 1985,
considered the application of Evangelical Hospital Corp. for the following
parking variations from the provisions of Section XI(E) (7) (ii) :
1) Permission to construct 38 additional parking spaces in front of the
building in addition to the six permitted resulting in a total of 44
parking spaces in front of the building.
2) Permission to construct the above 44 parking spaces to within 10 feet
of the Bliss and Windsor Drive rights of way which is in violation of
the requirement that parking in front of the building be not less than
25 feet from a street line.
The Zoning Board of Appeals recommends to the President and Board of Trustees
denial of both of the above variations for reasons that the petitioner did not
show the uniqueness of the property and failed to show adequate hardship
justifying the variations.
This recommendation was made on a motion by Member Savino, seconded by Member
Winters and approved on a Roll Call Vote of six (6) ayes: Members Bartecki,
Crouch, Fullan, Savino, Winters, Chairman Baroni; zero (0) nays.

The Chariman noted that the attorney for the applicant is requesting a continuance

V EVANGELICAL HOSPITAL CORP. - PARKING VARIATIONS (2025 Windsor Drive)
The Secretary noted that the required Legal Notice was published in the Oak Brook
DOINGS on December 20, 1984 and surrounding property owners were notified of this
hearing on December 14, 1984.
Peter Kroll and Casey Frankovich, Architect, were present representing this
application.
Mr. Kroll made the following comments concerning their proposal:
1) Evangelical purchased the property in 1980.
2) Documents prepared by the realtor prior to purchase noted 250 parking stalls,
although no physical count was made to verify the number.
3) Following purchase, a count was made and it was determined that only 197
parking stalls existed.
4) During the course of the next year, Evangelical experienced numerous parking
problems due to the insufficient number.
5) Since that time, they have attempted to utilize car pool incentives, off-site
parking as well as purchased vans for use by employees to offset the lack of
parking spaces.
6) In 1981, Evangelical approached the Village for a similar variation which was
denied.

7) Since that time, they have brought many areas of the building into compliance
with current Village codes.
Casey Frankovich described the proposed parking layout noting that it adds 38
parking spaces to the six existing in front of the building resulting in a total of
44 spaces in front of the building. These spaces will be located 10 feet from the
Windsor and Bliss Drive rights of way instead of the 25-foot required separation.
Mr. Frankovich described various berming and landscaping features which will be
added in front of the building, screening the proposed parking from public view.
He also noted that if the variation is granted, Evangelical intends to improve
other areas of the existing parking lot to Village code including installation of a
concrete curb around existing pavement as well as leasing a 10-foot wide strip from
the Tollway along the rear of the property in order to provided the required 10-
foot separation between the parking lot and the rear lot line.
In response to Member Crouch, Mr. Kroll noted that the parking lot now contains 203
parking spaces.
In response to Member Bartecki, Mr. Frankovich stated that making provisions for 30
percent compact cars would not increase the number of spaces under any possible
parking layout.
Chairman Baroni inquired as to the purpose of obtaining a lease from the Tollway
for the 10-foot strip at the rear of the property.
The Secretary noted that the current paved parking lot extends up to the rear lot
line adjacent to the Illinois Tollway and that current zoning standards require a
10-foot separation between a parking area and side or rear lot lines.
In response to Member Savino, Mr. Kroll indicated that their present operation
locates approximately 65-70 percent of their work force in this building. He noted
that Tuesdays and Thursdays are critical time periods when visitors attend meetings
at this building. He also noted that during a 2-3 month survey of the parking lot,
at any one time there were only 2-3 parking stalls vacant.
In response to Member Savino, Mr. Kroll noted their particular hardship being the
inability to expand existing departments in the building due to a lack of parking
space available.
Chairman Baroni noted that the variation request centers around the mistake made
prior to the original purchase, since someone did not physically count the number
of parking spaces existing.
In response to Chairman Baroni, Mr. Kroll stated that they had investigated suing
the realtor for the mistake, although were advised against following that course of
action.

