Kapff, Assistant to Village Manager Xat SUBJECT: Butler Estate - Old Oak Brook Subdivision: 1) Variation 2) Front Yard Variation The Butler Estate, as owners of Lot 13 in the Old Oak Brook Subdivision, have pro- proposed certain modifications to that property. Specifically, Lot 13 is that property which contains Paul Butler's original house and has frontage on both 31st Street and Natoma Drive and has a driveway access only off of 31st Street. At the time the Village originally approved the Old Oak Brook Subdivision, at the applicant's request, Lot 13 was permitted continued access from 31st Street and, as such, the Subdivision Plat was approved containing a no-vehicular access strip adjacent to Natoma Drive as well as a 60-foot setback line along that rear property line. The two applications before the Village which would effectuate the relocated access to Natoma Drive include two plat variations as follows: 1) Relocation of the no-vehicular access strip from Natoma Drive to 31st Street. 2) Modification of the 60-foot setback line along Natoma Drive to a 40-foot front yard setback, and One zoning variation which would permit the continued location of the existing garage and swimming pool between the house and Natoma Drive, which would now be its front lot line. Both the Plan Commission, at its January 20th meeting, and the Zoning Board of Appeals, at its February 4th meeting, recommended approval of the above based on the fact that the existing access at 31st Street is a traffic hazard, and also for the fact that all property within the Old Oak Brook Subdivision would then have access through interior subdivision streets. In the event that Village Board chooses to concur with these recommendations, it would be appropriate to direct the Village Attorney to prepare the necessary documents approving same. Specifically, their proposal is to relocate access to Lot 13 from its present location along 31st Street to Natoma Drive. This relocation places their front yard adjacent to Natoma Drive and requires the need for a variation to permit the continued location of an existing garage and swimming pool between the house and Natoma Drive. The Zoning Board of Appeals recommends approval of the requested variation based on the following findings of fact: 1) The plight of the owner is due to unique circumstances related to the double frontage of the property on 31st Street and Natoma Drive. 2) The applicant has demonstrated hardship involved in relocating the structures elsewhere on the lot. 3) The proposed access modification will eliminate a traffic hazard which presently exists at the current driveway at 31st Street. 4) Approval of the variation would provide no negative impact on surrounding properties. Savino, Chairman BFK/APS/jr Zoning Board of Appeals ZONING BOARD OF APPEALS Minutes —4— February 4, 1986 IV BUTLER ESTATE — FRONT YARD VARIATION — Lot 13 — Old Oak Brook Subdivision) Jack Segal, Attorney, and Jorie Butler, property owner, were present representing this application. Mr. Segal noted that their request is to change access for Lot 13 from Oak Brook Road to Natoma Drive and, as a result of this switching the front yard, they have been required to request a variaton which would permit the continued location of an existing garage and swimming pool between the front of the house and Natoma Drive. He noted that the garage was actually an old carriage house and is approximately 100 years old. The swimming pool is unenclosed and measures approximately 40 feet by 75 feet and is 40 years old. He stated that it would be very difficult, if not impossible, to relocate the .existing structures on the site and still stay out of easements and other setbacks on the property. Larry Peterman, director of landscape architecture with Balsamo/Olson, indicated that Exhibit 1, Plot Plan, and Exhibit 2, Landscape Plan, for the property were both prepared under his direction. He noted that the proposed landscaping is compatible with that in the area and will serve to screen the pool from Natoma Drive and to block off the former driveway from Oak Brook Road. In response to Chairman Savino, Mr. Peterman stated that he has reviewed the possibilities for moving the structures with qualified engineering staff at Balsamo/Olson, and it is their opinion that such structures would be very difficult to move. Upon questioning by Mr. Segal, Mrs. Butler stated that the garage/carriage house was greater than 100 years in age and that it was already on the property in 1930 when her father, Paul Butler, moved into the house. She estimates that the pool was constructed in 1946. She noted that the value of the garage, although not necessarily monetary, is a part of the character of the estate. It is presently used to store seven cars and equipment for operating the pool. She noted her intent to carry out the proposed landscape plan. In response to Member Weber, Mrs. Butler stated that nine of the Old Oak Brook lots have already beeen sold and that none of the adjoining property owners have indicated any opposition to the proposed driveway relocation. In response to Member Martinello, Mrs. Butler stated that the garage stalls do have doors and that the exterior of the structure is architecturally attractive. In response to Chairman Savino, Mr. Peterman stated that the primary reason for the driveway change was due to the increasingly difficult access to the property from 31st Street. In response to Member Weber, Mrs. Butler stated that a previously existing tennis court has since been removed and replaced by a garden. The Chairman noted that there were no members of the audience expressing support for or opposition to the proposed Variation. A motion was made by Member Weber, seconded by Member Martinello to recommend to the President and Board of Trustees approval of the requested Front Yard Variation based on the following findings of fact: 1) The unique location of the lot with respect to 31st Street and Natoma Drive. 