S-575 - 01/28/1986 - SPECIAL USE - Ordinances ORDINANCE NO. S— 575 AN ORDINANCE AMENDING AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR CERTAIN WORK AND CONSTRUCTION WITHIN THE FLOOD PLAIN PURSUANT TO SECTION 10-3-4- OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK (Ben Fuller Museum) WHEREAS, the President and Board of Trustees of the Village of Oak Brook granted a special use permit to the Ben Fuller Museum Association (hereinafter referred to as the "Association") subject to certain conditions by Ordinance No. S-470, adopted on March 10, 1981; and WHEREAS, one condition of the special use permit was that the Association complete the renovation of the Ben Fuller House within thirty (30) months of the placement of the house, which was moved from a former location, on its new foundation; and WHEREAS, because the house was placed on its new foundation in June, 1981, completion of the renovation was to have been completed no later than December 1983; and WHEREAS, pursuant to the Association's request, on January 24, 1984 this Board passed Ordinance No. S-516 which granted an extension of the completion date to January 1, 1986; and WHEREAS, the Association, by its president, Lyn Christian, has requested that the Village Board extend the date for completion of renovation of the house to enable the Association to complete this renovation; and WHEREAS, it is in the best interest of the Village of Oak Brook that the renovation completion date be extended to January 1, 1987 subject to the conditions set forth below; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That Section 3(E) of Ordinance No. S-470 entitled "An Ordinance Granting A Special Use Permit For Certain Work And Construction Within The Flood Plain Pursuant To Section 10-34 of the Code of Ordinances of the Village of Oak Brook (Ben Fuller Museum)" passed by the corporate authorities on March 10, 1981 is further amended to read as follows: That the Building Inspector be and is hereby authorized to issue two building permits in accordance with Subsection (D) hereof: (1 ) a permit for construction of the foundation and placement of the Ben Fuller house thereon, and (2) a subsequent permit for completion of the renovation thereof, provided that such subsequent building permit be issued within 18 months of substantial completion of the work encompassed in the initial permit, and that the renovation be completed on or before January 1, 1987, provided that an updated demolition bond be posted on or before March 1, 1986 to guarantee removal of the house, in form and sustance acceptable to the Village as approved by the Village Attorney. Section 3: That all other provisions of Ordinance No. S-470 shall remain unamended and in full force and effect. Section 4: That this Ordinance shall be in full force and effect from and after its passage and approval as provided by law. 1 Ordinance No. S— 575 Granting A Special Use Permit for Certain Work and Construction Within the Flood Plain (Ben Fuller Museum) Page two Section 5: All ordinances, rules and regulations of the Village of Oak Brook which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict, but only as they apply to the property hereinabove described. Section 6: If any portion of this Ordinance is for any reason held to be invalid, such determination shall not affect the validity of any remaining portion of this Ordinance.