Chairman Baroni briefly discussed the Windsor Office Plaza property directly
adjacent to this property and noted that the Village may have mistakenly granted a
variation for parking in front of that building.
Mr. Kroll also noted that they presently have rented 14 stalls at the Sunbeam
property, although due to proposed redevelopment of that property, that situation
may change.
Chairman Baroni noted that in addition to a request to install 38 additional
parking spaces in front of the building, they are also requesting permission to
locate these spaces 10 feet from the property line instead of the 25-foot
separation required.
Mr. Frankovich stated that that was required due to the physical constraints of the
site and that adequate landscaping would be provided within that 10-foot wide strip
adjacent to Windsor and Bliss Drives.
Member Crouch noted that when the property was owned by Searle and Western
Electric, the property apparently contained up to 250 parking spaces.
Mr. Kroll noted that those previous parking layouts had angled parking in the rear
of the property with a very narrow aisle. Evangelical brought that situation into
compliance by eliminating parking spaces, changing the format to a parallel parking
layout.
The Chairman noted that there were no members of the audience expressing support
for or opposition to the proposed Variations.
Chairman Baroni inquired as to whether the existing planting areas between parking
bays created a substantive problem.
Mr. Frankovich noted that elimination of the planting areas would not allow
creation of another row of parking, noting that elimination of the plantings or
going to more compact stalls would simply add more width to the aisle.
A motion was made by Member Savino, seconded by Member Winters that the Zoning
Board of Appeals recommend to the President and Board of Trustees denial of the
requested parking variations which would place an additional 38 parking spaces in
front of the building to within 10 feet of the Bliss and Windsor Drive rights of
way for reasons that the petitioner has not shown the uniqueness of the site or
provided an adequate showing of hardship which would justify granting of the
variations.

APPLICATION IN GENERAL:
Evangelical Hospital Corp. has made application to construct 44 parking spaces in
front of their corporate headquarters located at the northeast corner of Windsor
and Bliss Drives.
SPECIFIC ZONING RELIEF: '
Section XI(E) (7) (ii) of the Zoning Ordinance permits the location of:
"Not more than 10 percent of the required off-street parking spaces
not to exceed 6 spaces may be located in front of the building or
along the side of the building adjoining a street not less than
25 feet from a street line."
As noted on the November 26, 1984 Site Plan, the existing 6 parking spaces located
in front of the building are proposed to be replaced by 44 spaces, this being 38
more than permitted.
In addition, these spaces are proposed to be approximately 10 feet from both the
Windsor and Bliss Drive rights of way instead of the required 25-foot separation.
HISTORY:
The Village of Oak Brook, beginning in 1981, considered a similar request by
Evangelical for parking in front of their building. I have attached pertinent
portions of that file for your further review.
Specifically, the Zoning Board of Appeals recommended denial of placing 39
additional parking spaces in front of the building similar in design to the current
request, at their meeting of November 3, 1981.

Subsequently, the Village Board, at its meeting of November 10, 1981, concurred with
the Zoning Board of Appeals and denied the requested variation.
At its meeting of November 24, 1981, the Village Board voted to reconsider its earlier
denial and, at the applicant's request, referred this petition back to the Zoning Board
of Appeals for further consideration. It was the understanding at that meeting that
the applicant would, in some way, modify the request. This matter was never reheard
by the Zoning Board of Appeals, as the applicant, on April 2, 1982, formally withdrew
its request.

As you may recall, the Zoning Board of Appeals at their November 3, 1981
regular meeting made a unanimous recommendation to the Village Board of
Trustees denial of this requested Parking Variation.
The Village Board, at their November 10, 1981 meeting, initally concurred
with that recommendation and voted to deny the requested variation.
However, the Village Board, at their November 24, 1981 meeting, voted to
reconsider their prior action of denial and referred the variation petition
back to the Zoning Board of Appeals for a second hearing on the matter.
The following plans have been added to your file which were received
subsequent to your last hearing. The plan sheet dated as received
December 16, 1981 was presented by the petitioner to the Zoning Board
at their November meeting. This plan sheet was different than previously
submitted plans in that it indicated an addition of only 31 additional
spaces for a total of 37 in front of the building, and also, indicated no
additional curb cuts for this additional parking.
There are two plan sheets dated as received December 15, 1981 which were
shown to the Village Board at their November 10, 1981 meeting, one of which
is a smaller scale of the December 16 plan sheet, while the other plan
indicates existing parking as contained on adjoining properties.

