OF THE VILLAGE OF OAK BROOK, ORDINANCE G-60, AS AMENDED,
RELATIVE TO REQUIRED YARDS
(7 Robin Hood Ranch)
WHEREAS, an application has been filed requesting variations from the
provisions of Sections VII(D)(8)(b) and VII(D)(8)(c) of the Oak Brook Zoning
Ordinance, Ordinance G-60, as amended, to permit the construction of a building
addition extending approximately 3 feet into the 18-foot required Side Yard and
20 feet into the 60-foot required Rear Yard; and
WHEREAS, a public hearing on such application has been conducted by the
Zoning Board of Appeals of the Village of Oak Brook on September 3, 1985 pursuant
to due and appropriate legal notice; and
WHEREAS, a recommendation has been made by said Zoning Board of Appeals
that the variations requested be granted; and
WHEREAS, the said Zoning Board of Appeals made explicit findings in its
report dated September 6, 1985 that the variations requested meet the applicable
standards set forth in Section XIII(G)(4) of the said Oak Brook Zoning Ordinance;
and
WHEREAS, the President and Board of Trustees of the Village concur with
the recommendations and findings made by the Zoning Board of Appeals;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That variations are hereby granted from the provisions of
Sections VII(D)(8) (b) and VII(D)(8)(c) of the Zoning Ordinance of the Village of
Oak Brook so as to permit construction of a building addition extending
approximately 3 feet into the 18-foot required Side Yard and 20 feet into the 60-
foot required Rear Yard, provided that said building addition is constructed in
- substantial conformity with the Site Plan submitted with the application, a copy
of which Site Plan is attached hereto and incorporated herein by reference.
Sect, ion 3: That this Ordinance is limited and restricted to the
property commonly known as 7 Robin Hood Ranch, Oak Brook, Illinois, which
property is legally described as follows:
Lot 17, except the North 20.O feet, as measured on the East
line of Lot 17, and parallel to the North Line of Lot 17, in
Robin Hood Ranch, situated in the West half of Section 36,
Township 39 North, Range 11 East of the Third Principal
Meridian, DuPage County, Illinois.

Section 4: That this Ordinance shall be in full force and effect from
and after its passage and approval pursuant to law.

The Zoning Board of Appeals, in reviewing this application, discussed various
issues concerning the request.
The first issue relates to the fact that the Robin Hood Ranch Subdivision was
subdivided prior to annexation into the Village and upon annexation, was placed
within the R-2 Zoning District which contains standards that are not met by the
majority of the properties within the Subdivision. Specifically, the R-2 District
calls for a one-acre lot area minimum and 40-foot front, 60-foot rear and 18-foot
side yard requirements. As indicated at the hearing, the vast majority of the
lots within the Subdivision are less than one acre in area with the Doyle's
property slightly less than one-half acre.
The yard requirements, when superimposed on the subject property, leaves a total
buildable area of 40 feet deep by 105 wide, or approximately 4,200 square feet of
buildable area.
Also discussed at the hearing was particular precedent established by the Village's
granting of previous variations within the Subdivision. The following is a listing
of the particular history in this regard:
1 Robin Hood Ranch - October 22, 1974 - Ordinance S-320 - Rear and Side Yard
Variations resulting in a 52-foot easterly side yard, a 15-foot westerly side
yard and a 50-foot rear yard.
2 Robin Hood Ranch - July 27, 1972 - Ordinance S-233 - Rear Yard Variation
resulting in a rear yard of 11'2".
4 Robin Hood Ranch - November 11, 1980 - Ordinance S-459 - Rear Yard Variation
resulting in a rear yard of 33 feet (the existing house, prior to the variation,
was located approximately 26 feet from the rear lot line) .

In reviewing the Village's file on Variations, I was unable to find any requested
yard variations which were subsequently denied by the Village for this Subdivision.

Dear President & Board of Trustees:
The Zoning Board of Appeals, at its regular meeting of September 3, 1985,
considered the application of Tom Doyle for rear and side yard variations in
conjunction with his proposed construction of an addition to the rear of his
house. This proposed addition will extend approximately 20 feet into the 60-
foot required rear yard and 1.2 feet into the 18-foot required side yard.
The Zoning Board of Appeals recommends to the President and Board of Trustees
approval of the requested Variations based on specific findings of fact
indicating the unique character of the property, since the Subdivision was
created prior to annexation into the Village and is regulated by a zoning
classification which creates a very small buildable area, and based on further
findings of fact indicating that:
1) The particular physical surroundings of the property involved would bring a
particular hardship upon the owner if the strict letter of the Zoning Ordinance
were to be carried out.
2) A granting of the Variation will not be detrimental to the public welfare or
injurious to other property or improvements in the neighborhood in which the
property is located.
3) The proposed Variation will not impair an adequate supply of light and air to
adjacent property or substantially increase the danger of fire.
4) The purpose of the Variation is not based exclusively upon a desire to make
more money out of the property.

