AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF
SECTION V(E)(2) OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK
ORDINANCE NO. G-60 AS AMENDEDt.
RELATIVE TO OBSTRUCTIONS IN YARDS

WHEREAS, an application has been filed requesting a variation from the
provisions of Section V(E)(2) of the Oak Brook Zoning Ordinance, Ordinance G-60,
as amended, to permit the construction of 70 surface parking spaces in the rear
yard adjoining Windsor Drive; and
WHEREAS, a `public hearing on such application has been conducted by the
Zoning Board of Appeals of the Village of Oak Brook on February 4, 1986 pursuant
to due and appropriate legal notice; and
WHEREAS, a recommendation has been made by said Zoning Board of Appeals
that the variation requested be granted; and
WHEREAS, the said Zoning Board of Appeals made explicit findings that
the variation requested meets the applicable standards set forth in Section
XIII(G)(4) of the said Oak Brook Zoning Ordinance; and
WHEREAS, in adopting Ordinance S-569, the Board granted certain zoning
relief which relates to parking and loading requirements; and
WHEREAS, the applicant has reconfigured and relocated its proposed
surface parking, in part under the building on the Subject Property, so that with
the additional space requested in their variation, the Applicant does not
presently contemplate the construction of a parking structure; and
WHEREAS, the President and Board of Trustees of the Village concur with
the recommendations and findings made by the Zoning Board of Appeals;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That a variation is hereby granted from the provisions of
Section V(E)(2) of the Zoning Ordinance of the Village of Oak Brook so as to
permit construction of 70 surface parking spaces in the rear yard adjoining
Windsor Drive subject to the conditions set forth below.
Section 5: That the variation herein granted is explicitly subject to
the following conditions:
A. That the 70 parking spaces shall be constructed in
substantial conformity with the Site Plan dated December
20, 1985 which was filed with the application.
B. That trees shall be planted in the locations indicated on
the Site Plan.
C. That if there is a conflict between the September 18, 1985
Site Plan drawn by FCL Associates, Inc. and the December
20, 1985 Site Plan, the latter shall govern.
D. That except as modified in subsection C above, the
variations, terms and conditions set forth in Ordinance
S-569 shall remain in full force and effect.

Section 4: That this Ordinance is limited and restricted to the
property known as 2001 York Road, Oak Brook, Illinois, which property is legally
described as follows:
Lot A of Sunbeam Corporation Second Assessment Plat, being
part of the Southeast Quarter of Section 24, Township 39
North, Range 11 East of the Third Principal Meridian recorded
as Document Number R64-37390 in DuPage County, Illinois.

Section 5: That this Ordinance shall be in full force and effect from
and after it passage and approval pursuant to law.