a Zoning Amendment as drafted by the Village Attorney and incorporating
certain listed changes. Detailed discussion was held on the procedures
and impact of the development and the intensity of land use, with Mr. Dave
Gooder, representing the petitioner being give the opportunity to make a
brief presentation.
The Zoning Board of Appeals did not act on the application concerning the
granting of a Special Use for the conversion of the Seminary building
into fifty-three (53) Townhouses.

The Zoning Board of Appeals at its November 3, 1981 regular meeting considered
the petition of the Evangelical Hospital Association for a Variation from the
front yard parking provisions of the Zoning Ordinance in an ORA-1 Zoning
District, Section XI (E) (7) (ii) .
The specific variation requested was to allow the construction of up to 39
additional parking spaces in the front yard which would be in addition to
the existing six spaces which are permitted by ordinance.
The Zoning Board of Appeals recommends to the Village Board of Trustees

The Secretary noted for the record that the legal notice for this application was
published in the Oak Brook DOINGS on October 15, 1981 and that surrounding property
owners were notified on October 14, 1981.
Mr. Peter Ernst and Mr. Carl Lundgren representing Evangelical Hospital Association
described the basis of the requested Parking Variation.
The applicant originally purchased the property on the basis of an incorrect real estate
listing which stated the existing parking to be approximately 250 spaces. After the
property had been purchased, the applicant, in dealing with the Building Department,
determined that there were a number of encroachments of the existing parking on
surrounding properties. In an attempt to comply with Village Ordinances, ERA reduced
their actual existing parking from 222 down to approximately 209. Their present problem,
as described by the applicant, is that they require additional parking for a number of
their employees who are presently located in Regency Towers due to this lack of parking
space. The applicant has attempted, without success, to lease parking space from
surrounding property owners.
Member Muschler inquired as to the specific hardship which would not be considered to
' be self-imposed.
Mr. Ernst stated that perhaps the hardship was self-made, but that all of the records
reviewed by the applicant before and after purchase of the property indicated the
existence of 250 parking spaces. Mr. Ernst submitted Exhibit 1 which was a real estate
listing as prepared by Hawthorn Realty Group for the subject property. He further
stated that the proposed additional spaces in front of the building would be heavily
bermed and screened from Windsor and Bliss Drive.
Mr. Lundgren also stated that EHA had spent approximately $1.75 million on renovating
the entire building in order to bring it more closely into compliance with Village codes.
Fire Chief Clark stated that this property is now approximately 95 per cent in compliance
with Village standards.
Mr. Ernst further stated that relative to the Zoning Board's standards that if the
Variation were granted, it would not alter the essential character of the locality.
Chairman Baroni noted that there were no members of the audience expressing either
approval or disapproval of the requested Parking Variation.
There being no further discussion, a motion was made by Member Muschler, seconded by
Member Reynolds to recommend to the Village Board of Trustees denial of the requested
Variation from the provisions of Section XI (E) (7) (ii) regarding permitted off-street