The Secretary noted that the required Legal Notice was published in the Oak Brook
DOINGS and surrounding property owners were notified of this hearing on August 15,
1985.
Tom Doyle, owner of the property, was present representing this application. He
noted that his request is to replace the existing 18' x 12' patio with an addition.
approximately 20' x 29' in size to the rear of their house. He noted that his
property lies within. the R-2 Zoning District which requires an 18 foot side and a
60 foot rear yard and one acre minimum lots. He noted that the Robin. Hood Ranch
Subdivision was created prior to annexation to the Village and that, therefore, the
vast majority of the lots fail to conform to R-2 zoning requirements.
Specifically, all but three of the properties are one half acre or less in area.
He noted for the record that four properties within, the subdivision have in the
past received rear yard variations for construction of additions to the rear of
their houses, these properties being located at 1, 2, 4, and 30 Robin Hood Ranch.
He noted the need for the side yard variation in order to construct the addition
with a consistent wall and roof peak to match the existing house which itself is
located slightly within the side yard, 16.8 feet from the side lot lire.
In response to Member Bartecki, Mr. Doyle stated their hardship as being the
changing space needs of his family.
In response to Member Weber, Mr. Doyle stated that the house directly South of his
property is located 20-25 feet from the common lot line.
In response to Arlene Heretik, 9 Robin Hood Ranch, Mr. Doyle stated that the
proposed addition would be approximately 17 feet from the common side lot line.
General discussion ensued among Board members concerning the specific requirements
of the R-2 Zoning District and the history relating to previously granted
variations.
The Chairman noted that there were no members of the audience expressing support
for or opposition to the proposed variations.
A motion was made by Member Lojewski, seconded by Member Martinello to recommend to
the President and Board of Trustees approval of the requested rear and side yard
variations based on specific findings of fact indicating the unique character of
the property, since the Subdivision was created prior to annexation into the
Village and is regulated by a zoning classification which creates a very small
buildable area, and based on further findings of fact indicating:

The applicant is proposing construction of a 20' x 29' addition to the rear of
their house which will lie almost entirely within the required yards. The
particular yards in question are 60 foot rear and 18 foot side within this
R-2 Zoning District. The existing house lies partially within the southerly
side yard and lies adjacent to the required 60 foot rear yard to the East.
The Zoning Board of Appeals, in reviewing variations, is required by the
Zoning Ordinance to utilize the standards contained in Section XIII(G) (4) , a
copy of which I have attached to this memo. In particular, it is the Zoning
Board's responsibility to make specific findings of fact based upon evidence
presented to it that:
1) The property cannot yield a reasonable return if the variation were not
granted.
2) The specific plight of the owner which has caused him to request the
variation is due to unique circumstances.
3) The variation, if granted, would not alter the essential character of the
neighborhood.
In addition to the above standards, page 968 attached, contains supplemental
standards to be utilized by the Zoning Board of Appeals when reviewing any
variation request.
In the event the Zoning Board makes a positive determination concerning the
above standards and requirements, sub-paragraph (4) (c) notes that the Zoning
Board may recommend certain conditions and restrictions to be placed on the

of Appeals and approve the Flood Plain, Special Use as presented and
authorize the Village Attorney to prepare the necessary documents to
effectuate same.

Mr. and Mrs. Thomas B. Doyle request a back and side lot
variation on their property at 7 Robin Hood Ranch in the
village of Oak Brook.
The Robin Hood Ranch Subdivision was in existence prior to
the incorporation of the village. The lot size, approximately
one half acre, does not comply with present village zoning
ordinances and it is impossible to add to the present structure
without a variation.
As our family size and requirements have changed since we
moved into the village 14 years ago, the lack of a family
room in our home creates a real hardship for us. We need
the room for the family' s comfort and convenience.
The addition will replace an existing slab and structure that
can be used only in warm weather. The replacement will be an
asset to and improvement of the neighborhood, visually more
pleasing than the current structure.

MONTH, WITH ZONING BOARD PUBLIC HEARING TO FOLLQW.
A Variation is a zoning adjustment which permits minor changes of district require-
ments where individual properties are both harshly and uniquely burdened by the
strict application of the law. The power to vary is restricted and the degree of
Variation is limited to the minimum change necessary to overcome the inequality
inherent in the property.
1. A Variation recognizes that the same district requirements do not affect all
properties equally; it was invented to permit minor changes to allow hardship prop-
erties to enjoy equal opportunities with properties similarly zoned. You must
prove that your land is affected by special circumstances or unusual conditions.
These must result in uncommon hardship and unequal treatment under the strict ap-
plication of the Zoning Ordinance. Where hardship conditions extend to other prop-
erties a Variation cannot be granted. The remedy for general hardship is a change
of the map or the text of the Zoning Ordinance.
2. You must prove that the combination of the Zoning Ordinance and the uncommon
conditions of your property prevents you from making any reasonable use of your
land as permitted by your present zoning district. Since zoning regulates land and
not people, the following conditions cannot be considered pertinent to the applica-
tion for a Variation: (1) Proof that a Variation would increase the financial re-
turn from the land, (2) Personal hardship, (3) Self-imposed hardship. In the last
case, the recognition of conditions created after the enactment of the Zoning Ordi-
nance would encourage and condone violation of the law.
3. No Variation may be granted which would adversely affect surrounding property
or the general neighborhood. All Variations must be in harmony with the intent and
purposes of the Zoning Ordinance.
