e AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF
SECTION XII(B)(2)(b) OF THE ZONING ORDINANCE OF THE
VILLAGE _OF_ OAK BROOK, ORDINANCE G-60, AS AMENDED RELATIVE TO
REQUIRED FRONT YARDS

WHEREAS, an application has been filed requesting a variation from the
provisions of Section XII(B)(2)(b) of the Oak Brook Zoning Ordinance, Ordinance
G-60, as amended, to permit the construction of an addition to a non-conforming
building, which addition will project 70 feet into the required 100-foot Front
Yard, but will not project any further than the existing structure's present
encroachment; and
WHEREAS, a public hearing on such application has been conducted by the
4WZoning Board of Appeals of the Village of Oak Brook on September 3, 1985 pursuant
° to due and appropriate legal notice; and
WHEREAS, a recommendation has been made by said Zoning Board of Appeals
that the variation requested be granted; and
WHEREAS, in its report dated September 6, 1985, the said Zoning Board
of Appeals made explicit findings that the variation requested meets the
applicable standards set forth in Section XIII(B)(4) of the said Oak Brook Zoning
Ordinance; and
WHEREAS, the President and Board of Trustees of the Village concur with
the recommendations and findings made by the Zoning Board of Appeals;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
,OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That a variation is hereby granted from the provisions of
Section XII B)(2)(b) of the Zoning Ordinance of the Village of Oak Brook so as to
` permit construction of an addition to a non-conforming building, which addition
will project 70 feet into the required 100-foot Front Yard, provided that the
addition is construction in substantial conformity with the Site Plan submitted
with the application prepared by N. Batistich, Architects, received July 22,
1985, a copy of which Site Plan is attached hereto labelled Exhibit "A" and
hereby made a part hereof.
Section 3: That this Ordinance is limited and restricted to the
property commonly known as 2205 - 22nd Street, Oak Brook, Illinois, which
property is legally described as follows:
Lot 1 (except the West 144.79 feet thereof) and that part of
Lot 3 lying East of the East Line of the West 144.79 feet of
said Lot 1, extended South in Lestak's 22nd Street Assessment
Plat, in the Northwest 1/4 of Section 27, Township 39 North,
Range 11, East of the Third Principal Meridian, according to
the Plat thereof recorded December 19, 1956 as Document
0827346, in Du Page County, Illinois.