The application before you is for a variation from the zoning standards
to permit the addition of 32-39 additional parking spaces in front of
the building. They are specifically requesting relief from Section XI
(E) (7) (ii) which states that (On any lot in ORA-1 or ORA-2 Office-
Research-Assembly District, and an 0-3 Office District, not more than
10 per cent of the required off-street parking spaces, not to exceed
6 spaces, may be located in front of the building or along the side of
the building adjoining the street, not less than 25 feet from a street
line or 50 feet from the street lines of Cermak and York Road) .
This building presently has 6 parking spaces in front of the building
as permitted by the ordinance. The proposed additional spaces would
result in a total of between 38 and 51 total spaces in front of the
building.
I have attached a chart for your review which details the history of
this building since its construction showing the various uses of the
structure as well as a comparison between the required parking spaces
and those which were shown on the site plan at that particular time.
I have also attached a copy of the most recent Zoning Certificate for
this property issued to the Evangelical Hospital Association on May 9,
1980 which states that there were at that time 222 existing parking
spaces as opposed to the 250 spaces used by Searle, Inc.
It is my understanding that the Evangelical Hospital Association reduced
their total number of spaces initially to 222 in 1980 and later to 209 as
indicated by the current plans in order to bring their parking closer in
to compliance with current zoning standards regarding widths and separations.
Appendix II of the Zoning Ordinance contains other standards specifically
concerning access driveways from streets to off-street parking and loading
spaces. Paragraph (2) (b) (2) of Appendix II states that the radius connecting
the street pavement edge with the driveway edge shall be "not less than 8
feet at the intersection of a driveway and a street pavement in a street

having a right-of-way of 66 feet or less in width". The plans as submitted
give no indication as to the radius at the intersection of the driveway with
the street.
Paragraph 3 of Appendix II states that "The acute angle formed at the inter-
section of driveway and street pavement edges shall be not less than 60
degrees. The required turning angle for a vehicle entering or leaving a
driveway shall not exceed 90 ,degrees". This standard appears to be contradic-
tory in that if a driveway were placed at 60 degrees from the street edge of
pavement, there are instances where the required turning angle for a vehicle
either entering or leaving such driveway would be 120 degrees. As such, a
determination should be made as to the purpose of this paragraph.
Paragraph 4 of Appendix II states that the "Spacing between separate driveway
entrances on a lot (measured center to center at the lot line adjoining a
street) shall be no less than 40 per cent of the length of the lot line
adjoining the street, or 400 feet, whichever is less". Forty per cent of
the lot line along Bliss Drive is equal to 194 feet. The proposed separation
between the two driveways entering on Bliss Drive is' 95 feet, and as such,
is in conflict with this paragraph.
An alternate approach would be for the applicant to forego this additional
parking entrance off of Bliss Drive.
The plan which indicates an addition of 39 parking spaces is acceptable under
Paragraph 4, as no new driveway entrances off of Bliss Drive have been added.
You also have in your folder two additional Site Plans (Scheme A and Scheme
B) which were received by the Village October 29, 1981. Due to their late
date of submittal to the Village, they have only received a preliminary
review. As such, there are presently two additional problems with the two
schemes as submitted:
1. Scheme A shows the addition of 44 new parking spaces in front of the
building, for a total of 50. The plans as originally submitted on
September 29, 1981 showed the addition of a maximum of 39 additional
parking spaces. The legal notice as published on October 15, 1981
states that the applicant was requesting permission for "the construc-
tion of up to 39 off-street parking spaces which is in addition to the
existing 6 parking spaces". To the extent that Scheme A proposes the
addition of a greater number of parking spaces than is noted in the
legal notice, the Zoning Board of Appeals, as of this date, would be
unable to take action on such a scheme without the republication of a
revised legal notice.

2. Both schemes are in violation of Section IX (E) (7) (ii) regarding a
minimum separation of 25 feet from a street line (ROW) . The separation
as noted on both of the schemes is only 5 feet.
In addition, I have attached copies of Ordinances Nos. S-239 and S-271 which
are, as far as I can determine, the only instances in which variations have
been granted by the Village to allow additional parking within a front yard.
S-239 pertains to the property .at 721 Enterprise Drive.which has a "flagpole '
connection to Enterprise, although this lot's greatest portion of frontage is
actually on 22nd Street. The 22 parking spaces which were permitted in the
variation are along the Westerly portion of the lot and, as noted, they were
restricted from placing any additional parking within the 100 foot setback
from 22nd Street.
Ordinance S-271 relates to the property at 1818 Swift Drive. This lot is
configured similarly to the Enterprise Drive property in that its connection
to Swift Drive is by a "flagpole".
The justification behind the granting of each of these variations appears to
have been based partly on the fact that parking within the front yard of each
of the lots would be a good distance from any Village right-of-way as caused
by the fact that each of the lots are connected to such right-of-ways by long
"flagpole" entrance drives.
Additionally, concerning the Enterprise Drive parcel any parking as required
by Village ordinance which would have been placed in either the side or rear
yards would have been much more visible from 22nd Street.
The application before you would appear not to be justified by either of the
variations which have just been described.