2) The demonstrated hardship which would be created in the event the property owner were required to relocate the structures to conforming locations. 3) The definite traffic hazard created by the driveway at 31st Street which would be improved based on the relocated driveway. 4) That there would be no negative impact on surrounding properties caused by the proposed Variation. Lot 13 is that lot which contains. Paul Butler's house and is a through lot fronting on 31st Street and Natoma Drive. The Old Oak Brook Subdivision Plat presently notes a No. Access Strip along Natoma Drive and a 60-foot rear yard setback from Natoma Drive, since that was considered to be the rear yard of the lot. Proposed modifications would reduce the 60-foot setback to 40 feet as required within this R-2 Zoning District and relocate the No Access Strip from Natoma Drive to 31st Street. The Plan Commission recommends approval of the requested Plat Variations as such modifications would improve traffic safety along 31st Street, since access will be prohibited by the provision of a No Access Strip along 31st Street. This recommendation was made on a motion by Member Antoniou, seconded by Member Sandstedt and approved on a Roll Call Vote of seven (7) ayes: Members Antoniou, Beard, Doyle, Haglund, Sandstedt, Stachniak, Chairman Marcy; zero (0) nays. Kapff, Assistant to Village Manager SUBJECT: Butler Estate - Plat Variation - Old Oak Brook Subdivision The Plan Commission, at its regular meeting of January 20, 1986, recommended approval of two plat variations with respect to Lot 13 within the Old Oak Brook Subdivision as follows: 1) Relocate the existing No Access Strip from Natoma Drive to 31st Street. 2) Reduce the 60-foot rear yard setback adjacent to Natoma Drive to a 40-foot front yard setback as required within this R-2 Zoning District. In the event the Village Board chooses to concur with the Plan Commission's recommendation, it would be appropriate to direct the Village Attorney to prepare the necessary resolution approving same. He noted that the Estate, as owners of Lot 13, is now requesting that their access be relocated from Oak Brook Road to Natoma Drive. In conjunction with that modification, the Plat requires certain changes including the relocation of the No Access Strip from Natoma Drive to Oak Brook Road and reduction in the setback adjacent to Natoma Drive from 60 feet to 40 feet. Plan Commission members agreed that there would be certain advantages to 31st Street traffic through the closing of access from Lot 13. The Chairman noted that there were no members of the audience expressing support for or opposition to the proposed Plat Variation. A motion was made by Member Antoniou, seconded by Member Sandstedt to recommend approval of the requested Plat Variations on the condition that access to 31st Street be abandoned and based on the improved safety situation related to the request. Kapff, Assistant to Village Manager SUBJECT: Butler Estate - Plat Variation - Old Oak Brook Subdivision _ .,,_ Z. The Butler Estate, as owner of Lot 13 of the Old Oak Brook Subdivision, has made application for a Plat Variation. Lot 13 is the lot which contains Paul Butler's old house as shown on the enclosed Plot Plan prepared by Balsamo/Olson Group. As shown on the attached portion of the Old Oak Brook Subdivision Plat, Lot 13 was the only lot gaining access off of Oak Brook Road instead of from the internal roadway system constructed in conjunction with the Subdivision. As can be seen on the Plat, access was permitted to Oak Brook Road and prohibited from River Drive, since that was proposed to be the rear of the property. The Plat also contains a 60-foot setback adjacent to River Drive which is the required rear yard setback and also notes a no vehicular access strip adjacent to River Drive. The Butler Estate is now proposing switching their access from Oak Brook Road to River Drive (Natoma Drive as recently modified by the Village Board) . As such, they have applied for a Plat Variation which would, in essence, move the no vehicular access prohibition from River Drive to Oak Brook Road and replace the 60-foot setback line adjacent to River Drive with a 40-foot front yard setback line. In that regard, I have attached a copy of Article XII of the Subdivision Regulations which notes that the Plan Commission may recommend variations so long as such are in harmony with the intent and purpose of the Comprehensive Plan and Official Map of the Village of Oak Brook. The proposed modifications would remove access from Oak Brook Road at a point where such access is less than desirable and relocate such access to an interior subdivision roadway system as required for the other lots in the Subdivision. As such, it would appear that the proposed modifica- tions to the Plat fully conform with Village requirements. Respectfully submitted, Bruce F.