Whereas, a public hearing pursuant to said request has been
held by the' Zoning Board of Appeals of the Village of Oak Brook;

Whereas, the said Zoning Board of Appeals has recommended
that the variation be granted subject to certain conditions agreed .
to by the owners of the subject realty; and

A Variation is a zoning adjustment which permits minor changes of district require-
ments where individual properties are both harshly and uniquely burdened by the
strict application of the law. The power to vary is restricted and the degree of
Variation is limited to the minimum change necessary to overcome the inequality
inherent in the property.
1. A Variation recognizes that the same district requirements do not affect all
properties equally; it was invented to permit minor changes to allow hardship prop-
erties to enjoy equal opportunities with properties similarly zoned. You must
prove that your land is affected by special circumstances or unusual conditions.
These must result in uncommon hardship and unequal treatment under the strict ap-
plication of the Zoning Ordinance. Where hardship conditions extend to other prop-
erties a Variation cannot be granted. The remedy for general hardship is a change
of the map or the text of the Zoning Ordinance.
L You must prove that the combination of the Zoning Ordinance and the uncommon
conditions of your property prevents you from making any reasonable use of your
land as permitted by your present zoning district. Since zoning regulates land and
not people, the following conditions cannot be considered pertinent to the applica-
tion for a Variation: (1) Proof that a Variation would increase the financial re-
turn from the land, (2) Personal hardship, (3) Self-imposed hardship. In the last
case, the recognition of conditions created after the enactment of the Zoning Ordi-
nance would encourage and condone violation of the law.
3. No Variation may be granted which would adversely affect surrounding property
or the general neighborhood. All Variations must be in harmony with the intent and
purposes of the Zoning Ordinance.

10, 1981, and approve the Final Plat of Henrikson's Resubdivision, subject

B. Recommendation - Zoning Amendment - Whitehall Park
On July 20, 1981 the Plan Commission recommended approval of the requested
Zoning Amendment and Special Use in accordance with certain listed conditions.
On November 3, 1981, the Zoning Board of Appeals recommended approval of
a Zoning Amendment as drafted by the Village Attorney and incorporating
certain listed changes. Detailed discussion was held on the procedures
and impact of the development and the intensity of land use, with Mr. Dave
Gooder, representing the petitioner being give the opportunity to make a
brief presentation.
The Zoning Board of Appeals did not act on the application concerning the
granting of a Special Use for the conversion of the Seminary building
into fifty-three x(53) Townhouses.

That this matter be referred back to the Zoning Board of Appeals for
further consideration.

The Chairman noted that the applicant, by letter dated February 23, 1982, is

SUBJECT: Evangelical Hospital Association - Parking Variation
As you may recall, the Zoning Board of Appeals at.their November 3, 1981
regular meeting made a unanimous recommendation to the Village Board of
Trustees denial of this requested Parking Variation.
The Village Board, at their November 10, 1981 meeting, initally concurred
with that recommendation and voted to deny the requested variation.
However, the Village Board, at their November 24, 1981 meeting, voted to
reconsider their prior action of denial and referred the variation petition
back to the Zoning Board of Appeals for a second hearing on the matter.
The following plans have been added to your file which were received
subsequent to your last hearing. The plan sheet dated as received
December 16, 1981 was presented by the petitioner to the Zoning Board
at their November meeting. This plan sheet was different than previously
submitted plans in that it indicated an addition of only 31 additional
spaces for a total of 37 in front of the building, and also, indicated no
additional curb cuts for this additional parking.
There are two plan sheets dated as received December 15, 1981 which were
shown to the Village Board at their November 10, 1981 meeting, one of which
is a smaller scale of the December 16 plan sheet, while the other plan
indicates existing parking as contained on adjoining properties.

F. Evangelical Hospital Association - Parking Variation
On November 10, 1981, the 'Board of Trustees concurred with the recommendation
of the Zoning Board of Appeals and denied the request for a parking variation
in the front yard of the subject property.

The Village of Oak Brook authorize a tax abatement of $600,000.00 of the 1982
tax to be levied for the Sports Core Bond set by ordinance at $912,050.00
representing a 69% reduction in 1982 taxes; and that the Village Attorney be
directed to prepare the necessary ordinance for action at the next regular.

B. Liquor License Request - The French Baker

The Zoning Board of Appeals at its November 3, 1981 regular meeting considered
the petition of the Evangelical Hospital Association for a Variation from the
front yard parking provisions of the Zoning Ordinance in an ORA-1 Zoning
District, Section XI (E) (7) (ii) .
The specific variation requested was to allow the construction of up to 39
additional parking spaces in the front yard which would be in addition to
the existing six spaces which are permitted by ordinance.
The Zoning Board of Appeals recommends to the Village Board of Trustees
denial of this requested Variation, as the petitioner was unable to prove
hardship.
This motion was approved on a Roll Call Vote of five (5) ayes, Members
Fullan, Muschler, Reynolds, Savino, Chairman Baroni; zero (0) nays; two (2)
absent, Members Crouch, Hodges.

V EVANGELICAL HOSPITAL ASSOCIATION - PARKING VARIATION
The Secretary noted for the record that the legal notice for this application was
published in the Oak Brook DOINGS on October 15, 1981 and that surrounding property
owners were notified on October 14, 1981.
Mr. Peter Ernst and Mr. Carl Lundgren representing Evangelical Hospital Association
described the basis of the requested Parking Variation.
The applicant originally purchased the property on the basis of an incorrect real estate
listing which stated the existing parking to be approximately 250 spaces. After the
property had been purchased, the applicant, in dealing with the Building Department,
determined that there were a number of encroachments of the existing parking on
surrounding properties. In an attempt to comply with Village Ordinances, EHA reduced
their actual existing parking from 222 down to approximately 209. Their present problem,
as described by the applicant, is that they require additional parking for a number of
their employees who are presently located in Regency Towers due to this lack of parking
space. The applicant has attempted, without success, to lease parking space from
surrounding property owners.
Member Muschler inquired as to the specific hardship which would not be considered to
be self-imposed.
Mr. Ernst stated that perhaps the hardship was self-made, but that all of the records
reviewed by the applicant before and after purchase of the property indicated the
existence of 250 parking spaces. Mr. Ernst submitted Exhibit 1 which was a real estate
listing as prepared by Hawthorn Realty Group for the subject property. He further
stated that the proposed additional spaces in front of the building would be heavily
bermed and screened from Windsor and Bliss Drive.
Mr. Lundgren also stated that ERA had spent approximately $1.75 million on renovating
the entire building in order to bring it more closely into compliance with Village codes.
Fire Chief Clark stated that this property is now approximately 95 per cent in compliance
with Village standards.
Mr. Ernst further stated that relative to the Zoning Board's standards that if the
Variation were granted, it would not alter the essential character of the locality.
Chairman Baroni noted that there were no members of the audience expressing either
approval or disapproval of the requested Parking Variation.
There being no further discussion, a motion was made by Member Muschler, seconded by
Member Reynolds to recommend to the Village Board of Trustees denial of the requested
Variation from the provisions of Section XI (E) (7) (ii) regarding permitted off-street
parking in the front yard as the petitioner was unable to prove hardship.

SUBJECT: Evangelical Hospital Association - Parking Variation -
(2025 Windsor Drive)
The application before you is for a variation from the zoning standards
to permit the addition of 32-39 additional parking spaces in front of
the building. They are specifically requesting relief from Section XI
(E) (7) (ii) which states that (On any lot in ORA-1 or ORA-2 Office-
Research-Assembly District, and an 0-3 Office District, not more than
10 per cent of the required off-street parking spaces, not to exceed
6 spaces, may be located in front of the building or along the side of
the building adjoining the street, not less than 25 feet from a street
line or 50 feet from the street lines of Cermak and York Road) .
This building presently has 6 parking spaces in front of the building
as permitted by the ordinance. The proposed additional spaces would
result in a total of between 38 and 51 total spaces in front of the
building.
I have attached a chart for your review which details the history of
this building since its construction showing the various uses of the
structure as well as a comparison between the required parking spaces
and those which were shown on the site plan at that particular time.
I have also attached a copy of the most recent Zoning Certificate for
this property issued to the Evangelical Hospital Association on May 9,
1980 which states that there were at that time 222 existing parking
spaces as opposed to the 250 spaces used by Searle, Inc.
It is my understanding that the Evangelical Hospital Association reduced
their total number of spaces initially to 222 in 1980 and later to 209 as
indicated by the current plans in order to bring their parking closer in
to compliance with current zoning standards regarding widths and separations.
Appendix II of the Zoning Ordinance contains other standards specifically
concerning access driveways from streets to off-street parking and loading
spaces. Paragraph (2) (b) (2) of Appendix II states that the radius connecting
the street pavement edge with the driveway edge shall be "not less than 8
feet at the intersection of a driveway and a street pavement in a street

having a right-of-way of 66 feet or less in width". The plans as submitted
give no indication as to the radius at the intersection of the driveway with
the street.
Paragraph 3 of Appendix II states that "The acute angle formed at the inter-
section of driveway and street pavement edges shall be not less than 60
degrees. The required turning angle for a vehicle entering or leaving a
driveway shall not exceed 90 degrees". This standard appears to be contradic-
tory in that if a driveway were placed at 60 degrees from the street edge of
pavement, there are instances where the required turning angle for a vehicle
either entering or leaving such driveway would be 120 degrees. As such, a
determination should be made as to the purpose of this paragraph.
Paragraph 4 of Appendix II states that the "Spacing between separate driveway
entrances on a lot (measured center to center at the lot line adjoining a
street) shall be no less than 40 per cent of the length of the lot line
adjoining the street, or 400 feet, whichever is less". Forty per cent of
the lot line along Bliss Drive is equal to 194 feet. The proposed separation
between the two driveways entering on Bliss Drive is- 95 feet, and as such,
is in conflict with this paragraph.
An alternate approach would be for the applicant to forego this additional
parking entrance off of Bliss Drive.
The plan which indicates an addition of 39 parking spaces is acceptable under
Paragraph 4, as no new driveway entrances off of Bliss Drive have been added.
You also have in your folder two additional Site Plans (Scheme A and Scheme
B) which were received by the Village October 29, 1981. Due to their late
date of submittal to the Village, they have only received a preliminary
review. As such, there are presently two additional problems with the two
schemes as submitted:
1. Scheme A shows the addition of 44 new parking spaces in front of the
building, for a total of 50. The plans as originally submitted on
September 29, 1981 showed the addition of a maximum of 39 additional
parking spaces. The legal notice as published on October 15, 1981
states that the applicant was requesting permission for "the construc-
tion of up to 39 off-street parking spaces which is in addition to the
existing 6 parking spaces". To the extent that Scheme A proposes the
addition of a greater number of parking spaces than is noted in the
legal notice, the Zoning Board of Appeals, as of this date, would be
unable to take action on such a scheme without the republication of a
revised legal notice.

2. Both schemes are in violation of Section IX (E) (7) (ii) regarding a
minimum separation of 25 feet from a street line (ROW) . The separation
as noted on both of the schemes is only 5 feet.
In addition, I have attached copies of Ordinances Nos. S-239 and S-271 which
are, as far as I can determine, the only instances in which variations have
been granted by the Village to allow additional parking within a front yard.
S-239 pertains to the property at 721 Enterprise Drive which has a "flagpole
connection to Enterprise, although this lot's greatest portion of frontage is
actually on 22nd Street. The 22 parking spaces which were permitted in the
variation are along the Westerly portion of the lot and, as noted, they were
restricted from placing any additional parking within the 100 foot setback
from 22nd Street.
Ordinance S-271 relates to the property at 1818 Swift Drive. This lot is
configured similarly to the Enterprise Drive property in that its connection
to Swift Drive is by a "flagpole".
The justification behind the granting of each of these variations appears to
have been based partly on the fact that parking within the front yard of each
of the lots would be a good distance from any Village right-of-way as caused
by the fact that each of the lots are connected to such right-of-ways by long
"flagpole" entrance drives.
Additionally, concerning the Enterprise Drive parcel any parking as required
by Village ordinance which would have been placed in either the side or rear
yards would have been much more visible from 22nd Street.
The application before you would appear not to be justified by either of the
variations which have just been described.

Whereas, .the owner of the property more particularly herein-
after described has petitioned the corporate authorities of the
Village of Oak Brook for a variation to the rules and regulations
of "The Zoning Ordinance of the Village of Oak Brook, Illinois, of
1966" , as amended, with respect to the front yard parking require-
ments in an R-2 Zoning District; and
Whereas, a public hearing pursuant to said request has been
held by the Zoning Board of Appeals of the Village of Oak Brook;
and
Whereas, the said Zoning Board of Appeals has recommended
that. the variation be granted subject to certain .conditions agreed
to by• the owners of the subject realty; and
Whereas, the President and Board of Trustees of the Village of
Oak Brook concur in said recommendation and are of the opinion that
a variation should be granted;
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of t'ze Village of Oak Brook, DuPage County, Illinois, as
follows:
Section 1. That the applicable rules and regulations of "The
Zoning Ordinance of the Village of Oak Brook, Illinois, of 1966" ,
as amended, contained in Section XI, E, 7, are hereby varied per-
mitting the construction, maintenance an operation of twenty-two
(22) _.parking spaces instead of six (JEY spaces in accordance with the
owners' proposed site plan dated June 10, 1971, and provided further
that no additional parking be established within• the 100 foot set-
back from 22nd Street on the subject realty.
Section 2. The real estate effected hereby is legally described
as, to-wit:

G. Chicago Association of Commerce & Industry "Grand Award" - Fire Department
Fire Chief Clark presented the plaque awarded for the overall Fire
Prevention Program conducted during the year 1981, having also
received the same honor in 1980. Further commentary was made
on the Sprinkler Ordinance and Life Safety Code, and the communi-
cations between the Fire Prevention Bureau and Elementary School
District 53 over a period of several months. This preceeded
the passing of a proposed resolution urging the School Board to
follow the recommendations of the Fire Prevention Bureau.

adjustments for Fire Chief, Finance Officer and Assistant

MONTH, WITH ZONING BOARD PUBLIC HEARING TO FOLLOW.
A Variation is a zoning adjustment which permits minor changes of district require-
ments where individual properties are both harshly and uniquely burdened by the
strict application of the law. The power to vary is restricted and the degree of
Variation is limited to the minimum change necessary to overcome the inequality
inherent in the property.
1. A Variation recognizes that the same district requirements do not affect all
properties equally; it was invented to permit minor changes to allow hardship prop-
erties to enjoy equal opportunities with properties similarly zoned. You must
prove that your land is affected by special circumstances or unusual conditions.
These must result in uncommon hardship and unequal treatment under the strict ap-
plication of the Zoning Ordinance. Where hardship conditions extend to other prop-
erties a Variation cannot be granted. The remedy for general hardship is a change
of the map or the text of the Zoning Ordinance.
2. You must prove that the combination of the Zoning Ordinance and the uncommon
conditions of your property prevents you from making any reasonable use of your
land as permitted by your present zoning district. Since zoning regulates land and
not people, the following conditions cannot be considered pertinent to the applica-
tion for a Variation: (1) Proof that a Variation would increase the financial re-
turn from the land, (2) Personal hardship, (3) Self-imposed hardship. In the last
case, the recognition of conditions created after the enactment of the. Zoning Ordi-
nance would encourage and condone violation of the law.
3. No Variation may be granted which would adversely affect surrounding property
or the general neighborhood. All Variations must be in harmony with the intent and
-purposes of the Zoning Ordinance.
